    PLANOF RADIO FREQUENCY ASSIGNMENTS AND UTILISATION

    OF THE REPUBLIC OF MACEDONIA

    CHAPTER I

    GENERAL CONDITIONSFOR RADIO FREQUENCY ASSIGNMENTS AND UTILISATION

    1. INTRODUCTION

    1.1. The Plan of radio frequency assignments and utilisation in the Republic of Macedonia(hereinafter referred to as: Plan) shall particularly determine the conditions and manner ofradio frequency use (hereinafter referred to as: frequencies) to certain radio frequencybands (hereinafter referred to as: bands).

    1.2. This Plan is in compliance with the Plan of radio frequency bands allocation.

    1.3. The Plan has been prepared on the basis of provisions in the Constitution, Convention andRadio Regulations (RR) of the International Telecommunications Union (ITU),Recommendations of ITU and Recommendations and Decisions of the EuropeanConference of Postal and Telecommunications Administrations (CEPT), the EuropeanCommission directives, as well as standards of the European TelecommunicationsStandards Institute (ETSI), taking into account the use of radio frequencies so far.

    1.4 The plans of radio frequency assignments and use to certain radio services that are givenin the Annexes shall be an integral part of the Plan.

    1.5 This Plan shall particularly establish the channel arrangement of the frequency bands forcertain radio services.

    1.6 The Plan shall enable:

    1.6.1. technically and economically optimal planning, assignment and effective use offrequencies, taking into account that the radio frequency spectrum and thegeostationary orbit are naturally scarce resources;

    1.6.2. obtaining the conditions for preparation of by laws on technical and operationalconditions for use of certain frequencies;

    1.6.3. uninterrupted frequency use and protection from harmful interferences;

    1.6.4. adjustment of the Plan with the modifications on international level, aswell as reconciliations resulting from performance the bilateral and multilateralagreements with neighboring and other countries;

    1.6.5. adjustment of the use of radio frequency bands between the radio services and theusers; and

    1.6.6. implementation of new technologies and development of the radio communications.

    2. ASSIGNMENT AND UTILISATION

    2.1. The assignment and use of the frequencies, i.e. the radio frequency channels, shall bemade in conformity with the Law on Electronic Communications, the Plan on radiofrequency bands allocation in the Republic of Macedonia and the provisions of this Plan.

    2.2. The assignment and use of the frequencies that is not in conformity with the provisionsgiven in 2.1 may be performed if it is quite obvious that such an assignment and use shallnot cause harmful interferences to the stations that operate and that could operate in thefuture in accordance with the provisions given in 2.1. The stations that operate underthese conditions may not require protection from harmful interferences caused by stationsthat operate in accordance with the provisions given in 2.1.

    2.3. In assigning and using of frequencies, special measures should be undertaken in order toprotect the frequencies, i.e. the frequency bands allocated to the radio navigation,aeronautical mobile (R) and other safety services from harmful interferences.

    2.4. In solving of the harmful interferences, priority shall be given to the radio navigationservice, the aeronautical mobile (R) service and other safety services.

    2.5. No provisions of these regulations prevents the use by a station in distress, or by a stationproviding assistance to it, of any means of radiocommunication at its disposal to attractattention, make known the condition and location of the station in distress, and obtain orprovide assistance.

    2.6. Every emission that might cause harmful interferences to the radiocommunications fordanger, alarm, emergency or safety from the international danger and emergency

    frequencies established for this purpose by the Radio Regulations (RR) and the Plan ofradio frequencies bands allocation shall be forbidden.

    2.7. The allocations of the frequency bands, channel arrangements, assignments and thefrequencies use shall be subject to modifications.

    2.8. Modifications to the allocations of frequency bands, channel arrangements, assignmentsand the frequencies use may be made under one of the following conditions:

    2.8.1. if changes have been made in the Plan of radio frequency bands allocation, RadioRegulations (RR) of the International Telecommunications Union (ITU),Recommendations of ITU and Recommendations and Decisions of the European

    Conference of Postal and Telecommunications Administrations (CEPT), theEuropean Commission directives, as well as standards of the EuropeanTelecommunications Standards Institute (ETSI), the international and regionalagreements for frequency allocations in the certain bands or if such a change isestablished by a special agreement with a neighbouring or other country;

    2.8.2. if it is necessary, as a result of technical reasons, for resolving of a harmfulinterference between stations in the Republic of Macedonia or a station in theRepublic of Macedonia and a station in an neighbouring or other country.

    2.9. Any new assignment or change of the basic characteristics of the existing assignmentmay be made provided that no harmful interferences are caused to the stations that usefrequencies according to the provisions stated in 2.1 of this Plan.

    2.10. The frequency use may be limited to time intervals under one of the following conditions:

    2.10.1. such a limitation to be stipulated by international plans and agreements offrequency assignments or to be established by a special agreement with aneighbouring or other country;

    2.10.2. use of the same frequency by more users on same or near location or servicearea to be planned.

    2.11. To one user may be assigned one or more frequencies for one or more locations i.e.service areas. In the assigning of the frequencies the quality of the radiocommunicationsand the occupied frequencies should be taken into account.

    2.12. To more users may be assigned one or more frequencies for shared use in the sameservice area, taking into account the quality of radiocommunications and the occupiedfrequencies.

    2.13. A general frequency or band that is not required an authorisation for radio frequenciesuse, may be used by more users in the same service area or for the entire territory of thecountry. In the use of the general frequency or band, the quality of radiocommunicationsand occupied band shall not be taken into account.

    2.14. The frequency assignment to the governmental users responsible for national securityand defense in the band allocated exclusively for civil use may be made under thefollowing conditions:

    2.14.1. the assignment is coordinated with the Agency for Electronic Communications;

    2.14.2. the assignment shall not cause harmful interferences to the existing and plannedassignments for civil users.

    2.15. The frequency assignment to a civil user in a band allocated to governmental use may bemade under the following conditions:

    2.15.1. the assignment is coordinated with the governmental users responsible fornational security and defense;

    2.15.2. the assignment shall not cause harmful interferences to the existing and plannedassignments of the governmental users responsible for national security anddefense.

    2.16. The frequency assigned to a given service shall be separated from the limits of the bandallocated to this service in such a way that no harmful interferences are caused to theservices to which the adjacent frequency bands are allocated.

    2.17. The frequencies in the bands between 5 MHz and 30 MHz shall be reserved and shall beused, due to their propagation characteristics, for long distance radiocommunications.Whenever frequencies in these bands are used for short or medium distanceradiocommunications, the minimum power necessary should be employed in order toreduce the harmful interferences

    2.18. In order to provide compliance with the provisions of this Plan in respect to the frequencyutilization, the Agency for Electronic Communications shall perform:

    2.18.1. control over the emissions of stations operating with authorisation for frequencyuse in order to review the prescribed technical and exploitation conditions for theiroperating and shall undertake appropriate legal measures for stations whichtechnical and/or exploitation conditions deviate from the prescribed ones;

    2.18.2. discovering of emissions of stations operating without authorisation and shallundertake appropriate measures;

    2.18.3. examination of the radio frequency spectrum, including the examination ofemissions of stations that have not been issued an authorisation for radiofrequency use as well as emissions of stations from the neighbouring and othercountries, in order to determine the radio frequency spectrum occupation oncertain locations, i.e. areas, for the needs of planning, as well as for protection ofthe frequencies operated, or that are planned to be operated by stations in theRepublic of Macedonia according to international and regional plans.

    2.18.4. examination of harmful interferences between a station in the Republic ofMacedonia and a station in the neighbouring or other countries.

    2.19. The effective radiated power and the effective antenna height of a station should notexceed the necessary one that provides the satisfying quality of theradiocommunications.

    2.19.1. The effective radiated power of a station shall be determined according to theminimum necessary level of the receiving station, i.e. the minimum necessarylevel in the border of the approved service area according to the appropriateregulations for radiocommunications of the Republic of Macedonia and incompliance with the ITU and CEPT recommendations and ETSI standards.

    2.19.2. The effective radiated power of the station may not disturb the electro magneticcompatibility (EMC) in the radiocommunications.

    2.20. Protection ratio (R.F) is minimal value of the ratio between the wanted and the unwantedsignal, usually stated in decibels, on the entrance of the receiver that is determined underspecial conditions in such a manner that certain quality of the reception of the wantedsignal may be achieved on the exit of the receiver.

    2.21. Whenever necessary, the stations shall use coded squelch enabling more effective use ofthe spectrum (reducing of the number of used frequencies, shared use of frequencies,reduction and/or elimination of interferences etc).

    2.22. The frequencies may be used only within locations i.e. service areas, determined by aradio frequency authorisation.

    2.23. Every effort should be made to keep frequency tolerance and the power level of thespurious emissions at the lowest values which the state of the technique and the natureof the service permit.

    2.24. The basic technical characteristics of the stations should satisfy the provisions of theregulations in the field of radiocommunications of the Republic of Macedonia. In theabsence of such regulations, the basic technical characteristics of the stations should bein compliance with the relevant standards of the European TelecommunicationsStandards Institute (ETSI), the recommendations of the European Conference of Postaland Telecommunications Administrations (CEPT), and the recommendations of theInternational Telecommunications Union (ITU).

    2.25. For effective spectrum use, the receivers used by any service should comply as far aspossible with the frequency tolerance of the transmitters of that service.

    2.26. The technical characteristics of the receiving stations should comply with the class ofemission; in particular, selectivity should be appropriate on the required bandwidths ofemissions.

    2.27. The use of damped wave emissions is forbidden in all stations.

    3. PLANOF RADIO FREQUENCY ASSIGNMENTS AND UTILISATION

    IN FIXED SERVICE

    This Plan shall determined the basic conditions and manner of radio frequency assignmentsand use as well as the channel arrangement in bands, that in accordance with the Plan of radio

    frequency bands allocation in the Republic of Macedonia are allocated to fixed service incompliance with the existing regulations and standards and adopted international decisions andrecommendations.

    The basic conditions for assignment and use are related to the following bands:

    For effective spectrum use, in the bands with channel arrangement of different channelspacing, for assignment of frequency channels with small spacing the first channel with thebiggest spacing (A1) shall be preffered.

    3.1 BAND 30 1000 MHz

    In the Plan of radio frequency bands allocation, the band 30 1000 Hz is allocated forfixed, land mobile, broadcasting, aeronauthical mobile, amateur and mobile satellite service on

    the primary basis.In the bands 68 370 Hz 400 470 MHz, the subbands allocated for fixed service shall

    be used for low capacity links with channel spacing 12.5 kHz or 25 kHz.

    3.1.1 Frequency band 370 380 Hz

    In the Plan of radio frequency bands allocation the band 370 399.9 H Hz is allocatedfor fixed and mobile services on the primary basis.

    In the fixed service the band 370 380 MHz shall be used for the systems for one way andtwo way links for sound broadcasting (FM) with channel spacing of 250 kHz (figure 1). Thechannel arrangement is given in table 1,

    3.2 BAND 1 3 GHz

    In the Plan of radio frequency bands allocation, the band 1 3 GHz is allocated for moreservices such as fixed, mobile, land mobile, radio location, radio astronomy etc.

    In the fixed service the band 1 3 GHz the channel arrangement (figure 2) and theconditions for use are in accordance with the Recommendation T/R 13 01, Annex A, B, C,Dsuch as:

    1) in the band 1350 1375 MHz / 1492 1517 MHz, Annex A;2) in the band 1375 1400 MHz / 1427 1452 MHz, Annex B;3) in the band 2025 2110 MHz / 2200 2290 MHz, Annex C;4) in the band 2520 2593 MHz / 2597 2670 MHz, Annex D;

    In the fixed service in the band 1 3 GHz the sub bands 2025 2070 MHz / 2200 2245MHz (Annex C) and 2558 2593 MHz / 2632 2670 MHz (Annex D) are allocated forgovernmental users.

    The existing systems for point-to-multipoint (SR100/SR500) that use frequencies in thebands 1427 1464.5 MHz / 1492.5 1530 MHz may operate until the amortisation of theequipment. Those systems using frequencies in the band 1452 1467 MHz that from 1.04.2007shall be allocated for broadcasting service on the primary basis may operate until theintroduction of digital broadcasting (T DAB). New systems for point-to-multipoint shall beplanned in the bands determined in Annex , B and C.

    The band 2500 2690 MHz (Annex D) is allocated for introduction of mobilecommunication systems of the third generation IMT 2000/UMTS.

    3.2.1 Frequency bands 1350 1375 MHz / 1492 1517 MHz

    These frequency bands shall be allocated exclusively for low capacity digital systems forpoint-to-point and point-to-multipoint. The channel arrangements for systems with channelspacing of 3.5 MHz, 2 MHz, 1 MHz, 0.5 MHz, 0.25 MHz 0.025 MHz shall be defined accordingto the formula:

    a) for systems with channel spacing of 3.5 MHz (channels ):

    3.3 BAND 2300 2500 Hz

    In the Plan of radio frequency bands allocation, the band 2300 2500 Hz shall beallocated for fixed and mobile service on the primary basis, and for amateur and radiolocationshall be allocated on the secondary basis (figure 7).

    The band 2300 2 500 Hz shall be allocated for civil and govrenmental users. Thegovernmental users shall utilise the band in coordination with the Agency for ElectronicCommunications.

    In the fixed service the band 2300 2483.5 Hz shall be also allocated for mobile TVlinks.

    The band 2400 2483.5 MHz shall be also allocated fon non specific SRD applicationsusing for telemetry, telecommand, alarms, voice transmission, video and data etc, as well aswireless access systems WAS/RLAN.

    3.4 BAND 3400 3600 Hz

    In the Plan of radio frequency bands allocation, the band 3400 3600 Hz shall beallocated for fixed and fixed satellite service on the primary basis and for mobile service shallbe allocated on the secondary basis (figure 8).

    In the fixed service the band 3400 3600 Hz shall be allocated for low and mediumcapacity digital systems for point-to-point (P P) and point-to-multipoints (P MP) with differentchannel arrangements. The channel arrangement and conditions for use are in accordance withthe Recommendation ERC/REC 14 03, Annex B.

    The band 3400 3600 Hz may be also used for fixed wireless access systems (FWA),according to the Recommendations ERC/REC 13 04 and ERC/REC 04-05.

    This band may be also used for ENG/OB applications according to the RecommendationERC/REC 25 10.

    The radio frequency channels may be used individually or in blocks depending on thechannel spacing.

    3.4.1 Point-to-multipoint systems (P P)

    Point-to-multipoint systems (P P) may operate in the sub bands 3410 3500 MHzpaired with 3500 3600 MHz where the frequency assignments are multiple of the basic slot of0.25 MHz. Where a frequency duplex allocation is required, the spacing between the loweredges of each paired sub band shall be 100 MHz. The channel arrangement shall bedetermined according to the formula:

    lower sub band: 0.25 N + 3410 to 0.25 (N+k) +3410upper sub band: 0.25 (N+400) + 3410 to 0.25 (N+k+400) +3410

    3.5 BAND 3600 4200 Hz

    In the Plan of radio frequency bands allocation, the band 3600 4200 Hz shall beallocated for fixed and fixed satellite service on the primary basis (figure 9).

    In the fixed service the band 3600 4200 Hz shall be allocated for low, medium andhigh capacity systems for point-to-point (P P) and point-to-multipoint (P MP), with differentchannel spacing. The channel arrangement and conditions for use are in accordance with theRecommendation ERC/REC 12 08, Annex B, Part 1 and Part 2.

    The band 3600 3800 Hz (Annex B, Part 2) may be also used for fixed wirelessaccess systems (FWA), according to the Recommendations ERC/REC 13 04 and ERC/REC04-05.

    The radio frequency channels may be used individually or in blocks depending on thechannel spacing.

    3.5.1 Frequency and 3600 3800 MHz

    1) Point-to-multipoint systems (P P) with duplex spacing of 100 MHz

    Point-to-multipoint systems (P P) may be operated in the sub bands 3600 3700 MHzpaired with 3700 3800 MHz, where the frequency assignment should be multiple of the basicslot of 0.25 MHz. If duplex frequencies allocation is required, the spacing between each pairshall be 100 MHz. The channel arrangement shall be defined according to the formula:

    3.6 BAND 4400 5000 Hz

    In the Plan of radio frequency bands allocation the band 4400 5000 Hz shall beallocated for fixed and mobile service and a part of the band shall be also allocated for fixed

    satellite service on the primary bases, for civil and governmental users.In the fixed service the band 4400 5000 Hz shall be allocated for digital radio relay

    systems with high capacity up to 155 Ambit/s (SDH, STM 1). The channel arrangement andconditions for use are in accordance with the Recommendation ITU R F.746 7 Annex 2.

    The channel arrangement shall be defined according to the formula:

    In the Plan of radio frequency bands allocation, the band 5925 6425 MHz shall beallocated for fixed and fixed satellite service (e/s) on the primary basis.

    In the fixed service the band 5925 6425 MHz shall be used for analogue and digitalradio relay systems with high capacity of 1800 telephone channels i.e. 140 Mbit/s (SDH). Thechannel arrangement and conditions for use are in accordance with the RecommendationERC/REC 14 01, Annex 1 (figure 12).

    In the Plan of radio frequency bands allocation the band 6425 7125 MHz shall beallocated for fixed and fixed satellite service (e/s) on the primary basis.

    In the fixed service the band 6425 7125 MHz shall be used for medium and highcapacity analogue and digital radio relay systems of 1800 telephone channels i.e. 140 Mbit/s(SDH). The channel arrangement and conditions for use are in accordance with theRecommendation ERC/REC 14 02, Annex 1 and Annex 2 (figure 12).

    3.13 BAND 10.0 10.68 GHz

    In the Plan of radio frequency bands allocation the band 10.0 10.68 GHz shall beallocated for fixed and mobile service on the primary basis for civil users and a part of the bandshall be used for radio location of civil and governmental users, as well as amateur andamateur-satellite service on the secondary basis.

    In the fixed service the band 10.0 10.68 GHz shall be used for one way and two waylinks with channel spacing of 28 MHz and 20 MHz. The channel arrangement and conditions foruse are in accordance with the Recommendation ERC/REC 12 05, Annex A and footnote 57of the Plan of radio frequency band allocation.

    The systems operating in the band 10.0 10.68 GHz with channel arrangement differentof the arrangement given in the recommendation ERC/REC 12 05, Annex A may operate by2015 (figure 18).
