1. LAWS ADOPTED BY THE STATES

(a) Loi (201-) (Amendement) au sujet des assemblées paroissiales (P.173/2014—adopted in 3rd reading, 21.1.15) This Law revises the right to call a Parish Assembly.

(b) Criminal Justice (Insane Persons) (Amendment) (Jersey) Law 201-

(P.160/2014—adopted in 3rd reading, 24.2.15) This Law allows the Inferior Number of the Royal Court to try the question of whether an accused person is unfit to plead.

(c) Terrorism (Amendment No 4) (Jersey) Law 201- (P.23/2015—adopted in 3rd reading, 10.3.15)

This Law revises the definition “property” in the Terrorism (Jersey) Law 2002, and has the effect that whether, for the purposes of that Law, information is subject to legal professional privilege will be determined in accordance with Jersey customary law.

(d) Video Recordings (Amendment) (Jersey) Law 201- (P.10/2015—adopted in 3rd reading, 24.3.15)

This Law widens the descriptions of video works to which the Video Recordings (Jersey) Law 1990 applies. In particular the description is extended to works stored in any electronic form and so as to include certain video games.

(e) Crown Advocates (Amendment) (Jersey) Law 201- (P.25/2015—adopted in 3rd reading, 14.4.15)

This Law removes the requirement to obtain the Bailiff’s agreement to the appointment of, or termination of the appointment of, a Crown Advocate.

4. REGULATIONS MADE BY THE STATES

(a) Financial Services Ombudsman (Case-Fee and Levy) (Jersey) Regulations 2015

(R&O.9/2015—in force 21.1.15) These Regulations provide for the Office of the Financial Services Ombudsman to prescribe schemes for case-fees and levies to be paid by certain financial services providers in respect of the expenses of that Office.

(b) Public Elections (Amendment No 5) (Jersey) Regulations 2015 (R&O.12/2015—in force 4.2.15)

These Regulations replace the form to be used for the annual statement of persons, in a household, whose names are to be included on the electoral register.

(c) Taxation (Exchange of Information with Third Countries) (Amendment No 12) (Jersey) Regulations 2015

(R&O.13/2015—in force 3.2.15) These Regulations give effect to a bilateral tax information exchange agreement between Jersey and Romania.

(d) Planning and Building (Amendment of Law) (Jersey) Regulations 2015

(R&O.19/2015—in force 10.3.15) These Regulations make provision as to the persons who are to discharge functions under the Planning and Building (Jersey) Law 2002 that would otherwise fall to the Minister for Planning and Environment.

(e) Loi (1914) sur la Voirie (Amendment) (Jersey) Regulations 2015 (R&O.26/2015—in force 17.3.15)

These Regulations provides for a civil penalty to be imposed on a person who has failed to comply with a notice or an order given by a Connétable for the purposes of the branchage.

(f) Proceeds of Crime (Financial Intelligence) (Jersey) Regulations 2015

(R&O.28/2015—in force 11.3.15) These Regulations establish a financial intelligence unit to carry out the functions of such a unit under art 41B of the Proceeds of Crime (Jersey) Law 1999.

(g) Foundations (Amendment of Law) (Jersey) Regulations 2015 (R&O.29/2015—in force 17.3.15)

These Regulations make miscellaneous amendments to the Foundations (Jersey) Law 2009, amongst them provision requiring the members of the council of a foundation to ensure that the foundation keeps proper accounting records.

(h) Proceeds of Crime (Amendment of Law) (Jersey) Regulations 2015

(R&O.30/2015—in force 17.3.15) These Regulations have the effect that whether for the purposes of the Proceeds of Crime (Jersey) Law 1999 information is subject to legal professional privilege will be determined in accordance with Jersey customary law and revises the definition “property” in that Law.

(i) Terrorist Asset-Freezing (Amendment of Law) (Jersey) Regulations 2015

(R&O.31/2015—in force 11.3.15) These Regulations extend the definition “designated person” in the Terrorism (Jersey) Law 2002 and make provision for the application of the Law to assets held jointly by a designated person and another person.

(j) Shipping (Fishing Vessels Safety Codes of Practice) (Jersey) Regulations 2015

These Regulations require Jersey registered fishing vessels that are less than 15 metres in length to comply with the Jersey Fishing Vessels Code of Practice for the Safety of Small Fishing Vessels.

A. GUERNSEY

1. LAWS APPROVED BY THE STATES OF DELIBERATION

(a) Income Tax (Guernsey) (Amendment) Law 2015 (Billet d’État No I of 2015. Approved 28.01.15—in force from 26.09.13 under and subject to the provisions of the Taxes and Duties (Provisional Effect) (Guernsey) Law 1992) This Law amends s 39D of the 1975 Law by extending the anti-avoidance provisions that prevent the rolling forward of profits in a company, in order to take advantage of the tax cap, to all sources of income with retrospective effect from 26 September 2013 (the date upon which the Minister of the Treasury and Resources Department made a statement relating to the making of such measure).

(b) Parochial Church Property (Guernsey) Law 2015 (Billet d’État No III of 2015. Approved 25.02.15—in force on a day to be appointed by Ordinance of the States) This Law vests the majority of the rectories of the 10 ancient parishes, the glebe land of the parishes and other specified buildings in the respective Constables on behalf of their parishes and introduces a statutory mechanism for the sale of rectories. The Law also creates Management Boards for each ancient parish which will make recommendations on the management of the ancient parish church, its churchyard and the glebe land of the parish, oversee works approved at parochial meetings and encourage suitable additional uses of the ancient parish church. This Law does not affect the status of the ancient parish churches and churchyards themselves.

2. ORDINANCES APPROVED BY THE STATES OF DELIBERATION

(a) Income Tax (Guernsey) (Approval of Agreement with Macao) Ordinance 2015 (Billet d’État No I of 2015. Approved 28.01.15—in force 28.01.15) This Ordinance specifies the agreement between the States of Guernsey and the Government of the Macao Special Administrative Region of the People’s Republic of China signed on 3 September 2014 for the purposes of the Income Tax

(Guernsey) Law 1975. The agreement provides for the obtaining and exchanging of information in relation to tax.

(b) Air Navigation (Bailiwick of Guernsey) (Environmental Standards Ordinance 2015 (Billet d’État No I of 2015. Approved 28.01.15—in force 02.02.15) This Ordinance gives effect to Annex 16 (Environmental Protection) of the Chicago Convention. The Annex specifies certain standards for aircraft noise certification and aircraft emissions certification (dealing with fuel venting and emissions of smoke, unburned hydrocarbons, carbon monoxide and oxides of nitrogen) which are given effect in the Bailiwick by this Ordinance. In particular, this Ordinance requires all aircraft registered in Guernsey and all aircraft taking-off and landing in the Bailiwick to have a valid noise certificate and emissions certification in accordance with Annex 16; defines the circumstances under which the relevant certification can be issued and its period of validity and the exception from the requirement for certification; requires information relating to the noise certificate to be included in the flight manual and carried on the aircraft; permits exemptions to be issued by the Director of Civil Aviation; sets out the relevant offences and penalties and provides for the provisions to have extra-territorial effect so that the Ordinance applies in respect of Guernsey registered aircraft wherever they might be.

(c) Driving Licences (Guernsey) (Amendment) Ordinance 2015 (Billet d’État No III of 2015. Approved 25.02.15—in force 25.02.15) This Ordinance introduces a High Risk Drink Driver Scheme which is intended to deal with drivers whose apparent dependency on alcohol presents a risk to road safety. Under the scheme, when a driver has been convicted of an offence in circumstances which meet the “High Risk” criteria, that individual will be required to satisfy the Medical Advisor at the Driver and Vehicle Licensing s of the Environment Department that they do not have an alcohol misuse problem and are fit to drive before consideration can be given to the reissue of his or her driving licence.

(d) Pilotage (Amendment) Ordinance 2015 (Billet d’État No VII of 2015. Approved 29.04.15—in force 01.06.15) This Ordinance amends the Pilotage Ordinance 1967 in the following ways—

(a) by repealing the age and nationality requirements for the issue of pilotage licences,

(b) by updating the qualifications requirement for the issue of pilotage licences,

(c) by providing for the Chief Officer of the Public Services Department to act as Acting President of the Pilotage Examination Committee in the absence of the President or during a vacancy in that office,

(d) by updating the description of a pilot signal, (e) by repealing the First Schedule, which relates to the forms

of Pilot Boarding Notes, and by amending s 37 so that provision is made instead for such Notes to be in the form required by the Pilotage Board from time to time, and

(f) by correcting a typographical error.

(e) Machinery of Government (Transfer of Functions) (Guernsey) (Amendment) Ordinance 2015 (Billet d’État No VII of 2015. Approved 29.04.15—in force 01.06.15) This Ordinance corrects an anomaly in the Machinery of Government (Transfer of Functions) (Guernsey) Ordinance 2003 by amending two paragraphs of Schedule 2 to that Ordinance. The effects of the amendments are to make clear that all functions and duties under the Boats and Vessels (Registration, Speed Limits and Abatement of Noise) Ordinance 1970 shall be performed by the Public Services Department, with the exception of granting permission under s 8(1) for a vessel to exceed a speed of six knots in the coastal restricted zones, which function shall be performed by the Environment Department.

(f) Criminal Justice (Sex Offenders and Miscellaneous Provisions) (Bailiwick of Guernsey) Law 2013 (Commencement) Ordinance 2015 (Billet d’État No VII of 2015. Approved 29.04.15—in force 29.04.15) This Ordinance commences some of the provisions of the Criminal Justice (Sex Offenders and Miscellaneous Provisions) (Bailiwick of Guernsey) Law 2013 (“the 2013 Law”) on 29 April 2015. The provisions to be commenced include those relating to the use of a pre-recorded interview as the complainant’s evidence-in-chief during a trial, the introduction of anonymity for complainants, the prohibition of cross-examination based on a complainant’s previous sexual history without leave of the court, the prohibition on unrepresented defendants from cross-examining complainants and the prosecution for extra-territorial offences in cases of dual criminality.

The Ordinance also commences a provision of the 2013 Law amending the Sexual Offences (Incitement, Jurisdiction and Protected Material) (Bailiwick of Guernsey) Law 2009 with effect on the date that the 2009 Law is registered on the Records of the Island.

(g) Guernsey Financial Services Commission (Transfer of Functions) (Fees) (Bailiwick of Guernsey) Ordinance 2015 (Billet d’État No VII of 2015. Approved 29.04.15—in force 01.05.15) This Ordinance transfers the functions of the Guernsey Financial Services Commission relating to the enactment of regulations or orders which prescribe or specify fees or charges payable to the Commission to the Policy Council (in the case of fees charged under the seven regulatory laws specified in s 4 of the Ordinance) and the Commerce & Employment Department (in the case of fees charged under the Companies (Guernsey) Law 2008 and the Limited Liability Partnerships (Guernsey) Law 2013).

(h) Income Tax (Guernsey) (Approval of Agreement with the British Virgin Islands) Ordinance 2015 (Billet d’État No VII of 2015. Approved 29.04.15—in force 29.04.15) This Ordinance specifies an agreement providing for the obtaining, furnishing and exchanging of information in relation to tax as an approved international agreement for the purposes of the Income Tax (Guernsey) Law 1975. The agreement specified is a Protocol to a Tax Information Exchange Agreement previously made between the States of Guernsey and the Government of the British Virgin Islands in April 2013. The Protocol was signed on behalf of Guernsey on 25 November 2014 and on behalf of the British Virgin Islands on 11 December 2014.

(Approved 21.01.15) This Law amends the Road Traffic Offences (Motor Vehicles and Bicycles) (Sark) Law 2013 by providing that it is an offence to park a tractor or construction vehicle on any specified public road or part thereof other than during such hours of the day and months of the year as may be specified by regulations made by the Road Traffic Committee.
