Federal Indirect Costs (IDC) – It is Minnesota Department of Transportation (Mn/DOT) policy to recover all costs mandated by M.S. 16A.127 that are allowed by the federal grantee. Most federal aid received by Mn/DOT is highway aid; Mn/DOT does not request IDC from the Federal Highway Administration (FHWA), as this would reduce the amount available for highway projects.

2. Carry Forward
Request: The committee requests information on any carry forward funds on all sources of revenue, the legal citations, purpose, expenditures, and the total funds to carry forward.
Response:
Mn/DOT receives funding from a variety of sources, with this funding provided in many different funds. Funding includes direct appropriations, appropriations from capital budgets, statutory appropriations (e.g., 40% of motor vehicle sales tax revenues are deposited in the Transit Assistance Fund and are used for “…transit purposes, under the Minnesota Constitution, article XIV, section 13.”), and a variety of others. Occasionally appropriations are made that are funded by proceeds of trunk highway bonds outside the capital budget bills. The nature of funding for a significant portion of Mn/DOT’s work leads to large amounts of spending authority being carried forward from one fiscal year to the next. As an example, large amounts of highway construction contracts are encumbered in the spring, near the end of a fiscal year, and are carried forward into the following year or years depending a the length of time needed to complete the project.
The nature of this funding and its complexity results in large amounts of funding being carried forward from one fiscal year to the next and across biennia. Policy allowing carrying forward this funding is addressed in riders to the regular appropriations laws, as well as provisions in statute. Most of these are part of routine business; the only type of carry forward for which a dollar amount is being reported is that associated with number 7 below.
The specific types of carried forward funding are the following.
1. Airport Development and Assistance Funding is available for five years after the appropriation.
2. Local Road appropriations are regularly carried forward to future fiscal years. This is largely because the local roads assistance is based on statutory language (M.S. chapter 162) that provides aid on a calendar year basis; while appropriations are on a fiscal year basis (therefore there is presumably at least a six month cash reserve).
3. Appropriations for highway construction, whether from direct or trunk highway bond appropriations, are regularly carried forward because the projects occur over a period of time that almost always is beyond the fiscal year in which

projects are encumbered. Appropriation bill rider language permits carrying forward this funding until the all projects funded in the appropriation are completed.
4. Appropriations for capital projects, often referred to as continuing appropriations, are carried forward in compliance with M.S. 16A.642 State Bonds, Reports and Cancellations.
5. Statutory appropriations are always allowed to be carried forward.
6. Between FY 2010 and FY 2011 a large amount of funds were carried forward that were part of the American Recovery and Reinvestment Act of 2009 (ARRA) was carried forward in that Laws of 2009, chapter 9, appropriated these funds “until expended.”
7. A special rider was added to Laws of 2009, Chapter 36 permitting carrying forward into fiscal years 2010 and 2011 of “…any unexpended and unencumbered operating balances from trunk highway appropriations for fiscal year 2009.” Approximately $50 million of appropriations were carried forward, as reported in the fund statement for the trunk highway fund.

Laws of 2009, chapter 36 Subd. 7.Use of State Road Construction Appropriations Any money appropriated to the commissioner of transportation for state road construction for any fiscal year before fiscal year 2010 is available to the commissioner during the biennium to the extent that the commissioner spends the money on the state road construction project for which the money was originally encumbered during the fiscal year for which it was appropriated. The commissioner of transportation shall report to the commissioner of finance by August 1, 2009, and August 1, 2010, on a form the commissioner of finance provides, on expenditures made during the previous fiscal year that are authorized by this subdivision. This language is regularly included in transportation appropriations bills

Statutory Language The statutory language that addresses carry forward is in M.S.16A.28. One of the principal provisions provides the authority to carry forward unspent appropriations from the first year of a biennium to the second year of a biennium, except for grants. This provision was enacted in 1993.
16A.28 TREATMENT OF UNUSED APPROPRIATIONS.
Subdivision 1.Carryforward. Agencies may carry forward unexpended and unencumbered nongrant
operating balances from the first year of a biennium into the second year of the biennium.
Subd. 2.Use of carryforward. No money shall be carried forward without the approval of the commissioner
of management and budget.
Subd. 3.Lapse. Any portion of any appropriation not carried forward and remaining
unexpended and unencumbered at the close of a fiscal year lapses to the fund from which it was originally appropriated. Any appropriation amounts not carried forward and remaining unexpended and unencumbered at the close of a biennium lapse to the fund from which the appropriation was made.
Subd. 4.Reinstatement; final lapse. The commissioner may reinstate a lapsed appropriation within three months of
the lapse. A reinstated appropriation lapses again no later than three months after it first lapsed. A payment under a reinstated appropriation may be made only under section 16A.15, subdivision 3.
Subd. 5.Permanent improvements. An appropriation to acquire or better public land or buildings or other public
improvements of a capital nature, including the acquisition of real property does not lapse until the purposes of the appropriation are determined by the commissioner, after consultation with the affected agencies, to be accomplished or abandoned. This subdivision also applies to any part of an appropriation for a fiscal year that has been requisitioned to acquire real property or construct permanent improvements. An appropriation to pay moving expenses lapses at the end of the third fiscal year during which it was made available.
Subd. 6.Canceled October 15. On October 15 all allotments and encumbrances for the last fiscal year shall be
canceled unless an agency head certifies to the commissioner that there is an encumbrance for services rendered, goods ordered, or grants issued in the last fiscal

year, or certifies that funding will be carried forward under subdivision 1. Encumbrances for grants issued by June 30 may be certified for a period of one year beyond the year in which the funds were originally appropriated. Services rendered under grant contracts may occur during the certification period. The commissioner may reinstate the part of the cancellation needed to meet the certified encumbrance or charge the certified encumbrance against the current year's appropriation.
Subd. 7.Exceptions. Except as otherwise expressly provided by law, subdivisions 1 to 6 apply to
every appropriation of a stated sum for a specified purpose or purposes heretofore or hereafter made, but do not, unless expressly provided by law, apply to any fund or balance of a fund derived wholly or partly from special taxes, fees, earnings, fines, federal grants, or other sources that are by law appropriated for special purposes by standing, continuing, or revolving appropriations.
Subd. 8.Historical Society. Except as provided by law, an appropriation made to the Minnesota Historical
Society, if not spent during the first year, may be spent during the second year of a biennium. An unexpended balance remaining at the end of a biennium lapses and shall be returned to the fund from which appropriated. An appropriation made to the society for all or part of a biennium may be spent in either year of the biennium.

For the sake of brevity, not every org chart is attached, but at least one from each year is attached in years where changes were made. Charts showing staffing levels by class and staffing levels by fund are also attached. Please note that the chart by fund is FTEs, and the chart by class is actual headcount, so the numbers on the two charts do not match.
Note: FTE is calculated by totaling the number of hours paid and dividing by the number of available regular hours a full time employee could have worked for the reporting period. For example, a full time employee who started mid year would be counted as .50 FTE in a fiscal year end report. FTE includes full time, part time, seasonal, temporary, and overtime hours worked. Since one FTE can include more than one employee and overtime, it is not a head count of employees.

Mn/DOT has made several changes to its bridge inspection and maintenance processes after the collapse of the Interstate 35W bridge, which resulted in the tragic death of 13 people and injury to more than 100 others. Mn/DOT uses a decentralized organization to operate and maintain its transportation infrastructure, guided by a central organization that is responsible to provide support and to set policy and management direction to accomplish to statewide transportation goals. Mn/DOT’s eight transportation districts are responsible for inspecting and maintaining their bridge inventory. Each district’s bridge engineer is responsible to manage those activities within the district. The centrally located Bridge Office provides training and technical
support to the districts and maintains a bridge management data system to store current and historical record of bridge condition and inventory. Since August 2007, statewide staffing to perform bridge maintenance has increased by about 50 percent, or 55 positions. Standard methods have recently been developed and are being used statewide to report maintenance needs during bridge inspections and to prioritize and schedule follow-up maintenance. In 2009, new performance measures were developed to report progress in completing planned preventive maintenance and high priority reactive maintenance items identified during bridge inspections.

State pavement condition continued to deteriorate due to an aging system and competing investment needs. The share of miles rated Poor reached record highs in 2009 and is predicted to rise from about 7% of the state system to 19% of the system by 2019. Mn/DOT estimates that from $200 to $400 million more per year beyond current plans would need to be invested from 2014 to 2019 to reach performance targets. Comparison—For Interstate highways, according to USDOT data for 2008 corrected for Minnesota, 2.7% of Minnesota Interstate miles were rated Poor compared to 1.6% of US miles. 55.3% of Minnesota Interstates were rated Good, versus 72.6% for the US. Minnesota ranked in the bottom quarter of the 50 states for both.

9. Lawsuits

Mn/DOT is involved with several different kinds of lawsuits. Tort claims are detailed in 1) below, I-35W bridge actions are detailed in 2), and eminent domain actions, which start with the state filing a petition in state district court, are detailed in 3). This information does not include formal charges filed against Mn/DOT with the Minnesota Department of Human Rights, which are handled like lawsuits, or the lawsuit filed in federal district court that claims that Mn/DOT’s DBE program is unconstitutional. There are no timelines for lawsuits. We do not estimate costs for lawsuits. 1) Payment of tort claims against the state is made from funds appropriated by the Legislature to agencies for their general operations to the extent such funds are available without unduly hindering the operation of the agency, from appropriations of dedicated receipts if practicable, or from funds appropriated for the payment of tort claims. The tort claims appropriations for each of the fiscal years ending June 30, 2010, and June 30, 2011, are $761,000. The maximum limit of liability for all tort claims arising out of a single occurrence in Minnesota on or after January 1, 2000, and before January 1, 2008, is $1,000,000. The maximum liability for any one claim is $300,000 for claims arising before August 1, 2007, and $400,000 for claims arising on or after August 1, 2007, and before July 1, 2009. The maximum limit of liability for tort claims against the state on or after January 1, 2008, and prior to July 1, 2009, is $1,200,000 for any number of claims arising out of a single occurrence. For tort claims against the state on or after July 1, 2009, the maximum limits are $500,000 for any one claim and $1,500,000 for any number of claims arising out of a single occurrence. 2) On August 1, 2007, the 35W interstate bridge over the Mississippi River collapsed. Thirteen people were killed, and approximately 145 injured. The bridge, which opened in 1967, was designed by a private contractor under contract with the state of Minnesota and was inspected and maintained by Mn/DOT. The state has received 186 Notices of Tort Claim arising from the collapse of the 35W bridge. The Legislature enacted a compensation fund codified in Minnesota Statutes, Section 3.7391 et seq., and appropriated $36,640,000 for payments to representatives of decedents and claimants who were on the 35W bridge at the time of the collapse. A panel of three attorneys determined the amount of payments. All 179 claimants accepted payments from the compensation fund and the emergency relief fund in the aggregate amount of about $37 million on the condition that they waived the right to sue the state for additional recovery.
However, the majority of those claimants have commenced litigation against the original bridge designer, an engineering firm that inspected the bridge under contract with the state, and a construction company that was performing work on the bridge at the time of the collapse. The state has been third-partied into this litigation which is venued in Hennepin County district court. The state has brought third party claims against the other defendants seeking recovery of the $37 million paid to claimants by the statutory compensation fund, the emergency relief fund and for the state’s damages associated with the collapse. The state’s claim against the construction company performing work on the bridge at the time of the collapse has been settled for $1 million. The state’s claim against the company which had performed inspections and analysis of the bridge has been settled for $5 million. The state is pursuing a claim against the company that designed the bridge. The Minnesota Supreme Court is reviewing lower court rulings that would permit the state’s claim to proceed. 3) At any one time, there are many Mn/DOT eminent domain actions being heard before condemnation commissioner panels throughout the state (approximately 20-25% of property acquisitions are made by eminent domain). Some cases are appealed to state district court. There is a continuous flow of parcels acquired by eminent domain, with the actual number depending on many factors such as the number of parcels of land that can be acquired by direct purchase, the construction needs of the department, and revenues available for highway projects. Annual costs for right-of-way acquisition in recent years have ranged from $86 million in FY2006 to $47 million in FY10. The cost of parcels acquired by eminent domain last year was about $25 million.
