An educator shall fulfill all of the terms and

obligations detailed in the contract with the local board of education or education agency for the duration of the contract. Unethical conduct includes but is not limited to:

1. abandoning the contract for professional services without prior release from the contract by the employer, and

2. willfully refusing to perform the services required by a contract.

An educator shall file reports of a breach of one or more of the standards in

the Code of Ethics for Educators, child abuse (O.C.G.A. §19-7-5), or any other required report. Unethical conduct includes but is not limited to:1. failure to report all requested information on documents required by the Commission when applying for or renewing any certificate with the Commission;

2. failure to make a required report of a violation of one or more standards of the Code of Ethics for educators of which they have personal knowledge as soon as possible but no later than ninety (90) days from the date the educator became aware of an alleged breach unless the law or local procedures require reporting sooner; and

3. failure to make a required report of any violation of state or federal law soon as possible but no later than ninety (90) days from the date the educator became aware of an alleged breach unless the law or local procedures require reporting sooner.

These reports include but are not limited to: murder, voluntary manslaughter, aggravated assault, aggravated battery, kidnapping, any sexual offense, any sexual exploitation of a minor, any offense involving a controlled substance and any abuse of a child if an educator has reasonable cause to believe that a child has been abused.

Houston teacher, school administrators charged with failure to report child abuse, 2012 The top two administrators and a teacher at a Galveston County school are charged

with failure to report child abuse after leaving a student s concerns unheard for nearly three weeks, officials said.

Mainland Preparatory Academy is used to making history, as it was the first charter school in Galveston County. Now the La Marque charter school is first again but this time it is no honor. Officials at Mainland Prep are the first to be charged under a Texas law which requires teachers, school officials, doctors and other professionals to report evidence of abuse within 48 hours. It started in December when a 10-year-old student told her teacher that she had been sexually assaulted by a family member. After she told her teacher, no one from the school told anyone else, until 20 days later. School Superintendent Diane Merchant, Principal Wilma Green, and the teacher, Rayshonda Ashton, turned themselves in on Friday to Galveston County officials, and all were released on $1,000 bonds. Police said the administrators admitted that they thought someone else was going to report the abuse. Police: teacher, counselor failed to report child sexual assault, 2012 Wednesday, Myrtle Beach police arrested Carole McMahon and Julie Farmer-Janis, a teacher

and counselor at Myrtle Beach Intermediate School , for failing to report the sexual abuse of a student.

Police say the two knew the child had been sexually assaulted and failed to report it for two months. According to the warrants, the girl reported to Farmer-Janis in November that a man living in her home had sexually assaulted her in October. The warrants show that McMahon, the teacher, acted as a translator between Farmer-Janis, the counselor, and the girl's mother. The warrants say Farmer-Janis and the girl's mother came to an agreement that if the man moved out of the house before January 4, Farmer-Janis would not report the assault to police because of fears over the family's immigration status. When they learned the man was still in the home on January 4, they called police. On Wednesday, they were each charged with failing to report child abuse or neglect and obstruction of justice. In their roles at the school, the women fall under the South Carolina law as "mandatory reporters" of sexual abuse. The mother was charged with unlawful neglect of a child. We are not releasing her name to protect the identity of the child. Horry County Schools spokesperson Teal Britton says Farmer-Janis has been employed since August 2001. A Wichita teacher had her license revoked this week after allegedly failing to report

suspected child sexual abuse quickly enough, and some education officials say the punishment was too severe.

“It’s an absolute atrocity,” said Walt Chappell, a member of the Kansas State Board of Education from Wichita. “What this does is send a shiver down the spine of every teacher in the state.“Here’s someone who is concerned about children and wants to protect children,” said Chappell, who said he has spoken with both the teacher and her lawyer. “And … they ran her through the wringer over something where she was trying to do her best.”Donna L. Ford, 51, a kindergarten teacher at Cleveland Elementary School, surrendered her teaching license to the state board, which voted 6-2 on Tuesday to accept the surrender and revoke Ford’s license. She had been a teacher for 17 years.Chappell and board member Sue Storm voted against the measure. Janet Waugh abstained, saying she did not have enough information to cast an informed vote.According to a letter Ford submitted to the state Department of Education in March, she surrendered her license as a condition of her resignation with early-retirement benefits.The resignation was “a result of allegations that I delayed reporting alleged sexual abuse for a period of two weeks,” she said in the letter.Kansas law requires teachers, doctors, counselors and other mandatory reporters to inform the Kansas Department of Social and Rehabilitation Services or law enforcement agencies if they suspect a child has been abused.Wichita district policy requires all employees to report suspected abuse by phone to state officials “on the same day the suspicion arises.”

EXCLUSIVE: 3 Broward Teachers Charged With Failing To Report Child Abuse,

2013 DAVIE (CBS4) – Three teachers at Western High School in Davie face

misdemeanor charges of failing to report child sexual abuse. Investigative documents obtained by CBS 4 News from the Broward State Attorney’s Office lay out the allegations against the teachers. Prosecutors say two years ago a special needs child wrote an essay in which she described how she was raped by someone she dated. Prosecutors say the child’s teacher, Cathy Schwartz, shared the essay with two other teachers but that none of the trio contacted the state’s child abuse hotline. The child’s mother did not want to be identified. She says she didn’t learn about the essay until 7 months later when it was disclosed during a meeting about her daughter’s educational progress. http
