THENORTH-WESTFRONTIERPROVINCEPUBLICSAFETYORDINANCE,1948.___ORDINANCENo.VIIOF1948_____ANORDINANCEtoempowertheProvincialGovernmenttotakeactionagainstcertainpersonsandorganisationsintheinterestofpublicsafetyintheNorth-WestFrontierProvince.Preamble---WHEREAStheGovernor,North-WestFrontierProvinceissatisfiedthatcircumstancesexistwhichrenderitnecessaryforhimtotakeimmediateactionagainstpersonsandorganisationsintheinterestofpublicsafetyintheNorth-WestFrontierProvince;ANDWHEREAStheLegislatureoftheNorth-WestFrontierProvinceisnotinsession;

Now,THEREFORE,inexerciseofthepowersconferredonhimbySection88oftheGovernmentofIndiaAct,1935,asadaptedbythePakistan(ProvisionalConstitutionOrder,1947,andinpursuanceoftheinstructionsreceivedfromtheGovernorGeneralofPakistan,theGovernor,North-WestFrontierProvinceisherebypleasedtomakeandpromulgatethefollowingOrdinance:---Shorttitle,extent,andcommencement---1.(1)ThisOrdinancemaybecitedastheNorth-WestFrontierProvincePublicSafetyOrdinance,1948.(2)ItshallextendtothewholeoftheNorth-WestFrontierProvince.

(3)Itshallcomeintoforceatonce.Definitions---2.InthisOrdinance,unlessthereisanythingrepugnantinthesubjectorcontext,thefollowingexpressionshavethemeaningsherebyrespectivelyassignedtothem,thatistosay:---(a)Propertyshallmeanmoveableaswellasimmovableproperty:(b)TribalAreasshallmeantheareasalongthebordersoftheNorth-WestFrontierProvinceandwithintheNorth-WestFrontierProvinceofPakistan,notformingapartofthesaidProvinceoranyStateoranyforeignterritory,whichareasbeforethe15thAugust,1947,wereadministeredbyandwereunderthepoliticalch

argeoftheGovernorofthesaidProvinceactingastheAgenttotheGovernor-GeneralandhavesincebeapartofPakistan.(c)PrejudicialActshallincludeanyactwhichisintendedorislikely:---(i)toprejudicetherelationsoftheGovernmentofPakistanorProvincialGovernmentwithanyState,foreignpowerortribalarea,adjacenttotheNorth-WestFrontierProvince,orthemaintenanceofpeacefulconditionsinthetribalarea;(ii)toendangerpublicsafetyorthemaintenanceofpublicorder;

(iii)tobringintohatredofcontempt,ortoexcitedisaffectiontowardstheGovernmentestablishedbylaw;(iv)topromotefeelingsofenmityandhatredbetweendifferentclassesofpeopleintheNorth-WestFrontierProvinceorTribalAreas;(v)tocausefearoralarmtothepublicortoanysectionofthepublic;(vi)todisrupttheintegrityofPakistanasbylawestablished;(vii)toassociateitselfwithanymovementprejudicialtotheinterestsofPakistan.Explanation.---Havinginonespossession,ormaking,wearing,carryingordisplayinganyuniform,flag,banner,emblemorbadge,associatedwithanyOrganisationdeclaredbytheGovernmenttobeharmfultotheinterestsofPakistanshallbepresumedtobeanactofthenaturedescribedintheprecedingclause(c).(e)OffenceshallmeananyactoromissionmadepunishableunderthisOrdinance.Powertoarrestanddetaincertainpersons---3.(1)TheProvincialGovernment,onbeingsatisfiedthatanypersonhascommittedanyprejudicialactorthatwithaviewtopreventhimfromcommittinganyprejudicialact,itisnecessarysotodo,mayorderthearrestwithoutwarrantofs

uchperson,andineffectingsucharrestallmeansnecessaryforthepurposemaybeused.(2)TheProvincialGovernment,may,commitanypersonarrestedunderthelastprecedingsub-sectiontosuchcustodyinsuchpartofPakistanandforsuchlengthoftime,astheProvincialGovernmentmay,fromtimetotime,orderinthatbehalf.(3)TheProvincialGovernmentmay,bygeneralorspecialorder,determinetheconditionsastothemaintenance,disciplineandpunishmentofoffencesandbreachofdisciplinewhichshallbeapplicableinthecaseofpersonscommittedtocustodyasaforesaid.Powertorestrictthemovementoractionsofcertainpersons---

4.(1)TheProvincialGovernment,onbeingsatisfiedwithrespecttoanypersonthathehascommittedorislikelytocommitanyprejudicialact,maymakeanorder:---(a)directingsuchpersonstoremovehimselffromtheNorth-WestFrontierProvinceinsuchmanner,bysuchtimeandbysuchrouteasmaybespecifiedintheorderandalsoprohibitinghisreturntotheProvinceforsuchperiodastheProvincialGovernmentdeemsfit;(b)directingthat,exceptinsofarashemaybesopermittedbythetermsoftheorder,orbysuchauthorityorpersonasmaybespecifiedtherein,heshallnotbeinanysuchareaorplacewithinsuchtimeasmaybespecifiedintheorder;

(c)requiringhimtoresideorremaininsuchplaceorwithinsuchareaintheNorth-WestFrontierProvinceasmaybespecifiedintheorder,and,ifhebenotalreadythere,toproceedtothatplaceorareawithinsuchtimeasmaybespecifiedintheorder;(d)requiringhimtonotifyhismovementsortoreporthimself,orbothtonotifyhismovementsandreporthimself,orbothtonotifyhismovementsandreporthimself,insuchmanner,atsuchtimeandtosuchauthorityorpersonasmaybespecifiedintheorder;

titutionisbeingconductedinamannerprejudicialtothepublicsafety,maintenanceofpublicorderortherelationsoftheGovernmentofPakistanortheProvincialGovernmentwithanyState,foreignpowerortribalareaadjacenttotheNorth-WestFrontierProvince,itmay:---(a)closesuchinstitutions,andtakepossessionofanylandorbuildingoccupiedbyorutilisedforsuchinstitution,togetherwithanypropertythereinorthereon,or(b)removefromthemanagingbodyofsuchinstitutionanymemberthereof,orrequirethemanagingbodyoranypersonincontrolthereoftodismissanyteacherorotheremployeeorexpelanystudent;or(c)withholdanygrantmadetosuchinstitutionbyGovernmentorprohibitthepaymenttosuchinstitutionofanygrantmadetoitbyanylocalauthority.Controlofprocession,meetings,etc.---7.(1)TheProvincialGovernmentmay,bygeneralorspecialorder,prohibit,restrictorimposeconditionsupontheholdingofortakingpartinpublicprocessions,meetingsorassemblies.(2)Forthepurposesofsub-section(1),anyprocession,meetingorassembly,whichisopentothepublicortoanyclassorportionofthepublic,whetherheldinapublicoraprivateplaceandwhetheradmissiontheretoberestrictedbyt

heissueofticketsorotherwise,shallbedeemedtobeapublicprocession,meetingorassemblyasthecasemaybe.(3)AnypoliceormilitaryofficermaytakesuchstepsandusesuchforceasmaybereasonablenecessaryforsecuringcompliancewithanyordermadeundertheOrdinance.Powertoissuesearchwarrants.---8.ThepowertoissuesearchwarrantsconferredbySection98oftheCodeofCriminalProcedure,1898,shallbedeemedtoincludethepowertoissuewarrantsfor.---(a)thesearchofanyplaceinwhichanyMagistrate,mentionedinthatsection,

hasreasontobelievethatanyprejudicialacthasbeen,isbeingorabouttobecommitted,orthatpreparationforthecommissionofanysuchactisbeingmade;(b)theseizureinoronanyplacesearchedunderclause(a)ofanythingwhichtheofficerexecutingthewarranthasreasontobelieveisbeingusedorisintendedtobeusedforanypurposementionedinthatsection;andtheprovisionsoftheCodeshall,sofarasmaybe,applytosearchesmadeundertheauthorityofanywarrantissuedandtothedisposalofanypropertyseizedunderthissection.Generalpowerofsearch.---

9.AnyMagistrateorPoliceOfficernotbelowtherankofaHeadConstablemayenterandsearchanyplace,ifhehasreasontobelievethatsuchsearchisnecessaryforthepurposeof;---(a)ascertainingwhetheritisnecessaryorexpedienttoexercisesuchpower;or(b)ascertainingwhetheranyordergiven,directionmade,orconditionprescribedintheexerciseofsuchpowerhasbeendulycompliedwith;or(c)generallygivingeffecttosuchpowerorsecuringcompliancewithorgiving

effectto,anyordergiven,directionmadeorconditionprescribedintheexerciseorsuchpower;ProvidedthataHeadConstableshallnotenterandsearchanyplaceunlesssoauthorisedinwritingbytheSuperintendentofPoliceoftheDistrictwithinwhichsuchplaceissituated.Powertoorderforfeitureoftheproperty.---10.(1)WithoutprejudicetotheotherprovisionsofthisOrdinance,theProvincialmay,inthecaseofanypersonagainstwhomanorderU/S.3oradirectionU/S.4,ismadeorwhohascontravenedanyprovisionofthisOrdinanceorinthecaseofanorganizationagainstwhichanorderU/S.5ismade,may,inadditiontoanyotherpenaltyprovidedforbythisOrdinanceorderthatalloranyofthepropertyofsuchpersonororganizationshallbeforfeitedtoGovernment.(2)Nosale,alienationorotherdispositionofsuchproperty,madeatanytimewithinoneyearbeforethedateoftheorderofforfeitureorsubsequenttothecommissionoftheoffenceoratanytimenothereinprovidedfor,withthefraudulentintentionofpreventingsuchforfeiture,shallhaveanyeffectagainsttherightoftheGovernmenttoeffectsuchforfeiture.(3)Allimmovablepropertyofsuchperson,alienatedorotherwisedisposedofagainsttheprovisionsofsub-section(2)shallbeforfeitedinthesamemannerasifnosuchalienationordisposalhadbeenmade;unlesssuchalienationordisp

osalwasmadeingoodfaithandforvaluableconsiderationandwasregisteredmorethanoneyearbeforethecommissionoftheoffence,incasesuchregistrationiscompulsoryunderlaw.(4)Inanyproceedingconcerninganypropertyallegedtohavebeenforfeited,theorderorconvictionpassedbytheProvincialGovernmentshallbeconclusiveevidenceofthefactthatsuchpersonhascommittedanyprejudicialactorthatsuchorganizationhasbeendeclaredunlawfulU/S.5oftheOrdinance.(5)AftertheorderofforfeitureismadetheCollectororanyotherofficerappointedbytheProvincialGovernmentinthatbehalfmayseizeandtakepossessionoftheforfeitedproperty.

Explanation:---OrderunderthisSectionmaybemadeagainstanypersonwhoordinarilyresidesorhasanypropertyintheNorth-WestFrontierProvince.Disclosureofthegroundsoftheorderofdetentionordeclaration.---11.AnypersonagainstwhomanorderunderSection3,sub-section(1)orunderSection4,sub-section(1)ismadeorwhoisaffectedbyanyordermadeunderSection5,orwhosepropertyisforfeitedundersection10,shallbeentitledtoreceiveintimationonlyinrespectofthosegroundsonwhichsuchorderordeclarationismade,whichintheopinionoftheProvincialGovernmentwouldnotbeagainstthepublicinteresttodisclose.Savingsastoorders.---12.(1)NoorderunderthisOrdinanceshallbecalledinquestioninanycourtand

nocourtshallhavepowertomakeanyorderunderSection491oftheCodeofCriminalProcedure1898,inrespectofanyordermadeunderthisOrdinanceorinrespectofanypersonagainstwhomsuchanorderhasbeenmade.(2)WhereanorderpurportstohavebeenmadebyanyauthorityinexerciseofanypowerconferredbyorunderthisOrdinance,theCourtshall,withinthemeaningoftheIndianevidenceAct,1872,presumethatsuchorderwassomadebythatauthority.Punishmentforabscondingorconcealing.---

13.IftheProvincialGovernmenthasreasontobelievethatapersoninrespectofwhomanorderunderSection3,sub-section(1)orunderSection4,hasbeenmade,hasabscondedorisconcealinghimselfsothatsuchordercannotbeexecuted,theGovernmentmay---(a)makeareportinwritingofthefacttoanyMagistrateofthe1stClasshavingjurisdictionintheplacewheresuchpersonordinarilyresidesorhasanyproperty,andthereupontheprovisionsofSection87,88and89oftheCodeofCriminalProcedure,1898,shallapplyinrespectofsuchpersonandhisproperty,asiftheorderdirectinghimtobedetainedoranyordermadeunderSection4,wereawarrantissuedbyaMagistrate;(b)byordernotifiedintheofficialgazettedirectsuchpersontoappearbeforesuchofficer,atsuchplaceandwithinsuchperiodasmaybespecifiedintheorder;andifsuchpersonfailstocomplywithsuchdirections,heshall,unlessheprovesthathisabscondingorconcealmentwasnotwilful,inasmuchasitwasnotpossibleforhimtocomplytherewithandthatwithintheperiodspecifiedintheorderhehadinformedtheofficerconcernedofthereasonwhichrenderedcompliancetherewithimpossiblebepunishedwithimprisonmentforatermwhichmayextendto5yearsorwithfineorwithboth.PunishmentfordisobeyingdirectionsgivenorordersmadeunderSection4,oftheOrdinance.14.IfanypersoncontravenesanyordermadeU/S.4heshallbepunishedwithimpri

sonmentforatermwhichmayextendto5yearsorfineorwithboth,andifsuchpersonhasenteredintoabondinpursuanceoftheprovisionsofsub-section(2)ofSection4,suchbondshallbeforfeited,andanypersonboundtherebyshallpaythepenaltythereof,orshowcausetothesatisfactionoftheconvictingcourtwhysuchpenaltyshouldnotbepaid.Disseminationofrumours,etc.15.Whoever---(a)makesanyspeech,or(b)bywordswhetherspokenorwrittenorbysignsorbyvisibleoraudiblerepresentationsorotherwisepublishesanystatement,rumourorreport,

shallbepunishedwithimprisonmentwhichmayextendtothreeyearsorwithfineorwithbothifsuchspeech,statementrumourorreport.(i)causesorislikelytocausefearoralarmtothepublicortonaysectionofthepublic;(ii)defamesorislikelytodefameGovernmentoranyservantoftheCrown;(iii)furthersorislikelytofurtheranyprejudicialact.Obstructinglawfulauthorities---16.Ifanypersonvoluntarilyobstructs,oroffersanyresistanceto,orimpedeso

rotherwiseinterfereswith,---(a)anyauthority,officerorpersonexercisinganypower,orperforminganyduty,conferredorimposeduponitorhimbyorinpursuanceofthisOrdinance,orotherwisedischarginganylawfulfunctionunderthisOrdinance;or(b)anypersonwhoiscarryingouttheordersofanysuchauthority,officerorpersonasaforesaidorwhoisotherwiseactinginaccordancewithhisdutyinpursuanceofthisOrdinance---

heshallbepunishedwithimprisonmentforatermwhichmayextendto5yearsorwithfineorwithboth.Punishment.---17.Anypersonwhocommitsanyprejudicialactorattemptstocommitorabetsorattemptstoabetordoesanyactpreparatorytothecommittingofanyprejudicialactshallbepunished,inadditiontoanyotheractionwhichtheProvincialGovernmentmaydeemnecessarytotakeagainsthimunderthisOrdinance,withimprisonmentforatermwhichmayextendtosevenyearsorwithfineorwithboth.PunishmentinGeneral.---18.WhoevercontravenesanyprovisionofthisOrdinanceordisobeysorneglectstocomplywithanyordermadeordirectiongiveninaccordancewithitsprovisionsshall,wherenoexpressprovisionismadebythisOrdinanceforthepunishmentofsuchcontravention,disobedienceornegligence,bepunishedinadditiontoanyotheractionwhichtheProvincialGovernmentmaytakeagainsthimforsuchcontravention,disobedienceornegligence,withimprisonmentwhichmayextendtofiveyearsorwithfineorwithboth.Evasionofprovisionsforthetakingofpossessionoftheproperty.---19.WhereanypersonauthorisedbyorunderthisOrdinancehasinpursuanceofpowers,conferredbyorunderthisOrdinancegivennoticethatheorsomeotherpers

ondulyauthorizedbyhimhastakenorintendstotakepossessionofanyproperty,anypersonhavingcontrolofsuchproperty,whoalienates,removesorsecretsthesame,oranypartthereoforotherwisedisposesofthesameincontraventionofanydirectionsissuedtohimforitsdisposal,shallbepunishedwithimprisonmentwhichmayextendtofiveyearsorwithfineorwithboth.Attemptsetc.tocontravenetheprovisionsofthisOrdinance---20.Anyperson,whoattemptstocontravene,orabets,orattemptstoabetordoesanyactpreparatorytothecontraventionofanyoftheprovisionsofthisOrdinanceorofanyordermadethereunder,shallbedeemedtohavecontravenedthatprovision,or,asthecasemaybe,suchorder.Powertogiveeffecttorulesandordersetc.---

21.Anyauthority,officerorpersonwhoisempoweredbyorinpursuanceofanyprovisionsofthisOrdinancetomakeanyorderortoexerciseanyotherpowermay,inadditiontoanyotheractionprescribedbyorunderthisOrdinance,takeorcausetobetaken,suchstepsanduse,orcausetobeused,suchforceasmay,intheopinionofsuchauthority,officerorperson,bereasonablynecessaryforsecuringcompliancewithorforpreventingorrectifyinganycontraventionofsuchorder,orfortheeffectiveexerciseofsuchpower.Savingforactsdoneingoodfaith-underthisOrdinance.22.Nosuit,prosecutionorotherlegalproceedingshalllieagainstanypersonforanythingingoodfaithdoneorintendedtobedoneinpursuanceofthisOrdinance.

Applicationofotherlawsnotbarred.---23.TheprovisionsofthisOrdinanceshallbeinadditionto,andnotinderogationoftheprovisionsofanyotherAct,OrdinanceorRegulationforthetimebeinginforce.Powertodirectpaymentbyparentorguardianoffineimposedonaminorperson:-24.WhereanypersonundertheageofsixteenyearsisconvictedbyanycourtofanoffenceunderthisOrdinanceandsuchpersonissentencedtofine,theCourtmayorderthatthefineshallbepaidbytheparentorguardianofsuchpersonas

ifsuchfinehadbeenimposedupontheparentorguardian.(2)InanysuchcasetheCourtmaybeitsorderdirectthatindefaultofpaymentoffinebytheparentorguardian,theparentorguardianshallsufferimprisonmentasifsuchparentorguardianhadhimselfbeenconvictedoftheoffenceforwhichsuchpersonisconvicted.Offencescommittedbycorporationorassociation.---25.WherethepersoncommittinganyoffencepunishableundertheOrdinanceisacorporation,company,bankorassociationofpersons,anysecretary,directororotherofficer,memberorpersonconcernedwiththemanagementthereofshallbepunishedwiththepunishmentprovidedfortheoffence.OffencesunderthisOrdinancetobecognizableandnon-bailable.---26.NotwithstandinganythingcontainedintheCriminalProcedureCode,1898,anyoffencepunishableunderthisOrdinanceshallbecognizableandnon-bailable.Effectoforders,etc.inconsistentwithotherenactment.---27.EveryordermadeandeveryactiontakenunderthisOrdinanceshallhaveeffectnotwithstandinganythinginconsistenttherewithcontainedinanyenactmentoranyinstrumenthavingeffectbyvirtueofanysuchenactment,otherthanthisOrdinance.

DelegationofPowers.---28.TheProvincialGovernmentmaybyorderdirectthatanypowerordutywhichisconferredorimposedunderthisOrdinanceontheProvincialGovernmentshall,insuchcircumstancesandundersuchconditionsasitmayspecify,beexercisedordischargedbyanyofficerorauthoritysubordinatetotheProvincialGovernment.A.D.F.DUNDAS,Governor,North-WestFrontierProvince.DatedPeshawar,the4thJuly1948
