Part of Lot 19 Concession 9, (municipally known as 9700 Highway 27, Kleinburg)

The subject lands are zoned OS1, Open Space Conservation Zone, subject to the provisions under By-Law 1-88 as amended.

To permit the construction of a canopy as follows:

1. To permit a minimum rear yard setback of 10.24 metres to the canopy. 2. To permit a structure for other than conservation or flood control projects within

the OS1 zone (a canopy of 304m2).

3. To permit a canopy structure with an overhang of 5.9 metres (on one section, other sections are a minimum of 0.85 m).

1. A minimum rear yard setback of 15.0 metres is required. 2. No building or structure other than for conservation or flood control projects is

permitted within the OS1 zone. 3. A maximum overhang (encroachment) of 0.3metres is permitted for an accessory

structure.

The Owner is requesting permission to construct an open and unenclosed canopy with the following variances:

No building or structure other than for conservation or flood control purposes is permitted within the OS1 zone 0.3m

The subject lands are designated "Valley Area" by OPA #601 (Kieinburg-Nashville Community Plan) and "Natural Area" by the City of Vaughan Official Plan 2010, which is subject to approval from the Ontario Municipal Board.

OPA #601 states that "only those recreational activities which take place outdoors and which do not negatively impact the natural features/functions of the valley/stream corridor shall be deemed compatible with the natural character of the valley or stream corridor'' (Section 4.1 0.1 0.1, subsection 4). Accordingly, the proposal to construct an open and unenclosed canopy in an existing picnic area is consistent with the policies of the Official Plan.

The Development Planning Department conducted a site visit with photo documentation on April 18, 2012. The subject lands are located on the west side of Highway #27 and are developed as a passive recreational/memorial site for the Polish Army Veterans Association of America.

The Applicant is requesting permission to construct an open and unenclosed canopy above an existing picnic area. The proposed canopy consists of 14 concrete footings, with the remainder of the area below the roof to remain unaltered and unexcavated.

Authority (TRCA) approved the size and location of the proposed canopy. The Applicant is seeking relief from the use and setback provisions of the OS 1 Open Space Conservation Zone in order to construct the proposed canopy in accordance with TRCA approval.

On this basis, the Development Planning Department is of the opinion that the proposal is minor in nature, meets the intent of the Zoning By-law, and is desirable for the appropriate development of the land.

The Applicant has indicated on the submitted site plan that the existing concrete slab and one-storey frame shed located to the northwest of the proposed canopy is to be removed, as the structures currently encroach into a Regional road allowance. A condition of approval to this effect is included below.

The Development Planning Department supports Minor Variance Application A 117/12 subject to the following condition:

. . Background . . It is our understanding jhat the purpose of the above-noted variance application is to permitthe construction of an open air canopy 1 picnic shelter with a minimum rear. yard setback of 10.24 metres, and an overhang of 5.9 metres. It is also our understanding that the proposed structure is located within an 081 zone~ ·

·. The by-law requires· a 15.0 met~e rear yard setback and permits an overhang of 0.3 metres. The by-law also does not allow building or structures other than for conservation or flood control projects within an OS1 zone. ·

Applicable Policies and Regulations The subject property is entirely within a Reguiat~d Area of the Humber River Watershed. In accordance with the Development, Interference with Wetlands and Alterations to Shorelines and Watercourses Regulation (Ontario Regulation 166/06), a permit is required from the TRCA prior to development, if In the opinion of the authority', the contr:ol of flooding, erosion, dynamic beaches or pollution or the conservation of land· may be affected· by the development. ·

Development is defined as the construction, reconstruction, erection or placing of a building· or structure · of ~ny kind or site grading. ·

In addition, the TRCA's Valley and Stream Corridor Management Program (VSCMP) sets out. development guidelines for properties influenced by valley and stream corridors. Site-Specific Comments As not.ed above, the subject property is entirely within a Regulated Area of the Humber River Watershed.

The area of the property proposed for development' is a peninsula piece outside of the Regional Storm Flood Plain but entirely within the Main Humber River valley corridor. ·

Based upon a site visit conducted by TRCA staff on January 13, 2012, TRCA geotechnical staff required a minimum 6 metre setback from the closest slop~ feature for any proposed works.

TRCA staff note that the applicant has already received a permit under Ontario Regulation 166/06 for a· proposed canopy on the subject property (Permit No. C:120056,Jssued February 3, 2012). The drawings provided as part of this variance application indicate an approximate so metre setback to the top-of­slope, which differs from our· permit approved drawings.

Recommendations · In light of the above, TRCA staff have no objections to the Committee of Adjustment Application A 117/12, subject to the following conditions: ·

1. The applicant successfully obtain a revision to their Ontario Regulation 166/06 permit to reflect the relocation of the pro posed canopy I picnic shelter; and ·

2. The applicant submit the variance application review fee of $300 payable to the Toronto and Region Conservation Authority. '- · ·

TRCA staff reql.Jest that a Notice of Decision for this application be forwarded to our office when available. However, please be advised that all future development proposals should be circulated to the TRCA for our review and approval prior to any works taking place. · · . .

Cultural Services has received the request for comments regarding the application noted above and would like to offer the following comments:

1. The subject parcel of land lies in an area identified as a being of high archaeological potential in the City's database of archaeological resources. As such, the owner is advised that the following standard clauses apply:

i. Should archaeological resources be found on the property during construction activities, all work must cease and both the Ontario Ministry of Tourism, Culture and Sport and the City of Vaughan's Policy Planning and Urban Design and Recreation and Culture Departments shall be notified immediately.

ii. In the event that human remains are encountered during construction activities, the proponent must immediately cease all construction activities. The proponent shall contact the York Regional Police Department, the Regional Coroner and the Registrar of the Cemeteries Regulation Unit of the Ministry of Consumer and Business Services.
