Introduction

This information and particulars are intended to give a fair and substantially correct overall description for the guidance of the intended purchasers. No responsibility is to be assumed for the accuracy of individual items. Situation and direction The property is situated directly to the east of the Covenham Reservoir. To drive to the land from Louth, take the A16 north towards Grimsby. After approximately four miles, turn right on to Peartree Lane. At the end of Peartree Lane, continue straight over the crossroads on to Bull Bank, then travel past Covenham Reservoir where you will find a private track on your right identified by a For Sale board. You will find the land approximately 200 metres down this track on your right. Description This 11.11ac (4.50ha) of land is currently down to grass having been grazed for a number of years. There may be potential for other amenity uses (subject to planning) particularly considering its close proximity to the Covenham reservoir and water sports centre. Alternatively there may be potential to bring the land back into arable production, subject to gaining the relevant environmental approvals. The land is classified as Grade 3 on the MAFF Provisional Agricultural Land Classification of England & Wales. The soils are predominantly from the Holderness soil series.

Basic Payment Scheme The land is registered with the Rural Land Registry. If required the Basic Payment Scheme Entitlements held by the seller will be available to the purchaser in addition to the purchase price at the market value upon completion plus VAT. The vendor will reserve the 2015 Basic Payment Scheme payment and the purchaser(s) will be required to indemnify the vendors against any non-compliance for the remaining period of the 2015 claim. Early Entry Early Entry on to the land may be available to the purchaser (by negotiation), but only after exchange of Contracts and the payment of a 20% non-refundable deposit. Wayleaves, easements, covenants and rights of way An overhead electrical wayleave crosses the property in a north/south direction. Access to the land is by way of a shared track leading from Bull Bank, marked in green on the plan of the land. The land is sold subject to and with the benefit of all existing wayleaves, easements and rights of way, whether mentioned in these particulars or not. Boundaries The buyer(s) shall be deemed to have full knowledge of all boundaries, and neither the seller nor the selling agents will be responsible for defining ownership of boundaries. Overage (Claw back) Agreement The land will be subject to an overage agreement triggered by any uplift in value brought about by a planning permission for a use other than agricultural or non-commercial equestrian use. The agreement states that 25% of any uplift in value will be paid to the vendor or beneficiaries for a period of 30 years. The payment will be due upon the earlier of implementation or the sale of the land with the benefit of planning permission. A copy of the overage agreement is available from the selling agent’s office and prospective purchasers are advised to take independent legal advice in this regard prior to submitting an offer.
