D. PUBLIC CONVENIENCE AND NECESSITY EVALUATION (SEE ATTACHED RESPONSE TO SECTION D & E)

The City of Los Angeles is very concerned if a new request to sell alcohol is subject to one of the conditions below. There is a strong likelihood that the City will deny your "public convenience or necessity" application if one of the above listed conditions apply to your site. (It is strongly suggested that you contact your Council Office and discuss your project. If the Councll Office does not oppose your project, you should then check with your local area police vice unit as well as the Planning Department Public Counter at (213) 482-7077 for the determination of whether the proposed site is within a Specific Plan area, and the Community Redevelopment Agency (CRA) project staff at (213) 977-1682 or 977-1665, to determine if your site is in a CRA Project Area. If any of the five conditions listed below apply to your site, you should carefully consider if you want to file for a Public Convenience or Necessity finding.

1. The proposed site is in an area with a long-term level of undue concentration of alcoholic beverage outlets.

2. The geographic area is the target of special law enforcement activity, i.e., police task force is working on reducing vice in the area, or eliminating juvenile crime (such as cruising or graffiti) or gang activity.

3. The proposed site is in close proximity to sensitive uses, including schools, parks, churches, youth activities, homeless shelters, mental health or alcohol or drug treatment centers.

4. The geographic area has elevated levels of alcohol-related crimes, including but not limited to: public intoxication, driving under the influence, assault, vandalism, prostitution, drug violations, loitering.

5. The proposed site is located in a Specific Plan or Community Redevelopment Agency Project area which specifically includes a policy to control future alcoholic beverage sales.

E. If the project site is not subject to one of the above criteria, your project will be evaluated by the City Council with consideration given to the following possible benefits and detriments to the community:

1. Possible Benefits

The City Council will evaluate these factors and make a decision on the overall merits of your request Therefore, you should answer below as to why you believe any of these above listed beneficial or detrimental conditions apply to your project and provide any documented proof to support your belief:**

The ARCO gas station has been at the site since 1996 with the packaged food sales added

in 1986 and the mini-mart added in 1990. Mr. Sam Ourfalian has operated the business since

October 19, 2010. The property is well maintained with ample lighting of the exterior,cameras

inside and outside of the building and daily cleaning of the propertv Ibere are nn_a]cohol _

establishments within 1000 feet of the subject proRerty. The owner's representati1re met

on two occasions with LAPD Devon§hire Vice and no problems weLe raised with this business.

Vice Officer Glassford of the Devonshire Division of LAPD indicated at the public hearing

for the conditional use application that the area has a very ]ow crime rate

The Northridge West Neighborhood Council did not object to the conditional use application

which was approved on November 30, 2011.

If any of the five conditions listed below apply to your site, you should carefully consider if you want to file for

Public Convenience or Necessity finding:

1. The proposed site is in an area with long-term level of undue concentration of alcoholic beverage outlets.

There are no alcoholic establishments within 1000 feet of the site.

3. The proposed site is in dose proximity to sensitive uses, including schools, parks, churches, youth

activities, homeless shelters, mental health or alcohol or drug treatment centers.

Within 1000 feet of the site there are two sites with sensitive uses identified by L.A. Mapping Service:

1. Calahan Street Elementary School18722 Knapp Street, Northridge 91324.

2. Walden Family Services, 18860 Nordhoff Street, Suite 200, Northridge 91324

4. The geographic area has elevated levels of alcohol-related crimes, including but not limited to: public

intoxication, driving under the influence, assault, vandalism, prostitution, drug violations, loitering.

According to the State of California Department of Alcoholic Beverage Control states that the location is NOT

a high crime reporting district.

Vice Officer Glassford of the Devonshire Division of LAPD indicated at the public hearing for the conditional

use application that the area has a very low crime rate.

5. The proposed site is located in a Specific Plan or Community Redevelopment Agency Project area which

specifically includes a policy to control future alcoholic beverage sales.

seeking gas and staples such as candy, coffee, milk, bread, soda, jelly, butter, paper goods, etc., without

the necessity of stopping at a super market for small quantity items.

d. Result in an aesthetic upgrade to the neighborhood (in what exact way}

The property is well maintained, with ample exterior lighting, cameras inside and outside of the building

and daily cleaning of the property.

e. Contribute to the long term economic development (how)

The existing gas station and mini market provide a stable source of sale and business taxes to the City of

Los Angeles.

f. Provide a beneficial cultural/entertainment outlet {specify)

Not applicable. This is not a restaurant, cocktail lounge or an entertainment outlet.

Age 35-49: 912

Age 50-64: 777

65 & older: 437

The above data represents 78% of the census tract population.

Ninety percent (90%) of the customers are over the age of 21 years old.

3. With regard to the operation of the proposed business explain:

a. The method of business operation: (large volume of alcohol to food sales, "late" hours (after

midnight), high% unskilled (no ABC training class} staff, high %of underage (under 21) staff, etc.)

This is a gas station and mini market. The hours of operation are from 6:00AM to midnight and the

proposed sales of alcohol are from 11:00 AM - 11:00 PM. Alcohol sales will not be the primary business.

The primary business is a gas station and a mini market.

b. Would the business duplicate a nearby business already in existence?

This business does not duplicate a nearby business and there are no alcoholic establishments within

1000 feet of this site.

c. Other non-alcohol sales business options available so alcohol does not have to be sold, e.g., more

specialty products, broader range of items like fresh meats or fruits and vegetables, etc.

The alcohol sales will not be the primary business. The primary business is a gas station and a

convenient market.

Pursuant to Los Angeles Municipal Code Section 12.24-W, 1, I hereby APPROVE:

a Conditional Use. Permit authorizing the sale and dispensing of beer and wine only for off-site consumption in conjunction with the operation of a fueling station and mini-mart,

upon the following additional terms and conditions:

1. All other use, height and area regulations of the Municipal Code and all other applicable government/regulatory agencies shall be strictly complied with in the development and use of the property, except as such regulations are herein specifically varied or required.

2. The use and development of the property shall be fn substantial conformance with the plot plan submitted with the application and marked Exhibit "A", except as may be revised as a result of this action.

3. The authorized use shall be conducted at all times with due regard for the character of the surrounding district, and the right is reserved to the Zoning Administrator to impose additional corrective Conditions, if, in the Administrator's opinion, such Conditions are proven necessary for the protection of persons in the neighborhood or occupants of adjacent property.

4. All graffiti on the site shall be removed or painted over to match the color of the surface to which it is applied within 24 hours of its occurrence.

5. A copy of the first page of this grant and all Conditions and/or any subsequent appeal of this grant and its resultant Conditions and/or letters of clarification shall be

printed on the building plans submitted to the Zoning Administrator and the Department of Building and Safety for purposes of having a building permit issued.

6. The applicant shall defend, indemnify and hold harmless the City, its agents, officers, or employees from any claim, action, or proceeding against the City or its agents, officers, or employees to attack, set aside, void or annul this approval which action is brought within the applicable limitation period. The City shall promptly notify the applicant of any claim, action, or proceeding and the City shall cooperate fully in the defense. If the City fails to promptly notify the applicant of any claim action or proceeding, or if the City fails to cooperate fully in the defense, the applicant shall not thereafter be responsible to defend, indemnify, or hold harmless the City.

7. The subject authorization to sell and dispense alcoholic beverages shall be for a five (5) year time period. Said time period to begin on the effective day of this action shown elsewhere in the report. If the owner of the I arid wishes to continue operation as granted herein, he must file a new application with the Office of Zoning Administration. Said application must be filed no later than three months prior to the expiration of this grant and said application must be made on the appropriate forms and fees paid.

8. Approval of Plans Review. At any time during the effective period of this grant, should documented evidence be submitted showing continued violation of any condition of this grant, resulting in an unreasonable level of disruption or interference with the peaceful enjoyment of the adjoining and neighboring properties, the Zoning Administrator reserves the right to require the applicant to file for a plan approval application together with associated fees, the purpose of which will be to hold a public hearing to review the applicant's compliance with and the effectiveness of these Conditions. The applicant shall prepare a radius map and cause a notification to be mailed to all owners and occupants of properties within a 500-foot radius of the property, the Council Office, and the Los Angeles Police Department corresponding Division. The applicant shall also submit a summary and any supporting documentation of how compliance with each condition of this grant has been attained. Upon this review the Zoning Administrator may modify, add or delete conditions, and reserves the right to conduct this public hearing for nuisance abatement/revocation purposes. (A standard used in the Office of Zoning Administration)

9. Authorization.

a. Beer and wine only for off-site consumption in conjunction within a mini-mart and fueling station. Cessation of the fueling station shall also require the same of the mini-mart.

b. Hours of operation from 6 a.m. to midnight daily with sales of alcohol from 11 a.m. to 11 p.m. daily. (Volunteered in the Application)

10. Entertainment/Other Services. Neither video games nor pool tables are to be available on the subject property. (Volunteered in the Application Response o)

11. Environmental Mitigation Measures. Comply with the environmental mitigation measures of Mitigated Negative Declaration No. ENV 2011-0893~MND, attached

Pursuant to California State Public Resources Code Section 21081.6, the City shall monitor or require evidence that any mitigation conditions are implemented and maintained throughout the life of the project and the City may require any necessary fees to cover the cost of such monitoring.

12. Lighting. (Commercial Comer Development Minimum Operating Standard)

a. The parking areas shall be illuminated in order to make easily discernible the appearance and conduct of all persons on or about the property.

b. All lighting shall be shielded and directed onto the site and no floodlighting shall be located so as to shine directly onto any adjacent property. This condition shall not preclude the installation of low-level security lighting.

13. Maintenance: The subject property, including any associated parking facilities and abutting streets, sidewalks and alleys, shall be maintained in a neat and attractive condition at all times and shall be kept free of trash and debris on a daily basis.

14. Noise.

a. Regulating noise shall comply with the City of Los Angeles Noise Ordinance Nos. 144,331 and 161,571, and any subsequent ordinances, which prohibit the emission or creation of noise beyond certain levels at adjacent uses unless technically infeasible.

b. Parking lot cleaning and sweeping, and trash collections shall occur no earlier than 7 a.m., nor later than 8 p.m., Monday through Friday, and not earlier than 10 a.m., nor later than 4 p.m. on Saturdays. There shall be no parking lot cleaning or sweeping or trash collection permitted on Sundays or holidays. (Commercial Corner Development Minimum Operating Standard)

15. Sale of Alcoholic Beverages.

a. Advise. The applicant is advised that the subject permit is a land use permit, not a license for sale of alcohoL The conditions and requirements of this permit apply to the subject facility. The conditions shall be complied with in addition to any conditions or requirements imposed by the Department of Alcoholic Beverage Control, Los Angeles Police Department, or any other licensing or permit agency. Noncompliance with the subject conditions could result in revocation of the subject use permit. Any change of conditions or change in the mode or character of the authorized use requires approval of the Zoning Administrator.

b. Training. Within six months of the effective date of the determination, operators, managers, and all employees selling alcohol to patrons shall enroll in and complete a Standardized Training for Alcohol Retailers (STAR), which is sponsored by the Los Angeles Police Department. This training shall be completed by all new employees selling alcoholic beverages within four weeks of employment and shall be completed by all employees once every 24 months for those who sell alcoholic beverages. shall be recorded and maintained by the grantee and submitted to the City Planning Department upon request.

c. The quarterly gross sales of alcoholic beverages shall not exceed the 25 percent of the gross sales of during the same period. Said records shall be kept no less frequently than a quarterly basis and shall be made available to the Planning Department upon demand. A signed statement from a Certified Public Accountant may be eligible for consideration. (Volunteered in the Application Response x, subsequently modified by the project proponent, modified by the Zoning Administrator)

d. Method of Sale.

1) Beer shall not be sold in less than quantities provided in manufacturer's packages. Wine coolers shall not be sold in units of less than a four-pack of manufacturer's package. Wine shall not be sold in containers less than 750 ml of manufacturer's package.

2) Single sales of beer or malt beverages in quantities of 22 oz., 32 oz., 40 oz. or similar size containers are prohibited.

3) No alcohol/high energy drinks, such as those frequently marketed under the brand names 4 Loko and Joose, shall be sold.

4) No malt beverages or malt beverage products shall be sold with an alcohol content of 16% alcohol by volume or greater. (Application responses)

5) No single cups, glasses or other similar containers shall be sold. Such items may be available in packages consistent with the standards of a full service store which sells houseware and kitchen items. (Application response f)

6) Electronic age verification device(s) which can be used to determine the age of any individual attempting to purchase alcoholic beverages or tobacco products shall be installed on the premises at each point­of-sale location. These device(s) shall be maintained in an operational condition and all employees shall be instructed in their use prior to the sale of any alcoholic beverage.

7) The beer and wine which is stored in the refrigerated areas will be locked up between the hours of 11 p.m. to 11 a.m. and alcoholic beverages shall not be accessible from adjacent cooler or displays. (Volunteered in the Application, modified by the Zoning Administrator)

8) Any further expansion of the herein authorized conditional use exception involving the subject use or the creation of a new establishment within the grantee's ownership used in connection with the selling or serving of alcoholic beverages shall only be permitted after the filing of approval of the proper application for this purpose.

16. Security

a. All windows shall be maintained free of signs and other materials which inhibit views into the facility.

b. No pay phones shall be installed nor maintained on the subject property outside the view and control of the applicant/operator.

c. Security cameras shall be installed interior and exter·ior providing views throughout.

d. An employee of the site shall observe the exterior of the site to ensure no loitering occurs.

17. Any further expansion of the herein authorized conditional use exception involving the subject use or the creation of a new establishment within the grantee's ownership used in connection with the selling or serving of alcoholic beverages shall only be permitted after the filing of approval of the proper application for this purpose.

OBSERVANCE OF CONDITIONS -TIME LIMIT ~ LAPSE OF PRIVILEGES -TIME EXTENSION

All terms and Conditions of the approval shall be fulfilled before the use may be established. The instant authorization is further conditional upon the privileges being utilized within two years after the effective date of approval and, if such privileges are not utilized or substantial physical construction work is not begun within said time and carried on diligently to completion, the authorization shall terminate and become void. A Zoning Administrator may extend the termination date for one additional period not to exceed one year, if a written request on appropriate forms, accompanied by the applicable fee is filed therefore with a public Office of the Department of City Planning setting forth the reasons for said request and a Zoning Administrator determines that good and reasonable cause exists therefore.

TRANSFERABILITY

This authorization runs with the land. In the event the property is to be sold, leased, rented or occupied by any person or corporation other than yourself, it is incumbent upon you to advise them regarding the conditions of this grant.

VIOLATIONS OF THESE CONDITIONS, A MISDEMEANOR

Section 12.29 of the Los Angeles Municipal Code provides:

"A variance, conditional use, adjustment, public benefit or other quasi-judicial approval, or any conditional approval granted by the Director, pursuant to the authority of this chapter shall become effective upon utilization of any portion of the privilege, and the owner and applicant shall immediately comply with its Conditions. The violation of any valid Condition imposed by the Director, Zoning Administrator, Area Planning Commission, City Planning Commission or City Council in connection with the granting of any action taken pursuant to the authority of this chapter, shall

constitute a violation of this chapter and shall be subject to the same penalties as any other violation of this Code."

Every violation of this determination is punishable as a misdemeanor and shall be punishable by a fine of not more than $1,000 or by imprisonment in the county jail for a period of not more than six months, or by both such fine and imprisonment.

APPEAL PERIOD d EFFECTIVE DATE

The applicant's attention is called to the fact that this grant is not a permit or license and that any permits and licenses required by law must be obtained from the proper public agency. Furthermore, if any Condition of this grant is violated or if the same be not complied with, then the applicant or his successor in interest may be prosecuted for violating these Conditions the same as for any violation of the requirements contained in the Municipal Code. The Zoning Administrator's determination in this matter will become effective after DECEMBER 15, 2011, unless an appeal therefrom is flied with the City Planning Department. It is strongly advised that appeals be filed early during the appeal period and in person so that imperfections/incompleteness may be corrected before the appeal period expires. Any appeal must be filed on the prescribed forms, accompanied by the required fee, a copy of the Zoning Administrator's action, and received and receipted at a public office of the Department of City Planning on or before the above date or the appeal will not be accepted. FINDINGS OF FACT

After thorough consideration of the statements contained in the application, the plans submitted therewith, the report of the Zoning Analyst thereon, the statements made at the public hearing on October 14, 2011, all of which are by reference made a part hereof, as well as knowledge of the property and surrounding district, I find that the requirements for

authorizing a conditional use permit under the provisions of Section 12.24-W have been established by the following facts:

BACKGROUND

The site is a level, square, commercial corner lot, with an approximate 130-foot frontage on the north side of Nordhoff Street and a 125-foot frontage on the east side of Wilbur Avenue. The property is developed with a one-story mini-mart building located near the center of the site with an attached gas canopy and eight gas pumps on the south side of the mini-mart building facing Nordhoff. Four driveway aprons provide access to the site (two on Nordhoff and two on Wilbur) and circulation is provided around the site. A combination block and wood fence is located along the north and east property lines which adjoin single-family properties. The east adjoining property has a row of tall cypress trees along the shared property line and the north adjoining property has mature trees and landscaping along most of the shared property line. Parking spaces are located along the west side of the mini-mart building and along the east property line.

The surrounding area consists predominately of single-family dwellings and three commercial zoned corners at Nordhoff and Wilbur including the subject site. Further east is a 200-foot wide (north/south) strip of land zoned PF used for transmission lines and plant nurseries. The north and east adjoining properties are zoned RS-1 and are developed with single-family dwellings. The dwellings all have their rear yards along Nordhoff or Wilbur Avenue and front yards on Crebs Avenue with side yards adjoining the subject property. The south abutting properties, across Nordhoff Street, are zoned C2-1 VL and [Q]CR-1, and developed with a two-story Spanish style office building (built in 2001) with an asphalt parking lot around the building. The remaining CR zoned lots are mostly vacant/undeveloped except for one lot with a single-family dwelling (built in 1949). The southwest abutting corner property is zoned RE9 with remaining oversize lots zoned RA-1 , consisting of approximately 10 acres, and developed with a few single-family dwellings (built in the 1920's) with a portion of the property used for a cultural arts events (dance/theater). The west abutting property, across Wilbur Avenue, is zoned QCR-1VL and developed with a two-story multiple office building complex (built in 1978) with an asphalt parking area to the west and north.

Nordhoff Street, adjoining the property to the south, is a Major Highway, dedicated to a width of 100 feet and improved with sidewalk, curb, and gutter.

Wilbur Avenue, adjoining the property to the west, is a Secondary Highway, dedicated to a width of 90 feet, and improved with sidewalk, curb, and gutter.

Previous zoning related actions on the site include:

Case No. ZA 99-0017(CUB} -·On April 8, 1999, the Zoning Administrator denied a Conditional Use to permit the sale and dispensing of alcoholic beverages (beer and wine only) for off-site consumption in conjunction with an existing gas station and convenience store in the C2-1VL Zone.

Case No. ZA 90-0450(CUB)- On September 12, 1990, the Zoning Administrator denied a Conditional Use to permit the sale and dispensing of alcoholic beverages (beer and wine only) for off-site consumption in conjunction with a 1,300 square-foot mini-market, as part of a gasoline service station on a site located in the C2-1VL (commercia!) Zone, with said market operating 10 a.m. to 10 p.m., Monday through

Sunday, seven days a week. The decision was appealed and sustained by the Board of Zoning Appeals under Case No. BZA 4282.

Case No. CPC 2000-2931 (SP}(TOD) - On November 15, 2000, the CPC disapproved the proposed Northridge Transit Oriented District (TOO).

Case No. CPC 86-0253(GPC)- On September 12, 1988, Ordinance No. 163,915-SA750 became effective, changing the height district from 1 to 1 VL.

Building and Safety Permit No. 07016-20000-2357 4 - Issued April 21, 2008, for a change of use from a gas station/retail to a take-out restaurant. The permit was extended to December 1, 2009.

Certificate of Occupancy- Issued December 31, 1991, add 3.5' x 28' one-story to existing 28' x 31' building to create a 28' x 34.5' change to use to retail (food) auto service station.

Certificate of Occupancy -Issued January 5, 1967, for a one-story 28' x 43' service station, canopy, and minor repairs.

PUBLIC HEARING

On September 13, 2011, notice of the public hearing was mailed to property owners/occupants within a 500-foot radius and to other interested parties. On September 21, 2011, the notice was executed to be published. The public notice was posted on the site on September 26, 2011.

At the time of preparation of the Project Planner's Report, no public agency or anyone from the general public submitted correspondence. Prior to the public hearing, staff ofthe Office of Zoning Administration conducted a site visit of the property and observation of the immediate area. The following information was obtained from the information presented in the application and research of the Project Planner:

The applicant seeks a Conditional Use Permit for the sale of beer and wine for off­site consumption. Case History shows previous requests in 1990 and 1999 were denied.

According to the applicant:

"The convenience market and gas station have been operating since 1987 and provide an essential service to the immediate neighborhood. The sale of alcohol will not result in exterior changes, increase the floor area, or change hours of operation. The use will remain as a convenience market and gas station to service the immediate neighborhood. . . . . There are no alcohol establishments within 1;000 feet ofthe subject property."

The following operational information was provided:

$ Hours of operation- gas station and convenience store will be open from 6 a.m. to midnight. Alcohol sales will be from 11 a.m. to 11 p.m.

~~~ There are 8 parking spaces on site of which 5 spaces are required. ® There will be a maximum of "four employees" on site at any given time.

e There are temporary window displays advertising the products available in the store.

• "Beer is available" in single cans and bottles. Wine will be sold in less than one liter containers.

• Security guards are not being provided in the "current liquor store" nor are they necessary because of the nature of the business and location of the liquor store and market.

e Security cameras are installed in the interior and exterior of the building.

Project Planner Observations

It appears answers to questions (emphasized in quotation marks above) may have been copied from a previous request not associated with the applicant's business.

Staff reviewed the submitted justification, plans, and conducted a site visit on July 12, 2011, at approximately 9 a.m. (part of environmental review site visit).

Staff observations were consistent with the submitted site and floor plan. The following items staff observed may need more discussion:

- The floor plan indicates beer and wine product will be located in three cooler doors to the east of the front entra nee. A better location may be to the rear of the store to deter theft.

- Trash and debris (empty oil containers, cups, etc.) was observed along the east side of the property (by the parking spaces) in a small dirt area between the

cinderblock wall and the wood fence (see staff photos). Daily grounds keeping should be considered.

- No bike rack was observed which would otherwise be considered for a commercial corner project.

- There are security cameras and TV monitor inside the market but only one camera was observed outside. The exterior of the building should have security cameras to cover the entire site.

~ A wood fence enclosure is located at the rear northeast corner of the site, adjoining two single-family properties. Staff was unable to determine what was inside (not identified on site plan) however, it appears to be an incinerator of some type because it looks like a smokestack. More information may be needed to ensure such use/location is mitigated to reduce potential adverse impacts (no permit was found). Similarly, the trash enclosure is located in the same corner, which appeared clean and with no odors, but could result in noise impacts to the adjoining single~family properties.

- A pay phone was observed (and shown on plans) along the east side of the property. Removal should be considered to reduce potential noise impacts and loitering.

- Temporary signage and stationary metal bars (see staff photos) tend to detract from the overall appearance of the site.

Wilbur Avenue and Nordhoff Street in this area appear to be used predominately for pass through traffic, such as commuter, Northridge Mall or CSUN traffic. Although the site does adjoin a single-family neighborhood to the north, off of Dearborn Avenue and Crebs Street, access to the site does not seem convenient for pedestrians in that neighborhood, as there is not direct access, therefore it is at least

500 to 1,000 feet away. Similarly the neighborhood to the northwest and to the south would have to cross major streets with fast moving traffic. Aerial photos show that within 500 feet of the site, there are approximately 26 to 30 homes, thus there appears to be a fairly limited market in this neighborhood. More discussion as to how the sale of beer and wine serves the immediate neighborhood, such as support letters from the immediate neighborhood, may be helpful.

Since case history indicates the same owner had applied in 1999 for the same request, information such as what has changed at this location since that time may be helpfuL Also, does the applicant own other mini-marts that sell alcohol and if so, where, etc.

Based on staff research and submittal information, there are no active alcohol establishments within a 1 ,000-foot radius of the site. It should be noted, a Letter of Public Convenience and Necessity will be required before ABC can issue a license due to the high crime and overconcentration for the subject police reporting district and census tract, respectively.

Additional crime data review indicates the following:

Subject Reporting District No. 1785 includes a portion of the CSUN campus which may account for the high number of "Disturbing the Peace" incidents where most districts in the Devonshire Division reported 0 to 2 incidents. Crime data from 2008 and 2009 indicates a decrease in certain types of arrests. For example, 2010 OWl's were 6 compared to 17 in 2008 and in 2009 (same

amount for each year). Other arrests tend to fluctuate, such as Public Drunkenness in 2008 was 6 and 9 in 2009 compared to 5 in 201 0. Drug related (Narcotics) arrests appear to be increasing as follows: 18 in 2008, 23 in 2009, and 26 in 2010. 2010 Part I Crimes came to 173 and Part II Arrests at 107. The greatest amount of Part I activity included 59 B/T Auto (believe this is stealing items from cars) and 49 Other Theft (other than auto theft), which citywide averages is 22 for both categories.

LAPD input may be helpful to determine if there is a specific problem area in this reporting district or if the crime activity is spread out. The subject application was faxed to LAPD on July 11, 2011. No input has been received regarding the subject request.

Additional Information on Case No. ZA 99-0017(CUB}- On AprilS, 1999, the Zoning Administrator denied a Conditional Use to permit the sale and dispensing of alcoholic beverages (beer and wine only) for off-site consumption in conjunction with an existing gas station and convenience store in the C2-1VL Zone. The applicant then was noted as the new owner (same as subject applicant) who stated they are upgrading the entire site (landscaping/lighting) and have resolved trash/litter issues since they took over the business. Concerns raised at that time are similar to the previous denial below, such as over-concentration and high crime, however, to a lesser extent (i.e., 385 reported crimes compared to 362 city average and 6 alcohol licenses versus 5 allocated for off-sale) and concern of potential adverse impact to residential area (i.e., minors living in the area may try to buy alcohol) LAPD was on record as opposed to the request and noted the intersection at Nordhoff and Wilbur had a high incident of traffic accidents and 5 DUI's issued in 1998. Some neighbors

were opposed because they felt it was unnecessary and an inappropriate location in a residential neighborhood. The Council Office was also on record as being opposed to alcohol sales at convenience stores.

Additional Information on Case No. ZA 90-0450(CUB)- On September 12, 1990, the Zoning Administrator denied a Conditional Use to permit the sale and dispensing of alcoholic beverages (beer and wine only) for off-site consumption in conjunction with a 1,300 square-foot mini-market, as part of a gasoline service station on a site located in the C2-1VL (commercial) Zone, with said market operating 10 a.m. to 10 p.m., Monday through Sunday, seven days a week. The decision was appealed under Case No. BZA 4282 however, the Board of Zoning Appeals sustained the decision. Concerns raised at that time was that the sale of alcohol could cause adverse impacts to the nearby residential area, that there was an over-concentration of alcohol sales in the subject census tract (13 versus 7 allocated for off-sale), reported crimes was 660 compared to city average at that time of 577. Two neighbors were opposed due to trash being spilled from the property and concerns about potential increase in noise. LAPD had commented that the high crime was largely due to gang activity south of the area, beyond the railroad tracks in approximately 12 apartment buildings. However, the railroad tracks serve as a barrier to the neighborhood as there is no through street to the north. Based on staff knowledge of the area, the apartments are on Parthenia Street, approximately 1/2 mile south of the property and Wilbur Street remains a dead end street at the railroad tracks based on aerial photos, thus there is no direct access. Additionally, south of the railroad tracks is a different Police Reporting District.

The property is located in the Northridge Community Plan, an Airport Hazard Area 450' Height Limit Above Elevation 790, and a Liquefaction Area. The property is not currently within the area of any specific plans or interim control ordinances.

The public hearing was held on October 14, 2011 and attended by the project proponent, his representative, and representatives from the Los Angeles Police Department and the Council District. The project proponent's representative stated that since the prior denial, the level of crime in the area has decreased. She also noted that the Los Angeles Police Department and Neighborhood Council support the request.

The Zoning Administrator read into the record a letter received after preparation of the Project Report where a resident opposes the request. It was stated in the letter that beer and wine is a! ready available at nearby stores, this type of use should not be so close to an elementary school and residential area, many patrons of the gas station already dispose of bottles and litter in the surrounding area, an approval would promote drinking and driving, and the prior reasons for a denial have not changed.

The Zoning Administrator reviewed responses to questions in the application to ensure they were current and accurate. Concern was raised by the Zoning Administrator, Council Office representative, and representative of the Los Angeles Police Department regarding the project proponent's desire to sell singles. The project proponent was given an explanation of conditions typically imposed on CUBs (e.g. limitations on how alcoholic beverages are sold, expiration period, and Approval of Plans Review) intended to reduce potential crime and nuisance activities.

The Zoning Administrator concluded by stating in his opinion the character of the surrounding community could change if the authorization does not limit the sales of singles

(i.e., non-manufacturer packaged), large quantity single sales of beer, and energy drinks that contain alcohol. The Zoning Administrator gave the project proponent an opportunity to think about the issues raised at the public hearing. Subsequently, the representative of the project proponent spoke with the Zoning Administrator and acknowledged the need to impose conditions on the manner alcohol is sold.

After review of the entire administrative record, the Zoning Administrator approved the request and found it in compliance with intent and purpose of the Los Angeles Municipal Code as discussed below in the Findings.

BASIS FOR CONDITIONAL USE PERMITS

A particular type of development is subject to the conditional use process because it has been determined that such use of property should not be permitted by right in a particular zone. All uses requiring a conditional use permit from the Zoning Administrator are located within Section 12.24-W of the Los Angeles Municipal Code. In order for the sale of beer and wine for off-site consumption to be authorized, certain designated findings have to be made. In these cases, there are additional findings in lieu of the four standard findings for most other conditional use categories.

FINDINGS

Following (highlighted) is a delineation of the findings and the application of the relevant facts to same:

1. The proposed location will be desirable to the public convenience or welfare.

The Office of Zoning Administration twice denied requests (i.e., Case Nos. ZA 99-0017(CUB) and ZA 90-0450(CUB)) to permit the sale and dispensing of beer and wine for off-site consumption in conjunction with an existing gas station and convenience store on the subject site. The selling of alcoholic beverages has contributed to loitering, littering, prostitution, drug transactions, public urination, public drunkenness, nuisance, and other crime activities in areas of Los Angeles. In both cases, concern was raised regarding the potential for crime and nuisance activities that might occur at the subject site.

Since the prior denials, the level of crime has decreased in the area. In fact, a representative of Los Angeles Police Department attended the public hearing and noted that crime is not a problem. Also, the project proponent gathered signatures of support for the request.

The sale of alcoholic beverages for off-site consumption will be incidental to the other goods and services provided in the mini-mart. Therefore, authorization of the Conditional Use Permit would be a convenience for the mini-mart's patrons by allowing one-stop shopping. The convenience of purchasing beer and wine with other quick-stop purchases would decrease the number of vehicle trips to other locations. Moreover, the sale of alcoholic beverages provides additional revenue the industry typically uses to offset the low profit margin on fuel. Usually, this allows the operator to keep fuel prices lower.

The project proponent has volunteered conditions regarding the sale of alcoholic beverages (see application justification and by oral communication 11101111) in

order to reduce the potential for crime and related nuisance activities that could occur. In the opinion ofthe Zoning Administrator, the project proponent has justified why the proposed location will be desirable to the public convenience or welfare. Notwithstanding, pursuant to Business and Professional Code Sections 23958 and 23958.4, City Council must determine that issuance of the license would serve public convenience or necessity (PCN). Through this process, City Council can override an approval by the Office of Zoning Administration.

2. The location is proper in relation to adjacent uses or the development of the community.

The selling of alcoholic beverages has contributed to loitering, littering, prostitution, drug transactions, public urination, public drunkenness, nuisance, and other crime activities in many areas of Los Angeles. However, Los Angeles Police Department was present at the public hearing and indicated the request is not seen as a significant concern. Nonetheless, because of an over-concentration of similar establishments in the area and high crime, conditions are imposed on the project to ensure the location is proper in relation to adjacent uses and development of the community.

3. The use will not be materially detrimental to the character of the development in the immediate neighborhood.

A Conditional Use Permit (CUP) is discretionary request for a particular use which is not allowed as a matter of right within the zone. The CUP process singles out types of uses which are essentially desirable, but because of potential impacts are not desirable in every location, in unlimited numbers, or in a location without restrictions tailored to them. A CUP should be denied, if impacts cannot be mitigated or if the proposed use is not compatible with the surroundings.

The use will not be materially detrimental to the character of the development in the immediate area. In this instance, there are feasible and effective mitigation measures to control on-site crime and nuisance activities related to the sale of alcoholic beverages. One goal of the Office of Zoning Administration is to minimize the use of limited public resources available to patrol the subject site and enforce applicable laws. Prohibiting additional establishments that sell alcoholic beverages is one method to reduce the potential harm this use poses. This is the method twice previously employed.

Another method, as applied in this instance, is to establish conditions which become a protective measure for residents, businesses, and visitors to the area and that clearly define the operation parameters for the use of the site. In the instant case the operator is committed to preventing crime and nuisance activities on-site, as indicated by volunteering limitations on how they sell alcoholic beverages.

4. The proposed location will be in harmony with the various elements and objectives of the General Plan.

The Northridge Community Plan Map designates the property for Neighborhood Office Commercial land use with corresponding zones of C1, C1.5, C2, C4 and RAS3 and Height District 1VL per footnote 4. The Plan seeks to promote the economic well-being of the community by designating land for commercial purposes

subject to appropriate planning standards that enhance the appearance of commercial districts. The subject Conditional Use Permit for the fueling station and mini-mart will further the intent of the General Plan to allocate land uses to meet the needs of the City.

5. The proposed use will not adversely affect the welfare of the pertinent community.

In the instant case, feasible and effective mitigation measures are imposed to control potential crime and nuisance activities related to the sale of alcoholic beverages. The conditions of approval will ensure the use would not have a detrimental impact to the community and furthers the City's goal to ensure that the establishment does not become a nuisance or require additional resources of LAPO to monitor and enforce.

6. · The· granting of such application will not result in an undue concentration in the Area of establishments dispensing, for sale or other consideration, alcoholic beverages, including beer and wine, giving consideration to applicable State laws and to the California Department of Alcoholic Beverage Control's guidelines for undue concentration; and also giving consideration to the number and proximity of such establishments within a one thousand feet radius of the siteJ the crime rate in the area (especially those crimes involving public drunkenness, the illegal sale or use of narcotics, drugs or alcohol, disturbing the peace and disorderly conduct), and whether revocation or nuisance proceedings have been initiated for any use in the Area.

According to the State of California Department of Alcoholic Beverage Control (ABC) licensing criteria, 5 on-sale and 3 off-sale licenses are allocated to subject Census Tract No. 1152.02. There are currently 11 on-site and 6 off-site licenses in this Census Tract. The data indicates this is an area of over concentration of both on and off site establishments.

As reported by ABC from statistics provided by the Los Angeles Police Department, within Crime Reporting District No. 1785, which has jurisdiction over the subject property, a total of 280 crimes were reported in 2010, compared to the citywide average of 169 crimes and the high crime reporting district average of 203 crimes for the same period. The data indicates this area exceeds the high crime level of the City.

In 2010, there were 26 Narcotics, 1 Liquor Law, 5 Public Drunkenness, 23 Disturbing the Peace, 0 Disorderly Conduct, and 6 OWl related arrests. These numbers do not reflect the total number of arrests in the subject reporting district over the accountable year. Arrests for this calendar year may reflect crimes reported in previous years.

These statistics usually place a high demand on Los Angeles Police Department related to alcoholic beverage outlets. However, Los Angeles Police Department was present at the public hearing and indicated the request is not seen as a significant concern. Notwithstanding, because of the number of establishments in the area and high crime, conditions must be imposed that are proven to lessen crime and nuisance activities. Thus, approval of the Conditional Use Permit would not result in an undue concentration in this area. Also, in the opinion of this decision-maker,

increasing the number of establishments governed by such conditions has been shown to be successful throughout the City in protecting surrounding areas in part because it creates a competitive factor that crowd out other less desirable establishments.

The project proponent initially indicated his desire to sale single containers of beer and small containers of wine. Allowing such in area of over-concentration and high crime is not prudent. Further, the Zoning Administrator imposed a condition that the sale of beer in quantities of 22 oz., 32 oz., 40 oz. or similar size containers is prohibited. The basis of this is found in California Council of Alcohol Policy, in "Public Convenience or Necessity" Revised March 2006, that recommends, "[t]The sales of beer and malt beverages in quantities of quarter, 22 oz., 32 oz. and 40 oz. or similar size containers are prohibited. No beer or malt beverages shall be sold in quantities of less than six per sale."

A condition is imposed for expiration of the authorization in five (5) years. This is a standard used by the Office of Zoning Administration throughout the City for the last decade. This condition is in case of an operator's possible lack of sensitivity to the needs of the community and inability of the property owner to correct non­compliance with the conditions.

7. The proposed use will not detrimentally affect nearby residentially zoned communities in the Area after giving consideration to the distance of the proposed use from the following: residential buildings, churches, schools, hospitals, public playgrounds, and other similar uses; and other establishments dispensing, for sale or other consideration, alcoholic beverages, including beer and wine.

Calhoun Street Elementary School, at 18722 Knapp Street, is located within 600 feet of the subject property. As shown on the radius map, single-family properties adjoin the property to the north and east, however, no direct pedestrian or vehicle access is provided to or from the site.

The intent of the Finding is to ensure the buffering of sensitive uses from potential impacts such as loitering, public drunkenness, nuisance activities, and other crime activities associated with the sale and dispensing of alcoholic beverages. Conditions established herein are a protective measure for residents, businesses, and visitors to the area and to clearly define the operation parameters for the use of the site. Thus, little impact if any should occur to nearby sensitive uses.

ADDITIONAL MANDATORY FINDINGS

8. The National Flood Insurance Program rate maps, which are a part of the Flood Hazard Management Specific Plan adopted by the City Council by Ordinance No. 172,081, have been reviewed and it has been determined that this project is located in Zone C, areas of minimal flooding.

9. On August 24, 2011, a Mitigated Negative Declaration (ENV 2011-893-MNO) was prepared for the proposed project. On the basis of the whole of the record before the lead agency including any comments received, the lead agency finds that with imposition of the mitigation measures described in the MND (and identified in this determination), there is no substantial evidence that the proposed project will have a

significant effect on the environment. I hereby adopt that action. This Mitigated Negative Declaration reflects the lead agency's independent judgment and analysis. The records upon which this decision is based are with the Environmental Review Section of the Planning Department in Room 351, 6262 Van Nuys Boulevard.
