PART A: GENERAL

A.1 SCOPE OF WORK

This contract covers the SUPPLY, INSTALL, TEST AND COMMISSION POWER QUALITY RECORDERS WITH THEIR ACCESSORIES IN VARIOUS SUBSTATIONS on Prasa KZN Region, and any other work arising out of, or incidental to the above or required from the Contractor for the proper completion of the WORKS in accordance with the true meaning and intent of the contract documents.

A.2 ADMINISTRATION OF THE CONTRACT

For the purpose of this contract, “Engineer” means the Electrical Engineer, Prasa KZN or his duly authorised representative or any person lawfully acting in that capacity.

A.3 CHANGE OF NAME

Where ever reference is made to “South African Railways”; “South African Railways and Harbours”; “South African Transport Services”; “Administration”; “TRANSNET FREIGHT RAIL” or ”Transnet” in the Standard Specifications, as listed in clause A.4 below, it shall be changed to read “Prasa KZN”.

A.4 STANDARD SPECIFICATIONS AND INSTRUCTIONS OF PRASA KZN

The following specifications, instructions and documents shall, inter alia, form part of this contract:

(i) The project specification;(ii) The Bill of Quantities;(iii) General Conditions of Contract (GCC);(iv) Specification for Works on, over, under or adjacent to Railway lines and near High

Voltage Equipment, E7/1 PRASA (2012);(v) Specification for safety arrangements and procedural compliance with the Occupational

Health and Safety Act: Act 85 of 1993 and Regulations E.4E.

A.5 CONSTRUCTION REGULATION REQUIREMENTS

A.5.1 The Construction Regulations, 2014, an addition to the Occupational Health and Safety Act, 1993, will be applicable to this contract. The contractor is to ensure familiarity with and compliance to the regulation. The regulation can be obtained from the Department of Labour. The contractor is to ensure that the prices tendered for this contract make allowance for all the requirements of the regulation. Prasa KZN will consider the prices tendered to include the requirements of the regulation.

A.5.2 As part of the Construction Regulations, 2014, Prasa KZN has to provide the following documentation to the contractor:

(i) Risks on site

A preliminary risk assessment has been done by the Technical Officer in charge of this contract. This can be found in Annexure 1. This serves to highlight to the Contractor, the risks and hazards on the site of works. This will assist with the compilation of the health and safety programme, the method statement as well as the prices tendered by the contractor.

(ii) Aspects that must be covered in the Health and Safety Programme

To assist with the compilation of the Health and Safety Programme by the contractor, Prasa KZN has provided a list of elements which should be found in the plan. This can be found in Annexure 2. This list is not necessarily complete and the contractor is allowed to include other elements which are deemed important. Refer to clause A.6.1.1.3 for further details of the composition of the Health and Safety Programme. The Health and Safety Programme, as

submitted by the contractor, will be discussed and amended, if necessary before work on site begins (Refer to clause A.6.1.1.4).

(iii) Safety specifications of Prasa KZN

The E 7/1 and the E.4E specifications are included as part of the tender document.

A.6 DOCUMENTS THAT MUST BE RETURNED AS PART OF THE TENDER

A.6.1 The following documents must be returned by the contractor as part of the tender submitted:

A.6.1.1 Health & Safety Programme

As per clause 5 of the E.4E, the Contractor is responsible for the development of and adherence to a health and safety programme as detailed below:

A.6.1.1.1 The Contractor shall, with his/her tender, submit a Health and Safety Programme setting out the practical arrangements and procedures to be implemented by him/her to ensure compliance by him/her with the Act and Regulations and particularly in respect of :-

(i) the provision, as far as is reasonably practical, of a working environment that is safe and without risk to the health of his/her employees and subcontractors in terms of section 8 of the Act.

(ii) the execution of the contract work in such a manner as to ensure in terms of section 9 of the Act that persons other than those in the Contractor’s employment, who may be directly affected by the contract work are not thereby exposed to hazards to their health and safety,

(iii) ensuring, as far as is reasonably practical, in terms of section 37 of the Act that no employee or subcontractor of the Contractor does or omits to do any act which would be an offence for the Contractor to do or omit to do.

A.6.1.1.2 The Contractor’s Health and Safety Programme shall be based on a risk analysis in respect of the hazards to health and safety of his/her employees and other persons under their control, that are associated with or directly affected by the Contrac¬tor’s activities in performing the contract work and shall establish precautionary measures as are reasonable and practical in protecting the safety and health of such employees and persons.

A.6.1.1.3 The Contractor shall cause a risk assessment contemplated in clause A.6.1.1.2 above to be performed by a competent person, appointed in writing, before commencement of any Construction Work and reviewed during construction. The Risk Assessments shall form part of the Health and Safety programme to be applied on the site and shall include at least the following:

(i) The identification of the risks and hazards that persons may be exposed to;(ii) The analysis and evaluation of the hazard identified;(iii) A documented Health and Safety Plan, including safe work procedures to mitigate,

reduce or control the risks identified;(iv) A monitoring and review plan

A.6.1.1.4 The Health and Safety Programme shall include full particulars in respect of:-

(i) The safety management structure to be instituted on site or place of work and the names of the Contractor’s health and safety representatives and members of safety committees where applicable.

(ii) The safe working methods and procedures to be implemented to ensure the work is performed in compliance with the Act and Regulations;

(iii) The safety equipment, devices and clothing to be made available by the Con¬tractor to his employees;

(iv) The site access control measures pertaining to health and safety to be imple¬mented,

(v) The arrangements in respect of communication of health and safety related mat¬ters and incidents between the Contractor, his/her employees, subcontractors and the Technical Officer with particular reference to the reporting of incidents in compliance with Section 24 and General Administrative Regulation 6 of the Act and with the pertinent clause of the General Conditions of Con¬tract forming part of the Contract and

(vi) The introduction of control measures for ensuring that the Safety Programme is maintained and monitored for the duration of the Contract.

A6.1.1.5 The Health and Safety programme shall be subject to the Technical Officer’s agreement and he may, in consultation with the Contractor, order that additional and/or supplementary practical arrangements and procedures be implemented and maintained by the Contractor or that different working methods or safety equipment be used or safety clothes be issued which, compliance by the Contractor with his obligations as an employer in terms of the Act and Regulations. The Technical Officer or his deputy shall be allowed to attend meetings of the Contractor’s safety committee as an observer.

A.6.1.2 Proof of Registration with Compensation Commissioner

As per clause 28 of the GCC, the Contractor shall submit proof of registration and good standing with the Compensation Commissioner, in terms of Act 130 of 1993.

A.6.1.3 Method Statement

The Contractor shall submit, with his/her tender, a detailed method statement indicating the method or process the contractor will use to complete the works which must focus on the execution of the project. Mention will have to be made of the personnel, machinery, tools and equipment that the contractor intends using for the works.

The contractor must thus indicate that the methods he/she will use are feasible for the railway environment. The contractor to conform to E7/1 ‘Specification for works on, over, under or adjacent to Railway Lines and Near High Voltage Equipment’.

A.6.1.4 Category “C” Certificate

All personnel that will conduct work within 900mm of the “Live” High Voltage Electrical Equipment must have a valid Category “C” green certificate of Authority. This certificate must form part of the returnable documents.

A.6.2 Failure to provide these documents with the tender submitted will render the tender incomplete and the tender will therefore not be considered for award of business.

A.7 CONSTRUCTION PROGRAMME

The contractor shall conform to clause 20.2 and 23.2 of the GCC. The programme shall be made available within 30 (thirty) days by the successful tenderer from the commencement Date. The program of work must be in the form of a bar or Gantt chart or as otherwise directed by the Project Manager showing the following but not limited to:

• The Commencement date, commencement of the Works• The Completion Due Date, and the planned completion date• The sequence, timing and resources for carrying out the Works• The events influencing the execution of the Works• Expected occupation or work permit dates• Expected delivery dates of materials, machinery and other equipment deemed

necessary for the project

Where the activity is on-going and not of a once-off nature the proposed weekly production rate shall be indicated.

The plan will be subject to approval by the Regional Engineer/Project Manager but such approval will not relieve the Contractor of his obligations to undertake the work in an order and manner to ensure proper completion by the date/s specified in the contract. The plan shall be reviewed and up-dated when necessary with the consent or at the direction of the Regional Engineer/Project Manager. Should the program be altered for any reason prior to completion of the Contract then the Contractor shall submit the revised program to the Project Manager.

Should the Regional Engineer/Project Manager, at any time, be of the opinion that the rate of progress of the works or any part thereof is too slow to achieve the completion of the works he may notify the Contractor in writing, but the Contractor shall not be relieved of his obligations if such notice is not issued. The Contractor shall thereupon take steps to expedite progress so as to complete the works or any part thereof by the stipulated date. Failure to submit the construction programme on time will result in the cancellation of the contract.

A.8 SECURITY AND RETENTION

As per clause 24.8 of the GCC, the contractor shall deliver to the Project Manager, as part of the documentation required before commencement with works execution at his cost, the Performance Bond.

The Contractor shall ensure the Performance Bond remains valid and enforceable until the Final Approval/Completion Certificate is issued. The Performance Bond shall specify an expiry date, and if the Contractor has not become entitled to receive the Final Approval/Completion Certificate of the Works by the date 14 (fourteen) days prior to the expiry date, the Contractor shall extend the validity of the Performance Bond until such time that the Works have been completed.

Failure to provide security (Performance Bond), retention of 10% of the contract value will be deducted and will be paid to the contractor after 1 year from the date of the Final Handover.

A.9 DURATION OF CONTRACT

A.9.1 Prasa KZN requires that the Works be completed within EIGHT MONTHS of which 5 months will be for construction and 3 months for snags, which period shall include any statutory and builder’s holidays falling within this period. The completion date will be determined by adding the period specified above to the date of written notification of acceptance of tender, or to such later date as may be specified in the advice of award. Lead-time has been built into the period specified.

A.9.2 The suppliers shall provide a written undertaking in the form of a letter specifying the commitment period.

A.10 PENALTIES FOR LATE COMPLETION

If the contractor fails to complete the Works to the extent which entitles him to receive a Certificate of the Practical Completion in terms of Clause 23.10.2 as per the GCC, by the due completion date, the Contractor shall be liable to the Employer for an amount calculated 0.3% of the Contract Price per delayed day, which shall be paid for every day which shall elapse between the Time for Completion and the date stated in the Taking-Over certificate. However, the total amount due under this Sub-Clause shall not exceed the maximum of 10% of the Contract Price. (Clause 23.9 as per GCC is applicable)

A.11 MATERIAL AND LABOUR TO BE SUPPLIED BY PRASA KZN

Prasa KZN will provide -NONE

A.12 MATERIAL AND LABOUR TO BE SUPPLIED BY THE CONTRACTOR

A.12.1 The Contractor shall provide all Supervision, Labour and Material necessary for the proper execution and completion of the WORKS.

A.12.2 PRASA KZN supports BBBEE. The Contractor shall make extensive use of labour of the local communities. When called upon by the Engineer, the Contractor shall provide documentary proof in this regard.

A.12.3 The Contractor shall supply a fully qualified Substation supervisor to supervise on site activities as well as fully qualified Trade hands for the proper execution of the Works.

A.12.4 Void

A.13 PENALTIES FOR DELAYS TO RAILWAY WAGONS

A.14 SITE

The location and extent of the site is various localities within the Prasa KZN region, and will be pointed out during the site inspection. Access to the site is by public roads as well as by the service roads along the railway line. The Contractor must acquaint himself with the available access to the site and the condition of the roads during the site inspection. Prasa KZN will not be liable to ensure all weather passage on the service roads.

No housing of employees of the Contractor will be allowed on the property of the Prasa KZN, and the Contractor shall make his own arrangements for the housing of his employees.

A.15 SITE SERVICES

The Contractor shall make his own arrangements for the supply of water (for all purposes), light, power, sanitation and telephones, as required on the site.

A.16 SERVICES

Where the position of a known service cannot be determined with sufficient accuracy, by visual inspection, the Contractor shall open up and make further investigation before commencing with any of his activities, so that the position of such services may be determined with sufficient accuracy. Thereafter the Contractor shall assume responsibility for all known services.

The Contractor shall take all reasonable precautions to protect existing services during his activities on the site, and any known service damaged as result of the Contractor’s operations, shall be repaired and reinstated by the Contractor or the Authority concerned, all at the expense of the Contractor and to the satisfaction of the Engineer. If a known service is damaged, the Engineer must be notified immediately and all work on site must stop until the extent of the damage is quantified.

A.17 CLEARING OF SITE

The Contractor shall clear the site for his camp and the cost thereof shall be included in the rates tendered. The contractor is to ensure that each site on which he works is cleared of all waste on completion of the day’s work. The waste must be disposed off at a registered dumping site. Final payment will not be made unless all waste is removed from site and the site is clean.

A.18 HOURS OF WORK

Attention is directed to the provision of clause 23.4.1 of the GCC. No work will be permitted outside normal working hours, on Sundays, Saturdays and Public Holidays, unless the permission of the Engineer has been obtained in writing.

The permission will only be granted to suit occupation periods granted or in other exceptional circumstances and under such conditions the Engineer may decide.

Normal working hours shall mean the period from 08:30 to 15:00 on normal weekdays and from 08:00 to 17:00 on weekends.

A.19 OCCUPATIONS AND WORK PERMITSWork permits and Occupations are usually approved after 21 days from the application date. The program of works prepared by the Contractor should clearly indicate dates where a work permit will be requested.

The Contractor shall ensure that all work shall be arranged and conform to the requirements of the E7/1 specification.

Two conditions of work are foreseen:

Condition 1: Contractor to work on permits during normal working days where there is a standby supply (on Double unit Substations)Condition 2: Contractor to work on permits on weekends only where there is no standby supply (on Single unit Substations)

The Contractor shall be required to enter into a Safety Agreement with METRORAIL after the contract is awarded and before commencement of the works.

The Contractor shall be required to submit a time schedule of work and provide for his own record keeping as far as the number of allocated permits is concerned.

The Tenderers are required to provide an indication of the quantity of work permits that will be required for the construction. Any additional requirement for permits over and above this allocation will be charged. This provision excludes permits cancelled due to operational reasons.

A.20 PENALTIES FOR ILLEGAL OCCUPATION

The Contractor is not allowed to work on site without an occupation notice or the required protection. Should the Contractor perform any work on site, without an occupation notice or without the required protection, then the Contractor shall pay to Prasa KZN, a penalty of R10, 000.00 (Ten Thousand Rands) or shall be black listed and not be allowed to tender for any work at Prasa KZN. The decision as to the penalty for illegal occupation will be made by the Engineer. Also refer to clause A.29 for the tool that will be used to evaluate the performance of the Contractor.

A.21 CO-OPERATION WITH PRASA KZN’S TRAIN SERVICES PERSONNEL

The Contractor shall liaise and cooperate with the staff of Prasa KZN during any type of occupation at all times and in all respects, to obviate any delays. Should any train service be affected due to the negligence on the part of the Contractor, penalties will be raised in terms of clause 16 of the E7/1Specification. See clause A.22 for amounts that will be charged for delays to the train service.

A.22 PENALTIES FOR DELAYS TO TRAINS

Should the Contractor cause delays to the train service, either by late finish of daily occupation or inability to comply with the working programme and scheduled occupations, then the Contractor shall pay to Prasa KZN, and a penalty of R80.00 per minute per train that was delayed.

Where applicable, all material supplied by the Contractor to Prasa KZN must comply with the latest specification of Passenger Rail Agency of South Africa (PRASA). Clause 30.4 of the GCC is applicable.

A.24 SITE MEETINGS

Site liaison meetings will be arranged by the Engineer/Project Manager as necessary. The Contractor or his duly authorised representative shall be available when called upon to attend site meetings with the Engineer or his representative.

A.25 EXAMINATION OF THE WORK

No part of the Works or excavations shall be covered up or put out of view without the consent of the Project Manager, and the Contractor shall afford full opportunity to the Consultant to examine and measure the Works and to inspect the excavations before any Permanent Works are placed thereon. (Clause 30.5 of the GCC)

A.26 PLANT HIRE

The contractor shall supply and use suitable and sufficient plant, tools, equipment and material as may be required to carry out the work sufficiently, and must include his rates for any plant hiring on the Bill of Quantities. Tendered rates per hour shall include all costs for the operation of such plant, including operator, fuel, incidentals and any other indirect costs to tender such plant operational in terms of clause 24.11 and 30.2 of the GCC.

A.27 LABOUR AND PLANT RETURNS

Labour and Plant returns are required to be submitted weekly by the Contractor to the Engineer/Project Manager giving the following information:

(i) All labour engaged on the site for each working day.(ii) All plant engaged on site for each working day.(iii) Progress in (%) percent.

A.28 SITE INSTRUCTION BOOK AND SITE DIARY

A.28.1 The contractor shall provide a site instruction book for any instructions that need to be issued to him/her by PRASA KZN. The Contractor will have to sign for all instructions issued and will be issued with copies of the instructions.

A.28.2 The contractor will be responsible for keeping a site diary with all information related to the contract. This diary will have to be kept to make record of rain delays, production for the day, visitors to the site, expected date of material delivery, material delivered daily, labour and plant on site each day, etc. This will have to be filled in daily and will be called for should there be a request for an extension in contract period.

A.29 PERFORMANCE EVALUATION OF CONTRACTOR

This contract and the Contractor’s performance will be evaluated. The evaluation will be done monthly by the Engineer/ Project Manager in conjunction with the Contractor. This evaluation document will be used as a reference for future contract award by Metrorail. See attached annexure 6.

A.30 MEASUREMENT AND PAYMENT

On or about the fifteenth day of each month, the Contractor shall submit to the Project Manager a detailed list of material which has been properly provided and brought on the site by him/her for permanent incorporation in the Works but not yet incorporated, accompanied

by a written declaration signed by the Contractor certifying that the said material has been brought on to the Site for particular work and shall not be removed therefrom. (Clause 24.2 of the GCC)

A.31 INCREASE OR DECREASE IN COSTS OR ESCALATION

No contract adjustment or escalation factors are applicable to this contract.

A.32 PRELIMINARY AND GENERAL AND SITE ESTABLISHMENT

A.32.1 Fixed and value related items

(i) Provision in the schedule of prices

Provision is made in the schedule of prices for lump sums to cover the Contractor’s cost to supply, commission, maintain and eventually demolish and remove plant, tools and equipment, and for the Contractor to comply with any other obligations of a preliminary and general nature in terms of the contract.

(ii) Tendered sums

The sum tendered in the schedule of prices for any preliminary and general item, shall cover the Contractor’s direct and overhead costs, profit and all other costs for the provision of the item and/or compliance with the obligations, liabilities, risks and requirements associated with the item.

A.32.2 Scheduled fixed-charged items A.32.2.1 Initial financing

The sum tendered for in this item, shall cover the Contractor’s initial costs to provide security, as well as indemnities and insurance as per clause 11 and 34 of the GCC and any other financing obligations of a preliminary and general nature.

A.32.2.2 Establishing facilities on site

The sums tendered for the following items, shall cover the cost to provide, establish, equip and commission these facilities on site to allow the work to commence and to proceed to completion as required in terms of the contract:

(i) Office and storage sheds,(ii) Laboratories,(iii) Living accommodation,(iv) Workshops(v) Ablution and latrine facilities,(vi) Tools and equipment,(vii) Water supply, electric power, communications and access,(viii) Plant,(ix) Other.

A.32.2.3 Final removal of site establishment

The sum tendered for in this item shall cover the cost to demolish and remove from the site all items of the sub-clause A.32.2.2 hereof and shall include for making good and restoring the site to the satisfaction of the Engineer.

A.32.3 Scheduled time-related items

A.32.3.1 Continuing finance charges

The sum tendered shall cover all the Contractor’s time-related costs to provide security, as well as indemnities and insurance as per clause 11 and 34 of the General Conditions of Contract.

The sums tendered for the following items shall cover the Contractor’s costs for site rentals, repairs and depreciation of buildings, furniture, tools and equipment, the storage and distribution of fuels and lubricants, charges for water, electricity, communications, access and sanitation, and wages for staff operating and maintaining these facilities in accordance with the contract:-

(i) Office and storage sheds,(ii) Laboratories,(iii) Living accommodation,(iv) Workshops(v) Ablution and latrine facilities,(vi) Tools and equipment,(vii) Water supply, electric power, communications and access,(viii) Plant,(ix) Other.

A.33 VALUE-ADDED TAX

(i) Value added tax in terms of the Value-added Tax Act No. 89 of 1991 should not be included in the tendered rates. Provision is made in the Schedule of Prices/Summary of Prices for the lump sum addition of value added tax.

(ii) The total price inclusive of Value-added Tax shall be carried forward to the Tender form.

(iii) Value-added Tax shall be reflected on monthly contract payment certificate, but paid separately on the presentation of a VAT-invoice by the contractor.

(iv) The value of work reflected on the VAT-invoice must correspond with the nett amount indicated on the contract payment certificate.

A.34 INSURANCE

The Contractor will be responsible for insurance of all tools equipment; vehicles and labour that will be used for this contract, as per clause 34 of the GCC.

PART B: GENERAL

B.1 PURPOSE OF THE PROJECT

The purpose of the project is to measure and monitor the quality of supply to Rolling Stock to prevent any damages to the train and the substation equipment. This project will also assist in establishing the root causes of any failures on the line to enable viable solutions to be reached. The project will be 8 (eight) months.

B.2 CIDB GRADING

The CIDB grading will be 4EP or higher for the purpose of this project.

B.3 CONTRACTORS GENERAL OBLIGATION

The Contractor's general obligations under the contract comprise the construction, completion and, unless otherwise stipulated, the provision at his own expense of all labour, plant, tools, equipment, material, transport, consumable stores, services, samples and temporary works, and everything, whether of a temporary or permanent nature, required in and for the construction, completion and maintenance of the works.

B.4 ADDITIONAL WORKS

Any additional work not authorized by the Regional Electrical Engineer, even if proven necessary for the successful completion of the project will be tenderers own account.

B.5 DRAWINGS

The drawings will remain in the sole custody of Metrorail. One copy will be furnished to the Contractor free of cost. The Contractor shall give reasonable notice in writing to the Project Manager/Project Coordinator of any further drawing that may be required for the execution of the works. The drawings furnished to the Contractor shall be kept by the Contractor on the site and shall at all reasonable times be available for inspection and use by the Project Manager/Project Coordinator and Metrorail appointed deputies. In the case where the drawing is unavailable it is the contractor’s responsibility to take pictures and do final measurements on site under supervision of the Metrorail’s responsible person. On completion of the contract, the Contractor shall return to the Project Manager/Project Coordinator all copies of drawings provided under the contract.

B.6 SITE AND BILL OF QUANTITIES

The Contractor shall be held responsible to have inspected and examined the site and its surroundings and to have satisfied himself before submitting his tender as to the nature of the ground and sub-surface, underground services, the form and nature of the site, the nature of the works, the quantities and the materials necessary for the completion of the works, and, in general, to have obtained all requisite information as the risks, contingencies and other circumstances including the local climatic conditions, which may influence or affect his tender.

The quantities in the Bill of quantities are estimated/provisional and may be less than stated. The Contractor shall submit with his tender a complete and detailed priced schedule for the work.

B.7 WORKING ON METRORAIL’S SITES

No contractor will be allowed to commence work on site without a Site Access Certificate.The successful tenderer shall submit, within 2 weeks of the date of acceptance of his tender, a Safety Case, Method Statement and a Risk Assessment to the Project Manager/Project Coordinator. The Safety Case, Method Statement and Risk Assessment will be approved by Infrastructure Regional Engineers and the Risk Manager, and then the Site Access Certificate will be developed and issued to the contractor.

B.8 DEFECTS

When, in the opinion of the Engineer, any part of the work done or any material used or intended for use is not in accordance with the requirements of the contract, whether or not payment for such work or material has been made, he may order the Contractor in writing to remove any objectionable part of the material immediately and to replace it with acceptable material and to rectify or reconstruct the works in whole or in part, without cost to Metrorail.

When trenching, the contractor shall take all necessary precautions to prevent damages to underground services. All known services will be pointed to the contractor prior to commencement of work. Should any underground service, water mains, road pavement, drainage system, building or any other structure be damaged by the contractor, it shall be reported immediately to the Regional Electrical Engineer. The contractor shall be responsible for the cost of repairs.

 B.9 TECHNICAL SPECIFICATION AND BILL OF QUANTITIES

B.9.1 General

All prices to include ordering, loading, off-loading, storing, fixing, fitting/installing, constructing, finishing off, testing and commissioning, except where explicitly stated otherwise by the Engineer/Project Manager. All joints, screws, fixing material, etc., and labour in this connection to be included.

Notwithstanding the general conditions of the contract work shall be carried out in accordance with the following:

- Any site instruction issued to the contractor by the Engineer or his representative.- Work must be carried out as per the safety case, method statement and risk assessment issued

by the contractor to the Engineer/Project Manager.- This project specification.- The drawings as listed in this document- The Occupational Health and Safety Act, Act No 85 of 1993 - The Laws and by-laws of the Metrorail, inclusive of the Electrical Safety Instructions and the

E7/1 document.

B.9.2 Preliminary and General and Site Establishment

The tenderer shall allow for all Preliminary and General items and any site establishment deemed necessary in the tendered rates unless this has been specifically provided for in the bill of quantities.

B.10 SCOPE OF WORKS

The Contractor shall be responsible for storage, the supply, delivery of material to site, reception, off-loading, placing, fixing, fastening, installation, erection, making-off, connecting up, testing, commissioning, and guarantees of the equipment, materials and labour on the following aspects of the works.

B.10.1 Description of the works

The works in this contract shall include the following:

Develop drawing where applicable All materials and labour needed to complete the project for final handover in complete working

order as per section B18. Prior to installation, all Power Quality Recorders shall be tested by an approved authority and

test certificates shall be issued to the Regional Engineer/Project Manager. Recorders shall be manufactured using latest and ‘state of the art’ technology and methods

prevalent in electronics industry. The data stored in the recorders shall not be lost in the event of power failure. The meter shall

have Non Volatile Memory (NVM), which does not need any battery backup. Recorders shall be capable of measuring both AC and DC networks (88kVac, 11kVac and 3kV

dc) Recorder to show Instantaneous Parameters such as phase and line voltages, currents, power factors, overall

kVA, kW, kVAr, power factor, frequency etc. Load Profile Parameters such as kVAh/kWh/kVArh (lag/lead)/Maximum Demand (MD) in

kW/kVA/power factor/phase and line voltages/currents etc. Angle between voltage and current per phase.

Recorders to measure and show DC current I, Voltage V, Harmonics, Voltage Dips, Energy Demand, and etc.

Operating frequency shall be 50 hertz Equipment to be supplied by the contractor to conform to the relevant SANS/IEC/SABS or

equivalent, and proof of conformance must be provided. The scope of work may change by any quantity in accordance with Metrorail requirements at the

discretion of the Engineer and/or Client Transducers to be utilized must conform to IEC: 688-1 Measure the total energy consumption on all points of supply from the utility. The Data Logging System must be able to display power flow graphs on office PC’s, mobile

phones and etc. through wireless connections All final measurements to be done by the contractor on site. Tenderers to note that the scope

can be reduced by the client. The works shall include a warranty period of 5 years after project completion for all the installed

components. The project includes the training of staff to be able to use, maintain and understand the

functional system. Training must be provided for all tools supplied.

B.11 SITES TO BE COVERED

During the site visit the Contractor shall ensure that he is familiar with the site in terms of the Operational and Health Safety Act (refer to the E4E specification).

B.12 AS CONSTRUCTED DRAWINGS

Substation drawings (if available) will be given to the contractor during tender briefing. The Contractor shall correctly mark-up drawings. If the substation drawing is not available the contractor shall develop diagram which must be approved by the Regional Engineer.

If any changes are made during construction these changes shall be added to the drawings by the contractor.

Marking shall be in the following colours:

• Yellow - items omitted• Red - items newly brought on

Such changes shall, regularly during the construction period, be brought under the attention of the Electrical Engineer/Project Manager.

All such changes, correctly marked up, shall have been handed over to the Electrical Engineer/Project Manager at the date of commissioning.

No handing over shall be done before the Electrical Engineer/Project Manager has received such as-constructed drawings.

B.13 CONTRACTORS RESPONSIBILITIES

• The Contractor shall be responsible for the supply, factory testing, and delivery to site, offloading, and storage (if required), installation, erection, site testing, commissioning and handing over.

• The Contractor shall provide all materials, equipment and services necessary for the complete, safe and efficient progress and completion of the Contract.

• The Contractor shall draw up and submit to the Regional Electrical Engineer/Project Manager program of works as indicated on section 1.5.

B.14 COMMISSIONING TEST AND COMPLETION

The Metrorail staff, in conjunction with the Contractor, shall carry out the final commissioning test. The Contractor shall carry out any remedial work, if necessary.

All cost for commissioning tests shall be for the Contractors account.

B.15 WORKS BY OTHERS AND LIAISON WITH METRORAIL

Before commencement of any works involving the Contractor working under or over the existing Perway can occur, the Contractor shall contact the Electrical Officer (Contracts), six weeks before the time, for the arrangements needed to be made with the relevant parties within the Metrorail Organization.

Any entry and work involved in the High Voltage Substations will be done under supervision of Local Metrorail Staff, in accordance with the Electrical Safety Instructions.

Any remedial work and or preparation work required from Metrorail to complete the works as defined in this specification is for the Contractor’s account as well as any remedial work to be done by the Contractor himself.

Energising and de-energising of electrical equipment will be done in accordance with Chief Energy Engineering Instruction G18, in conjunction with Metrorail. The Electrical Control is responsible for the timeous notification of all parties concerned.

B.16 GUARANTEE

All work undertaken by the Contractor shall be subject to a guarantee for a period of one year against faulty and/or inferior workmanship and material.

The guarantee period shall commence the day the installation is formally handed over to and accepted by the local Metrorail staff.

The Contractor shall undertake to repair all faults or defects due to bad workmanship and/or faulty materials during the guarantee period.

Any defects that may become apparent during the guarantees period shall be rectified to the satisfaction of and free of cost to the Client.

The Contractor shall undertake work on the rectification of any defects that may arise during the guarantee period within the time noted in the Contract Document, from the time of being notified by the Client.

Should the Contractor fail to comply with the requirements stipulated above, Metrorail shall be entitled to undertake the necessary repair work or effect replacement of defective apparatus or material, and the Contractor shall reimburse Metrorail the total cost of such repair of replacement, including the labour costs incurred in replacing defective material.

B.17 HANDING OVER

Two handing-over dates shall be set:

The first handover when the Electrical System is commissioned to the satisfaction of the Technical Manager, in accordance with the details as set out in the handing over documentation of PRASA.

All non-consumable equipment and labour shall be guaranteed for 12 months after the expiry of the retention period.

The retention period shall be 12 months from the date of First Handover. A final inspection and Final Handover shall end the retention period. Provision is made for

partial handover of Completed Sections, i.e. Section between two adjacent Substations. The retention period however shall end with a final inspection of all completed Sections simultaneously.

B.18 THE WORKS

Supply and Install Power Quality Recorders on PRASA (Metrorail) Substations. The Power Quality Recorder must be capable of measuring both AC and DC (88kVac and 3kVdc).

B.18.1 Specification

• Power Quality Recorders to monitor kVA, kVAr, kWh and power factor. It shall measure voltage, current and frequency.

• Power Quality Recorder must include voltage and current harmonic recording capabilities• Power Quality recorder must be mounted with a complete Display Board that can display all

characteristics measured.• The power quality recorder shall assist in Demand side management to reduce peak

electricity demands, maximum Demand control. The recorder shall also send alarms/notifications to Electrical Control and Management

• The data base shall belong to Metrorail after hand over. All recorded data shall be available all the time on the database and can be downloaded anytime.

• Recording to be captured in real time.• The Meters shall have load profile data storage capacity of up to 800 days.• The system shall have a Dashboard Facility for recorded outputs and the output shall be

selected as required by the user.• The Power Quality Recorders must have the following features:

• The Power Quality Recorder must be supported by software that has a secure IP connectivity and remote configuration with the capability of generating reports conforming to EN50160 and NRS-048. The software must include the following:

• The Power Quality Recorder must conform to IEC 6100-4 and must be preferably locally manufactured, if not, local agents must be available. The recorders shall record all the power parameters per phase and also represent real time metering data. The recorder shall be able to communicate remotely via GSM/GPRS and with Optic fibre network.

• The Recorder shall produce graphical presentation of data which should be easily understood by various Metrorail users.

• The design life of the recording system shall be 10 years without requiring spares. Meters must be of a trusted brand, tried and tested by local and international industries.

• The Tenderer should provide at least 5 day training to Metrorail employees on how the system works, software training and provide maintenance procedure. The Tenderer shall provide Manufacturers Maintenance manuals. The Tenderer shall have evidence of competency in System design, Installation management, System Configuration, System Commissioning and System Maintenance.

• Tenderer to procure all required material deemed necessary to successfully complete the installation of the Power Quality Recorders.

• The tenderer shall be responsible for the complete installation of the Power Quality Recorders on the substation panels with complete wiring, CTs and VTs complete.

• Tenderer shall do the commissioning test after completing the installation and provide the commissioning or test certificate.

• The tenderer should ensure that the system is interlinked by:

Supply and Install a cat 6 Ethernet cable from existing switch to the workstation. Ensure that this is terminated on a 9u rack with a UTP panel and brush panel complete.

The Contractor shall provide Hard or Tough book Laptops or equivalent complete for Downloading of Data by Test Lab and the other will be based on the KZN Regional office for recording the real time data. The contractor shall ensure that the Laptops and the Office based display to be supplied are fully interlinked to the power quality recorders.

B.19 PENALTIES

• The contractor will be charged a penalty of 0.3% of the contract price per day delayed after the project duration has expired but not exceeding 10% of the contract value

• The contractor will be charged a penalty of R10 000.00 for working without an occupation• The contractor will be charged R10 000.00 for working on Metrorail site without a proper and

valid Site Access Certificate. • The contractor will be charged a penalty of R 80.00 per minute per train that was delayed.

B.20 PRICING THE WORK

B.20.1 Site storage

The contractor shall store the material and deliver onsite when ready for the installation. The contractor will be responsible for loading and off-loading, transporting the material from their point of storage to each substation site.

B.20.2 Security

The Tenderer shall make provision for securing the staff, plant, material and equipment on site.

B.20.3 Management & Supervision

The Tenderer shall provide for the pricing of necessary management and supervision costs for the duration of the contract.

B.21 TESTING AND COMMISSIONING

The Contractor will be required to perform the necessary metering Tests by an approved Test Laboratory or Specialist.

B.22 SCRAPPING OF MATERIAL

The scrapping of material will be treated as follows:

The Contractor will be required to remove all the material to be scrapped from site and deliver and off load it at the Metrorail Springfield stores. A Metrorail representative shall indicate a suitable site for these materials to be off loaded. The Contractor shall supply a delivery note.

The Contractor shall ensure the process is approved by the Clients Health and Environmental Specialist to mitigate environmental risks. The Contractor will be required to remove the scrap from site, load it onto suitable transport (steel to be cut as required, subject to the issue of the necessary permits), transport it to the Metrorail Depot or Stores and off load it.

The abandoned steel components shall not be left unattended for prolonged periods on site. The steel shall be removed from the track side or substation after each occurrence, safely stored temporarily (if required) and transported to the Metrorail Depot as soon as practically possible. All care shall be taken to avoid unlawful removal of these components from site.

B.23 QUALITY ASSURANCE

The Tenderer shall take into account when preparing a cost that he will be responsible for submitting a Quality Assurance plan for the project. This plan will be subject to scrutiny by the Project Manager and the Regional Engineer Metrorail.

The Tenderer shall further allow a cost for the successful implementation of the proposed Quality Assurance plan.

B.24 QUALIFICATION

The contractor shall provide the following; Qualified Electricians (with a valid Category C green certificate), qualified Trade Hands (with valid Category C green certificate).

B.25 COMPULSORY SITE MEETING

All contractors shall attend a site meeting and must provide their own safety clothing (safety boots and visibility vest)
