Congress Article 51. The Law 5,070, of July 7th, 1966 is amended in articles 2, 3, 6 and its paragraphs, 8 and its
paragraph 2, and 13 as follows:
“Article 2. The Telecommunications Suveillance Fund (FISTEL) sources are: c. Funds derived from the exercise of the telecommunications services grant power, in the public
regime, including payments originated from grants, penalties, and damages;
d. Funds derived from the exercise of the telecommunications services enforcement power, in the private regime, including payments originated from licenses, penalties, and damages;
e. Funds derived from the exercise of the spectrum grant power in general, including penalties, and
damages; f. Surveillance fees;
j. Funds derived from the approval fees of products and technical services rendered by the National
Telecommunications Agency; Original in Portuguese:
Art. 51. Os arts. 2º, 3º, 6º e seus parágrafos, o art. 8º e seu § 2º, e o art. 13, da Lei nº 5.070, de 7 de
julho de 1966, passam a ter a seguinte redação: “Art. 2º O Fundo de Fiscalização das Telecomunicações – FISTEL é constituído das seguintes fontes:
c) relativas ao exercício do poder concedente dos serviços de telecomunicações, no regime público,

Article 51. The Law 5,070, of July 7th, 1966 is amended in articles 2, 3, 6 and its paragraphs, 8 and its

c. Funds derived from the exercise of the telecommunications services grant power, in the public
regime, including payments originated from grants, penalties, and damages;
d. Funds derived from the exercise of the telecommunications services enforcement power, in the
private regime, including payments originated from licenses, penalties, and damages;
e. Funds derived from the exercise of the spectrum grant power in general, including penalties, and
damages;
f. Surveillance fees;
j. Funds derived from the approval fees of products and technical services rendered by the National
Telecommunications Agency;

I - o plano plurianual;
II - as diretrizes orçamentárias;
III - os orçamentos anuais.
§ 5º - A lei orçamentária anual compreenderá:
I - o orçamento fiscal referente aos Poderes da União, seus fundos, órgãos e entidades da

Article 24. The Union, the states and the Federal District have the power to legislate concurrently on: I. tax, financial, penitentiary, economic and urban law;
V. production and consumption;
VI. forests, hunting, fishing, fauna, preservation of nature, defense of the soil and natural resources, protection of the environment and control of pollution;
VIII. liability for damages to the environment, to consumers, to assets and rights of artistic, aesthetic,
historical, and touristic value, as well as to remarkable landscapes; Paragraph 1. Within the scope of concurrent legislation, the competence of the Union shall be limited
to the establishment of general rules.
Paragraph 2. The competence of the Union to legislate upon general rules does not exclude the supplementary competence of the states
Paragraph 3. If there is no federal law or general rules, the states shall exercise full legislative
competence to provide for their peculiarities.
Paragraph 4. The supervenience of a federal law over general rules suspends the effectiveness of a state
law to the extent that the two are contrary

§ 4º - A propaganda comercial de tabaco, bebidas alcoólicas, agrotóxicos, medicamentos e terapias estará sujeita a restrições legais, nos termos do inciso II do parágrafo anterior, e conterá, sempre que
necessário, advertência sobre os malefícios decorrentes de seu uso.
§ 6º - A publicação de veículo impresso de comunicação independe de licença de autoridade.

Congress Article 38. The broadcast concessions, permissions, and authorizations shall observe the following
clauses and principles:
d. The information services, entertainment, commercials and campaigns of broadcasters shall be subjected to educational and cultural goals inherent to the broadcast service, seeking to attain the
country’s higher interests; e. The broadcasters, except television, are obliged to daily retransmit, from 7:00 to 8:00 pm, except on
Saturdays, Sundays and holidays, the official news program of the Powers of the Republic, set aside 30
minutes to the news of the Houses of the Congress;
h. The broadcasters, including television, shall fulfill their informative goal by setting aside at least 5%
(five per cent) of their program to the transmission of news programs.
Article 39. The broadcasters, in the 90 days before the general elections, shall set aside 2 hours for free of charge electoral propaganda, 1 hour during the day and 1 hour between 8:00 to 11:00 pm distributed
in a non-discriminatory proportional basis.

observados, além de outros requisitos, os seguintes preceitos e cláusulas:

h) as emissôras de radiodifusão, inclusive televisão, deverão cumprir sua finalidade informativa,
destinando um mínimo de 5% (cinco por cento) de seu tempo para transmissão de serviço noticioso.
Art. 39. As estações de radiodifusão, nos 90 (noventa) dias anteriores às eleições gerais do País ou da circunscrição eleitoral, onde tiverem sede, reservarão diàriamente 2 (duas) horas à propaganda
partidária gratuita, sendo uma delas durante o dia e outra entre 20 (vinte) e 23 (vinte e três) horas e
destinadas, sob critério de rigorosa rotatividade, aos diferentes partidos e com proporcionalidade no tempo de acôrdo com as respectivas legendas no Congresso Nacional e Assembléias Legislativas.

Paragraph 1. No law shall contain any provision which may represent a hindrance to full freedom of
press in any medium of social communication, with due regard to the provisions of article 5, IV, V, X
XIII, and XIV. Paragraph 2. Any and all censorship of a political, ideological and artistic nature is forbidden.
Paragraph 3. It is within the competence of federal laws to:
I. regulate public entertainment and shows, it being incumbent upon the Government to inform on their nature, the age brackets they are not recommended for and places and times unsuitable for their
exhibition:
II. establish legal means which afford persons and families the possibilities of defending themselves against radio and television programmes and schedules which go contrary to the provisions of article
221, as well as against publicity of products, practices and services which may be harmful to health or
to the environment. Paragraph 4. Commercial advertising of tobacco, alcoholic beverages, pesticides, medicines and
therapies shall be subject to legal restrictions, in accordance with item II of the preceding paragraph
and shall contain, whenever necessary, a warning concerning the damages which may be caused by their use.

estará sujeita a restrições legais, nos termos do inciso II do parágrafo anterior, e conterá, sempre que
necessário, advertência sobre os malefícios decorrentes de seu uso. § 6º - A publicação de veículo impresso de comunicação independe de licença de autoridade.
