Extension of Service Agreement

This RIDER made this day of is part of and is to be attached to the Service Agreement (RFP 09-024 Inmate Phone Service) made on the 15 day of June, 2009, by and between County of Kane and Urban Elevator Service, Inc., for providing elevator preventive maintenance services to Kane County Government facilities.

The County hereby requests and Urban Elevator Service, Inc., agrees to the extension of contract, for an additional two (2) years of services with no cost escalation. The services rates at each facility to be paid by the County remain firm, as previously agree upon original service agreement signed and date on June 15, 2009 attach.

The new contract is commencing on June 15, 2011 and expiring on June 14, 2013.

The parties hereto mutually agree that the aforesaid Agreement, of which this RIDER is made pa~·s and shall be and remain in full force and effect in accordance with all the ~n c nd"s thereof, modified only as in this RIDER specifically provided.

Service Agreement Inmate Communication System and Services

This Agreement is made this the 15th day of July , 2009, by and between Legacy fumate Communications a dba of Legacy International, Inc. ("Legacy" or "the Company") with principal offices at 10833 Valley View St., Suite 150, Cypress, CA. 90630 and the County of Kane ("County") with principal offices located at 719 S. Batavia Avenue, Geneva, IL 60134

RECTIALS

WHEREAS, Legacy will install ·and m~tain its Inmate Communications Operating System iCON and the Kane County Juvenile Justice Center. iCON is a complete turnkey Irn.D.ate Calling Network with investigative, technical, and administrative communication features; and

WHEREAS, Legacy will provide and maintain for the life of this Agreement new inmate and visitation telephones to be installed at the Kane County Juvenile Justice Center located at 37W655 Rt. 38, St. Charles, IL 60175 ; and

· WHEREAS, the Company is in the business of providing various illmate communication services, operator assisted telecommunication services; ·and

WHEREAS, the County operates and/or manages a juvenile detention center; and

WHEREAS, the County desires to enter into this Agreement in order to permit Inmates/Detainees the use of company installed telephones to place collect, collect pre­paid, and/or Debit calls via Legacy inmate phone system- iCON; now

THEREFORE, in consideration of the premises ai:J.d of the mutual covenants and agreements contained herein, the parties do hereby contract and agree as follows:

1. SERVICES PROVIDED BY LEGACY

1.1 Services. ·. ~ .·. "·-: ..,... . . . .

(a) Collect Calls. To the extent consistent with applicable federal and state laws, rules and regulations, Legacy agrees to provide, and the County hereby agrees to accept the provision of operator services with automated assistance for the Kane County Juvenile Justice Center. Each operator service call originating from the telephones and placed through the Company may be charged "collect" to pre­approved destinations. Legacy will validate each call through the national Line Information Database and will only process "collect" calls to destination points that do not have registered blocks. Calls shall only be billed upon "acceptance"

by the destined party. Legacy shall notify each called destination that the call is corning from the Kane County Juvenile Justice Center, announce the name of the "caller/inmate", provide an option to access rate information, and allow for acceptance or denial of the call.

(b) Pre-Paid "Collect" Service. ·Legacy agrees to provide pre-paid collect service. The company will provide a toll-free access number for friends and family to call to set up pre-paid "collect" service accounts. The Company shall also provide access to an Internet site where pre-paid services can be ordered. Legacy shall also provide its "Friends and Family" program.

(c) Inmate Phones. The Company agrees to provide the inmate and visitation telephones for the entire period of this agreement. Including adding additional phones as needed and requested by the Facility.

(d) Communications Management System (iCON). The Company agrees to provide access to its inmate communications management system iCON. iCON shall provide the facility the ability to record and store all iinnate calls, live monitoring of inmate calls, detailed reporting of call traffic, and all other options and services offered in response to the County request for_ proposal for an Inmate Phone System.

(e) Client Support. The Company agrees to provide toll-free access to the County for twenty-four customer support.

(f) Service Response Levels. The Company will provide three response levels for the Jail.

i. Minor Category- A single phone non operational in a housing unit or booking. To be replaced within six (6) hours.

ii. Major Category- Two or more phones non-operational. Replaced within four (4) business hours.

111. Emergency- System Down. Technician on site within two (2) hours.

2. COMPENSATION

2.2 Payment. The Company shall remit all due commissions to the County fifteen (15) days after the end of the month (EOM).

2.3 Payment Calculation. Gross billable revenue is calculated as the sum of minutes and charges. Commission due the County and shall be calculated as the product of the total gross billable revenue multiplied by 58%.

3. COMPLIANCE WITH LAW

1.2 Compliance with Law. Legacy shall comply with all laws, rules and regulations affecting its obligations in conjunction with the provision of the including, without limitation, those relating to provision of information to End Users regarding operator services;

.4. TERMINATION AND CANCELLATION

4.1 Term. This agreement shall commence on the date of installation of Legacy's · services and shall continue in full force and effect for a period of two (2) years.

4.2 Renewal Options. Upon completion of the two (2) year term the.· County, at its own discretion, may exercise an option to renew the terms of this agreement, for a

· period of one· (1) year. The County will provide Legacy with sixty (60) day· notice of its intent to renew the Agreement. All terms and conditions shall remain in effect during the subsequent renewal periods.

Governing Law. This Agreement shall be construed under and in accordance With the laws of the State of Illinois and shall be deemed performable in Kane County, Illinois.

Assignment. Notwithstandi:rig the foregoing, neither the County nor Legacy may assign their rights and obligations under this Agreement without the prior written consent Of the other, which consent shall not be unreasonably withheld. ·

Enforceability. The . invalidity or enforceability of any provision of this Agreement shall not affect· the validity or enforceability of any other provisions hereof.

Notice. Notice shall be deemed to have been received upon receipt of a postage­prepaid letter or telephone facsimile transmission at the addresses set forth in the next sentence, unless otherwise changed by written notice from time to time. Regulatory Requirements. This Agreement shall be construed in accordance with applicable state and federal laws, rules and regulations. In the event those regulatory or legal requirements are in any manner inconsistent with or require

modification to the terms of this Agreement subsequent to the date of execution hereof, no written amendment or variation executed by both parties shall be necessary. Rather, any .such amendment or. variation shall be effective upon mailing of written notice by the Company via first-class, postage-prepaid mail or telephone facsimile transmission of written notice to the County.

5.6 Confidentiality. Legacy and County agree to hold confidential all inforination share.d that may be marked or indicated by the other. The County understarids that Legacy's inmate communications operating system, iCON, is proprietary and access to and all information: about the system are to be considered confidential. Access to the system cannot be granted to any non-designated facility personnel. Should the County contract a Vendor in the future to replace Legacy; the County Will insure that the iCON system is not viewed or accessed by the Vendor.

5.7 RFP for The Inmate Phone System. It is agreed by both parties that Legacy's response to the County's request for proposal to furnish an inmate phone system shall serve as an addendum to this Agreement. All services, conditions, and terms set forth in Legacy's response shall be considered part of this Agreement.

In Witness Hereof, the Company and the County have executed this Agreement on the 15th day of July , 2009. The individuals signing below warrant that they have the authority to sign for and on behalf of the respective parties.

COMPETITIVE SELECTION PROCEDURE - REQUEST FOR PROPOSAL TERMS AND CONDITIONS

1. AUTHORITY. This Request for Proposal is issued pursuant to applicable provisions of the Kane County Purchasing Ordinance.

2. PROPOSAL OPENING. Sealed proposals will be received at the Kane County Purchasing Department until the date and time specified, at which time the names of Offerors will be read aloud and recorded on an abstract during the public opening. Contents of the sealed proposals will be evaluated in private with proposal information kept confidential until an award is made. Late proposals shall be rejected and returned unopened to the sender. Kane County does not prescribe the method by which proposals are to be transmitted; therefore, it cannot be held responsible for any delay, regardless of the reason, in transmission of the proposals.

3. PROPOSAL PREPARATION. Proposals must be submitted on this form and all information and certifications called for must be furnished. Proposals submitted in any other manner, or which fail to furnish all information or certificates required, may be summarily rejected. Proposals may be modified or withdrawn prior to the time specified for the opening of proposals. Proposals shall be filled out legibly in ink or typewritten with all erasures, strikeovers and corrections initialed in ink by the person signing the proposal. The proposal shall include the legal name of the Vendor, the complete mai.ling address, and be signed in ink by a person or persons legally authorized to bind the Vendor to a contract. Name of person signing should be typed or printed below the signature.

) 4. PROPOSAL ENVELOPES. Envelopes containing proposals must be sealed and addressed to the County of Kane Purchasing Department. The name and address of the Vendor and the Invitation Number must be shown in the upper left corner of the envelope.

5. ERRORS IN PROPOSALS. Vendors are cautioned to verify their proposals before submission. Negligence on the part of the Vendor in preparing the proposal confers no right for withdrawal or modification of the. proposal after it has been opened. In case or error In the extension of prices in the proposal, the unit prices will govern.

6. RESERVED RIGHTS. The County of Kane reserves the right at any time and for any reason to cancel this Request for Proposals, accept or reject any or all proposals or any portion thereof, or accept an alternate proposal. The County reserves the right to waive any immaterial defect in any proposal. Unless otherwise specified by the Vendor or the County, the County has one hundred twenties (120) days to accept. The County may seek clarification from any Vendor at any time and failure to respond promptly is cause for rejection.

7. INCURRED COSTS. The County will not be liable for any costs incurred by Vendors in replying to this Request for Proposals.

8. AWARD. It is the intent of the County to award a contract to the lowest responsible Vendor meeting specifications. The County reserves the right to determine the lowest responsible Vendor on the basis of. an individual item, groups of items, or in any way determined to be in the best interests of the County. Award will be based on the following factors (where applicable): (a) Adherence to all conditions and requirements of the proposal specifications; (b) Price; (c) Qualifications of the Vendor, including past performance, financial responsibility, general reputation, experience, service capabilities, and facilities; (d) delivery or completion date; (e) Product appearance, workmanship, finish, taste, feel, overall quality, and

') results of product testing; (f) maintenance costs and warranty provisions; and (g) Repurchase or residual value.

9. PRICING. The price quoted for each item is the full purchase price, including delivery to destination, and includes all transportation and handling charges, premiums on bonds, material or service costs, patent royalties and all other overhead charges of every kind and nature. Unless otherwise specified, prices shall remain firm for the contract period.

10. DISCOUNTS. Prices quoted must be net after deducting all trade and quantity discounts. Where cash discounts for prompt payment are offered, the discount period shall begin with the date of receipt of a correct invoice or receipt or final acceptance of goods, whichever is later.

11. TAXES. Kane County is not subject to Federal Excise Tax. Per Illinois Revised Statutes, Chapter 120, Paragraph 441: Kane County is exempt from state and local taxes.

12. SPECIFICATIONS. Reference to trade names and numbers is descriptive, but not restrictive, unless otherwise specified. Proposals on equivalent items will be considered, provided the Vendor clearly states exactly what is proposed to be furnished, including complete specifications. Unless the Vendor specified otherwise, it is understood the Vendor is offering a referenced trade item as specified or is proposing as specified when no trade name is referenced, and does not propose to furnish an "equal." The County reserves the right to determine whether a substitute offer is equivalent to and meets the standard of quality indicated by the trade name and number referenced.

13. SAMPLES. Samples of items, when called for, must be furnished free of expense and, if not _) destroyed in the eva11:1ation process, will, upon request, be returned at the Vendor's expense. Request for

the return of samples must accompany the sample and include UPS Pickup Slip, postage or other acceptable mode of return. Individual samples must be labeled with Vendor's nanie, invitation number, item reference, manufacturer's trade name and number.

14. INTERPRETATION OR CORRECTION OF RFP DOCUMENTS. Vendors shall promptly notify the County of any ambiguity, inconsistency of error, which they may discover upon examination of the RFP documents. Interpretations, corrections and changes will be made by addendum. Each Vendor shall ascertain prior to submitting a proposal that all addenda have been received and acknowledged in the proposal.

15. VARIANCES. State or list by reference on the reverse side of this form any variations to specifications, terms and/or conditions.

16. INDEMNIFICATION. The Vendqr shall indemnify and hold harmless the County, its agents, officials, and employees from and against all injuries, losses, claims, suits, costs and expenses which may accrue against the County as a consequence of granting the Contract. ·

17. DEFAULT. Time is of the essence of this contract and if delivery of acceptable items or rendering of services is not completed by the time promised, the County reserves the right, without liability, in addition to its other rights and remedies, to terminate the contract by notice effective when received by Vendor, as to stated items not yet shipped or services not yet rendered and to purchase substitute items or services elsewhere and charge the Vendor with any or all losses incurred.

18. INSPECTION. Materials or equipment purchased are subject to inspection and approval at the County's destination. The County reserves the right to reject and refuse acceptance of items which are not

) in accordance with the instructions, specifications, drawings or data of Vendor's warranty (express or implied). Rejected materials or equipment shall be removed by, or at the expense of, the Vendor promptly after rejection.

19. WARRANTY. Vendor warrants that all goods and services furnished hereunder will conform in all respects to the terms of the solicitation, including any drawings, specifications or standards incorporated herein, and that they will be free from latent and patent defects in materials, workmanship and title, and will be free from such defects in design. In addition, Vendor warrants that said goods and services are suitable for, and will perform in accordance with, the purposes for which they are purchased, fabricated, manufactured and designed or for such other purposes as are expressly specified in this solicitation. The County may return any nonconforming or defective items to the Vendor or require correction or replacement of the item at the time the defect is discovered, all at the Vendor's risk and expense. Acceptance shall not relieve the Vendor of its responsibility.

20. REGULATORY COMPLIANCE. Vendor represents and warrants that the goods or services furnished hereunder (including all labels, packages and container for said good) comply with all applicable standards, rules and regulations in effect under the requirements of all Federal, State and local laws, rules and regulations as applicable, including the Occupational Safety and Health Act as amended, with respect to design, construction, manufacture or use for their intended purpose of said goods or services. Vendor shall furnish "Material Safety Data Sheet" in compliance with the Illinois Toxic Substances Disclosure to Employees Act.

21. EQUAL EMPLOYMENT OPPORTUNITY. Res.No. 82-90, 6-10-80; Res. No. 81-79, 6-9-81: Res. No. 82-90, 6-8-82; 05-303, 09-23-05) State law references--Fair Employment Practices Act, Ill.

22. PREVAILING WAGES. By submitting a proposal, Vendor expressly agrees to comply with all applicable State and Federal Prevailing Rate of Wage Laws, and all steps necessary to be in compliance therewith.

23. ROYALTIES AND PATENTS. Vendor shall pay all royalties and license fees. Vendor shall defend all suits or claims for infringement of any patent or trademark rights and shall hold the County harmless from loss on account thereof.

24. LAW GOVERNING. This contra9t shall be governed by and construed according to the laws of the State of Illinois ·

25. ELIGIBILITY. By signing this proposal, the Vendor hereby certifies that they are not barred from solicitation process for this contract as a result of a violation of Article 33E, Public Contracts of the Illinois Criminal Code of 1961, as amended (Illinois Compiled Statutes, 720 ILCS 5/33E-1 ).

26. CERTIFICATE OF INSURANCE REQUIRED BY KANE COUNTY Contractor to furnish and deliver prior to commencement of work, a completed Certificate of Insurance satisfactory to the requirements of County of Kane containing:·

a) The Contractor and all subcontractors shall provide a Certificate of Insurance naming the Owner (Kane County) as certificate holders and as additional insured. The certificate shall contain a 30-day notification provision to the owner (Kane County) prior to cancellation or modification of the policy.

b) Commercial General Liability insurance inCluding Products! Completed Operations, Owners and Contractors Protective Liability and Broad Form Contractual Liability with the exclusion pertaining to

OVERVIEW

STATEMENT OF WORK For

INMATE PHONE SERVICE

County of Kane is seeking to retain the service from a qualified and experienced Vendor for the provision of inmate phone service system and support to the Kane County Juvenile Justice Center. This is a two (2) year contract commencing from date of contract execution, with mutual option for an additional one (1) year extension.

Throughout our response the Company will hopefully demonstrate to the County its unique and superior ability to provide the inmate telephone system, telephones and services to the Kane County Juvenile Justice Center. Legacy's proposal includes a service and support plan that provides local technical support. The Company is uniquely qualified to provide the services requested by the County.

Legacy International, Inc. d/b/a Legacy Inmate Communications has provided operator assisted telecommunication services for public use phones and correctional facilities since its inception in September 1996. Legacy is a class "C" corporation with corporate and technical offices in Cypress, Los Angeles, and Santa Cruz California as well as satellite offices in Nevada, Georgia, and Illinois. The Company is currently servicing over 13,000 lines in the State of Illinois and over 175,000 lines nationwide. Legacy is not only an inmate communications system provider in the State but also a certified interexchanqe carrier and Competitive Local Exchange Companv(CLEC). All facets of the service will be provided by Legacy directly.

Legacy has included Lancaster County Nebraska as one of its references due to its three facility infrastructure which includes a Youth Service Center. Lancaster is also a recent installation and can provide reference on Legacy's ability to transition the communications infrastructure with zero down time. Legacy's inmate communications management system, iCON, was completely developed by its own Engineering Department and is entirely owned and operated by the Company. legacy's approach involves a turnkey solution that meets 100% of the RFP requirements, giving the Juvenile Center a modern, up-to-date system; a solution that is focused on improving the fundamentals of industry standard applications, not the just application of the day. The Company is currently providing call service to over 400 correctional accounts. This superior experience has enabled Legacy to build a nationwide telephony network anchored with a Siemens Class 5 Telco switch and data center, a back office infrastructure that includes billing our own calls, technical support and customer service departments. ') grade phones that are tamper-free and constructed to withstand the jail environment as described in the standard features of the proposed telephone handsets. Each inmate phone is incased in a housing constructed with 14 Gauge Steel, security screws are utilized at every point and the phones are completely tamper resistant. The inmate phones will be wall mounted and bolted and will withstand over 1500 pounds of pressure. The phones utilize security screws that require a special tool for access. The phones are compatible with standard local exchange mountings. All phones will be installed by Legacy's own installation team. The 12" Steel Cord exits from the top of the phone ensuring that the handset is not utilized to cause harm to others or oneself.

On and Off Site Based System .iCON is Web Browser based and will be managed in real-time not only from Legacy's supplied administrative Personal Computer located at the Juvenile Center but also from any authorized PC from on or off-site. } The Data Centers are automatically replicated on an on-going basis, so that each center holds a complete and up-to­date database of the call data and voice content from the facility. The system uses the central database located off­site for all calling applications. When an inmate lifts the receiver to make a telephone call, the on-site call processor immediately requests information from the Data Center, which instructs the call process9r at every stage of the call. The call detail record for the call is created and stored at the Primary Data Center, and immediately replicated to the Secondary Data Center.

Ease of Use The simple Graphical User Interface (GUI) is straightforward and intuitive. The simple design allows institutional staff and investigators to use the powerful investigative tools and comprehensive utilities with ease after only minimal training.

Anytime, Anywhere Access The proposed inmate telephone system has a built-in, password encrypted Virtual Private Network (VPN) router, which allows investigators and other authorized staff to log into the system from anywhere that they have Internet access. There is no need for specialized computers: any PC capable of running Microsoft Internet Explorer 6.0 or greater and on the Virtual Private Network has full access to all of the features, including live monitoring and playback of call recordings. In addition, the Legacy system allows authorized users, with an accredited password to connect to the inmate telephone system through any computer connected to the Internet. Once the user has securely logged in using his/her user name and password, he/she will be able to perform all administrative functions from any location.

Legacy's Superior 3-Way Calling Advantage ) Legacy has a distinct advantage over most other vendors in the inmate telephone market: Legacy is a Competitive

Local Exchange Carrier (CLEC) in Illinois and our proposal includes providing both local and long distance service for

the facility. Operating in the SS7 network architecture, with ·our own network and call switches, Legacy has total call

control of all aspects of the call, enabling the Legacy system to control all. 3-way call attempts.

Other ITS vendors contract for phone service and can only 'monitor the call' and are looking for a detection signal

with the call control in the hands of thelEC (Verizon, AT&T as an example). Since traditional vendors do .not have

network control, they rely on a combination of silence, dial tone, DTMF detection, and other energy algorithms that

does not accurately detect fraudulent activities or 3-way calling.

Many providers 'propose patented three-way detection technologies, which the Legacy team has tested in the past

and which have proven not worthy in the field. These technologies do not catch 100% of three-way calls, and they

also have a very high percentage of detecting and disconnecting valid calls that are not three-way (false positives).

Legacy's 100% solution for 3-way calling operates within the Legacy Network; not detecting from outside the network.

) With the Legacy network in place, any set-up signal initiated by the·called party that prompts a 3-way call or remote

call forwarding falls within Legacy's network and is received by the call control within the iCON platform. Whenever

attempts at fraud are received, the Legacy iCON system can respond by advising the parties to the call, terminating

the call, or both. Legacy will implement whichever option the facility chooses. In all cases, these calls are flagged on

the call detail record.

An Enhanced Inmate Identification System (AccuPIN) lri addition to a full featured PIN application, Legacy is offering Kane County Legacy's AccuPIN™, a patent pending enhanced identification system to complement the PIN system. The primary purpose of incorporating a PIN system is to readily identify what inmate is associated with a call record, including the voice content. Additionally, when presented in court, there must be no doubt as to identity of the caller. The Legacy solution is modeled to the level of multiple federal agencies' guidelines for electronic, password based authentication (ll.

To offer a more secure PIN system, most ITS vendors provide biometric identification options although the costs versus benefits remain difficult to justify. Legacy has created a PIN authentication protocol equal to Level4 Securityl2l and offers superior efficiencies; this application is economical, simple to use and by far the most reliable of any biometric application deployed in the corrections market today ... all at no cost to the facility or end user. We strongly urge Kane County to consider Legacy's AccuPIN™ application in comparison to other biometric applications and reflect on not only the operational efficiencies but also the level of service and accuracy. While we can offer a voice or fingerprint application as part of our system, we highly recommend the AccuPIN™ as .a superior product and encourage you to have us in for an oral presentation and demonstration.

Collect Calling to Mexico

Over the past decade, many correctional facilities nationwide have seen a dramatic

increase in Spanish speaking inmates. This increase involves a fair percentage of

inmates that have friends or family residing in Mexico. The Legacy iCON platform

provides collect and pre-paid collect call service to Mexico giving inmates the ability to

place collect calls to most destinations within that country. Legacy also offers services

to allow traditior:~al inmate collect calling to Canada, the United Kingdom, Japan, Germany, and the Caribbean.

Where traditional collect calls cannot be made, virtually any destination point in the entire World can be .called

utilizing any one of Legacy's prepaid calling options. Our inmate telephone system has the ability to speak any

language the Juvenile Center may desire. Additional or multiple languages can easily be configured to provide

endless· possibilities. For concerned family members needing assistance, multi-lingual customer service

representatives are also available 24-hours a day to answer questions on billing and set-up pre-paid collect serviCes.

Collect Calling to Cell Phones

One of the major headaches jail administrators face is inmates not having the ability to call cell phones. Besides,

there ar.e more cell phones than land lines which severely limit the ability of collect calling. Legacy is the first inmate

telephone provider to offer collect calling to a cellular telephone. Through our advanced billing and ITS platform, the

processor will give the called party an option of accepting and paying for a collect call with billing going to their credit

card number; all while INCREASING .REVENUE to the facility and reduce inmate grievances. All calls are subject to the

same call controls as the traditional collect calling from the detention facility.

Another feature from Legacy and our advantage as a CLEC and the iCON platform: Legacy's direct billing. While other

vendors will block a call with an unbillable number, if the validation process returns an address, Legacy will allow the

call to go through and if accepted by the called party, directly bill the called party, all increasing revenue and

completing more calls.

3. Uninterrupted Power Source (UPS) in place for all phone line controllers.

Legacy Response: Agreed. Legacy will provide and maintain an adequate number of appropriately sized APC Smart Uninterruptible Power Source (UPS) systems with surge protection and line conditioning. These systems will be capable of supporting all Inmate Telephone System (ITS) components including iCON, administrating PC's, and Routers for a minimum of two (2) hours. Regardless of any interruption in power, call records are protected at all times and are not subject to loss. System settings will return to the previous state upon restoration of power. The APC models utilized by Legacy can be monitored remotely.

4. The system can allow for specific on/off times for calls, as well as the ability to turn specific phones on or off at any time.

Legacy Response: Inmate Phone schedules can be changed at anytime and can be customized to meet the exact parameters of the facility. Facility personnel will have access to change phone schedules from any PC located in the facility. The Company's installation team will insure connection from anywhere in the facility. Schedules can apply to all inmate telephones, individual inmate telephones, or housing areas specified in the facility configuration module.

5. The system shall have the ability to limit the durations of calls, with the additional ability to give a two­minute, one-minute, and 3D-second warning that the limit has been reached.

Legacy Response: Juvenile Justice Center personnel can set a maximum time limit for the facility, individual inmate phones or group of phones in the Facility Configuration Utility of iCON. If the facility is utilizing iCON's PIN application, the maximum time limit on each call can be set by inmate PIN as well. The automated operator will warn the inmate and called party by providing two minutes, one minute, and thirty second warnings prior to the call terminating due to Maximum Duration. The PAN feature also allows for set durations by dialed number.

Legacy Response: Agreed. Legacy ha·s been a certified operator service provider in the State of Illinois since .1998. The Company's Certificate of Service Authority was granted by the Illinois Commerce Commission (ICC) on February 6, 1998 - Certificate number 97-0369. The Company is compliant with all rate caps set by the ICC and has never been subject to any formal complaint made through the ICC in the over eleven (11) years we have been providing service. Legacy was also granted authority to provide Local Exchange services in the State on February 29, 2008-Certificate number 08-0177. All facets of the provisioned services at the Justice Center will be provided by Legacy.

) facility requires. The Company services several County facilities ranging from ten inmate telephones to hundreds. The Company is experienced in providing service to juvenile facilities. Legacy has included Lancaster County Nebraska as one of its references due to its three facility infrastructure which includes a Youth Service Center. Lancaster is also a recent installation and can provide reference on Legacy's ability to transition the communications infrastructure with zero down time. Legacy's inmate communications management system, iCON, was completely developed by its own Engineering Department and is entirely owned and operated by the Company. Legacy's approach involves a turnkey solution that meets 100% of the RFP requirements, giving the Juvenile Center a modern, up-to-date system; a solution that is focused on improving the fundamentals of industry standard applications, not the just application of the day. The Company is currently providing call service to over 400 correctional accounts. This superior experience has enabled Legacy to build a nationwide telephony network anchored with a Siemens Class 5 Telco switch and data center, a back office infrastructure that includes billing our own calls, technical support and customer service departments. Legacy has never outsourced any departmental function and takes pride in directly servicing its customers. Legacy is extremely proud of its past and looks forward to bettering the future for it and its valued clients. 2. Distribution Channels - The vendor must provide information on their distribution channels, including ) sales, services, and spare parts. A description of the affiliation between the vendor and the

manufacturer of the products proposed in the RFP is also necessary in this section.

Legacy Response: iCON is completely owned, manufactured, and supported by Legacy Inmate Communications. All equipment utilized for iCON is in inventory and consists of basic telephony and information technology all supplied by Legacy. All cabling and wiring needed in provision of the service is in Legacy inventory- generally, the Company will utilize Graybar for

inventory purchase of these products.

The proposed Inmate Telephones are manufactured Telecom Marketing Group, Inc. (TMG). Legacy exclusively utilizes TMG model phones and has an inventory on hand equal to 30% of the phones currently in the field. This inventory includes all parts necessary for the inmate phones to function (handsets, volume control, telephony card, housing). TMG is the leading manufacturer of Coinless Inmate Telephones and Visitation Phones in the United States. Legacy has found TMG to provide the highest quality product engineered to minimize maintenance costs, while providing maximum security.

Legacy will be providing all local, lnterlata, and interstate calling service for the Juvenile Justice Center. The Company is a facilities based interexchange carrier in the State of Illinois as well as a Competitive Local Exchange Company. All circuits will be established and provided by Legacy Inmate Communications. The Company has provided both local and long distance operator services in the State of Illinois since 1998.

The Company takes great pride in offering the County quality transmission on every call serviced. Legacy is a nationwide facilities based interexchange carrier that transmits over 3,000,000 calls through our network daily. The Company owns and operates its state-of-the­art digital network which features Siemens Class 5 switching platforms with full SS7 technology loaded on each and every circuit insuring quick, crystal clear transmission. operates its own ultra-modern Live and Automated Operator Center where over 30,000 calls are processed each day. Redundancy is a key feature in our network design insuring maximized call availability that registered at over 99.9976% in 2008. Inmates will connect to Legacy's automated operators within three (3) seconds of picking up an inmate phone. Connection to the destination whether in the U.S., Mexico, Canada, or any other Country will be fast and reliable. The Company will utilize a dedicated, point-to-point DS1 circuit(s) to connect the facility to our interexchange network further insuring quick and reliable transmission at all times.

Calls are billed instantaneously upon call acceptance- without exception. Legacy possesses direct billing agreements with all major Local Exchange Companies, and where agreements are not direct all calls are billed by Legacy through its selected telecommunications billing clearinghouse. Billing is available to every destination point that has selected a local provider that accepts operator service and long distance billing.

Legacy has been billing operator service calls, on its own behalf, since its inception in 1996. Billing is not contracted out. Legacy is one of very few full-service telecommunication providers that have agreements in place to. bill calls throughout the country. Calls that are billed through the accepting party's local exchange company as part of their monthly local telephone bill identify, clearly, Legacy as the billing party. The originating number, call duration, date, time, and call charge are all posted within the customer's bill. Legacy also provides a customer service toll free number for the billed party to call should they have inquiries regarding their bill. All customer concerns are handled by Legacy's Billing Customer Service Department. Each representative has immediate access to each and every call billed via Legacy.

All operator service call attempts are first validated through the national Line Information Database (LIDB) as required by the Illinois Commerce Commission (ICC) as well as the Federal Communications Commission (FCC). Once

) a call has past validation the call is extended to the destination number. Billing time for the call will only begin once the destination number has pressed "1" to accept the call. Once the call is bridged billing time will begin. Upon termination of the call be either end -the call record is completed and rated in real time. All call rating is done through the iCON IVR system with selected rates applied at the Kane County facility. These rates are hard coded and cannot be interfered or tampered with by Legacy or any County staff. Within minutes of completion the call record is batched and transmitted to the billing authority utilizing the OCN number for Identification. The OCN is a number assigned to identify each Local Exchange Company authorized to provide service in the United States and is captured during the validation process and is also part of Legacy's Bellcore NPA software. Utilizing the OCN information Legacy is able to dispatch the record to the proper local billing authority.

Legacy also offers traditional "collect" calling to Mexico, Canada, Japan, Germany, United Kingdom, arid the Caribbean. These calls are billed on a daily bases and identified from the NPA in North America and by the Country Code outside of North America. Every call billed by Legacy through applicable local exchanges carries our Billing Customer Service number for billing queries or questions. Legacy's billing customer service department is open from 7:00am to 7:00pm Monday through Friday.

3. Location of Maintenance Personnel & Parts - The vendor must specify the location of the nearest site that the maintenance personnel work out of. Are parts stockpiled at this location? If not, where is the closest parts stockpile?

Legacy Response: Legacy will be utilizing local technicians based in Addison Illinois. Legacy also has an administrative office in Rolling Meadows. Legacy will maintain an inventory of 30% of all installed equipment at the

The installation of the system as well as on-going twenty-four customer support will be handled directly by Legacy.

Remote di<:~gnostics are used to test the entire system as well as lines and/or telephones. With the call processor's

diagnostic tools, technicians are able to make test calls from each trunk line, as if an inmate were using the system.

This allows for all diagnostics to be completed from the facility. Remote diagnostics is a 24/7 ongoing process that

ensures optimal performance of the system. The inmate telephone system can be operated remotely and is

capable of reporting on diagnostic operations or other programs initiated from either local or remote control. The

Company utilizes a dedicated, point-to-point circuit that is open and communicating between the facility and our

data center 24/7. Legacy has developed as part of its preventive maintenance and diagnostic program, a real-time

24-hour/ 7-day alarm and diagnostic interface. Through the Wide Area Network (WAN), real-time reporting is

recorded into the Legacy project record keeping system. Legacy has developed a statistical database and will

review each individual facility's calling patterns to determine a set of parameters that provide thresholds to

determine any irregular calling activity. When a parameter threshold is triggered, escalation and alarm will be

disseminated to the administrator and additionally to the appropriate Legacy staff. Legacy believes that customer

service begins long before any problems occur or are brought to our attention by owr customers. Legacy is totally

accot.,mtable for the inmate telephone system and has dedicated a large amount of resources and time to ensure

that our systems are constantly in check. All problems relating to the inmate telephone system will be handled by

Legacy.

Legacy will immediately notify the County of any remote diagnostic catch of failure of any aspect of the iCON system. Additionally, iCON features a state-of-the-art Trouble/Service Report feature that allows facility personnel to report and track service and repair requests- real time. These reports can be made from on or off-site. Once a report of service or system trouble has been made iCON simultaneously contacts Legacy's personnel via E-Mail and Cellular Telephone. Juvenile Justice Center staff can track work being performed on the service ticket and Legacy technician notes on problem resolution. Additionally, the system will file all service and repair requests for County tracking throughout the life of the Agreement.

Legacy Kane County Juvenile Justice Center Installation and Support Team

Duane Cutler- RFP Point of Contact Duane will serve as Legacy's main point of contact for Kane County through the entire consideration process. Duane was a main contributor to the Kane County response and is at the ready to answer any questions the County may have. Duane has been offering telecommunication services in the correctional market since 1998 and his pre~ious employment history includes U.S. Long Distance and Qwest. Duane also serves Legacy as its Vice President Sales­Correctional Facility Applications. Duane works out of Rolling Meadows Illinois.

Edward Arthurs, Project Installation Team Lead·- Ongoing Network/Voice Support Mr. Edward Arthurs first joined Legacy in 2000. He· has demonstrated exceptional trouble shooting skills and technical savvy that can be directly related to the success of Legacy's entire communications network operation. Eddie's experience in various communication system installations including; cabling and technical programming spans

) the course of twenty (20) years. Eddie holds certifications in most major communication systems as well as with the CT-1000 and 400 series inmate telephones, Protei, Elcotel, and Mitel. He has successfully installed numerous correctional facilities each with unique project requirements. Mr. Arthurs holds a PMI Project Management

Edward has recently concluded his duties as Installation Team Lead for the recent Legacy install at Hampton Roads Regional Jail in Virginia (November 2008). Hampton Roads has an Annual Daily Population (ADP) of 1,200 inmates and 167 inmate telephones. Legacy was also project team lead for Lancaster County, Lincoln Nebraska. Lancaster County was a multi-facility installation that included two adult jails and a Youth Service Center. Eddie will also provide on-going Network service support as one of Legacy senior telecommunications network technicians. Legacy owns and operates its own interexchange network with a capabilities to originate calls from anywhere in the United States with termination possibilfties to virtually every country in the world. The Company employs several network technicians, but considering Eddie will lead the installation team at the County facilit.ies and his standing as our most senior engineer on staff, he will serve as Reol Ranees direct contact for Network Engineer support and modifications. Patrick Snook, Information Systems Patrick will implement the local area networks that will form the centralized management infrastructure of the inmate communication system at the Justice Center. He will also provide logistical management of each of the interfaces that may be needed to provide each of the products and services supplied to the County. Patrick is highly analytical and technical with a proven track record of managing a team of professionals to acquire common goals. Patrick has experience in Operations, Information Technology, Project Management, and Quality Control. His communications experience includes numerous facility installations and over twelve (12) years of telecommunication IT management experience. His business experience includes; Director of Information Technology for BTl Communications Group and System Administrator for Delcom Systems Group. Patrick holds a BS degree in Computer Information Systems from Purdue University. Patrick will continue to provide on-going technical support of the LAN

Diedre Jay, Technical Support Deidre will be part of the iCON and inmate telephone installation team as well as coordinate with local technicians for the life of the agreement. Deidre (we call her D.J.) has been serving as one of Legacy's full time Technical Support members since opening our doors in 1996. Originally gaining experience at PCN, her extensive training in the programming of Protei, Elcotel, UltraTel, and AstraTel phones helps our clients to successfully deliver calls into our automated call center. With a total of fifteen (15) years in the telecom industry, she is responsible for the troubleshooting of technical customer issues and overseeing our local technicians throughout the country. We have also scheduled OJ to coordinate and deliver iCON training sessions for the County. As described later in this section, Legacy has contracted local telephone support technicians within the County to provide immediate on-site service as needed. Diedre will coordinate all facility pro-·active maintenance visits as well as service level requests. She and her team have. performed this function on behalf of our Company for over twelve (12) years. Contact Information:

Reol Ranees, Kane County Account Manager

Legacy has assigned Real Ranees to serve as the on-going Account Manager for the County. Real will work with our entire installation team and local technicians on coordination of all on-going projects through the life of the contract. Real has been a member of the Legacy team since 2002 and is well versed in all Legacy application and services. Real. will be the first point of contact for all service, data, and implementation requests from the County facility. He will also provide pro active support by monitoring call detail, rate information, branding, billing, and trouble/service tickets on a daily basis. In fact, the facility will hear from Real far more than they will ever need to call him. Estimated Time on Project: On going for life of agreement

6. Technical Personnel - Kane County needs assurance that in the event of a strike or other work stoppage, that a sufficient number of qualified maintenance personnel are available for system support. State the number of non-union qualified persons that are available currently on staff at your company for the following:

a. Maintenance Personnel

Legacy Response: Legacy has contracted TelePius Inc. of Addison Illinois to provide local service maintenance for the facility. Legacy contract with TelePius guarantees the availability of fifteen (15) service technicians seven days a week, 365 days a year. All TelePius employees are non-union.

b. Installation Personnel c. Technical Support Personnel

Legacy Response: Legacy Inmate Communications employs 184 hard-working individuals that are available to Kane County to provide installation and technical support throughout the life of the agreement. Redundancy and cross­training are key features of Legacy's staff model insuring maximum quality at all times. Legacy has profiled its installation team in answer to Question 5. Should, for any reason, one of our project team suddenly become unavailable due to sudden illness or other reasons the Company employs several installation technicians and information system personnel that can replace our designated Kane County personnel. Legacy is currently non­union.

The Company will provide l<ane County with 24-hour customer support 365 days a year, including holidays. Legacy owns and operates its 24/7 customer care center staffed with over fifty (SO) employees that are available at all times. Legacy will provide the Justice Center with a toll free number to access our center when needed. However, Legacy also believes in a pro-active customer approach and has assigned a designated account representative that will manage all the day to day requests the facility might have including new reports, commission questions, modifications to the current infrastructure (added Inmate Phones), or iCON questions. Legacy has assigned Real Ranees to act as Kane County's National Account Manager (NAM). Real has been a part of Legacy's team for eight (8) years and is well versed in all our products and services. More importantly, Real has been providing correctional facility support for over a decade and has a firm grasp of the communication needs in the correctional environment. When Real is not at work the 24-hour toll free number can be utilized to contact our customer care center which will have access to the County's iCON system and can record and dispatch the necessary resources to solve any problem. Legacy not only believes in a Customer First philosophy - we actually deploy one. We understand the importance of providing a quality service to the inmates- and the absolute need for our system to be operational at all times for investigators to access information that could help solve crimes before they happen.

) 7. Telecommunications Experience - The vendor must provide the length of time that they have been providing telecommunications equipment to the area, including the length oftime the vendor has offered the proposed system. This is in contrast to the length of time in business.

Legacy Response: As described throughout our response Legacy has been offering communication related services to correctional facilities since its inception in September 1996. The services were exclusively offered directly to correctional facility vendors from September 1996 through January 2003. The Company began to offer its services directly to correctional facilities in February 2003.

iCON is completely owned, manufactured, and supported by Legacy Inmate Communications.

8. Reference List - On page 3 of this RFP the vendor must provide a list of their clients as close to the Chicagoland area as possible who are currently using the proposed system. It is preferable that these references be governmental agencies similar to the County of Kane.

Legacy Response: The Company has provided a list of four (4) references as required by the County of Kane.

Hampton Roads Regional Jail- VA Legacy selected to submit Hampton Roads Regional Jail as a reference to demonstrate Legacy's ability to service large scale facilities. Hampton Roads services an inmate population over 1,200. The Communications infrastructure includes over 170 Inmate Telephones. Legacy employs a full-time on­site administrator. The communication system requires that Legacy also provide Pro Bono call forwarding for ICE inmates. Debit and pre-paid calling features are also provided.

Accomack County VA- Goliad County TX Legacy selected Accomack and Goliad counties as references due to their .equivalent size to the Justice Center facility. Both Counties have approximately twenty (20) inmate telephones in operation with average daily populations around one-hundred (100). iCON is in use at both facilities as well as the 400 Series TMG inmate telephones that we have

proposed to Kane County.

Lancaster County- NE Legacy has selected to provide Lancaster County Nebraska as a reference due to its status as one of our most recent installations and includes a Youth Detention Center. Lancaster County is a multi-facility client of Legacy's. The Company provides inmate communication services to two

(2) adult facilities and one (1) juvenile facility. There are over seventy (70) inmate phones utilized between the three facilities with an average daily population that exceeds 650. iCON and the 1100 Series TMG Inmate Telephones are utilized at all three facilities. The Company also provides Visitation Phones and monitoring for Lancaster County.

Kane County is concerned about the inmates' called/paying party and their ability to pay the rates charged by the service providers for both local and long distance. For this reason the commission rate shall be stated below and submitted with proposal response form, as well as how it is calculated. Legacy Response: Legacy is offering Kane County 58% of all gross billed revenues with absolutely no deductions made. Commissions are paid fifteen days from the end of each month. A Commission Calculation has been attached. Legacy's prop.osed rates are lower than current AT&T Inmate Calling Rates in Illinois. The Company understands that keeping reasonable rates for friends and family are a key component especially in the Juvenile setting. The Company will provide new inmate telephones at the Juvenile Justice Center. Legacy agrees to add and/or subtract inmate telephones as designated by the County throughout the term of the agreement. Legacy will provide correctional grade phones that are tamper-free and constructed to withstand the jail environm'ent as described in the standard features of the proposed telephone handsets. Each .inmate phone is incased in a housing constructed with 14 Gauge Steel, security screws are utilized at every point and the phones are completely tamper resistant. The inmate phones will be wall mounted and bolted and will withstand over 1500 pounds of pressure. The phones utilize security screws that require a special tool for access. The phones are compatible with standard local exchange mountings. All phones will be installed by Legacy's own installation team. The 12" Steel Cord exits from the top of the phone ensuring that the handset is not utilized to cause harm to others or oneself. ·

Legacy Response: As part of Legacy's technology innovations that provide operational results, Legacy offers a

superior method for 3-way calling prevention. Legacy has a distinct advantage over most other vendors in the inmate

telephone market: Legacy is a facilities-based interexchange carrier and competitive local exchange provider in

Illinois. The Company's proposal includes providing Legacy local and long distance service to the Kane County

Juvenile Justice Center: originating and terminating all calls, operating with SS7 technology, within our own network

and call switches, Legacy has total call control of all aspects of the call, enabling the Legacy system to sense and

control all 3-way call attempts. The Network relies upon on a combination of silence, dial tone, DTMF detection, and

other energy algorithms that accurately detect fraudulent activities or 3-way calling. Many providers propose

patented three-way detection technologies, which the Legacy team has tested in the past and which have not proven

100% worthy in the field. These technologies do not catch 100% of three-way calls, and they also have a very high

percentage of detecting and disconnecting valid calls that are not three-way (false positives). The Legacy solution

originates and terminates all calls, processing calls within our own network, not detecting from outside the network.

With the Legacy network in place, any set-up signal initiated by the called party that prompts a 3-way call or remote

call forwarding falls within Legacy's network and is received by the iCON call control. Whenever attempts at fraud

are received, the Legacy iCON system can respond by advising the parties to the call, terminating the call, or both.

All calls are processed directly through Legacy's network with no involvement with the local telephone company assuring access to pre-approved destination numbers at all times. Each attempted call is first validated through the national Line Information Database to ensure no call·is routed to any number where "collect" call blocks have been requested through the applicable local exchange company or to numbers that may have been subject to third party fraud in the past.

Call Recording Security

Administrators can 111ock" any call recording or record from the Call Archive Utility. All calls, whether locked our unlocked are available at all times throughout the life of the Contract. Each call recording is 11digitally signed" any attempt at modification to the recording will remove the signature (watermark). Legacy specifically marks each i::all recording with a unique "digital signature" should any person or program attempt to modify the call recording the signature is automatically removed. Legacy's Chief Technology Officer (CTO) Paul Troung will testify on behalf of Legacy Inmate Communications as required to do so by the County or any Court with jurisdiction in regard to our Call Recording technology and security. By assigning a Digital Signature that is maintained by Legacy, the Company can assure that no call recording that has this signature has been tampered with. The Company does not share the Digital Signature with its clients insuring further security. Shoulq the County wish to utilize any call recording in a Court of law the Company will verify that the Digital Signatllre has been maintained on the Downloaded copy, thus guaranteeing that the original call recording was not tampered with in any way.

iCON's Watch Word Plus./ Watch Lists

iCON also features an ultra modern voice to word transcription module. Investigators select a call recording for transcription from the Call Archive utility. A transcription of the call is delivered within ten minutes of selection. The system also provides a "watch word" dictionary. that allows for investigators to enter keywords and search call recordings that contain those keywords.

Technology ) Audio Mining technology creates XML speech index data for every word spoken within an audio file. The XML speech

index data includes word, time-stamp, confidence levels and meta-data associated with the speech information, and can be created from broadcast and telephony quality sources. XML speech index data makes the speech information within rich media files visible to text-based Web crawlers and search products, unlocking the information hidden within digital audio files on the Web and within private media archives.

Automatic XML speech indexing eliminates the time and cost associated with manually indexing rich media, enables the indexing of 100% of the speech information within audio files, and integrates with standard text-search products to enable the rapid access to specific audio content. Applications include enabling text-based search and the precise playback of audio within Web search, content management, CRM, media archive applications.

The underlying speech recognition software that Audio Mining employs is the same that is used in Dragon NaturallySpeaking. This technology has been proven in the marketplace on hundreds of thousands of machines. Audio Mining extends the underlying statistical models that support this recognition engine to scalable server architecture, specifically tailored for use in the production and presentation of streaming media.

Audio Mining at work for the Kane County Juvenile Justice Center· iCON, while working in concert with Audio Mining Software, allows facility investigators to add 11keywords" in to a Watch List category. By doing so iCON will search for the 11keywords" in all call recordings. If that word is found, the call recordings are placed in that Watch List and the investigators are notified by E-Mail, Cellular Telephone, or telephone number. Investigators may wish to utilize words such as "cocaine", "kill", "drugs", "sneak-in", 11hide", or even another inmates name in the Watch Word dictionary. There is no pre-set limit on the amount of words that can be utilized. Perfection in transcribihg voice to word cannot be met- by anyone. However this technology supports

) the best success rate possible. Watch Words and Lists can be set by inmate PIN, Source (Inmate Phone Number), Called Number (destination), frequency, or geographical area. Setting up Watch Word lists is easy and problem free.

Prepaid Calling Services

Traditional"collect" calls can be placed to any Local Exchange Line Information Database (LIDB) approved destination number that allows collect calling. Legacy holds billing agreements with every local exchange provider that allows collect calling in the Country. Traditional collect calls can also be made to Mexico, Canada, Japan, Germany, the United Kingdom, and anywhere in the Caribbean.

Legacy has developed a prepaid program that is the best in the industry, enabling friends and family to stay connected to the inmate. In addition

prepaid collect and direct bill.

Debit

Debit Cards can be sold at the Juvenile Justice Center for purchase by any inmate allowing calling virtually to every

domestic and international destination in the World. The facility is not required to offer Debit Cards as part of our

prepaid programs. It is an option only. A secure Debit account can be created upon booking or from the commissary,

and the inmate prepays for calls by purchasing time in bulk from the commissary. Family and friends can also fund an

inmate's Debit calling by depositing money into the inmate's account. An inmate can use Debit calling time to call

any facility-approved telephone number he or she chooses. The cost of each call is automatically deducted from the

inmate's Debit account. When the Debit service is integrated with the commissary, replenishing debit funds is as

simple as filling out a commissary order form. The Debit Cards are provided to the facility by Legacy and are

completely security friendly with construction paper utilized as its base. Debit Card PIN's are covered by a "scratch­

off". The County could receive compensation via a Commission or Discount on the Debit Cards.

If an inmate's family member or friend is unable to receive traditional collect calls, or is simply interested in a more

cost-effective calling option, they can pre-pay for collect calling time by opening a Prepaid Collect account. Instead of

being billed for their calls later, Prepaid Collect calling offers several convenient ways for inmates' loved ones to pay

in advance for calling time. Friends and family members can more easily manage their spending, while the facility can

be sure that no time or resources will be wasted on collections. When the inmate places a collect call to the number

attached to a Prepaid Collect account, and the call is positively accepted, the funds are automatically deducted from

the called party's account. Prepaid accounts can be set-up 24 hours a day, 365 days a year by calling Legacy's

customer service number {toll freeL or by visiting Legacy's websites {www.golegacy.com or www.legacyinmate.com).

Friends and Family can replenish existing accounts at anytime. The Automat~d Operator will inform the accepting

party of the amount of funds remaining in the account upon acceptance of each call. Friends and Family may also .

check account balances on line or by calling our 24 hour customer care center. Legacy will supply Prepaid Collect

Brochures (pictured two previous pages) to the facility to pass to interested parties. Legacy will also post on all family.

Legacy's Direct Billing Program

In addition to traditional collect and pre-paid collect, Legacy offers a direct billing program. Should any destination number be assigned a "collect call block"- removal of the block would be instantaneous from the time that Legacy is

) notified by the authorized party to remove the "collect call block". Legacy's Friends and Family program is specifically designed to provide a pro-active approach to removing cumbersome "collect call blocks" for friends and family of incarcerated loved ones. During the validation process Lega!=Y will allow that call to be extended to the destination party for acceptance. Should the call be denied at the destination number no further calls will be allowed .to that destination number unless informed by the called party of their wish to remove the block reported in the Line Information Database (LIDB). In all cases whether the call is accepted or not at the destination number; a Legacy representative will proactively call the friend or family member and inform them of their registered block within the LIDB. At that time the family member will be given several options which will include setting up an advance payment account and/or given.information on how to remove the "collect call block" from their home phone or through their Local Exchange Company. Legacy can make immediate adjustments upon notification on any indiVidual number to allow the removal of LIDB based blocks. Qualified friends and family can also request direct invoicing from Legacy for future calling.

Officer Check-In and Log

iCON offers an Officer Check-in feature that allows Jail Security Officers to call-in from any inmate telephone during rounds. The system will log the Officers Personal Identification Number, date, time, and location.

13. How is the administration of the proposed system handled?

Legacy Response: iCON is web browser based and while offering superior investigative tools is truly easy to navigate and learn. Prio·r to turn-up the Company will have configured the facility iCON database to supply all the services requested. Legacy will train designated facility personnel on how to administer the system. However, so

) long as the facility will not be utilizing PIN applications at this time, very little administration will required. Facility configuration including phone schedules can be handled by Kane County's assigned Legacy account coordinator,

14. Who would be doing the administration?

Legacy Response: The Facility Configuration which includes inmate phone set-up, user lists, and phone schedules will be administered by Legacy. The system will be delivered and installed without any administration needed by the facility. Training will be provided to Justice Center Personnel on how to access reports and investigative tools. . '

15. What amount of training is necessary prior to administration?

Training

Legacy will provide training on the inmate telephone system and all auxiliary services when the system is implemented.

The training will take place at Juvenile Justice Center where the inmate telephone system is being utilized. Additional training will be provided as necessary for new staff or authorized personnel from other agencies. Patrick Snook (Information Systems)· and Diedre Jay (Technical Support Coordinator) will provide the initial training sessions for facility with on­going training, including any training requirements to the other agencies the facilities serve

being provided by Real Ranees, Legacy's assigned account coordinator.

The training session is set-up as an open multi-media presentation with printed materials and question and

answer sessions. Training will cover in detail how to. access and use all the inmate telephone system

functions from a computer workstation, including playback of call recordings, downloading recordings to CD

and the type of media player required, exporting case files, and the like. Training will also include user

security levels, the permitted tasks of each security level, and how to assign users to each level or task. ·

iCON also provides "help" features for every application. A simple 11click" of the

mouse and instructions are given on how to complete a task. Legacy also provides

written and digital copies of the iCON Manual to the facilities. The Company has

provided a digital copy of the iCON manual which can be found in the front sleeve of

this binder. Any revision, upgrades, adds, moves, or changes to the system

throughout our Agreement with the County will be accompanied with modifications

to the supplied Manuals and training.

While iCON provides advanced. services - it truly is an easy-to-use web browser based system. User

instructions can be supplied in any language necessary. The Company will also insure that its training

personnel are bi-lingual in Spanish/English at a minimum. On-Site training will be scheduled as part of our

Installation and Implementation Plan. The Company will work with the facility to schedule times that are

) convenient for all involved. The installation team will stay on-site after installation to provide continual

·' training until suc;:h time the facility feels well versed with the iCON application.

Lega(:y Response: Legacy has offered local technical support for immediate response and on-going maintenance and inspection. By doing so we also help keep much needed revenue dollars in Kane County. Technicians will be dispatched from Addison, via TelePius Inc. located at 724 Racquet Club Drive. TelePius is less than fifteen miles from the facility and employs fifteen (15) qualified technicians. In order to maintain optimal performance from the furnished equipment and inmate telephones, Legacy technicians will visit the facility on a bi-monthly basis to inspect all site equipment at the facility. Legacy agrees to maintain and provide a log of requested visits to the facility. Legacy also offers to pay Kane County a $1000.00 Liability payment for any occasion that the below Response Service Levels are not met. Legacy will address all

major service outages within two (2) hours. Prior to submitting this response Legacy went to great lengths to find a local technicians that were not only close to the facility but also have experience in supporting accounts much like the Kane facility. Below is a chart of Legacy's guaranteed Service Level Responses. Additionally, our On Site Administrator will be trained to address telephone and equipment issues insuring immediate response.

All proposals submitted in response to this RFP will be evaluated based on the following criteria:

1. Compliance with request for proposals. This refers to the adherence to all conditions and requirements of the Request for Proposals.

2. Understanding of the project. This refers to the offeror's understanding of the engagement, the County's objectives, and the nature and scope of the work involved.

3. Equipment I services to be provided. This refers to the exact type and nature of the offeror's proposed equipment/services and how they accomplish the objectives of the program.

4. Qualifications of the contractor. Offeror's capability in all respects to perform fully the contract requirements, and the integrity and reliability which will assure good faith performance. This criteria includes:

4.1 The experience of the firm to similar programs;

4.2 Personnel to be assigned to the program, and their education, qualifications and experience on similar projects;

4.3 The availability of necessary personnel and other resources to successfully complete the program specified; and

' 4.4 Identification of sub-contractors, their responsibilities, capabilities and experience.

RESOLUTION NO. 09 - 241

INMATE PHONE SYSTEM (Juvenile Justice Center)

WHEREAS, proposals have been solicited and received for the Inmate Phone System at the

Juvenile Justice Center; and

WHEREAS,·the proposal specifications were based upon the Inmate Phone System, equipment and the level of commissions to be paid to the County; and

WHEREAS, Legacy Inmate Communications of Cypress, California, offered the most advantageous proposal, proposing a 58% commission to be paid to the County for all outgoing calls.

' NOW, THEREFORE, BE IT RESOLVED by the Kane County Board that the Chairman thereof is authorized to enter into a two year contract with the option for an additional one year extension, with Legacy Inmate Communications for the provision of an Inmate Phone System. The contract shall provide a commission rate of Fifty Eight Percent (58%) to be paid to the County for all calls. Revenue from this contract shall be paid into the General Fund 001-430, Revenue Line 000-34510, JJC Inmate Phone System Revenue.
