FEBRUARY COUNCIL MEETING: At the Council meeting on 27 February, in addition to the standard financial reports, Council approved a request for a residential house in Beacon Heights to become a holiday home; a sign on Sydney Highway promoting the Farm; and a request to relinquish the lease on the Salt Farm. Council meetings are held monthly and alternate between Home Island and West Island and are open to members of the public. Agendas and minutes are available on the Shire website.

MITINGAN FEBRUARY COUNCIL: Pada mitingan Council pada 27 February, disamping laporan keuwangan biasa, Council meluluskan pemintaan untuk sebuah rumah di Beacon Heights untuk dijadikan sebagai ‘holiday home’; sebuah sain di Sydney Highway untuk memajukan Farma; dan permintaan untuk melepaskan Farma Garam. Mitingan Council diadakan setiap bulan dan berganti diantara Home Island dan Pulu Panjang dan terbuka untuk memba-memba dari awam untuk hadir. Ajenda dan minutes disediakan di website Shire.

MID YEAR BUDGET REVIEW: At the February meeting Council also considered the mid-year review of the budget and, as a result of increased grant funding, was able to put aside $400,000 to implement projects arising from the Master planning. Council also approved two much needed new positions for the Shire— an Asset and Property Management Officer and an Admin Trainee. Funds were allocated by Council to commence tender documents and specifications for a house on Home Island.

Council juga meluluskan dua kerjaan baru yang sangat diperlukan untuk Shire—Asset and Property Management Officer dan Admin Trainee. Ongkos telah dikhaskan oleh Council untuk memulakan surat tender dan penerangan untuk sebuah rumah di Home Island.

MAJU PULU KITA / ADVANCE OUR ISLANDS: Wow, what a busy week it was. We were so delighted by the huge numbers at the design workshop on Saturday and at the follow up workshops on Wednesday. Thank you to everyone who gave their time and input so generously. We were very pleased to have the support of the Commonwealth as our funding partners with the

Administrator of Christmas Island and Cocos (Keeling) Islands, Mrs Natasha Griggs and officers from the Department in attendance.

We are excited to have funds (as outlined above) to implement community priorities as quickly as possible. Over 70 project ideas were captured and now the working group have the exciting but difficult task of prioritising those ideas using the matrix workshopped on Wednesday. If you would like to be on this working group, please contact Luluk Sloan at the Shire Office. The draft Maju Pulu Kita report will be provided publicly so every member of the community can review and comment on what the community and the Shire developed by working together. The staff of the Shire did a wonderful job in organising and facilitating this process and deserve a special mention.

MAJU PULU KITA / ADVANCE OUR ISLANDS: Wow, seminggu liwat yang sangat sebok. Kami sangat bergirang hati oleh jumlah orang yang bergitu banyak yang hadir di masyuarat desain pada hari Sabtu dan masyuarat selanjutnya pada hari Rebo. Terima kasih kepada semua yang memberi masa mereka dan pandangan mereka dengan sangat murah hati. Kami sangat bersenang hati yang telah mendapat sokongan dari Administrator Pulau Christmas dan Pulu Cocos (Keeling), Puan Natasha Griggs dan opisa-opisa dari Department yang hadir.

Kami sangat gembira untuk menerima duit bantuan (seperti yang diterangkan diatas) untuk melaksanakan keperluan-keperluan masyarakat secepat mungkin. DIRECTION ISLAND RESORT PROPOSAL: Thank you to members of the community who have registered for the Community Reference Group (CRG). We have 25 registrations to date with the group a great reflection of the make-up of our community. We will find a date for the CRG to meet in the near future. The CRG will be

provided with information and then invited to make recommendations to Council for Council to consider in their deliberations. In the meantime, any member of the community is welcome to make a submission. Submissions close on 12 March 2019.

CADANGAN RESORT PULU TIKUS: Terima kasih kepada penduduk dimasyarakat yang telah rejista untuk Community Reference Group (CRG). Kita telah menerima 25 rejistresen pada saat ini dengan kumpulan ini menjadi cerminan masyarakat kita. Kita akan mencari hari bulan untuk CRG untuk bertemu dimasa akan datang. WORKS UPDATE:

The sand bagging project at Pulu Gangsa has been completed. This 210metre section was completed within 2 weeks and looks wonderful. Congratulations to the team for their efforts.

Proposed Local Law The Shire of Cocos (Keeling) Islands proposes to adopt the following local law – 1. Shire of Cocos (Keeling) Islands Local Law 2019;

Raise Earthworms

Composting is the most effective method of treating food waste, and unlike general assumption, it can happen right inside your house.

This may sound a bit creepy, raising a bunch of earthworms in a box somewhere near your kitchen, where you cook.

But considering that raising these little compost makers turns out to be quite helpful in turning your life eco-friendly, isn’t it worth the effort?

Simply choose a place to start your compost and some soil in it and start throwing in food scraps. The smaller the pieces, the quicker these worms work their magic.

Oh and don’t feed them meat (any kinds of meat), bones, fish, dairy products and oily foods as these will produce odour that attracts flies.

After just a few days, you’ll have plenty of rich soil to grow onions, potatoes or any house plants for your kitchen!

The Indian Ocean Territories Administration (IOTA) is currently seeking motivated, professional and suitably qualified persons to join our team as the Administration Officer within the Indian Ocean Territories Health Service (IOTHS) based on West Island, Cocos (Keeling) Islands.

The IOTHS delivers a primary and acute health care service in two of Australia’s most remote and spectacular settings - Christmas Island (CI) and the Cocos (Keeling) Islands (CKI). The IOTHS includes a 24 hour eight bed hospital and primary care facility on CI and clinics on Home and West Islands in the CKI. The IOTHS is committed to “Working with our communities to keep us healthy for the whole of our lives”.

The key responsibilities of the Administration Officer, CKI, are to provide reception and administration services to clients and employees of the CKI Health Clinic as well as providing a Receiver of Relevant Monies service to clients of the Health Clinic.

Our ideal candidate will have experience in accounts and finance as well as demonstrated skills in customer service and a positive and proactive attitude. In addition, the successful candidate will have excellent interpersonal skills, be well organised and able to manage a number of tasks under pressure. Competency using Microsoft office programs and the ability to communicate in Cocos Malay and English are also essential.

Previous experience with the IOTHS, tertiary qualifications in accounting, finance or medical reception and experience in translation / interpretation are all desirable.

To be considered, applicants must be eligible to obtain a security clearance at baseline vetting level (must be an Australian citizen); hold a ‘C’ class Driving Licence transferable to the Indian Ocean Territories and have a valid Working with Children Check. The successful candidate will also be subject to a health assessment.

Criminal offences of assault III - grievous bodily harm and unlawful wounding

These are short articles about legal issues that may interest you. They are not legal advice. You should always get individual legal advice for your situation.

This is the final article of three about criminal offences of assault and similar offences. This article is about unlawful wounding and grievous bodily harm. Note that the defence of “provocation” does not apply to either of these offences.

Unlawful wounding

This offence is where you unlawfully wound someone. Wounding means penetrating or splitting the skin. Surface scratches are not sufficient; all layers of the skin must be penetrated or split for the definition of wounding.

“Unlawful” means that it is not excused or justified by law, the same as for unlawful assaults. So, for example, an operation to remove an organ, for which you have given consent, would not lead to a charge of unlawful wounding, because it is not unlawful.

A situation where a person has stabbed someone else will often lead to that person being charged with unlawful wounding.

This offence can be dealt with by the Magistrates Court or the District Court (commonly called an “either way” offence). It must be dealt with by the Magistrates Court unless either unless either you or the Prosecution ask for it to be dealt with by the District Court (called (“on indictment”)) and the Magistrate agrees. There are rules that the Magistrate must apply in making this decision.

If the offence is dealt with by the Magistrates Court the maximum penalty is 2 years imprisonment and/or a fine of $24,000, unless the offence is committed in aggravated circumstances. Aggravated circumstances were explained in more detail in the first article in this series. They are when the victim and offender are in a “family relationship” as defined under the Restraining Orders Act, or there was a child present when the offence occurred, or the victim was 60 or more years old, or the offence was also a breach of a restraining order. In aggravated circumstances, the maximum penalty is 3 years imprisonment and/or a fine of $36,000.

If the offence is dealt with by the District Court the maximum penalty is 5 years imprisonment, unless the offence is committed in aggravated circumstances. In aggravated circumstances, the maximum penalty is 7 years imprisonment.

Grievous bodily harm (“gbh”)

This offence is where you do grievous bodily harm to someone. Grievous bodily harm is where there is a risk of the victim dying, or a likely risk of the person dying, or they suffer permanent harm, or are likely to suffer permanent harm. An example might be where they have a life-threatening heart attack as a result of your attack upon them, or permanently lose hearing in one ear as a result of your punch to that ear.

This offence can only be dealt with by the District Court (called an “indictable-only” offence) because it is too serious to be dealt with by the Magistrates Court.

The maximum penalty is 10 years imprisonment, unless the offence is committed whilst you are stealing a motor vehicle, or in aggravated circumstances, or in prescribed circumstances (see paragraph below). If the gbh is committed whilst you are stealing a motor vehicle, or in aggravated circumstances, the maximum penalty is 14 years imprisonment.

The maximum penalty is also 14 years imprisonment if the victim is in one of the categories of people below and doing their job.

A public officer (eg a police officer, public servant)

Someone acting to assist a public officer

A driver of - A taxi - A ferry - A vehicle on a railway - A bus driver

An ambulance officer

An FES worker (firefighter), SES worker, Volunteer Marine Rescue Services officer

A hospital worker

A worker providing health services to the public A court security officer

A prison officer.

Where imprisonment is mandatory (you must go to prison) for gbh

If the assault is on a police, prison, youth custodial, ambulance or court security officer, or transit guard, then a sentence of immediate imprisonment is mandatory. This means the sentence of imprisonment cannot be suspended.

If you are an adult, you must receive a mandatory minimum prison sentence of 12 months.

If you are 16 years but under 18 years, you must receive a mandatory minimum prison or detention sentence of 3 months. A conviction must be recorded against you.

Dalam suatu keadaan yang seorang menikam orang lain akan biasa menyebabkan orang itu dituduh dengan kecederaan yang melanggar undang-undang.

Pelanggaran ini boleh diurusi oleh Magistrates Court ataupun District Court (biasanya dipanggil pelanggaran “either way”). Ia mesti diurusi oleh Magistrates Court kecuali kamu atau Prosecution memohon untuk diurusi oleh District Court (dipanggil (“on indictment”)) dan Magistrate bersetuju. Ada undang-undang yang Magistrate haru menggunakan untuk membuat keputusan ini.

Kalau pelanggaran diurusi oleh Magistrates Court, hukuman maksimum ialah 2 tahun dipenjara dan/atau denda $24,000, kecuali pelanggaran itu dilakukan dalam keadaan yang memberatkan. Keadaan yang memberatkan diterangkan dalam majalah pertama series ini. Ia adalah bilamana mangsa dan orang yang bersalah berada dalam “perhubungan keluarga” sepertimana yang dijelas dibawa Restraining Orders Act, atau ada anak-anak yang hadir dimasa pelanggaran itu berlaku,

While your emotions may require more concerted effort to understand and control than others’, you should still revel in your ability to feel emotion. Control Over Life’s Path While your disease might make you feel helpless at times, think about how you still have power over the direction of your life. With proper treatment, you can regain control of your mental and physical health, which will provide the ability to guide your life as you see fit. Significance of Companions Relying on others for aid is not weakness, but strength. Adding new people into one’s life only works to provide deeper insight into what it is to be human, and reflecting on the benefits of one’s friends and family, new and old, will allow you to approach your illness from different directions. Your disorder is your own and no one else’s. Though you have doctors, therapists, friends and family to guide you, ultimately you are in charge of your wellbeing. Sadness of Change Many people suffering from mood disorders fear entering treatment because they don’t want to lose what they see as a crucial part of themselves. The truth is that you will change as you learn to live with your disease, but that change will ultimately be for the better. Reflect daily on what positive changes you’ve noticed due to your treatment. Meaning of Mindfulness Many sufferers benefit greatly at the beginning of treatment by imagining a specific life they would like to lead. Through concerted effort, sufferers can take steps to achieve that goal. Power of Kindness Living with a mood disorder is far from easy, and there will be days that are especially difficult. However, if you strive to be kind no matter your attitude or the atmosphere around you, you will find that maintaining a positive, healthful outlook becomes easier.

atau mangsanya berumur 60 tahun atau lebih, atau pelanggaran itu melanggar perintah pertahanan. Dalam keadaan yang memberatkan, hukuman maksimum ialah 3 tahun dipenjara dan/atau denda $36,000.

Kalau pelanggarannya di urusi oleh District Court hukuman maksimum ialah 5 tahun dipenjara, kecuali pelanggarannya dilakukan dalam keadaan yang memberatkan. Dalam keadaan yang memberatkan, hukuman maksimum ialah 7 tahun dipenjara.

Kecederaan badan yang terok (“gbh”)

Pelanggaran ini ialah bilamana kamu menyebabkan kecederaan badan yang terok terhadap seseorang. Kecederaan badan yang terok ialah bilamana ada risiko yang mangsa itu mati, atau risiko berkemungkinan orang itu mati, atau mereka menderita kecederaan seumur hidup, atau berkemungkinan akan menderita seumur hidup. Contohnya mungkin seorang dapat serangan jantung yang terok bersebabkan kamu menyerang mereka, atau kehilangan pendengaran disatu kuping bersebabkan kamu menumbuk mereka dikuping itu.

Pelanggaran ini hanya boleh diurusi oleh District Court (dipanggil pelanggaran “indictable-only”) sebab ia terlalu serius untuk diurusi oleh Magistrates Court.

Hukuman maksimum ialah 10 tahun dipenjara, kecuali pelanggaran itu dilakukan dimasa kamu mencuri kereta, atau dalam keadaan memberatkan, atau dalam keadaan yang ditentukan (lihat paragraf dibawa). Kalau “gbh” dilakukan dimasa kamu mencuri kereta, atau dalam keadaan yang memberatkan, hukuman maksimum ialah 14 tahun dipenjara.

Hukuman maksimum ialah dipenjara untuk 14 tahun juga kalau mangsanya adalah salahsatu orang yang dalam daftar dibawa yang menjalankan tugas mereka.

Keadaan dimana penjara adalah wajib (kamu mesti dipenjara) untuk gbh

Kalau penyerangan dilakukan terhadap opisa police, penjara, penjaga remaja, ambulance atau security mahkamah, the assault is on a police, prison, youth custodial, ambulance or court security officer, or transit guard, maka hukuman penjara segera adalah wajib. Ini bermaksud hukuman penjara segera tidak boleh ditunda.

Kalau kamu seorang dewasa, kamu masti menerima hukuman penjara segera untuk 12 bulan.

Kalau kamu 16 tahun tetapi dibawa 18 tahun, kamu mesti menerima hukuman penjara segera atau hukuman tahanan untuk 3 bulan. Hukuman harus dicatat terhadap anda.
