MOTION FOR RECONSIDERATION
Pursuant to Supreme Court Practice Rule XI, 2(A)(1), Plaintiff-Appellant Mary
11. Macon ("Macon') moves the Court for reconsideration of its order, dated
November 18, 2009, in which the Court declined jurisdiction to hear this case and
Consequently dismissed her appeal.
Macon respectfully requests that the Court reconsider its decision and accept
Jurisdiction to review her case.
lI.
ARGUMENT IN SUPPORT OF RECONSIDERATION
Macon is mindful and respectful of the Couit's clear adrnonition that its Rules
of Praetice do not permit motions for reconsideration to simply rehash arguments
already advanced in the case. S.Ct.Prac.R. XI (2)(A). With that in mind, this motion
endeavors not to do so. Rather, it is Macon's intention in seeking reconsideration
of the Court's declination of jurisdiction to bring certain facts and circumstances that
were not included at tlre time of her filing the Memorandum in Support of Jurisdiction
and, therefore, were not available to be considered by the Court. It is Macon's sound
belief that once they are taken into account - in conjunction with the reevaluation of the
arguments already advance before this Couit in support of jurisdiction - that the Court
will find that this appeal is one of substantial constitutional import and that the issues
raised are of great interest to the hundreds of Ohio State Employees who could
potentially be adversely effected by the Court's decision to dismiss her appeal.
Macon was falsely accused of unethical and unprofessional behaviors without the
benefit of testimonies from her witnesses which, in an unbiased environment, would have
undoubtedly resulted in a fair and favorable decision in her case.
For this reason, Macon respectfully urges this case be accepted for review.
a
CONCLUSION
WHEREF®RE, Plaintiff-Appellant Mary H. Macon respectfuHy prays that
the Court reconsider its order of November 18, 2009, declining jurisdiction and further
prays that the appeal be reinstated and accepted for review_
Date: November 30, 2009.
Respectfully submitted,
^''-r . 'nyaef.,

Mary,
Vacation requests, I have the right to deny due to needing you for the business. Iwould like you here on Friday so that was denied.
For sick leave (which is also used for doctor's appointments), we typically do not denyrequests. So, if you MUST have this time off this Friday, this would be your option. Ican request doctor verification at any point in time. Therefore, if you use your sickleave, I'm requesting doctor verification.
Does this clarify?
Kim
>>> MARY MACON 10/26/2005 4:32 PM >>>Kim,I submitted an RFL for Friday requestino approval for a vacation day. Is there aproblem with using vacation time? Please help me understand why there would be anissue. It was my understanding that the procedures/process outlined in your email wererequirements when sick leave hours available were at 16 hours or below. Theattachment is information on my leave balances from TimeKeep.
I appreciate your comments and taking 8 hours sick time for an office visit doesn't seemto be a good use of time to me, either. Therefore, it seems practical to request vacationtime and spend the balance of the day with my family and visiting my Mother. She isstill in the Bedford nursing home.
Would you please allow Walt to attend our SLT for me?
Thank you.Mary
