    ADMINISTRA nON

    Robert Kelly, the Supervisor of Racing for many years, and Louis Derteen, Jr., the Assistant SupervISOr, direct the various activities of the Racing Com· mission. The departmental heads are: Auditing. Irving Harrington; Investiga· live, Tom. C. Parker; and Laboratory, Elsie S. Bellows, Ph. D.

    The records and statistics of all the racing activities are kept in the Com· mission office located at 911 Metropolitan Bank Building; Miami. Additional information not contained in this report will be gladly furnished to anyone on a request addressed to the Florida State Racing Commission, Post Office Box 4781, Miami, Florida.

  • INVESTIGATIVE DIVISION

    With the interest of the public in mind, the Racing Commission maintains an investigative division whose function is to maintain the conlidmtial files of records and fingerprints of pcrsoos associated with racing and to make investigations at the request of the Raciog Commission.

    Amoog the laws that this divisioo is charged to enforce is the so-alled 8'% law which requires that each association cm1\loy Florida residents to the extent of at least 8~% of the total number employed and these Florida residents must receive a minjm~ of 85% of the total wages paid.

    During the year some 13,000 persons were licensed ioduding over a thousand Dew employees of the various associations who required fingerprinting. From this number, twenty were found to have felony records which prohibits them by law from employment at a racing plant in Plorida.

    With the cooperation of the variow safety departments, 306 persons were ejected from the grounds of Florida race tracks for several reasons. Nine persons were ejected under arrest, convicted and fined for violation of Chapter 849.24, Florida Statutes, which states that anyone who returns to a race trade: after being ejected without first being reinstated by the Commission is charged with a misdemeanor.

    The Racing Commission wishes to express its appreciation to the Federal Bureau of Investigation, the Thoroughbred Racing Protective Bureau, the safety departments of the variom associations and local law enforcement agencies for the splendid cooperation received during the year. The Commission is also grateful to the Racing Commissions of other states for information used in the enforcement of the 8~% law.

    LABORATORY

    The laboratory is concerned with the microdetection of drugs in the saliva and urine of racing horses and greyhounds. A series of highly sentitive tests are made in the search for drugs which could alter the performance of the racing animal. Crystallography, paper chromatography and spectrophotometry are techniques employed in the detection and identification of microquantitics of illegal drugs. In the past year 9,299 Florida racing samples and 3~7 foreign racing samples were analysed; a total of 22 positives, including 10 foreign positivC5, were reported. Of the 12 Florida positives. a total of seven were found in samples taken from the same kennel Theobromine was present as the result of wing a chocolate-flavored food supplement that was erroneowly labeled.

    The Florida laboratory enjoys a top reputation among the racing labora-tories of the world. Training of the Panamaman racing chemist at our Laboratory was arranged through the U. S. Embassy in Panama. A Puerto Rico racing chemist also visited our laboratory for observation and study last summer. A continuous program of research at the laboratory is essential for recognition and identification of the many newly marketed drugs.

    SCOPE OF RACING

    The general business recession and the unseasonable weather experienced by the State during the winter months caused the racing revenue to decrease

  • 2.29% from the previous yeu. Even with this decrease, the 1957-1958 racing season will go 00 record as the second best year in Florida racing history. This was also the first year in the history of the Commission that over 2,000 racing days were allotted and supervised. Exhibit "A" of this report re.Bects the com-parison of the 19'7-19'8 season with those of past years.

    DUling the past year the Bonita-Ft. Myers Corporation commenced operation of the Naples-Ft. Myers Kennel Oub and from a review of its first season, it appears that dog racing in that area will prove a success. .

  • The 67 Counties of the State each received '170,671.64, of which .n~,-313.43 was apportioned under the old racing laws and '3',3'8.21 from the additional taxes on greyhound tracks enacted by the 19~~ legislature.

    Although 'the sum of '24,306,949.76 was ooUected by the Commission during the season in review, only 2% was expended in controlling. directing and supervising the operations and ilCtivities of the various licensees. 1bc expenditures for the year represent a saving of $44,294.87 from the budget appropriation.

    ABANDONED PARI·MUI1JEL TICKETS

    Pursuant to Chapter ~~O. I64, Florida Statutes, 19)7, it was declared by the Legislature that all abandoned pari-muruel tickets over two years of age should escheat to the State for deposit in the Principal State School Fund, to be used for the support and maintenance of public free schools. A total of '204,449.30 was received by the Commission oovering unclaimed 19n-19~6 pari-mutuel tickets during this past racing season. Exhibit "E" of this report lists the amounts remitted by the individual Associations.

    SCHOLARSHIP FUND

    Pursuant to Chapter ~'0.08, Florida Statutes, 19~7, the Legislature authorized the vuious tracks and fmotons to operate a total of twenty-three additional days of racing during the past year for the pwpose of creating and providing State Scholarships for qualified applicant> (rom the profit> derived therefrom. A total of '366,481.60 was remitted to the State Board of Control for Institutions of Higher Learning during the past racing season. This was an increase of ,16,967.H over the previous year. Exhibit "D" of this report list> the individual amounts n.ised for this worthy project br each participating Association.

    CHARITY DAYS

    Pursuant to Chapter nO.03, Florida Statutes, 19~7, the Legislature authorized the variow tracks and fcontons to operate a total of twenty-one additional days of racing during the past year wherein the profits would go to recognized charities of their choice. The 19)7 Legislature amended this Chapter so that recognized charities and institutions of higher learning located within 100 miles road travel of a track and not already participating in a scholarship day, could share in the profit> of the racing day. Unoer this new provision, a total of '378,286.19 was raised with the Commission supervising the distribution of this sum as follows:

    LmGATION

    Since the report for the fiscal year ending June 30, 19)7 was submitted, certain litigation then pending has been terminated.

    Tropical Park, Inc. and MaNriu / . HirJhJlein v. C. H. RAtliff, el aJ.

    The Supreme CoUrt of Florida held that the Commission's order deny-ing Hirshstein the privilege of attending any pari-mutuel operation in Florida "was entered pursuant to a putative hearing ordered by the Com-mission without proper notice of the proposed action and an opportunity to be heard," It concluded that certiorari should be granted as to Hirshsteio and quashed the Commission's order. As to Tropical Park, Inc., the Supreme Court held that the Commission's action in revoking ill liceose was harsh and inequit-able and quashed the Commissioo's order but with directions that consideration be given to the imposition of an order of ccnswe or reprimand.

    The Petitionee dismissed its Petition for Alternative Writ of Mandamus filed in the Supreme Court of Florida on July I~ , 19~7. The Petitioner sought to force the Commission to issue to it a permit for the construction of a fronton in Duval County after the Commission had denied the application because of the general reputation of some of the incorporators and aIso becawe of other legal reason.

This case was dismissed with prejudice by the Circuit Court of Dade County on Augwt 19, 19n

    During the year in review, the State Racing Commission was a party to the following suits:

    This was a suit instituted in the Circuit Court of Dade County in the nature of a Petition for Writ of Mandamus and an Alternative Writ was issued directing the Racing Commission to show cause why it refused to issue a trainer's license to Petitioner. The Commission filed a return to the alternative writ and a motion to quash. On hearing the Commission introduced evidence to the eHect that the Petitioner was indefinitely suspended by the Michigan Racing Commission for improper conduct as a trainer of horses and further that be had been found guilty of other misconduct which alIirmatively precluded him from receiving the stamp of approval of the Florida State Racing Commis-sion. The court entered its fuJ.al judgment granting the motion to quash and the &.ltemative writ was quashed.

  • business and entertainment was presented to the delegates representing prac· tically all the various State Commissions and several foreign racing boards.

    John R. Ring, Chairman of the Florida Commission, received signal honor at the Convention when he was elected president of the National Association for 19'8·19'9.

    The Association of Official Racing Chemists held their convention in conjunction with the National Association and gave additional recognition to Florida by electing Dr. Elsie S. Bellows their president for the coming year.

    FLORIDA BREEDERS

    "Florida-bred" now is a nationally recognized racing term that connotes the highest qualities of a race horse. The Sushioc State yearly is gaining fame for its thoroughbred products and the continued excellent performances by "Florida-bred" racers at tracks throughout the nation bode well for the future of the state's breeding industry.

    Florida's thoroughbred breeders have increased rapidly in the past year and there is hardly a County in the central and southern portions of the state that does not boast one or several breeding farms. The temperate year-around climate plus the nourishing soil dements have induced many wdl-knowo Northern breeders to move their operations to Florida for both breeding and training headquarters.

    During 19'7· '8 "Florida·bred" horses won pucscoviding an optimistic criterion for the years ahead. "Florida·bred" compebtors scored 320 victories during 1951·'8 with 274 "Florida·bred" horses compiling the rl!cord. Breeding awards during the period totaled ,1',200 compared to $10,8'0 the preceding Iiscal year.

    A high point of the past year was the first running of the Florida Breeders Futurity at Sunshine Park. The inaugural Futurity attracted an ama>ing tol1l of 107 oomin~.

    The phenomenal forward strides taken by the state's breeding, training and racing groups have been aided by the support of the Florida Breeders Association, the racing associations, the racing writers and the Racing Com· mission. Such cooperation was vital in the formative stages and is assured now that success has Deen attained.

    CONCLUSION

    We, the ~mbers of the Florida Racing Commission, express to you our deep appreciation for the trust and confidence you have exhibited toward m in our administration of racing affairs. We pledge to protect the public and the state interests and shall always endeavor to keep racing on the high plane on which it has been conducted in the past.
