gentlemen of the Grand Jury. John Giordani, Chief
Deputy District Attorney on behalf of the State of
Nevada presenting the case of State of Nevada versus
Erick Rangel and Jose Rangel under Grand Jury case
number 19CGJ169A and B. A copy of the proposed
Indictment has been marked as Grand Jury Exhibit Number
1. In addition I have marked as Grand Jury Exhibit
Number 2 a packet of instructions on the law. If at any
point during the course of this presentation or during
the course of your deliberation you need further
instruction on the law please let me know. With that I

A I was on the phone with her and then when
she went out that day I was still texting her the whole
night.

that Lesly goes out?
A It was like, like midnight when she went

misspellings in the text or did it appear to be a normal
sentence she sent?
A No, it was just a sentence that she sent.
She just said that she needed to talk to me about
something.
Q Do you know what she specifically said?
A She said I need to talk to you about
something like, you know, some and then she like said,
you know, verbal language but --

you about shit was 4:40, but when did you send your what

A It should be like a minute when she sent me

Q And then you never heard back from her?

A She lived with my parents with me.

she didn't return home?
A Well, I kept like trying to call her and
then her phone went straight to voice mail. So I went
home and I told my mom because she asked for her and
then after that like we tried to get in contact with his
family.
Q His being?
A Erick Rangel.
Q Okay. How did you know Mr. Rangel?
A Because he was like a family friend from
like, you know, we've been known him for like ten years
and stuff like that, uh-huh.
Q Okay. At some point that next day did you
file a missing persons report?
A Yeah, it was that weekend. I think it was

communicate with Erick's family?

A No, I contacted his sister.

that communication.

the Rangels at some point?
A Yes.
Q Was that on the 29th?
A Yes.
Q What did you observe when you got there?
A When we first got there we were trying to
like, you know, we were knocking and then trying to --
and no one was answering. And then we came back like an
hour later and then we just saw a vehicle and then the
mom and then the two daughters and they were like
putting furniture in the truck.
Q Okay. Did you see items that appeared to
be cleaning supplies or cleaning --
A Yeah, they were wearing -- one of them was

A No.
Q Do you know who Mr. Rangel's father is? Do

Q Did you see him there at the home when you
were there?
A No.
Q Okay. You just saw you said the mom and
sisters. I'm just trying to figure out who these people
are.
A Yes.
Q Is that the mom of Erick Rangel?
A Yes.

Q And how long have you known Erick Rangel
approximately?
A Approximately about five, six years.
Q Would you consider yourself to have been
friends for that time period?
A About so, yes.
Q Okay. Did Erick Rangel contact you at the
very end of August, 2020?
A Yes, he did.

A Morning hours, roughly between maybe 8:00
a.m. or so.
Q And when he contacted you did you answer?
A Yes, I did.
Q When you answered did you recognize the
voice of the person on the line?
A I did but wasn't quite sure.
Q Okay. And what did you do when you
answered?
A I asked who it was and he stated it was
Erick.

Q What did Erick say when he contacted you?
A When he contacted me he asked me if he
could, if I could help him out. He had said do you
remember that favor that I asked you for, he goes can
you help me out, so I asked him a few times --
Q Let me stop you for a moment because the
Grand Jury's hearing all this for the first time, okay?
A Sure.
Q What do you mean he said do you remember
that favor I asked you about, what's the context there?
A The story behind that?
Q Yeah.
A Maybe about, almost about a month, not too
sure quite exactly when, but when I was in there eating
on my lunch break, him and his brother had joined me
because they seen me in the restaurant eating. He asked
me, he said hey, he was pretty drunk, he asked me, he
said hey, if I ever need a favor from you can you do it
for me.
Q Okay. And let me stop you there. This was
months prior, right?
A Approximately, yes.
Q Okay. Or at the very least several weeks?

Q Okay. So this conversation you're
describing now has absolutely nothing to do with the
disappearance or murder of Lesly Palacio, can we agree
there?
A Yes, we can agree there.
Q Okay. So he calls you basically out of the
blue late August and asked you about this favor; is that
right?
A Correct.
Q Okay. Now that it's in context, can you go
on and explain the rest of the conversation?
A Sure. So he asked, he said so can you do
me that favor. So I said okay, what's up, what do you
need. So he had stated that he needed me to bring him
gas. So I kept asking, well, why do you need gas. I
thought that it was kind of odd that he wanted me to
bring him gasoline. He said that he didn't want to be
seen on camera. He said he needed me to bring him the
gasoline. So I kept poking around a little bit to ask
why because I thought it was kind of weird.
Q Let me stop you. Did he say where he was?
A Yes, after about a couple more times asking
he stated he was in Utah.
Q Okay. Go on.

goes I need the gasoline, he said I killed a bitch.
Q I killed a bitch?
A Yes. And then I -- he was so calm about it
to the point where I just, I didn't believe it, so at
that point I'm just like are you serious, I'm like, no,
you're messing with me. He goes no, I'm for real, he
goes I killed a bitch. And then he said it again one
more time and then he said I'm serious, she's dead in
the back seat of my car right now.
Q Did he say car?
A Truck.
Q Your mask is killing me here. Did you say
car or truck, I'm sorry?
A Let me rephrase that. He did say she is
dead in the back seat of my truck.
Q Okay. Thank you, sir. When he said I
killed a bitch several times, did you respond or did you
question him further or how did that go?
A At first I took a pause, I kind of
questioned him a little further because I fully didn't
believe it at the time, especially because of just how
calm he was I figured, no, he can't be serious. So I
asked him and he kept saying I'm serious. So at that
point I pretty much just told him, I said, you know, I
said hey, I can't do you that favor, you know, I've got13:34:45

to go pick up my daughter in the morning, made up an
excuse to kind of get him to back off a little bit
because he was pretty persistent in asking. Then he
goes, for the most part he goes -- I said why would you
call me and say this. He goes, well, he goes it's a
burner phone. And then that's when I stated you fucked
up by telling me.
Q Okay. And what do you know a burner phone
to mean?
A A burner phone, I mean, I'm not really too
sure what it was. I'm assuming it's obviously a ghost
phone or something.
Q Okay. So you were saying to him why did
you call me and he says it's a burner phone?
A Correct.
Q Okay. And when you made your excuse as to
why you couldn't help him, did that essentially
terminate the conversation?
A It terminated it right then and there. He
just said okay. And then after I told him that he
fucked up by calling me he just says all right then and
then he hung up on me.
Q Did you know Mr. Rangel to drive a
particular vehicle?

Q When he asked you weeks before or months
before if you would do him a favor, did he tell you what
the favor was going to be?
A No, ma'am, he did not. All he said was if
I ever need a favor from you would you do it for me,
would you come through and do it. I didn't really think
much of it, you know, he was drunk at the time and I was
like, you know, let me go ahead and shut him up so I was
like, yeah, you need a favor, sure, you know.

Q What did you do before homicide?
A I was a narcotics detective for 14 and a
half years and five years in patrol.

August of last year. At some point in time in late
August or very early September, did you become aware of
a missing persons report regarding Lesly Palacio?
A Yes, I did.
Q Do you recall what date that first came to
your attention?
A The first of September last year, 2020.
Q Prior to it coming to your attention, was
someone else in the Las Vegas Metropolitan Police
Department handling that missing persons case?
A Yes, the detectives in the missing persons
section originally got the case on the 30th of August.
Q Did you, as a homicide detective, develop
or learn that there may be other missing person cases
related to Lesly Palacio's missing persons case?
A Yes, the missing persons people received a
missing persons report from the family of Erick and Jose
Rangel listing them as missing and they put two and two
together that the two were related and came to us.
Q Okay. So the missing persons detective put
those together and brought it to your attention?
A Correct.
Q And to be clear, those reports, those three
different missing persons reports were

A Correct, Palacio was the 30th and the
Rangels was the 31st.
Q When you received the case, what was your
first kind of assignment or where did you go? What did
you do first?
A When I first -- they brought the case to me
and they briefed me on their findings. They had located
surveillance video of Erick Rangel and Lesly Palacio
from the early morning hours of August 30th, and based
on their investigation of the facts from interviewing
both family members they decided that this was extremely
suspicious and that she was possibly dead. They briefed
me on their investigation. I then drafted search
warrants for the Rangles' house on Tipper Avenue and for
Erick Rangel's sister's house on Whitney Ranch. We
served those warrants, interviewed the family members
who gave us consistent stories that they had given to
missing persons detectives.
Q Okay. Now, you had indicated earlier that
you received some information regarding Lesly being out
earlier in the evening; is that right?
A Yes.
Q And did several of your colleagues collect
video surveillance from several Las Vegas area bars?

group is from the Longhorn Casino on Boulder Highway and
Harmon.
Q Okay. And do those appear to be fair and
accurate depictions and still photos taken from the
actual video surveillance associated with those
establishments?
A Yes.

A Yes, that was from August 30th at
approximately 4:30 a.m. That's Mr. Rangel and Miss

That was approximately midnight 20 a.m. on the 30th.
That's them arriving and they're walking from Mr.

approximately 1:00, there was additional video found at
a Putter's bar on Charleston and Sloan. They went
there, arrived there approximately 2:15 and had drinks
there. It's not clear on the video at what time they
left but then they resurfaced at the Bourbon Street at
approximately 4:30.
Q Understood. So fair to say they're
drinking relatively heavily throughout the evening and
early morning hours?
A Correct.
Q And I'm showing you again State's 35. Can
you see the pattern on Lesly's shirt in this still
photograph?
A Yes, it's a horizontal striped black and
white type pattern.
Q And for the record she's wearing blue
jeans?
A Correct.

A Yes. The way it broke out for manpower, we
served two warrants at once. I and my co-case took the
Rangel daughter's apartment because the family was there
that needed interviewed. Detective Mitch Dosch handled
the crime scene at Tipper, the Rangel residence.
Q Okay. Did you, as the lead case detective,
become aware of surveillance video that was located in
the area of the Tipper residence?
A Yes.
Q And did you impound that video?
A Yes.
Q And then was that provided to our office
during the course of this prosecution?
A Yes.

thong part that goes between the legs and the crotch is
actually around the waist as if somebody had placed them

at all?
A No, they went through but they were, as if
you put a leg -- a leg was through the waist hole and
the waist was in a leg hole.

A That's the body again. She's black from
decomposition.
Q At the time in September of 2020, do you
know the weather generally?
A Yes, it was very hot.

A Those are a pair of women's jeans
consistent with what she was wearing in the video that
were in a bush several feet away.

A Yeah, we were able to locate, we located
what I believe were heel drag marks in the dirt leading
from the wash to the bush indicating to me that whoever
had dumped her had pulled her up out by the arms and the
chest then was dragging the feet behind.
Q Is this body ultimately sealed up in a bag
and taken to the coroner's office for an autopsy?
A Yes.
Q Did you attend that autopsy?
A Yes, I did.

are we looking at here?
A That's a cleaned-up photo of the front of
the body and the underwear that are on inappropriate.
You can see on the upper leg the frilly part is supposed
to be the top part of the underwear and then the thinner
part that goes through the crotch is actually going

version did he essentially deny leaving the residence
with his son Erick on August 30th of 2020?
A He initially did, yes.
Q Did he say essentially that all he
remembered was it seemed like the girl had an overdose
and Erick had -- well, that?
A Yes, that's correct.
Q Okay. Did you at some point confront him
with the video surveillance from the Tipper Street?
A I did, yes.
Q At that point in time did he provide a
different version of events?
A He did. He then stated that he wanted to
be completely open and honest with us from that point on

Q What did he say was his involvement after
he had learned of the surveillance video?
A He stated that morning he was awake early
in the morning preparing to take his wife to church as
well as a job that he was going to have later that
afternoon. He would have been in the garage area and he
hears his son Erick come inside and he hears somebody
else is with him that he believed to be Lesly Palacio.
They go upstairs, they're gone for about 30
minutes, he continues to do some things in the garage
and then Erick comes down. Erick is shirtless and the
body of Lesly Palacio has been drug down on a sheet, a
bed sheet, and Erick is starting to freak out at that
point and states that he has to do something with the
body.
At that point Jose decided that he needed
to help him get the body out of the residence before
anyone else within the household, being his daughters or
his wife saw the body to eliminate their involvement,
and he did help him load the body at that point into
Erick's vehicle.
Q Did Mr. Jose Rangel indicate to you whether
there was any blood or vomit or anything that he noticed
on the body?

lying on that sheet that she appeared to be deceased to
him but he did not see physical injuries to indicate
that. He did not recall seeing any vomit or any other
bodily discharge or any blood to him, but he did
describe the fact that she was only dressed in a shirt
and that her panties were pulled up awkwardly on her but
she was not wearing any pants.
Q Did you ask him was that you in the video
hosing off the driveway?
A I did. He identified himself in the video
initially loading her into the vehicle with Erick. He
identified himself closing the door of that vehicle
after the body was put in and then he did acknowledge
the fact that he was outside cleaning up or watering
down the driveway and moving some things around the
front of the house afterwards as well.
Q Did he claim, however, with regard to the
hosing the driveway off that he wasn't doing it to
destroy evidence, he was doing it for some other reason?
A He stated he was nervous and he didn't know
what to do with himself at that point so he stayed out
front. He gave a story that he had received a letter
from his HOA that their yard needed to be cleaned up and
he went in that mode since he was out front and that's

Q Did you ask him whether he or his wife
cleaned up evidence inside the scene meaning inside the
home?
A I did ask him that. He denied having any
involvement with that. He did not believe his wife or
anybody else in the house had any part of a cleanup
inside the residence.
Q Did you ask him if he physically went to
Mexico with his son?
A I did. He stated that afternoon, well,
that morning Erick leaves with the body and Jose
believed he was going to Utah to destroy the body is
what he was told. He did not believe he would see Erick
return that day or did not know when he would be coming
back. So later that afternoon when he goes to his
daughter's apartment, Erick shows up. He sees Erick,
Erick is acting very weird, making some statements to
the fact that he may kill himself or he may kill Jose,
made some other statements that people may come kill
them or the family. Jose makes a decision to then leave
the area with Erick. They gather some money up and
drive to Southern California and then eventually into
Mexico.
Q And the place where Jose was apprehended,

Jose indicate to you that he and his son discussed what
happened on the way to Mexico?
A We asked about any conversations that they
may have made had related to the incident and what Jose
recalled was Erick would not get into details but he
made some statements to Jose along the lines that she
may have overdosed on narcotics and had drank a lot that
night.

A But he doesn't have any specifics to
anything else other than that, at least that he was
willing to tell us.
Q Okay. Other than that version that Erick
gave to Jose, did he say anything about Erick saying how
Lesly ended up dead other than what you just described?
A No.

A I'm currently employed as a detective with
the Las Vegas Metropolitan Police Department currently
assigned to the homicide section.
Q How long have you been in the homicide
section?
A Eight years.
Q And were you involved in an investigation
that started as a missing persons and turned into a
homicide investigation regarding Lesly Palacio?
A I was.
Q Did you have a particular role when it came
to the investigation?
A I did.
Q What was that role, sir?
A Typically in our investigations we do what
is known as a wolf pack approach. That means that we go
out as a squad and then everyone is given different duty
assignments. In this case it was a division of labor.
My job or my primary responsibility during that
investigation was to conduct a search along with crime
scene analysts of a residence down in the southeast part

Q And that date was?
A It was September 2nd, 2020.

are we looking at generally?
A So this photo that you see before you is
the front of the residence. This is a two-story single
family residence, approximately 13 to 1400 square feet
and it's north facing. So this photograph, if we could
figure out the orientation, is looking from north to

A So this photo is inside that single
carport, if you will, to the garage area looking from
the south towards the north. In fact, that silver/gray
van is my vehicle, my Metro vehicle.
Q And I believe that might be your face.
A That might very well be my head.

A So going to the aforementioned black, it's
a 2004 Cadillac, it looks like an SUV, this is under the
front end of the vehicle. This is the left front wheel
that you see to the right of that photo and underneath
it is a maroon rug consistent with like a bath rug.

A So we're again looking from the south, from
the north to the south. This would be the west side of
that residence. And as you can tell there's not much
space between the adjacent homes in this particular
neighborhood.

Q And what's on the floor of the kitchen
area?
A So in those white trash bags, those
commonly known as like a kitchen trash bag, what
appeared to be an effort to move out the contents of the
residence, and instead of using your traditional boxes
the group that was moving utilized these bags.
Q Fair to say there are also cleaning
supplies up on the counter?
A Yes.
Q State's 12?
A So specifically like in that last
photograph to the left, and now this is a close-up
photo, are cleaning supplies.
Q What are we looking at in State's 13?
A So going back to two photographs ago of the
kitchen, this was on the right-hand side in the corner
near the sink is a mop bucket and a mop.
Q On the head of that mop does there appear
to be a dark substance on the bottom right portion of
the exhibit?

A So again that is another pair of latex-like
blue gloves.

A Correct. So this particular photograph,
again the house faces north, so this -- if you're coming
up the stairs it's in a two-part thing with a landing in
between the two sets of stairs. So in this particular
photograph this is being taken from the landing looking
from north to south into that house on the second floor.
Q Were there three bedrooms on the second
floor?
A Correct.

commonly associated as the north bedroom because it's on
the north side of the house.

A It is.
Q Does there appear to be any sheets on that
bed?
A So it appeared that the fitted sheet
typically that would go over a mattress was gone.
Q And State's 18, is this that same bed we
were just looking at?
A Just a little bit closer to the edge of the
mattress.

What are we looking at here between the white and the
green towels or blankets?
A So that little stain or apparent stain

A It is. And this would be looking down on
the ground and just inside the entryway of that
particular bedroom. As you can see on the upper
right-hand corner is the door.
Q And what is this red card here?
A It appeared to be a gaming card associated
with one of the local gaming establishments here in Las
Vegas.
Q And whose name was on that card?
A Erick, E-R-I-C-K, Rangel.

bedroom is that rack and that is the northern most
garment hanging on that rack.
Q And State's 22, what are we looking at

A So on that garment, if you can see the
patterns you can see sort of like a blue fragmented
pattern is another stain of apparent blood.
Q And you say apparent. Is there a reason
you say apparent blood?
A Because I don't want to tell you that
that's blood and then it be shown otherwise, so
apparent.
Q Is there something called a phenolphthalein
test or something to that effect?
A Phenolphthalein?
Q Phenolphthalein test that crime scene
analysts do on scene?
A Correct. It's a presumptive test to
identify the presence of blood.
Q And that's in no way definitive that it is

A Well, there's different kinds of blood.
You could actually have canine blood, you can have human
blood, so it might identify as blood but understand that
it may not be human blood.
Q Understood. But the items that did show
positive presumptive for blood, those items were
impounded from the residence?
A A swab of those stains, yes, a
representative swab of those stains.
Q To include this here on the white shirt?
A Indeed.
Q State's 23, is this the same bedroom but
now the blankets have been removed from the mattress?
A Correct.
Q And State's 24, is that another or I guess
that same spot of apparent blood?
A Just another photograph now with the marker
that the crime scene analyst would apply showing that
they had swabbed that stain and identified it as an
apparent bloodstain.
Q And there appears to be a wallet in the top
left corner; is that correct?
A There is.

A So primarily depicted in the middle of that
photograph is a roll of what would again common kitchen
trash bags. Going back to some of the earlier photos,
it appeared that the occupants of the home were
employing those bags to use as a means to pull items out
of the house.
Q State's 28, what is this on the bed here,
if you know?
A I can't see the -- it appears to be a
bottle of some sort but I might be wrong.

the left, there's a little like vanity table or a table
for what looks like it could be used for a variety of
reasons, a desk and on that desk were apparent cleaning
supplies.
Q State's 30, is that just a close-up of one
of those cleaning supplies on the desk?
A Just a close-up of a bottle of ammonia.
Q With the lid off?
A The lid is off.
Q And what's that on the table next to the
ammonia?
A Those would be fake eyelashes.
Q State's 31, is this that same bedroom but
now it's been changed a little bit here?
A It has. And an explanation for why it's
been changed is that when we are conducting a search we
document the room with the photographs to see how we
found it. And then what we do is we move all of the
items that we're searching, whether it's in a dresser or
on a desk, to kind of a centralized location and in this
particular situation we utilized the bed. It's a big
area that we can place items and then that's how you see

A So these are two apparent bloodstains that
were just forward the toilet that's in the master
bathroom.
Q And were those like the apparent, other
apparent bloodstains swabbed and then impounded as
evidence?
A They were.

medical examiner. There's unfortunately a backlog as
you might imagine these days with the COVID, especially
as it relates to toxicology findings, but again that is
not a question that I can answer probably accurately.

Q Do the gloves follow under toxicology as
well?
A No. So referring to the Clark County
Coroner's office, they are a separate agency from the
LVMPD. Their toxicology testing is done through a
different lab. Metro has its own in-house laboratory,
although they may utilize other labs. I wouldn't be
able to tell you specifically when and where and what
situations they were, but in the case where the gloves,
for instance just as an example, those gloves are
examined before the forensic scientist and then those
swabs are taken off of the gloves and then put through
some kind of an analysis then we would get the results
of that analysis, but that is done within the Las Vegas14:38:01
