New Delhi, the 9th October, 2015

G.S.R.769(E).- In exercise of the powers conferred by clauses (b) and (c) of sub- section (2)of section 141 of the Border Security Force Act, 1968 (47 of 1968), the Central Government herebymakes the following rules regulating the method of recruitment to the post of Assistant Commandant(Official Language), Combatised in the Border Security Force, in the Ministry of Home Affairs,namely:-

I. Short title and commencement.- (I) These rules may be called the Border Security Force,Assistant Commandant (Official Language) Group 'A' Combatised post Recruitment Rules,2015.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and pay band and grade payor pay scale.- The number of thesaid post, its classification and pay band and grade payor pay scale attached thereto, shall beas specified in columns (2) to (4) of the said Schedule.

3. Method of recruitment, age limit, qualifications, etc.- The method of recruitment to the saidposts, age limit, qualifications and other matters relating thereto, shall be as specified incolumns (5) to (13) of the afore said Schedule.

4. Disqualifications - No person, -

(a) who has entered into, or contracted a marriage with a person having a spouseliving; or

(b) who, having a spouse living, has entered into, or contracted a marriage with anyperson,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage ispermissible under the personal law applicable to such person and the other party to themarriage and that there are other grounds for so doing, exempt any person from the operationof this rule.

S. Ineligibility of aliens.- No person who is not a citizen of India shall, except with the consent ofthe Central Government signified in writing, be appointed or employed under these rules:

Provided that nothing contained in these rules shall debar the appointment oremployment of a subject of Nepal or Bhutan under these rules.

6. Medical Fitness.- (I) Notwithstanding anything contained in these rules, only those personswho are in medical category SHAPE-I, shall be eligible for appointment under the provisionsof these rules.

(2) For the purpose of this rule, SHAPE-I means.-

(i) Medical classification done by Medical Officer after assessing fitness of theofficer under given factors indicated by the code letters SHAPE, whichrepresent the following function:-

S - Psychological

H - Hearing

A - Appendages

P - Physical Capacity

E - Eye-Sight

(ii) Functional capacity of an officer under each factor will be denoted by numeral Ito 5 against each code letter, indicating declining functional efficiency. Thenumerals will be written next to the code letter, except that where an officer isin Grade-I in all factors, his category may be denoted by writing SHAPE-Iinstead of writing S,H,A,P,E,. General evaluation of these numerals is asunder:-

1. Fit for all duties anywhere.

2. Fit for all duties but may have limitations as to type of duties and areasof employability depending on whether the duties involve severe stressor demand acuity of hearing/vision of both ears/eyes.

3. Excepting "S" factor, fit for routine or sedentary duties but may havelimitations of employability at high altitude (above 2,700 meters)extreme cold areas or hilly terrain and for long assignments.

4. Temporarily unfit for duties on account of hospitalization or sick leave.

5. Permanent unfit for duties.

7. Superannuation:- (1) The person appointed under the these rules shall retire from service onthe afternoon of the last day of the month in which he attains the age of fifty-seven years:

Provided that the person whose date of birth is the first of a month shall retire fromservice on the afternoon of the last day of the preceding month of attaining the age of fifty-seven years.

(2)fifty- seven years.

8. Power to relax. - Where the Central Government is of the opinion that it is necessary orexpedient so to do, it may, by order, for reasons to be recorded in writing, relax any of theprovisions of these rules with respect to any class or category of persons.

9. Saving>- Nothing in these rules shall affect reservations, relaxation of age limit and otherconcessions required to be provided for the Scheduled Castes, Scheduled Tribes, Ex-servicemen and other special categories of persons in accordance with the orders issued by theCentral Government from time to time in this regard.

No person shall be granted extension in service beyond the age of retirement of

the medium and English as a compulsory or elective subject or as the medium of examination at the

(ii) three years' experience of using or applying terminology (terminological work) in Hindi andtranslation work from English to Hindi or vice-versa, preferably of technical or scientific literatureunder the Central Government or the State Government or an autonomous body or statutoryorganisations or public sector undertakings or Universities or recognized research or educationalinstitutions; orthree years' experience of teaching in Hindi and English or research in Hindi or English under theCentral Government or the State Governments or an autonomous body or statutory organisations orpublic sector undertakings or Universities or recognized research or educational institutions.

Note 1: The departmental Subedar Major (Hindi Translator) in Pay Band -2 (Rs.9300-34800) andgrade pay of Rs.4800/- with two years of regular service in the grade shall be considered alongwithoutsiders and in case the departmental candidate is selected for appointment to the post, it shall bedeemed to have been filled by promotion.Note 2: The period of deputation including period of deputation in another ex-cadre post heldimmediately preceding this appointment in the same or some other organisation or department shallordinarily not exceed three years.Note 3: The maximum age limit for appointment by deputation shall not be exceeding fifty-twoyears as on the date of receipt of applications.

Note 4: For the purpose of appointment on deputation basis, the service rendered on a regularbasis by an officer prior to the Ist January, 2006 or the date from which the revised pay structurebased on the Sixth Central Pay Commission recommendations has been extended, shall be deemed tobe service rendered in the corresponding grade payor pay scale extended based on therecommendations of the Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade payor pay scale, and where this benefit willextend only for the post(s) for whieh that grade payor pay scale is the normal replacement gradewithout any up gradation.
