Dear Friends, Happy New Year! As we enter into 2019, we're excited about all that we'll do together. In 2018, we saw a lot of change - both in the world and at NPCC. We began the first year ofour strategic plan focusing on building more capacity in and for our members. We shiftedour programming to be more responsive to your needs - including starting an annualcalendar of professional development workshops, expanding our Learning Labs, andhosting our first ever Best Nonprofit Conference. We created new programming to be moreaccessible, like The Community, our custom, online platform for member engagement, witha new Knowledge Center, Referral Center, Community Forum, and a personalizedHelpLine. We launched a Job Board to help promote your job openings without breakingyour budget. We added new partners to our Member Vendor Program, so that you can getthe back-office help you need at a discounted rate. We successfully advocated for thethings you care about, such as eliminating the state UBIT on commuter benefits, anddefeating attacks on nonprofit nonpartisanship. We're proud of our accomplishments in 2018, and they could not have happened withoutyou! We enter 2019 with a lot of exciting work on the horizon: we're strengthening our advocacy,through sold-out Policy Forums, a legislative platform, and comprehensive, sector-widepolicy proposals like the one below; we're adding new resources, focused on practicaladvice, tools, and templates that you need, to our Knowledge Center; we're gearing up forour move to the Ford Foundation Center for Social Justice this summer; and with you, we'reworking to create the community and movement that the nonprofit sector needs to be strongand effective. We will continue to leverage NPCC's unique position to protect and promote the sectorand, with your feedback, bring you the information and programs you need most. We lookforward to seeing you at our upcoming workshops and forums and especially at the AnnualMeeting of Members, March 28, 2019, at the Ford Foundation Center for Social Justice. Weremain grateful for everything you do to make our communities better, and we resolve inthis next year to continue to build a powerful nonprofit community with you. UBIT Win! Governor Cuomo Signed UBIT Legislation into LawLast month, legislators in New York passed a bill essentially declaring on a bipartisan basisthat taxing nonprofit transportation benefits like the federal government has done isunjustifiable and bad tax policy. In December, New York Governor Cuomo agreed, signingthat legislation into law, which decouples New York from federal tax law to prevent anautomatic tax hike on nonprofits. New York imposes a 9% unrelated business income tax onnonprofits for all income taxable under federal tax law. The bill signed by the Governormakes clear that a state tax does not apply to nonprofit transportation benefits, and theclarification is retroactive to the beginning of this year. New York becomes the second state,after North Carolina, to decouple certain state taxes on nonprofits from federal taxes.
NPCC SURVEY - Did Your Nonprofit Donations Increase or Decrease in 2018?The new federal Tax Cuts and Jobs Act (TCJA) went into effect in 2018, impacting theability to deduct charitable contributions to nonprofits. NPCC would like to know if you saw achange in donations in 2018 from 2017. Please fill out this 2-minute survey. We'll use thisinformation - in the aggregate, without identifying information - to advocate for fairer taxreform for nonprofits.
Property Tax Exemptions - Drug Policy Alliance DecisionThe Supreme Court of the State of New York held that the Drug Policy Alliance (a 501(c)(3)charitable organization) was eligible for a property tax exemption, annulling a determinationof the Tax Commission denying that exemption. The case, in which NPCC and the LawyersAlliance for New York submitted an amicus brief, reaffirms the tax exemption is available toorganizations that use its property "exclusively or primarily for its exempt purposes."
Strong Nonprofits Campaign for Government COLAStrong Nonprofits for A Better New York, a coalition co-chaired by the Human ServicesCouncil, FPWA, and The Fiscal Policy Institute, are advocating with state legislators for a2.9 percent cost-of-living adjustment for state-contracted human services providers in theupcoming state budget.

Government Shut-DownWe don't have much more to say that you haven't already read or heard about thegovernment shut-down. We do want to make sure you're planning for delays in federalfunding and/or grant application processing, and doing the risk management that becomesnecessary in times like this.
IRS Notice on Transportation UBITThe IRS issued guidance for calculating parking expenses (but not Metrocards) forunrelated business taxable income purposes and provided penalty relief to nonprofits. Seethe IRS News Release. IRS Notice 2018-99 (called "Interim Guidance") instructs for-profitsand nonprofits on calculating which parking expenses are taxable. IRS Notice 2018-100provides for waiver of tax penalties for nonprofits that failed to submit quarterly estimatedtax payments for the new tax on transportation benefits. Generally, this means that if youusually don't submit quarterly payments, then you're off the hook for this year, but the taxeswill still be due when you file your Form 990 (or whenever you submit UBIT payments at theend of your fiscal or calendar year).

States Consider Sales Tax Under WayfairThe U.S. Supreme Court in its decision in South Dakota v. Wayfair recognized new taxingauthority in the states. These changes matter to nonprofits because sales tax exemptionsvary across the states, and charitable organizations may find themselves liable for taxesthat were not applicable to them last year. Only five states have no sales tax and 23 out ofthe remaining 45 states and the District of Columbia are applying the case to out-of-statesellers to collect additional revenues through previous legislation, crafting regulations, orsimply claiming authority to do so. Eight states were set to begin collecting such taxes onJan. 1, 2019. The remaining 15 states are expected to take up legislation this year to tapinto the new source of revenue. Check with a tax expert on what you need to do to protectyour organization.

Improving Standardized Grants Data ElementsThe federal Office of Management and Budget (OMB) has developed data standards forgrants management reporting that are now open for public comment. Among other things,the intent of standardized data elements is to ensure that grant recipients and governmentagencies spend less time on administrative compliance and more on performing work thatdelivers results. But, to ensure the intent becomes reality, the Results-OrientedAccountability for Grants Team at OMB is asking nonprofits to provide detailed feedback,including comments, concerns, and specific user stories to identify and understand neededrevisions before the data elements are finalized. Comments can be made until Jan. 15,2019 at the Federal Grants Management Data Standards comment site.

The U.S. Programs' Equality team seeks applicants for its Soros Equality Fellowship, whichaims to support emerging mid-career professionals who will become long-term innovativeleaders influencing the racial justice field. The fellowship award provides individuals with agrant of $100,000 to support production of an innovative racial justice project over thecourse of 18 months. The team seeks a diverse cohort of applicants, including but notlimited to activists, artists, journalists, and organizers, to produce a project with meaningfulimpact. This approach recognizes the power of individuals to use a variety of tools, fromtraditional advocacy to the arts, to impact change and uplift the mission and values of anopen society. Grant Readiness and Insights Training Program - Applications Now AcceptedDeadline to apply: Thurs., Jan. 31, 2019 The Robin Hood Foundation is accepting applications for a training program that helpsexecutives get funding. The deadline to apply to the Grant Readiness and Insights Trainingprogram is Jan. 31, 2019. Participants will receive coaching and take workshops aimed athelping them obtain grants from "results-driven, evidence-based funders," according to apress release. Eligible executives will lead social service nonprofits based in the New YorkCity metropolitan area that have annual budgets between $500,000 and $10 million, andhave been operational for at least three years.
