BEIJING China is deeply con- cerned over India's reser- vations to its mega Silk Road projects and looks to address the issues during Prime Minister Narendra Modi's visit here next month, as it could be "problematic" if India tries to obstruct them, a Chinese think-tank today said. NEW DELHIVikas Yadav, serving a

30-year jail term withoutremission in the NitishKatara murder case, onThursday moved the DelhiHigh Court challenging thedecision of a single judgerefusing extension of theparole granted to him.

Yadav was recentlygranted seven-day custodyparole by the high court'ssingle judge to visit his 93-year-old ailing grandfatherand to challenge the highcourt order in the SupremeCourt.

After expiry of parole,he had again moved thecourt for extension of threemore weeks. Justice A.K.Pathak on April 10 dis-missed the plea.

Challenging the April 10order, Yadav said he wasnot able to prepare the

appeal in seven daysparole time granted to him.

A division bench ofChief Justice G. Rohini andJustice R.S. Endlaw wouldhear the plea on Friday.

Yadav said he needsextension of parole as thedocuments in the case arebulky and more time wasneeded to prepare hisappeal.

The high court onFebruary 6 had enhancedto 30-year jail term with-out remission the life sen-tence awarded to VikasYadav and his cousinVishal Yadav for Katara'smurder, a friend of VikasYadav's sister.

co-founder of online maga-zine 'St Stephen's Weekly', onThursday moved the DelhiHigh Court against the col-lege and its principal ValsonThampu, challenging his sus-pension and banning of themagazine's publication.

On April 15, Mehta wassuspended till April 23 after aone-man inquiry committeeappointed by the St Stephen'sprincipal found him guilty of"breach of discipline".

Mehta, a third-year philos-ophy student, was allegedlysuspended for launching theonline magazine.

Last month, the collegebanned the e-zine started byMehta and other studentsover an interview of the prin-cipal, which, he said, had notbeen cleared. The e-zine wentlive on March 7 and regis-tered over 2,000 hits on theinterview.

Filing the petition, Mehta

called the ban "arbitrary, ille-gal, malafide and shockinglyunreasonable".

"The main malicious accu-sations against the petitioner(Mehta) in this case aretwofold - that of publishingan online magazine withouttaking prior approval fromthe principal and subsequent-ly conveying the news of theproscription of this magazine,to the media," said theplea.

Mehta sought "quashing ofthe order banning/suspendingpublication of the StStephen's Weekly, stay on thesuspension order andrestraining the principal fromtaking any further actionagainst him".

Mehta has also requested inhis petition that he be award-ed the Rai Saheb Banarsi DasMemorial Prize, for which hewas earlier selected by thecollege. He was droppedfrom the list in the wake ofthe controversy.

most transparent party, theAAP was the last politicalparty to submit its expenditureincurred in 2013 Delhi polls tothe Election Commission, morethan a year after the deadline, areport by Association forDemocratic Reforms (ADR)and National Election Watchhas claimed.

The BJP too submitted itsexpenditure more than 10months after the due date,while the Congress was threemonths late in furnishing thedetails to the ElectionCommission. The deadline tosumbit the expenditure detailsof December 2013 Assemblypolls to the EC was February24, 2014.

The report analysed the fundsreceived and expenditureincurred by the BJP and AAPduring the election period of 26days of Delhi Assembly pollsof 2013.

The AAP submitted itsexpenditure details to the EC aslate as April 6 this year whilethe BJP submitted the detailson December 31, 2014 and theCongress furnished its expen-diture details on May 13, 2014---three days before the LokSabha polls. Interestingly, BJPally, the Shiromani Akali Dal(SAD) submitted its expendi-ture details on February 5, wellbefore the deadline.

The AAP received Rs 20.75crore donation--of which Rs 20crore was in form of cheques--while the BJP received Rs 27

lakh of which Rs 21 lakh wasin cash and rest in cheque. TheAAP spent Rs 26.11 crore onelection.

Interestingly, during theAssembly polls which saw ahigh-profile campaign by theBJP and rallies addressed byPrime Minister Narendra Modi,the party incurred expenditureof just Rs 3.15 crore.

Of the total expenditure, theAAP spent Rs 17.06 crore onexpenditure towards its candi-dates, while Rs Rs 7.26 crorewere spent on publicity.

Similarly, the BJP incurredzero amount towards its candi-dates, followed by publicity onwhich it spent Rs 2.63 cror,which constitutes 83 per centof its total election expendi-ture.

that the plea of artistic freedom could notbe advanced to justify attribution of vulgarand obscene expletives to Father of theNation Mahatma Gandhi.

It said it was the collective responsibili-ty of the nation to respect Gandhi.

"Is it not a collective responsibility ofthe nation to respect Mahatma Gandhi.You cannot respect an ideal but vulgarisethe man who gave the ideal in the garb andguise of artistic freedom," the apex courtbench of Justice Dipak Misra and JusticePrafulla C Pant said.

The court said this as it reserved verdicton a petition by Devidas RamachandraTuljapurkar -- editor and publisher of abulletin magazine of All India BankEmployees Association -- who has chal-lenged filing of a case against him by thePatit Pawan Sanghtan for publishing in1994 a poem by Marathi poet VasantDattatray Gujjar 'Gandhi Mala BhetlaHota' (I met Gandhi) that was written in1984 and allegedly attributed someobscene and vulgar expletives to Father ofthe Nation.

As senior counsel Gopal Subramaniumsought to defend the poet, saying artisticfreedom could only be curtailed by consti-tutional and statutory provisions and notby the halo of historic personalities, thecourt asked him: "If some were to put

these words in the mouth of QueenVictoria how would the British have react-ed.

"Linguistic freedom is not a problem butusing the linguistic freedom to say some-thing to Mahatma Gandhi is an issue," thecourt said, adding that it was not a ques-tion of individual comfort of an artist butthe statutory and constitutionalcomfort.

Defending the author of the controver-sial poem, Subramanium said howsoeverbig a person may be but his persona couldnot be allowed to "knock at the liberty ofan artist and the constitution is based onideals and not the persons who gave thoseideals".

"The framer of the constitution were notabove the constitution," he said, addingthat the "idea of hallowed historical per-sonalities was alien to the constitution".

Telling Subramanium "you can lam-poon, satire or criticise the historical per-sonalities but you can't attribute expletivesto them", the court said: "When the ques-tion is of artistic freedom and its collectiveimpact on the generation today and tomor-row then Mahatma Gandhi would stand onhigher pedestal" in proceedings againstthe author under penal provisions.

Addressing the court, amicus curiae FaliNariman said the Emblem Act protectsMahatma Gandhi from such depiction. Heurged the court that it should go only by

the statutory provisions and not the otherpleas advanced by the counsel for the peti-tioner.

While Nariman told the court that whileinterpreting Section 292 of the IPC itshould take care that "this is an age of den-igrating the national heroes and drag themto dust and court should not be a party toit".

On the other hand, Subramanium urgedthe court that any reading of Section 292of IPC keeping in mind hallow of histori-cal personalities could give a handle toState to get back on the media and people.There has to a balance between the dan-gers and over-protectionism.

Patit Pawan Sanghtan had filed the com-plaint in 1994 both against the publisherand the author of the poem.

The complainant organisation hadaccused both of using the obscene lan-guage and creating enmity between differ-ent sections. Both Tuljapurkar and Gujjarwere absolved of charge of creating enmi-ty between different sections but both thetrial court and the Bombay High Courtdeclined to unsaddle them of the obsceni-ty charge.

Tuljapurkar had moved the court in2010 and it stayed all the proceedingsagainst him on July 7, 2010. The author ofthe poem Gujjar did not challenge the highcourt declining to quash the obscenitycharge against him.

The Supreme Court on April 8had said that it would lay down alaw as to whether an accused hasgot the right to recall witnesses fortheir re-examination in a criminalcase.

The proceedings of the case inthe trial court were first stayed bythe apex court on March 10.

On March 24, the apex court hadalso issued notice to accused ShivKumar Yadav seeking hisresponse on the appeals.

According to the prosecution,the incident took place on thenight of December 5 last yearwhen the 25-year-old victim, afinance executive working inGurgaon, was heading back home.

Police had said the woman had

taken the taxi from Vasant Vihar toreturn to her house in Inderlokarea of North Delhi and theaccused, who took another route,allegedly raped her. Yadav wasarrested on December 7, 2014from Mathura.

In her statement recorded beforethe court earlier, the woman hadidentified Yadav as the one whohad raped her.

The court has framed chargesagainst Yadav under IPC foralleged offences of endangering awoman's life while raping her,abducting with an intent to compelher for marriage and criminallyintimidating and causing hurt. Union Home MinisterRajnath Singh laid foundationstone of the project inDecember last year before theDelhi Assembly poll. The totalproject cost, however, is Rs1260.63 crore. DelhiGovernment has sought almostthe entire project cost bydemanding Rs 1,200 from theDDA, saying that it shouldfund the project for the devel-opment of capital.

Public Works Department(PWD) of Delhi governmenthas to build the Elevated Roadflyover. "We have written to

DDA to give us Rs 1,200 croreto fund the third phase of theBarapullah Elevated Road.DDA has sufficient fund forthe development of Delhi.

"In view of this, the develop-ment authority should fund thisproject," PWD ministerSatyendra Jain said here.

Jain said that DDA has sepa-rate development fund, whichhas been collected from theDelhiites and hence as it isdevelopment project, DDAshould give money for thirdphase of the BarapullahElevated Road.

If DDA wants to build thisproject on its own, Delhi gov-ernment would not have anyobjection. Giving furtherdetails about the project, theminister said that governmenthas also proposed to build ajogging track on the side ofBarapullah Elevated Road.

The CBI Thursday arrested aDeputy Commissioner of IncomeTax at his Central RevenueBuilding office here for allegedlyreceiving a bribe of Rs 1.5 lakhfrom an industrialist for settlingtax issue.

CBI sources said an IRS officerof 2008 batch M Logapathy, post-ed as Deputy CommissionerIncome Tax here, along with analleged middleman Hitesh Kumar,Logapathy's personal attendantAbhishek Kumar and business-man Vikas Singla were arrested inconnection with the briberycase.

The sources said the four weredetained yesterday and were takeninto custody early this morningafter a thorough search andseizure operation during whichthe bribe amount was recoveredby CBI.

They claimed the agency hasrecovered property documentsworth crores of rupees fromLogapathy's possession indicatinghis alleged connivance in manyother such cases in which it sus-pected that he was taking one percent of the tax demand asCommission for settling theseissues.

The sources said bribe of Rs 1.5lakh was allegedly given toLogapathy by Vikas Singla,Director CBS Steel PrivateLimited, through advocate HiteshKumar in a case of alleged taxevasion.

Giving details of the operation,the sources said Kumar andLogapathy were under the scannerof the agency for quite some timeand CBI was keeping an activesurveillance on them listening totheir conversations through phoneintercepts and other means.

Asked whether the issue could have animpact on the border settlement, he said "ofcourse." "We have to address the issue.Development of people of the two countriesand rise of the countries is much more impor-tant."

"I think the two government will have thiskind of thinking to make some breakthroughon the border issue in the next five to 10years. From our side this government wantsto make full use of Modi's strong regime.This is critical opportunity to address thisticklish issue," he said.

AAP disciplinary ...Delhi Chief Minister Arvind Kejriwal's res-

idence, party leader Sanjay Singh said, "Wehave referred the matter of Yogendra Yadav,Prashant Bhushan, Ajit Jha and AnandKumar holding the 'Swaraj Samwad' to thenational disciplinary committee. It will takesuitable action."

While speaking to the media, Bhushantoday questioned the intention of forming thecommittee as it comprised of same peoplePankaj Gupta and Ashish Khetan, who hadearlier made serious allegations against himand Yadav.

Yadav and Bhushan, ousted from theparty's national executive on March 28 foralleged "anti-party" activities, held a day-long conference on Tuesday that was attend-ed by over 4,000 people, many of whomclaimed to be AAP volunteers.

The event was seen as an attempt to breakthe AAP-led by Kejriwal. However, Yadav,Bhushan and Kumar have denied any inten-tion to split or leave the party.

Earlier in the day, Yadav and Bhushan hint-ed at forming a political party and alsonamed Kumar as the national convener of the

steering committee of 'Swaraj Abhiyan' -- anon-political movement to establish 'swaraj'(self-rule) in the country's cultural, political,economic and social fields.

Court to...judgement passed by the magisterial court

which had dismissed the complaint filed bythe CEO of a news portal against Kejriwaland five others, including the party.

The sessions court passed the order on arevision petition filed by Anuranjan Jha,CEO of news portal Media Sarkar, anddirected the complainant to appear before themagisterial court on April 20.

"Vide separate detailed order the impugnedorder dated November 14, 2014 is set asideand the matter is remanded back to the trialcourt. The complainant is directed to appearbefore the trial court on April 20," the judgesaid.

The sessions court on April 8 had reservedits order on the plea challenging the magiste-rial court's verdict.

Jha had challenged the magisterial court'slast year's order dismissing his criminaldefamation complaint against AAP, Kejriwal,Manish Sisodia, Kumar Vishwas, YogendraYadav and Shazia Ilmi.

The magistrate had dismissed the plea onthe ground that despite providing sufficientopportunities to Jha to lead pre-summoningevidence in support of his plea, he opted notto do so. Jha had only examined himself insupport of his plea.

In his revision petition, Jha has said themagistrate had failed to appreciate that fromhis sworn statements and the documents pro-duced by him, it was clear that the leadershad made alleged defamatory imputationsagainst him.

Khan, a freelancer, alleged that in an April2004 affidavit filed by Irani for the LokSabha elections, it was stated that she hascompleted her BA in 1996 from DelhiUniversity (school of correspondence).

It claimed that in another affidavit of July11, 2011 by Irani for election on Rajya Sabhaseat from Gujarat, it was stated that her high-est educational qualification was B.Com partI from the School of Correspondence, DU.

The complainant alleged that in anotheraffidavit of April 16, 2014 filed by her for theLok Sabha polls, it was said that she was aBachelor of Commerce Part-I from theSchool of Open Learning, DU.

"It is evident from the contents of the affi-davits filed by Smriti Z Irani that at best, onlyone of the depositions by her on oath inrespect of her educational qualifications iscorrect," the plea claimed.

It alleged that she had given "false infor-mation" about her educational qualificationsin the affidavits.

It further said, "the aforesaid affidavits ofSmriti Z Irani, apart from the ostensibly falseand discrepant statements in respect of hereducational qualifications, also appear tocontain false/ discrepant statements inrespect of immovable properties owned byher, and other details set out by her."

"The aforesaid facts and circumstancesreveal commission of offences by theaccused under section 125A of theRepresentation of People Act, 1951, besidesany other offences that may attract otherpenal provisions as an outcome of an addi-tional investigation," the plea said.

It requested the court to take cognisance ofthe offences alleged in the plea and summonIrani for trial.

Padma awards...that the awards are fundamentally flawed

and urged Yadav that his new party shouldtake it up as a public issue.

"I believe that this practice of givingPadma awards by the central government isfundamentally flawed and should be discon-tinued," he said in a letter to Yadav.

"Your party should take it up as a publicissue and demand that the practice be discon-tinued," Sachar, whose report on poor socio-economic condition of Muslims had prompt-ed the then UPA government to launch sever-al measures for their welfare.

Delhi govt ...According to officials of the health depart-

ment, the city's government hospitals willhave 38 such committees to be headed byMLA of the area who will get an office in thehospital to address patients' grievances.

Health Minister Satyendra Jain said thepatient welfare committees will ensure com-munity participation and monitor functioningof health care facilities.

"Their role will be to deal with day to daypublic grievances and resolve these issues atlocal level. Decisions on issues like lack ofmedicines, cleanliness and treatment will betaken on the spot by these committees," hesaid.

The government has also formed 10 districtcommittees, to be chaired by MLAs, to lookafter dispensary and health related schemesand programmes.

Jain further announced that DelhiGovernment has given medicines to 35 lakhstudents (1 to 19-years of age) of the cityunder the de-worming drive and now it plansto involve students of private schools in thecoming months.

"Even students of private schools are hav-ing junk food and have irregular food habits.So they will also be included in the de-worm-ing programme. So far they were not includ-ed in the programme," Jain said.

A Health department official said immu-nization programme Indradhanush Kawachwas carried out from April 7 to 14.

In the first phase 1,11,613 students and13,222 pregnant women were immunizedand 14,198 ORS, 26,073 zinc tablets, 60,887vitamin-A tablets were given.

"This immunization programme is beingheld in all parts of the city and the idea is tostrengthen it in the coming months. Thismonth we held it at 700-800 centers but weplan to take this number to 1,000. Our targetis that 100 per cent kids of the city are immu-nized," Jain said.

The debate over the moves bythe Central and the Jammuand Kashmir governments to

resettle Kashmiri Pandits inKashmir is one that will only bringpain to any well-wisher of the State.To understand this, one has to goback in time, when the second halfof the 1980s saw Kashmir spiral outof control, gripped by violence, sus-picion and dread. What had begun asan ethnic conflict was soon imparteda religious colour by Pakistan’sInter-Services Intelligence (ISI).The Pandits, a Hindu minority in theKashmir Valley, were targeted bythe Jammu Kashmir LiberationFront (JKLF), even though theorganisation had sought to build onthe original secular foundations ofthe National Conference, and by theHizb-ul-Mujahideen, a secessionistoutfit, which sparked their exodus.By 2008, their population, asassessed by the Kashmiri PanditSangharsh Samiti (KPSS), wasreduced to 651 families from 75,343families on January 1, 1990. Nearly70,000 families fled in the turmoilof 1990-92, and even though theviolence was brought under control,most of the remaining families leftthereafter.

Years of turmoil

By 1990 — I was SpecialCommissioner, Anantnag, in SouthKashmir then — the public hadceased to visit government offices.But in early March, several hundredpeople from the Nai Basti neigh-bourhood went to the SpecialCommissioner’s office in Khannabaldemanding to see me. Because ofthe disturbed circumstances, I hadset up office and residence in therest house in the district headquar-ters. Mohammad Syed Shah, gener-ally known as Syed Shah, the broth-er of the separatist leader, ShabbirShah, and Muslim United Front(MUF) member of the dissolvedState Assembly, demanded to knowwhy Pandits were leaving en masseand in turn why the administrationwas doing nothing about it. Mr.Shah accused the administration of

encouraging the migration so thatthe Army would be left free tounleash its heavy artillery on allhabitations.

When I asked the delegation if itbelieved that I would be party tosuch a plan, this was their response:‘I had been kept in the dark, whilethey were privy to “secret” informa-tion’.

That the Pandits were apprehen-sive was hardly surprising, I said.Places of worship, like the one inAnantnag, where the majority went,were being used to issue threats tothem over loudspeakers. I learntlater that these inflammatory ser-mons, and their reverberating publicapplause, were audio recordings cir-culated to mosques to be playedover loudspeakers at prayer time.Local Muslims needed to reassurethe Pandits of their safety, I said.The administration would providesecurity whenever a threat to thePandits was anticipated, but howeffective it would all be woulddepend on unstinted public support,given that the residences of thePandits were scattered. The gather-ing concurred and dispersed.

I requested State GovernorJagmohan that he appeal to thePandits, in a telecast, that they stayon in Kashmir, and assure them oftheir safety on the basis of the assur-ances of the Anantnag residents.Unfortunately, the only announce-ment to this effect was that“refugee” camps were being set upin every district, and Pandits whofelt threatened could move to themrather than leave the Valley. Panditsin service who felt threatened werefree to leave their stations; theywould continue to be paid theirsalaries. I relate this story becausethe present flurry of allegationsbrings a sense of déjà vu. ThePandits — more than 1,20,000 in theearly 1980s — numbered about7,000 in the Kashmir Valley, in2005.

Talk of a return

There has been much talk of the

return of Kashmiri “migrants” totheir homes in the Valley ever sincean elected government took office inthe State in 1996. The separatistleaders, Mirwaiz Omar Farooq andShabbir Shah, have repeatedly askedthe Kashmiri migrants to return. Butevery time the issue would be raisedat the national level, Pandits in theValley would be attacked brutallyand the issue would be put on theback burner.

Any talk, therefore, of their returnwill continue to be pointless unlessthose living in the Valley are secure,physically and economically. By2003, the Pandits were scatteredacross 270 neighbourhoods in townsand villages. They soon formed anon-governmental organisation, theHindu Welfare Society, whichattempted to document the locationsand requirements of their brethren.This body managed to stop anotherexodus after 23 Pandits were killedin Nadimarg village in early 2003.At the time, the demands of theValley Pandits were simple: a housein a secure locality and jobs for 500men and women. They were gratefulfor Muslim support and the mainreason for their staying back wasalso the need to pursue a livelihood.Their only complaint: official apa-thy to their plight. Although theState Chief Secretary in 2005-2006,Vijay Bakaya, also a Pandit, waswilling to lend them a ear, the Stateadministration remained unrespon-sive.

Data and reality

On June 21, 2008, on a visit toSrinagar, I met three large groups ofPandits who had stayed on in theValley; two were from two groups ofthe Hindu Welfare Society, Kashmir(which had split by this time), andthe third, from the KPSS. I hadcalled for the meeting to urge themto come together to place theirrequirements before the governmentrather than pursue separate roadmaps.

I was presented an interim censusreport by the KPSS, and financed by

members of the Pandit diaspora,covering 62 mohallas of Anantnag,Bandipore, Baramulla, Budgam,Ganderbal, Kulgam, Kupwara,Pulwama, Shopian and Srinagar, aswell as a consolidated survey ofland. The conclusions, although sub-ject to reverification, were alarming.The number of Pandits in the Valleywas just 3,000. While there wassome record of buildings havingbeen occupied by the security forces— houses for which the ownerswere receiving rent — there was noconsolidated record of land andproperty of this group, which was ofjusticiable “munsif’ quality. Therewas no record of the propertiesattached to temples, thoseencroached upon, those leased out,or under occupation. The groupscame up with varying data on unem-ployed youth, as their job prospectswas a primary concern. On anotheroccasion, they had spoken of chil-dren castigating parents for havingstayed back in Kashmir. Sadly, Ilearnt that there were about 150families in the outlying areas whofaced penury. However, these num-bers were not an unduly cumber-some figure as far as their employ-ment potential in the State servicesin the Valley was concerned. Ireceived a final list, of 200 youngmen and women, from the HinduWelfare Society in April 2010.

Let’s get back to the present. In areply to a question asked recently inParliament, the Union Minister ofState for Home Affairs, Kiren Rijiju,said that the Centre had announced apackage of Rs.1,618.40 crore in2008 for the return and rehabilita-tion of migrant Kashmiri families,which included a grant for the pur-chase or construction of houses, ren-ovation of damaged or dilapidatedhouses, construction of transitaccommodation, and cash relief andemployment. “The package is beingimplemented by the Jammu andKashmir government and till now,one family has returned to the valleyavailing the benefit of Rs.7.5 lakhfor construction of house,” Mr.Rijiju had said in a written reply.

Further, as many as 1,474 State

government jobs had been providedto newly appointed migrant youthswho stayed in newly constructed1,010 transit accommodations insouth, east and north Kashmir.

Central package

In reply to another question, Mr.Rijiju said that at present, 60,452families of Kashmiri migrants wereregistered in the country, of whom38,119 were in Jammu, 19,338 inDelhi and 1,995 families in otherStates. Migrants mainly comprisedKashmiri Pandits and Sikhs.

This is the culmination of thePrime Minister’s successive pack-ages for the rehabilitation ofKashmiri Pandits, announced in2004 and 2008. Along with ID cardsbeing given to the migrants, thesesteps have brought them much need-ed recognition. In the first of thesepackages, 5,242 two-room tene-ments were constructed in Jammu,and 200 at Sheikhpora in Budgamdistrict of the Valley. Of these 200flats, initially constructed formigrants from the Valley, 31 havebeen allotted to local migrants with-in the Valley, including Pandits. Butit didn’t meet with success asSheikhpora is not near the town.

This was acknowledged by MuftiMohammad Sayeed in his lasttenure as Chief Minister, when hesaid that there would no longer becommunally exclusive townships. Itdoesn’t require much imagination torealise that apart from the danger ofghettoisation, such a step would ren-der the Pandit community vulnera-ble. But the present initiative, whilebuilding on the earlier ones, seemsto have been arrived at without con-sultation with the community.

Even in the unlikely event of thePandits resolving to return, the num-bers provided by Mr. Rijiju wouldscarcely overwhelm the Valley.However, what would those return-ing do? What does one do to earn aliving? In 2012, as Chairman,National Institute of Technology(NIT), Srinagar, I had visited Jammu

to request migrant teachers and staffto return to Srinagar, where the NIThad been headed by a Pandit. All ofthem rejected the idea.

Looking ahead

The answer lies in going muchfurther. What I told my Kashmiriinterlocutors from Nai Basti,Anantnag, in 1990, still holds true.The ground situation in the Valleymay not reflect a threat to returningPandits, but it is the responsibility ofKashmiris within the Valley to reas-sure those returning of their wel-come. There can be no quibblingover this.

There has been a long-standingdemand for a MinoritiesCommission in the State along thelines of the National Commissionfor Minorities (NCM), and support-ed by at least two past Chairpersonsof the NCM, including myself. TheState government has been receptivebut little has been done. This alonewill not encourage the return ofmigrants.

In the long term, a meaningfulplan for the State must include for-eign direct investment and develop-ment in the form of the much-talkedabout smart cities, which can be thenew townships. This will encourageyoung Kashmiris, many of whomhave achieved excellence in theirchosen fields, to invest and think ofa new life in Kashmir, providinglivelihoods and living space to oth-ers.

As peace returns in large measureto Kashmir, is it not time that it joinsthe rest of the country in marchingahead and in ushering in the eco-nomic revolution that all Indianslook forward to?

The new government inDelhi is reportedly plan-ning to dismantle the 5.8-

kilometre-long pilot Bus RapidTransit (BRT) corridor andreplace it with a six-lane roadinstead. Those who have fol-lowed the saga of the BRTexperiment in Delhi will not besurprised by the decision to dis-mantle the corridor despite itsapparent benefits.

The BRT corridor in SouthDelhi provides dedicated lanesfor pedestrians, cyclists, andbuses, creating an incentive forpeople to use public transportwhile also ensuring a fairer dis-tribution of space on urbanroads. A concerted policy ofencouraging public transport, inconjunction with policies topenalise the use of private vehi-cles, could have helped reduceair pollution levels in the city aswell. Instead of taking concretesteps to reduce traffic congestionand pollution in the city, the gov-ernment is planning to dismantlethe limited facilities that publictransport users enjoy in this city.

Since the corridor’s inaugura-tion in 2008, it has faced stiffopposition from the car-owningelite. As a result, the project hasnever been expanded, despiteinitial plans to construct a 100kilometre network of BRT corri-dors in the city. In recentmonths, Saurabh Bhardwaj,MLA, Aam Aadmi Party, hasbeen quite active in trying to getthe bus lanes dismantled. He hasargued that while BRT corridorsare desirable in theory, this cor-ridor was poorly designed andtherefore unable to meet itsobjectives. While some of thedesign criticisms advanced byhim are valid, none of them log-ically lead us to the conclusionthat the Delhi BRT project can-not be salvaged and made towork.

The criticisms

The most common point ofcriticism has been that the roadis too narrow and has too muchvehicular traffic to be able toafford two dedicated lanes for

buses. Assuming that vehiculartraffic is indeed slower when theBRT is operational (which is notalways true), we must recognisethat making the additional laneavailable for vehicular traffic isonly a temporary solution to theproblem of traffic congestion.The root cause of congestion isthe increasing use of cars. Busesalong this stretch carry twice thenumber of people as cars do,while occupying much less roadspace. Public transportation isthe long-term solution to theproblem of traffic congestion,and the BRT encourages it.

The other criticism is that theDelhi BRT does not follow thebest standards of BRT planning.The Delhi BRT is often com-pared unfavourably to the

“closed” Ahmedabad BRT corri-dor, which does not allow citybuses to enter the BRT lane.Such a BRT system allows bettercontrol over the flow of dedicat-ed BRT buses, and is able to pre-vent any fluctuation in the num-

ber of buses entering the corri-dor at a given point in time.While these are real advantagesof a “closed” BRT corridor, italso denies a large share of bususers the benefit of using the buslane. It is worth noting that pre-cisely because the Delhi BRT is“open” and more inclusive, itcaters to more than five timesthe commuters of theAhmedabad BRT. Even if busesin the Delhi BRT run at a slowerspeed on average, the overallimpact is much greater, and thebenefits more evenly distributedamong various classes.

It is true that buses in the DelhiBRT corridor have not been ableto attain the speeds commonlyachieved by BRT systems else-where. However, this is primari-

ly because cars are not finedwhen they enter the BRT lane.Any transportation system con-sists not just of physical infra-structure — roads, traffic sig-nals, bus stops, etc — but also aninstitutional infrastructure that

makes the system work asintended. There wasn’t enoughcoordination between the DelhiIntegrated Multi Modal TransitSystem Ltd. (DIMTS), theorganisation in charge of design-ing, constructing, and operatingthe BRT corridor; the DelhiTransport Corporation (DTC),which operates the buses; andthe Delhi Traffic Police, whichhas the authority to enforce traf-fic rules.

No institutional support

The attitude of the trafficpolice has been bizarre. Fromthe inception of the project, thepolice has flatly refused toenforce traffic rules on the BRTcorridor. They have not prevent-ed private vehicles from entering

the bus lane, or fined driverswho flouted the rules. While theDIMTS was forced to hire traffic“wardens” for this role, theywere ineffective because theydid not have the authority to fineor punish drivers who violatedthe rules. Little was done to pre-vent the parking of cars on foot-paths, or car drivers from misus-ing cycle lanes. Pedestriancrossings were often unmanned,and motorists who terrorisedpedestrians trying to reach thebus stop went scot-free. In anycase, the traffic police has neverseen the protection of the rightsof way of buses, cyclists andpedestrians as a part of its job.

None of these institutionalfailures are likely to be mitigatedby improvements in the physicaldesign of the BRT corridor,either in this location or else-where. Fundamentally, theypoint to a lack of political lead-ership, and more broadly to theindifference of both civil andpolitical society towards themarginalised classes of com-muters who stand to benefit themost from a functioning BRTsystem. It is no surprise to see online retailer Flipkart pullingout of Airtel Zero, the controversial plan offered byIndia’s leading telecom provider Bharti Airtel to pro-

vide its subscribers free access to select websites.Flipkart had to contain the fallout after Airtel Zero wasseverely criticised by the proponents of Net neutrality,the principle that all Internet traffic has to be treatedequally. The e-retailer faced a severe backlash on socialmedia over its decision to join Airtel, and even had itsapp down-rated on app stores by die-hard Net neutralityadvocates. For all the pro-Net neutrality utterances itmakes now — ironically, Airtel also does so — what isstill a surprise is what made it join the platform in thefirst place. Flipkart did so disregarding the wave of sup-port for Net neutrality that has been sweeping acrossIndia following the recent publication of a consultationpaper on it by the Telecom Regulatory Authority of India.Politicians, celebrities and the common person alike havejoined the cause. Did it not occur to Flipkart that its ownsuccess until now could not have been possible but for anopen Internet? Was it pushed into such a deal by privateequity investors who have pumped in a few billion dol-lars into the business in recent years? Or was it embold-ened by the relative silence of Net neutrality supporterson a similar scheme, which goes by the name of inter-net.org? Facebook introduced internet.org a few monthsago to subscribers of Reliance Communications. AirtelZero and internet.org are very similar schemes. Airtelwould know; it is Facebook’s partner in Africa. The onlydifference is in positioning. Internet.org is presented asan attempt to make the Internet available to those whodon’t have access to it. There is no denying that many inIndia still do not have Web access. But the actors in inter-net.org are all commercial enterprises, as they are inAirtel Zero. The list includes Facebook, RelianceCommunications, and many of the nearly three dozenIndian content and news sites, some of which have beenvocal in their support for Net neutrality. Many of theirbusiness models are based on their ability to accumulatebigger audiences and more readers. Such free plans, alsocalled zero-rating plans wherein the subscriber getsaccess to select sites, are deemed to be against Net neu-trality and banned in countries such as Chile. Whatevermade it join Airtel Zero in the first place, Flipkart is nowmaking the right redemption noises, leaving Airtel in thelurch. The dramatic pullback has given supporters of Netneutrality more ammunition, much more than would havebeen the case had Flipkart not decided to join Airtel Zeroin the first place.

"However, to our shock andsurprise, Mr P C Chacko, whowas earlier the chairman of theJoint Parliamentary Committee(JPC) for spectrum issue andsubmitted his report beforeParliament, is now commentingon the proceedings of the otherforum, namely the trial court,"Raja said.

He said Chacko did not callhim before the JPC for deposi-tion despite several requestsfrom him and leaders of variousparties and assurances from him.

"Again, the man who did nothave the courage to call mebefore the JPC for my deposi-

tion..... Is now attempting tointerfere in other ways with theproceedings of the trial court tomislead the media and publicwhich is totally untenable,uncivilised and unwarranted," hesaid.

Yesterday Chacko had said thatthe CBI statement, which includ-ed points like Raja misled thethen Prime Minister ManmohanSingh, "is a fact".

Chacko, who headed the JointParliamentary Committee intothe 2G spectrum allocation issue,said that there were "deviations"to the first come first served prin-ciple, a point that was also madeby the prosecutor.

devised by a five-judges panel andadopted by the Supreme Court wayback in 1999, on taking "suitableremedial" actions against judges,accused of misconduct and impro-priety, of the apex court and thehigh courts was today put in publicdomain. The apex court registryput the report of the committee onits website in pursuance of a direc-tion issued by the court whiledeciding a sexual harassment com-plaint of a former woman judicialofficer against a sitting judge ofthe Madhya Pradesh High Court.

The 1997 report of the panel,consisting of SC judges, Justices S

C Agrawal, A S Anand, and S PBharucha and two senior-mostChief Justices of High Courts, P SMisra of the Andhra Pradesh HighCourt and D P Mohapatra of theAllahabad High Court, was adopt-ed with some changes by theSupreme Court in its full courtmeeting on December 15, 1999.

The report prescribes three dif-ferent sets of procedures for takingaction on complaints againstjudges of the High Courts, Chiefjustices of HCs and judges of theSupreme court respectively.

The procedures to deal withcomplaints against HC judges saysthat if a complaint is received bythe Chief Justice of the High court

concerned then "he shall examineit". "If it is found by him (CJ) thatthe complaint is of a serious natureinvolving misconduct or impropri-ety, he shall ask for the responsethereto of the judge concerned,"the report said, adding if the CJ issatisfied that no further action isneeded, then he shall close the pro-ceedings and inform the CJIaccordingly. If the Chief Justice isof the opinion that the complaintneeds "deeper probe", then he shallforward to the CJI the complaintalongwith the response of thejudge concerned and his own com-ments.

The panel further suggests theprocedures when the CJI either

directly receives the complaint orthey are forwarded by thePresident against a HC judge.

"If it is found by him (CJI) that itis either frivolous or directly relat-ed to the merits of the substantivedecisions in a judicial matter ordoes not involve any serious com-plaint of misconduct or impropri-ety, he shall file it," it said.

If CJI is of the view that it needsprobe then he "shall forward" thecomplaint to the Chief Justice ofthe High court for further com-ments and the same procedurewould be followed as in the casewhen the complaint is firstreceived by the CJs of the HighCourts.

At a high-level meeting, theHome Ministry reviewed mobile andtelecom connectivity for the upcomingAmarnath Yatra 2015 and orderedensuring better connectivity during thetwo month-long pilgrimage beginningJuly 2 as connectivity was crucial forthe conduct and regulation of the pil-grimage. "BSNL is also working onaugmentation of VSAT capacity andincrease in bandwidth. BSNL will alsoenhance number of base transceiverstations and their configuration to takecare of congestion where pilgrims willbe halting for night stay or en-route.

identified camps located at the holycave, Panjtarni, Sheshnag and Sangamas the camps where satellite phonesand VASAT connectivity is crucial forthe conduct and regulation of theYatra," an official release said.

NEW DELHIThe government owes around Rs 600

crore to Air India for using its aircraft fortravel of VVIPs. The Ministry of CivilAviation has taken up the issue with vari-ous ministries regarding the pendingamount related to the services of Air Indiaaircraft availed for such VVIP travel.

According to official sources, Ministriesof Home Affairs and External Affairs,among others, have accrued "Rs 500-600crore" dues till March 31.

"These are dues to be paid to Air Indiafor using aircraft for travel of VVIPs," asource said. Air India is surviving on abailout package approved in 2012.

The erstwhile UPA dispensation had inApril 2012 approved Air India's turn-

around plan, with a committed publicfunding of Rs 30,231 crore, staggered overa period of nine years, with some specificriders.

Besides a debt of Rs 40,000 crore, theairline had reported losses to the tune ofRs 5,388 crore in FY-14 as against Rs5,490 in the fiscal 2012-13.

After a streak of losses, Air India hadreported a net profit of Rs 14.6 crore inDecember last year, from a loss of Rs168.7 crore in the corresponding period of2013.

India's biggest onlinecab-hailing service Olahas raised $400 million

from investors led byRussian billionaire YuriMilner's DST Global, thecompany said onThursday.

The company hadreported $314 million(roughly Rs. 1,958 crores)of this investing round in afiling to the Registrar ofCompanies earlier in themonth. Other participatinginvestors in the Series Eround of funding includedGIC, Falcon Edge Capitaland existing investorsSoftBank Group, TigerGlobal, Steadview Capitaland Accel Partners US.

Of the overall $400 mil-lion (roughly Rs. 2,495crores) announced, $100million (roughly Rs. 623crores) would go towardsexpansion and growth ofits TaxiForSure arm, Olasaid in a statement. Thecompany bought rivalTaxiForSure for $200 mil-lion in March as it com-petes with its domesticrivals and the emergingchallenge of fast-growingUnited States-based rivalUber. The money will alsogo towards expansion ofits Ola brand as it plans tonearly double its footprintto 200 cities by the end ofthe year, the company said.Ola added it has expandedto 100 cities in the currentyear from 10 cities a yearago, with the acquisition ofTaxiForSure also helpingaugment its scope.

The company statementadded the "additionalinvestment will allow Ola

to go deeper into smallercities to build personaltransportation ground-up.Ola has already seentremendous growth in tier2 & 3 cities owing to verylimited transportationoptions that currentlyexist. There is a largeopportunity waiting to beunlocked, to transform theecosystem from within.Ola will help drivers fromthese small towns turnentrepreneurs, creatinglasting social and econom-ic impact for them, while arobust transportation utili-ty is created for the citi-zens."

Rajasthan Royals beat SunRisersHyderabad by six wickets to notch up theirfourth consecutive win in this edition ofthe IPL cricket tournament here onThursday.

Chasing a modest 128 for a win, thetable-toppers made heavy weather of therun chase, achieving the target on the lastdelivery of the match.

The SRH bowlers did well to take thematch thus far but Rahane's 56-ball 62proved to be the difference between thetwo sides.

Man-of-the-match Rahane, who regis-tered his first half-century of the this sea-son, and Sanju Samson (26) worked wellfor their 64-run opening stand before a fewwickets made the match exciting in theend.
