An official visa invitation letter issued by a local entity to apply for a Chinese business visa is available upon request. Conference sell-outsThe IBA places its conference in venues of a suitable size for the event; however there are times when our conferences may sell out. Should this happen, prospective delegates will be informed and a waiting list will operate. The waiting list will function on a ‘first come, first served’ basis, subject to receiving registered delegate cancellations. The IBA will not be liable for any travel or accommodation expenses incurred by an individual who travels to the conference without a confirmed place at the event.

Cancellation of registrationIf cancellation is received in writing at the IBA office by 5 February 2016, fees will be refunded less a 25 per cent administration charge. We regret that no refunds can be made after this date. Registrations received after 5 February 2016 will not be eligible for any refund of registration fees.

Provided you have cancelled your registration to attend an IBA conference in accordance with the terms of the ‘cancellation of registration’ clause included in the ‘Information’ section of the relevant conference programme, you must then confirm to us in writing at the IBA office as soon as possible but in no event later than one year (12 calendar months) from the date of any such conference all necessary details to enable any reimbursement owed to you to be paid. We regret that no refunds will be made after the date that is one year (12 calendar months) after the date of the relevant conference.

Cancellation and no-show policyAll reservation forms are to be either emailed ([email protected] and copy to [email protected]) or faxed (+86 (21) 6882 0160) to hotel latest by 17 February 2016.Once the reservation is confirmed, a full cancellation charge will be imposed on any cancellations or shortened stays.

Check in/check outCheck-in time is 1400 and check-out time is at 1200 noon. Request for early check-in will be subject to availability. Delegates who wish to occupy their guest rooms before 1400, placing a reservation a night prior to the arrival date is recommended. Request for late departure is subject to availability. Fifty per cent of the room rate will apply for check out before 1600 and 100 per cent of the room rate will apply for check out beyond 1600.

Overview

The ICC Commission on Arbitration and ADR’s Task Force on Decisions as to Costs is releasing a new Report. This is the Commission’s latest initiative to ensure that ICC arbitration continues to be a viable and attractive form of dispute resolution for its users.

The objective of this Report is to inform users how arbitral tribunals may allocate costs with a view to controlling time and costs effectively and to assist in creating fair, well-managed proceedings which meet the expectations of users.

The Report identifies ways in which tribunals and parties might use costs allocation powers to promote cost effective and efficient conduct of proceedings, clarifies the variety of considerations that tribunals take into account in assessing reasonableness and apportionment of costs, and discusses other costs issues arising out of third party funding, success fees and the treatment of settlement offers. In compiling the Report, the Task Force examined costs allocation decisions made in arbitral awards arising out of the ICC International Court of Arbitration and eight other arbitral institutions, as well as the approaches taken in various national systems and laws. This research is included in Appendices to the Report

This half-day conference on the eve of IBA Arbitration Day will serve as the Asia launch of the Report, and will gather a panel of international arbitration experts to discuss two pertinent issues arising out of the Report –the various considerations that an arbitral tribunal could take into account in making decisions on the allocation of the costs of the arbitration, and the use of costs decisions as a case management tool.
