    SUMMARYEffective January I, 2008, the California Building Standards Commission adopted portions ofthe 2007 California Fire Code. The remaining portions of the document were not adopted.Health & Safety Code Secrion 17958.5 permits the City ofOak land to make such changes ormodifications to the Codes as are reasonably necessary to account for the protection of life,health and property based on local conditions.The Fire Department has reviewed these code do cuments and recom mend s that council adopt the2007 edition of the Califomia Fire Code including City ofOakland amendments.F ISCAL IMPACTThere is no fiscal impact. This an administrative action mandated by State law. Resources fromexisting budgeted staff will continue to enforce the model fire code regulations.BACKGROUNDIn adopting the amend ments to the Oakland Fire Code, the City proposes making certain substantivemodifications which has the effect of imposing more stringent requirements locally than aremandated by the Califomia Fire Code.These are specifically listed below, but may be generally characterized as relating to: (1) automaticsprinklers in the high fire hazard area; (2) fire alarm or other life safety systems; (3) fire departmentaccess; (4) citation program; and (5) administration.

The FireDepartment has determined that the proposed m odifications to the Califomia Fire Code arereasonably necessary because of the following climatic, geological, and topographicalconditions:

    The topography of the City ofO aklan d presents problems in delivery of emergencyservices, including fire protection. Hilly terrain with narrow, winding roads and longdead ends causes extended response times w ith poor apparatus access. Much of the urban/wildland intermix are covered with highly flammable non-fire-resisrive natural vegetation. The proposed am endments to "Fire Departm ent A ccess"establish m inimum standards for water supply, road width, and road grade and v ehicleaccess. The seasonal clima tic cond itions during the late summ er and fall create seriousdifficulties regarding the control of and protection against fires in the City ofOakland.The hot, dry weather typical of this area in summer and fall coupled with strong Diablowinds frequently results in wildfires that threaten the City ofOakland. The natural vegetation occurring in our region is among the most highly flammable in theworld. The proposed amendm ent to the Califomia Fire Code, Chapter 47 Wildland -Urban Interface - provides the Fire Chief the authority to require property owners toprovide additional building construction enhancem ents and defensible space requirementswhen their property presents an extraordinary hazardous fire condition. While code requirements, such asfire-resi stive constm ction and the installation of lifesafety devices such as fire alarms and smoke detectors have a direct bearing on survivalin a fire situation. The failure to maintain the equipment once it has been installed alsohas a direct effect on life safety. The propo sed am endm ents to Appe ndix Cha pter I,provides the Fire Chief or his designee with addition fire code enforcement authority.

    SUBSTAINABLE OPPORTUNITIESThe life safety provisions for existing buildings in the proposed Code adoption provide forimprovem ents in fire safety which prom ote socio-economic sustainability by pro viding:Econom ic: Inspections and enforcement are one means of ensuring that properties located in theHigh Fire Severity Area are maintained in a safe manner. The fire safety raring of a city has adirect relationship to its ability to attract new residents and businesses.

    R E C O M M E N D A T IO N (S ) AN D R A T IO N A L EIn the City ofOakland there exists a potential threat to the safety of citizens, property and theenvironment due to the danger posed by fire, earthquake or other natural disaster. Theimplementation of effective and ongoing Fire Prevention programs can substantially reduce thelikelihood of injuries, loss of life and property.The proposed m odifications to the O akland Fire Code are reasonable and necessary due to existingclim atic, geologica l, and topograph ical local conditions within the City. The adoption of the 2007Califomia Fire Code inclusive of the proposed local code am endments w ill help reduce the risks tolife and property.

    before making any changes or modifications pursuant to Section 17958.5 make expressfindings that such changes or modifications are needed due to climatic, geographic, ortopographic conditions; andWHEREAS, the City Council does herewith find that the City of Oakland has certainclimatic, geologic, and topographical features that can have a deleterious effect onemergency services such as fire protection and emergency medical services, and,WHEREAS, after due considerarion, the City Council of the City of Oakland hereby findsthat due to local climatic, geologic and topographic condirions as stated in this secrion, thatmodifications and changes to the current 2007 California Fire Code are reasonably necessaryto provide sufficient and effective protection of life, health and property for the followingreasons:1. The City of Oakland is situated near several known major faults^ each capable ofgeneraring earthquakes of significant m agnitude. These include the South HaywardFault, the North Hayward, the San Andreas, and the Rodgers Creek Faults. These fauhsare subject to becoming active at any time; the City ofO aklan d is particularly vulnerableto devastation should such an earthqu ake occur. The potential effects of earthquake

    activity include isolating the City of Oakland from the surrounding area and restricting oreliminating internal circulation due to the potential for collapsing of highway overpassesand underpasses, along with other bridges in the City, or a landslide, and the potential forvertical movement rendering surface travel unduly burdensome or impossible.2. The City ofO aklan d is bisected by Interstate 80, 880 and 580. Interstates 80 and 880 aredesignated by the California Highway Patrol as approved transportation routes for highlytoxic and radioactive materials. The potential for release or threaten ed release of ahazardous material along one of these routes is highly possible given the volumetransported d aily. Incidents of this nature will normally require all availa ble em ergencyresponse personnel to prevent injury and loss of life and to prevent, as far as practicable,

    property loss. Emergency personnel responding to such aforementioned incidents may beunduly impeded and delayed in accomplishing an emergency response. Potential risk tothe protection of life and public safety and, in particular, residents and occupants instructures without the protection of automatic fire sprinklers.3. The seasonal climatic conditions during late summer and early fall pose serious,challenges to the Oakland Fire Department in controlling and fighting wild land urbaninterface fires. The hot, dry weath er' typical of this area in fire season coupled w ithstrong Diablo W inds can result in wildfires that threaten the City of Oakland. Naturalvegetation occurring in our region is among the most highly flammable in the world.While some code requirements, such as fire-resistive roof classification, have a direct

    bearing on fire survival in a wild land fire situation, others, such as residential firesprinklers, may also have a positive effect In dry climate on low hum idity days,mate rials are much m ore easily ignited. Mo re fires are likely to occur and any fire, oncestarted, can expand rapidly. Residential fire sprinklers can arrest a fire starting within astructure before it spreads to adjacent bmsh and structures.4. The topography of Oakland presents problems in delivery of emergency services,including fire protection . Hilly terrain has narrow, winding roads with limited access foremergency response and residential egress, preventing rapid access and orderly

    evacu ation. Mu ch of these hills are covered with highly non-fire-resistive naturalvegetation. In addition to access and evacuation problems, the terrain m akes delivery ofwater extrem ely difficult. Some hill areas are served by water pum p system s subject tofailure in fire, high win ds, earthquak e and other power failure situatio ns. Due to thetopography in much of the City of Oakland, roadway condition, angle of approach ordeparture, steeply sloping roadways and grades are commo n.5. There is expansive soil in many areas of the Oakland Hills that retain ground water from

    severe rainstorms. This produces a condition wherein the moisture content of the soil issufficient that roadway s become damaged due to soil expansion and shrinkage. Allweather, paved surfaces capable of supporting the imposed loads of fire apparatus arenecessary to ensure access of emergency response persormel. These roadw ays, approachangles, steep slopes and grades can also make it difficult for fire apparatus and otherem ergen cy veh icles to access a site. It is therefore essential that these roadw ay accessesbe provided with proper all-weather paved surfaces, angle of approach, grades and gateaccess; now, thereforeTHE COUNCIL OF THE CITY OF OAKLAND DOES ORDAIN AS FOLLOWS:Sec tion 1. Secrion 15.12 Repealed. Section 15.12 of the Oakland Mun icipal Code isrepealed in its entirety.Section 2. Section 15.12, Oakland Fire Cod e. Section 15.12, Fire Code, is reinstated in theOakland Municipal Code as follows:Section 15.12, Oakland Fire Code

    15.12.010 2007 California Fire Cod e is Ad opted an d Am end edA. The 2007 California Fire Code, including Appendix Chapter I , 1 App endix B , AppendixC, and Appendix D as amended below, and referenced National Fire ProtectionAssociation Standards and other standards as adopted by the Califomia State FireMarshal, is hereby adopted and made a part of this Chapter as though fully set forthherein, subject to the modifications thereto set forth in this Chapter below.B. This Chapter shall be known as the "Oakland Fire Code" and shall be referred to in thisChapter as "this Chapter," "this Code" or "the Oakland Fire Code."C. To the extent permitted by law, the Fire Chief may, at his/her sole discretion, reviserequirements set forth in the Oakland Fire Code in specific instances due to climatic,geographic or topographic conditions.D. A c opy of this Code is on file in the office of the Fire Chief of the City ofOakland.

W here any secrion of the 2007 California Fire Code or any otherreferenced codes, regulations or standards are amended by this chapter, all provisions of suchoriginal codes, regulations or standards not so specifically amended shall remain in full forceand effect. No twith stand ing the foregoing, in the event prov isions set forth herein conflictwith any section of the 2007 Califomia Fire Code or any other referenced codes, regulationsor standards, the provisions of this Code shall prevail and control.Failure to comply with any of the provisions of this Code, including failure to prov ide, obtainor maintain valid permits, certifications, tests, listings, affixed labeling, inspection approvals,or other conditions of permit; failure to repair, demolish, remove, or rehabilitate unsafematerials, appliances, fixtures, equipment or other property; or failure to prevent, restrain,correct, or abate conditions unsafe or hazardous for egress or fire protection or health due toinadequate maintenance, excess loading, dilapidation, or abandonment shall be and isdeclared to be prima facie evidence of an existing and continuing hazard to life or limb,property or public w elfare.Section 102 Ap plica bility - Amend this Section J 02 as follows:Add : 5. All materials, assemb lies, appliances, fixtures, equipment, and installations thereof;all arrangements of occupancies, exits, aisles, stairs, and doors; all parapet walls, comices,spires, towers, tanks, statuary, signage, structural members, appendages, and appurtenancesthereto in buildings and stmctures regulated by this Code shall be so arranged, assembled,installed, maintained and of sufficient size and so protected as to reduce and minimize allegress, fire, safety, and health hazards.Add : 6. The quality of all materials, assemblies, appliances, fixtures, and equipm ent;methods of connection, assembly, and installation; allowable stress, strain, deflection, rateand volume and velocity of flow, pressure, temperature, and opacity; and assumed loads andcapacities to be used in the design and construction of all buildings and stmctures, plumbingand mechanical installations, and electrical systems shall be consistent with requirements ofthis Code and nationally recognized standards of quality and generally recognized and well-established methods of testing, design, installation, and construction. Testing, listing, andaffixed labeling shall be prima facie evidence of conformity with approved standards forsafety to life and limb, property, and public welfare.102.7.     Section 105. Fermits - Amend this Section J 03 as follow s:105.3.7. Information on the permit.Ad d: Every perm it shall also contain an agreement as follows which shall be executed by thepermit holder as a condition of issuance:"I hereby agree to save, defend, indemnify and keep harmless the City ofOak land and itsofficials, officers, employees, representatives, agents and volunteers from all actions, claims,dem ands, litigation, or proceedings, including those for atto m eys' fees, against the City inconsequence of the granting of this permit or from the use or occupancy of the public right-of-way, public easement, or any sidewalk, street or sub-sidewalk or otherwise by virtuethereof, and will in all things strictly comply with the conditions under which this permit isgranted. I further certify that I am the owner of the property involved in thi s perm it or that Iam fully authorized by the owner to access the property and perform the work authorized bythis permit."Section 108. Bo ard of Ap peals - A mend this Section 108 as follows:Amend: 108.1. Ap peals . In order to hear and decide appeals of ord ers, decisions, ordeterminations made by the Fire Chief relative to the application and interpretation of thenon-adm inistrative (technical) requirements of this Code, the property o wner may request anadministrative hearing with a Hearing Exam iner. The request shall be filed in writing withthe Fire Chief and shall be accompanied with a fee as established in the Master Fee Schedule.The request for an administrative hearing shall contain the following information:1. A brief statem ent setting forth the legal interest of the party or parties in the real propertyidentified in the order, decision or determination made by the Fire Chief; an d2. A brief statement in ordinary and concise language of that (those) specific order(s),decision(s) or determination(s) protested; and3. A brief statement in ordinary and concise language contending that issuance of the order,decision or determination was a result of error or abuse of discretion together with anymaterial facts claimed to support such contention; and4. A brief statement in ordinary and concise language of the relief sought and the reasonswhy it is claimed the protested order, decision or determination should be reversed, modified,or otherwise set aside; and5. The signature of the property owner, and his or her mailing address; and6. The verification (by declaration under penalty of perjury) of at least one person requestinga hearing as to the truth of the matters stated in the request for hearing; andThe written request for an administrative hearing with the accompanying fee shall bereceived by the Fire Chief witliin fourteen (14) calendar days from the date of the service ofsuch order, decision or determination of the Fire Chief

    Amend: 108.2. Sch edu ling a nd N oticing . As soon as practicable after receiving the requestfor administrative hearing, the Fire Chief shall fix a date, time and place for theadministrative hearing. Written notice of the time and place of the hearing shall be given tothe appellant at least seven (7) calendar days prior to the date of the hearing.The failure of the Fire Chief to serve any person required herein to be served shall notinvalidate any proceedings hereunder as to any other person duly served or relieve any suchperson from any duty or obligation imposed by the provisions of this section.Amend: 108.3. Scope of Hea rin g, Only those technical matters or issues specifically raisedby the appellant in the Request for Administrative Hearing shall be considered in theadministrative hearing .Amend: 108.4. H ea rin g Exa m ine r. The Hearing Examiner shall not be an employee of theCity of Oakland and shall be qualified by experience and training regard ing fire and,building constm ction and other matters pertaining to this Code.Amend: 108.5. Li m itat ion s of A uth ori ty, The. Hearing Exam iner shall have no authorityrelative to interpretations of the administrative provisions of this Code and shall not beempowered to waive or otherwise set aside the non-administrative (technical) requirementsof this Code.Amend: 108.6. Effect of H ea rin g. Decisions of the Hearing Examiner in all instances shallbe final and conclusive.Amend: 108.7, Review of Ad m inistra tive Determ inatio n. The limitation period providedpursuant to Califomia Code of Civil Procedure Secrion 1094.6 shall apply to all petirionsfiled seeking judicial review of administrarive determinations made by the Fire Chief or theHearing Examiner.Section 109 H az ard ou s Co ndition s Violations - Amend this Section 109 as follows:Add: 109.1 H az ar do us C on ditio ns, Any comm ercially or residenrially zoned parcel, lot orpremise on which flammable materials as defined by this Code are openly stored orabandoned, causing blight or hazardous conditions, so as to constitute a potential fire orhealth hazard shall constitute a public nuisance and shall be ordered cleaned by the issuanceof a norice to abate in accordance with Section 106.1 of this Code.Amend: 109.1.2. R em un er ati on . In addition to the penalties provided by law, a violatorshall be liable for such costs, expenses, disbursements, and attorneys' fees paid or incurredby the City or any of its officials, officers, representatives, employees, agents, volunteers,vendors, or third-party contractors in correction, abatement and prosecution of the violation.Add: 109.2.1. Vio lation s. Any violation of this Code is deemed a public nuisance and amisdemeanor, but may be cited or charged, at the election of the enforcing officer or CityAttom ey, as infractions, w ith the exceptions cited below in subsection (b ). No thing in thissection shall prevent any other remed y at law. Each person shall be guilty of a separateoffense for each and every day during a portion of which a violation of any provision of thisCode is com mitted, co ntinued, or permitted by such person.

    Add: 109.2.2. M isde m ean ors. Not withstanding Section 103.4.4.1, violation of any of thefollowing provisions of this Code shall be charged only as a misdemeanor;Add : 109.3.2. Au tho rity to Abate V iolations. Whenever the Fire Chief has issued an orderor notice pursuant to this Code, and the condition remains uncorrected after the timespecified in the order or notice, the Fire Chief may proceed to abate the condition byremoval, restriction, rehabilitation, demolition, instituting security protocols, or whatevermeans the Fire Chief determines are reasonably necessary to cause the abatement of suchviolations.Add: 109.3.3. Co st Recov ery. The costs of any abatement action taken pursuant to thisCo de shall be recovered b y the City pursuant to the prov isions of this section. Afterperforming the abatement work on the property in quesrion, the Fire Chief shall cause to berecorded with the County Recorder, a "prospecrive Norice of Special Assessment Lien."Such notice shall summarize the work performed, the cost and date of completion. The costsshall be imposed as a lien in conformance with Section 107 of this Cod e. They City mayproceed to recover such costs in a civil lawsuit.Add: 109.3.4. Notice of Ab atem ent O rd er s, Notices and A ctions. If norice has not alreadybeen given pursuant to Section 103.4.2, the Office of the Fire Marshal ("Fire Department")shall personally serve, or shall send one copy of the official notice to abate by regular mail,postage prepaid, to the person owning the parcel, including undeveloped land, on which thefire or dangerous condition is located, or to any person in control of said parcel, as suchperson's name and address appear on the current County of Alameda's assessment roll. Ifsuch address is unknown to the Fire Department then notice shall be affected by physicallyposting such no tice on the property itself Service by mail shall be deemed com pleted at thetim e of deposit in the United States mail.Ad d: Section 112. Jud gm ent and LiensAdd : 112.1 A uth ori ty to Lien. The cost incurred pursuant to Sections 103 and 106 of thisCode in obtaining Real Property Ownership Reports and in razing or demolishing any fire orsecuring or cleaning any parcel and abating its associated fire hazard, or instituting a firewatch by action of the Fire Chief shall be a proper charge against the City Treasury and shallbe paid from there. Re-inspections and administrative fees to ascertain Code compliance foroverdue abatement of previously noticed or cited violations shall be charged against theowner. Fees shall be in the amount as currently described in the Master Fee Schedule. TheFire Chief shall give the owner or other interested party of such premises a written notice andstatement showing the itemized cost of such abatement, and requesting payment thereofAlternatively, said charges may be directly collected in a civil lawsuit or by the filing andforeclosure of a lien.Add: 112.2 Notice of H ear ing on Lien. W ater sources, hydrants and other fire protectionequipment required by this code shall be subject to periodic tests as required by the codeofficial. All such equipment installed under the provisions of this code shall be maintained inan operative condition at all times and shall be repaired or replaced where defective.Additions, repairs, alterations and servicing of such fire protection equipment and resourcesshall be in accordance with approved standards.Add : 4715.8 Cle ara nc e of Fue l.
