ANNEXURE to Order No. KPTCL/B5A/SA3/5474/97-98/II dated 25.04.2015

PROCESSINGS OF THE GOVERNMENT OF,KARNATAKA

SUB :- Guidelines regarding Transfer of Government Servants

lead:- Government Order No. DPAR 4 STR 2001, dated 22-11 -2001.

Preamble:

In the Government order 1 read • above, orders were issued .. framing comprehensive guidelines for transfer of Government servants, as per the

* ‘ *•recommendations of the Administrative Reforms Commission tinder the

. Chairmanship of Shri Haranahalli Ramaswamy.

Thereafter,- specific instructions were being issued every year for transfer of Government servants mainly in accordance with the instructions contained in the Government order read above.

It is now found expedient to regulate the transfer of Government servants to * ensure their continuance in a post for a reasonable peridd so that they get real

exposure to the acti vities of the department and deliver the results/ outcomes as envisaged. Further, as per the recommendation of the Karnataka Administrative Reforms Commission, it is aimed to bring in more transparency, accountability in administration. More over, for uniform distribution of Personnel throughout the State for effective functioning of the Government, it is felt necessary to issue fresh general orders regulating the transfer of Government servants.

Government Order No. DPAR 22 STR2013, Bangalore, dated 7.6.2013

For the reasons explained in the preamble and in supersession of the Government Order dated 22.11.2001, read above, Government are pleased to issue revised instructions regulating the transfer / deputation of Government servants as indicated in this Government tjrder. These instructions shall come into

effect from the year 2013-54. These guideline's are not applicable to iho£ Government servants who. are already governed by separate Acts /Rules frame for the purpose of transfer.

2. Periodical Transfers :~

- General transfers shall be made in the months of May and June every year. No Government servant shall be considered for transfer / deputation except in the circumstances and in the manner specified in this order. For the year 2013-14, General Transfers shall be made before 30-06-2013.

3. Explanation In this order, unless the context otherwise requires;

(a) ‘Competent Authority’ means the Appointing Authority or such other

Authority authorized to make transfer / deputation;

(b) 'Deputation' means transfer o f a 'Government servant from a post in . one department to -aft equivalent post in another department and

includes deputation to en-cadre posts / ex-cadre posts / local bodies i co-operative societies / foreign service posts, cs the case may be, as per the provisions o f Karnataka Civil Services (General Recruitment) Rules, 1977 / Karnataka Civil Service Rules / Cadre and Recruitment Rules-applicable as the case may he to the posts to which the Government servants are to be deputed;

(c) 'Group- A, B, C, D’ posts means the posts under the Government, classified as Group - A, B, C, D in rule 5 of the Karnataka Civil

Services (Classification, Control and Appeal) Rules, 1957;

(d) ’Transfer1 means the posting o f a Government servant from one headquarters to another headquarters or from one office to another within the same headquarters , to-take up duties of a new post or in consequence of a change of headquarters;

Note:- Movement of a Government servant within the same office / unit from one post to another one or desk / compilation to another one under the same head office shall not be treated as transfer.

(I) 'Units of Seniority* means the jurisdiction of the respective Appointing Authority in respect of a post;

4 Process of Transfer :~

a. Transfers / deputations shall be made by the Competent Authority subject to the conditions indicated in this order* mainly in the interest of public service in a transparent manner. Transfers should as far as possible be made through Counseling on the basis of requests by giving preference to the length of service of a particular Government servant in a particular place and also by considering the various aspects as indicated in this Government Order and by considering the factors determining the inter-se priorities between the officers. Preference may also be based on the performance of the Government servant on the basis of his Annual Performance Reports.

b. The Cadre Management Authorities constituted for transferring Government servants in the Government Order read above are hereby abolished. Transfers shall hereafter be effected by the Competent authority.

5. Restriction on transfer

The Competent Authority shall ensure that the number of Government servants transferred/deputed in any year is kept to the barest minimum and ordinarily, the number of Government servants transferred / deputed in any year shall not exceed si* percent of the total working strength of the cadre in that particular unit of seniority. Transfers / deputations should be done in

such a way feat no Government servant should remain on compulsory waiting.

4 Responsibility of Competent Authority :«

The Competent Authority, while effecting transfers / deputations or giving postings may further ensure that,-

(a) The Government -servant against whom there are serious charges and against whom departmental proceedings/ criminal proceedings are initiated or pending or prosecution is being contemplated, shall not be posted to sensitive/ executive posts and should be posted to non­executive posts where they cannot interfere with the investigations against them. Further* a Government servant against whom a departmental enquiry / criminal case is pending should not be deputed to a post on his request.

(b) The maximum period of deputation to a particular post shall be five years at a time.

i A Government servant shall not be considered for deputation if he has not completed the 'cooling off period’ of two years in his parent department after completion of the last deputation, even if he has not completed five years in the earlier deputation. Further, deputation of a Government servant repeatedly to the same post is prohibited.

ii Unless a suitable person is not available to i l i up a particular post in a department as per the Cadre and Recruitment Rules of that Department, no Government servant shall be deputed to such posts from other Departments. Such deputations made if any, shall be reviewed every year and the deputationist shall be repatriated to the parent department soon after the availability of a suitable departmental officer to hold that post.

7. The transfers should not be considered beyond the month of June, exceptin the following circumstances by the competent authority:-

P) Where transfer/ deputation of a Government servant is considered instead of placing him under suspension;

(8) Where new offices/posts are created or posts have fallen vacant due to retirement, promotion, resignation, reversion, dismissal, death, compulsory retirement or when a direct recruit is to be posted on his first appointment or a promotee has to be posted on promotion or due to any unforeseen circumstances and when the posts are requited to be filled immediately;

(81) Where the transfer is necessitated in particular cases, only due to exceptional circumstances or special reasons, restricting the number of such annual transfers to minimum after recording reasons for the same

(w) The facility of mutual transfer / deputation shall be extended to the Government servant only once in Ms service and

(v) Where prtma facie a complaint of serious nature is received or leveled against a Government servant to the satisfaction of the Head of the Department after ascertaining that Articles of charges/ Charge sheet have been issued to him or permission has been given for his prosecution in a competent Court of Law.

The minimum period o C g ^ io r a particular post may be prescribed / revised from time to time , by an order by the Administrative Departments of the Secretariat, with the prior approval of the Chief Minster, in respect of certain types of sensitive cadres in the departments coming, under their administrative control, depending upon the nature of duties assigned to the post.

9. Premature / delayed Transfer -. f * * > *, • ..»* ,tv* ^ • ••

a. Generally there should be no premature transfers. The tenure of posting of a Government servant may be extended or reduced by the Competent

i C. } ■ •Authority in the following cases after recording the reasons for the Same in writing. The minimum period of slay at a place as prescribed in para 8 can be reduced and the concerned Government servant transferred prematurely if the competent authority feels that he or she is not suitable for discharging the duties at the present place and the reasons are recorded to this effect in writing;-

(i) The employee due for transfer after completion of tenure at a place or posting or post has less than two years of service for retirement;

(ti) The employee possesses special technical qualifications or experience for the particular job for which a suitable replacement is not immediately available;

p i) The employees working on a project or Flagship programmes of Government of India which are in the crucial stage of implementation and his withdrawal will seriously jeopardize timely completion of such projects;

(iv) Where both the spouses are Government servants and if one of the spouses is transferred, then the other spouse may also be transferred to the same place or nearby place depending upon the availability of vacancy even if one of them has not completed the minimum periodof stay; '

(v) Where a female Government servant is a widow / spinster/ unmarried divorcee, she may be transferred and in case she is appointed for the first time, may be posted to a place of her choice subject to availability of vacancy;

(vi) Where a Government servant is an office-bearer of the Karnataka State Government Employees Association only, such Government servant shall not be transferred until the completion of the term for which he has been elected. In case no elections are held within three months of the completion of fee said term, he may be transferred. In case he is reelected, he may be continued in the same place until the completion of the second term only.

(vii) Where a Government servant is physically handicapped / challenged or disabled subject to certification by the Medical Board;

(viii) Where a Government servant or his/ her spouse or children are

\suffering from serious or terminal ailments, depending upon the availability of the facility of medical treatment at the requested place subject to certification by the Medical Board;

b. However, before effecting any premature transfers and for making any transfer alter the transfer period, and also for extending the tenure of a Government servant for the reasons stated above, prior approval of the Hon’ble Chief Minister must be obtained without foil by the concerned Administrative Department of the Secretariat. The Principial Secretaries / Secretaries to Government should not under anycircumstances issue transfer orders and later seek ratification/ post facto approval of the Chief Minister.

10. Maintaining a proper balance of vacancles:-

Notwithstanding anything to the contrary contained in this order, if the number of vacancies in any cadre in any department in any district is disproportionately large, the Competent Authority shall, as far as possible, see that the vacancies are evenly distributed among the various districts.

11. Monitoring the transfers:-

Transfers will be monitored throughout the year. Therefore, all the Competent Authorities should file a return indicating the number of transfers effected in the form appended as ANNEXURE-2 to this order, fifteen days after the end of the General transfer period. Thereafter, these returns should be filed every three months for the periods ending September, December and March within the next fifteen days. It is the responsibility of Principal Secretaries/ Secretaries to Government to consolidate the reports of every department coming under their administrative control and send the same to DPAR periodically.

Transfer cannot be claimed as a matter of right by the Government servants. Bringing political pressure for transfers is prohibited. I f any Government servant brings political pressure regarding his posting to a particular place at any time, in contravention o f the instructions contained in circular No. SI AA SU E l 26 SE NOU VA 93 dated 22.5.1993, Official Memorandum No. DPAR 41 STR 94 dated 5.8.1994 and Official Memorandum No. SI AA SU EE 54 SE NOU VA 93 dated 1942- 1994, he shall be proceeded with accordingly. It shall also be ensured that he is not posted to such a post.

13. Review of the decisions of t ie Competent Authority;-

(i) A Government servant may, within a period of one week from the date of the order of his transfer make an application to the Competent Authority' accompanied by a copy of the order* seeking a review specifying therein, the reasons for the same.

(it) The Competent Authority shall consider all the circumstances of the case and pass such orders as it deems fit subject to the Provisions contained in this order.

u ' Transfers in Karaataka Government Secretin*!:-

Notwithstanding anything to the contrary contained in this order, the movement of the Government servants belonging to the

Movement of the members of the Karnataka Government Secretariat Service

1. Unlike the field departments, whose role mainly relates toimplementing policies and programmes of Government, the Karnataka Government Secretariat has a different role, namely, formulating the plans (including the five year plan) / policies, rendering specialist / technical advice in legal, personnel, financial and such other matters, interacting with the Government of India including the external agencies and functioning as the storehouse of Government. Besides; the Karnataka Government Secretariat is a single Unit office. Hence, the word 'movement" has been used in relation to the members of the Karnataka Government Secretariat Service and not the word "Transfer". „ ’

2. For the purpose of the movement of the members of the Karnataka Government Secretariat service, the various departments of the Karnataka Government Secretariat are classified into four categories, namely, Development Departments, Regulatory Departments, Service Departments and Technical / Specialist Departments as specified b e l o w .

3. Each department of the Karnataka Government Secretariat has been allocated work as per the Karnataka Government (Allocation of Business) Rules, 1977. Each department deals with certain distinct activities, Acts, Rules, Regulations etc., allocated to it. A Member of the Karnataka Government Secretariat Service, who is posted to a particular department needs reasonable time to acquaint himself with the work of the department and acquire proficiency and expertise in dealing with the work allocated to him.

4. In the background mentioned above, the movement of the members of the Karnataka Government Secretariat Service and their training shall be regulated as prescribed hereunder

Hie tenure referred to above excludes the period of training mentioned in item (b) below:

(b) Every member of the Karnataka Government Secretariat Service holding posts in the cadres of Assistants* Senior Assistants, Section Officers and Under Secretaries shall be deputed to field departments for a period of at least two years within five years of entering each of the said cadres;

Provided that those who have attained the age of 52 years may not be so deputed.

(c ) The Principal Secretary / Secretary to Government concerned can rotate the officers within his department;

<d) In case, however, the Principal Secretary / Secretary to Government desires to surrender to the Department of Personnel and Administrative Reforms, the services of any officer before the completion of the minimum tenure mentioned in para 5 above, he shall record reasons for the same and seek prior clearance of the Department of Personnel and Administrative Reforms for such surrender. However, alleged mis-conduct cannot be a ground to surrender any officer to the Department of Personnel and Administrative Reforms. In such cases, appropriate^ disciplinary action should be initiated;

(e) As far as possible, Department of Personnel and Administrative Reforms will ensure that the movement of the members of the Karnataka Government Secretariat Service is within each of the four categories mentioned in para 2 above.
