 The BMW Valet Program is a benefit designed to provide a "Premier Care Experience" for 2000 750iL customers. This program is provided as standardservice on every 2000 750iL purchased from any Authorized BMW center in the United States or Puerto Rico for the duration of the New Vehicle LimitedWarranty period of 48 months or 50,000 miles, whichever occurs first.

 Any authorized BMW center in the United States or Puerto Rico will pick up your vehicle from any reasonable location when a recommended maintenance

or warranty repair appointment is made by you. In addition, upon your request, your authorized BMW center will provide you with a free BMW loanervehicle for the duration of the repair. Upon completion of repairs to your vehicle, your authorized BMW center will return your vehicle to you.

BMW Maintenance Programs - 2000 Models

Maintenance Programs are a benefit designedto help reduce the cost of scheduled and un-scheduled maintenance.

Every 2000 750iL purchased from any Autho-

rized BMW center in the United States or PuertoRico is covered by Full Maintenance for the newvehicle warranty period of 48 months or 50,000miles, whichever occurs first.

 All other 2000 model vehicles purchasedfrom any Authorized BMW center in the UnitedStates or Puerto Rico are covered by Sched-uled Maintenance for 36 months or 36,000 miles,whichever occurs first. Coverage begins on thedate of first retail sale or the date the vehicle isfirst placed in service as a demonstrator or com-

pany vehicle, whichever is earlier.

 Any authorized BMW center in the United Statesor Puerto Rico will perform the scheduled oradditional maintenance services (depending onthe maintenance program) on your vehicle atno expense to you. The maintenance scheduleintervals are based on normal driving conditionsand operation. Should you request more fre-quent maintenance service, the cost ofthese services will not be covered by eitherMaintenance Program.

Coverage

Scheduled Maintenance  covers factoryrecommended maintenance, as determined by theService Indicator System, for the period of 36 monthsor 36,000 miles, whichever occurs first. See pages5-12 of this statement for additional information.

Full Maintenance  covers all items underScheduled Maintenance and additional itemswhich need replacement due to normal wearand tear and which are not covered by the origi-nal New Vehicle Limited Warranty, such as brake

pads, brake rotors, wiper blades, external enginebelts and clutch, are included provided wearand tear exceeds BMW specifications. Any ad- justment required due to normal operating con-ditions is also included.

Maintenance Intervals

 Time intervals should be followed using themaintenance interval as indicated by the BMWService Indicator lights on the check control panelin the dashboard.

 This BMW Service and Warranty InformationStatement should be presented to your BMWcenter when maintenance is required. YourBMW center will stamp this book documentingthe services or maintenance performed.

Exclusions from coverage

– Items reimbursable under your New VehicleLimited Warranty.

– Gasoline and gasoline additive.– Windshield washer additive (except when in

conjunction with scheduled maintenance).– Tires, wheel alignment, tire balance and ro-

tation.– Wear and tear of soft trim items, such as:

seats, carpets, moldings, headliner, doorpanels and all chrome trim.

– Damage detected when performing the rustperforation inspection.

– Damage which results from negligence, im-proper operation of the vehicle, wear and tearor deterioration due to driving habits or condi-

tions, improper repair, environmental influences,flood, accident or fire damage, road salt corro-sion, alteration, installation of non-BMW ac-cessories, or use of improper, poor quality orcontaminated fuel.

– Altered or unreadable Vehicle IdentificationNumber (VIN) or odometer irregularities or ve-hicles where the true mileage cannot be deter-mined.

– Maintenance or repair after the vehicle isdeemed a total loss.

– Maintenance or repairs performed by other than

an Authorized BMW center within the UnitedStates or Puerto Rico.

– Vehicles used in competitive events.– Oil changes performed outside the recom-

mended maintenance intervals as indicatedby the Service Interval Indicator.

Upgrades

Note: For those vehicles covered by Sched-uled Maintenance for 36 months/36,000miles, BMW offers the possibility to upgrade toScheduled Maintenance for 48 Months/50,000

Miles or upgrade to Full Maintenance for either 36

 months/36,000 miles or 48 months/50,000 miles.

Maintenance System

 The BMW Maintenance System has been devisedwith the following objectives: to maximize vehiclesafety, reliability, and resale value by minimizingbreakdowns resulting from wear, and minimizingcost and inconvenience by computing maintenance

intervals based upon the specific manner in whicheach individual vehicle is driven.

Maintenance intervals on motor vehicles have con-ventionally been specified based upon accumu-lated mileage. However, the type of driving condi-tions has a major influence on routine maintenancerequirements; distance traveled is only one of thesignificant factors. A vehicle driven for 50,000 milesof short trips in the city with numerous cold starts,prolonged periods of idling, stop-and-go driving,and high engine speeds during acceleration re-quires more frequent maintenance intervals than avehicle driven for 50,000 miles for long distances atlow engine speeds primarily at operating tempera-ture.

 The advanced technologies at BMW have led to thedevelopment of the unique BMW Service IntervalIndicator System which computes the actual opti-mum maintenance requirements based not onlyupon the accumulated mileage, but taking into ac-count important factors such as engine coolant tem-

peratures, high or low engine speeds, short or longtrip driving, and number of vehicle starts. The main-tenance interval may therefore be maximized withconsiderable savings to owners of vehicles sub-

 jected to light duty.

 The Service Indicator consists of five green,one yellow and one red Iight-emitting-diodes(LEDs) and the inscriptions “OIL SERVICE” and“INSPECTION”.

Whenever the ignition is switched on, up tofive green LEDs  will light up, depending onthe amount of use the vehicle has had sincethe last maintenance service and your drivingstyle. As the number of illuminated green LEDsdecreases, this is an indication that the nextservice is almost due and helps you to makethe necessary arrangements on a timely basis.

 The green LEDs disappear when the engineis started.

Notification that maintenance is required is indi-cated with the illumination of the  yellow LEDand accompanying inscription. These will remainilluminated with the ignition on.

If the maintenance interval has been exceeded,the red LED will light up in addition to the yellowone to remind you of the urgent need for servic-ing. In the interests of road safety and reliability,you should avoid driving your BMW whenthe red LED signal is showing, and have theessential maintenance work performed withoutdelay.

 After each maintenance is performed the Ser-vice Indicator is reset in order to compute thenext service interval.

 The green LEDs which then light up with theignition show you the interval before the nextmaintenance is due.

If the Service Indicator displays an illogical read-ing, for instance the green and red LEDs at thesame time, or if there is no display, consult aBMW center.

If the speedometer, tachometer or coolant tem-

perature gauge should develop a fault, the Ser-vice lndicator will probably cease to operate cor-rectly as well, since it depends on correct speed,distance and temperature readings. The faultmust be located and rectified by a BMW center.

 A detailed list of all maintenance operations in-cluded in each of the elements of the BMWMaintenance System is found on pages 4-17. These elements are as follows:

Quality Certification I will be performed by yourselling center and certified on the following page.

 The performance of certain subsequent mainte-nance elements, as required by the BMW New Vehicle Limited Warranty, will be specified at in-tervals computed by the BMW Service IntervalIndicator as follows:

– Oil Service: Engine oil changed with theengine at operating temperature. Note:change oil at least once a year. All 2000

BMWs (except M roadster and M coupe) areequipped with a newly-developed syntheticengine oil. At the time of the printing of thisbooklet BMW High-Performance Synthetic5W-40 Oil (Part Number 07 51 0 002 545)and Mobil 1 5W-30 and 5W-40 oils arestrongly recommended and approved byBMW. BMW is evaluating various syntheticoils for inclusion in our list of recommendedmotor oils.

For the most current list of synthetic oils, please

contact your BMW center, or call BMW of North America, Inc. at 1-800-831-1117. Youcan also obtain this information from ourwebsite, www.bmwusa.com/.

If you need to add oil between oil changesand are unable to obtain BMW High Perfor-mance Synthetic Oil, Mobil 1 or another

special oil on the list, use a synthetic oil withan API rating of SJ or higher.

– Inspection I: Major vehicle maintenance asspecified in the following pages under In-

spection I.

– Inspection II: Additional major vehicle main-tenance as specified in the following pagesunder Inspection II.

 The following maintenance elements must beperformed at the mileage/time stated (time inter-vals begin from the vehicle’s production date):

– Brake Fluid Service: Change brake fluid ev-ery two years.

– Engine Coolant Service: Change coolantevery four years.

– Oxygen Sensor Service: The oxygen sensordeteriorates strictly on a mileage basis andmust therefore be replaced every 100,000miles to maximize vehicle fuel economy andminimize exhaust pollution. The replacementof the oxygen sensor is required under theterms of the applicable BMW emission sys-tem warranties.

_ Spark Plug Service: Certain 2000 modelBMWs are equipped with platinum-tippedspark plugs. These allow a longer service lifethan conventional plugs. On models soequipped, replace spark plugs every 100,000miles. Please see your BMW center for themost current information.

– M-Mobility System (Motorsport models only):Replace sealant cartridge every three years.

For your convenience, you may also wish to haveyour BMW center perform any necessary opera-

tions to fulfill any state inspection requirements inyour area concurrent with the maintenance ele-ments specified above during other repairs.

Make sure that confirmation of maintenance work is always entered in this Service and WarrantyInformation Statement. You may need this forany warranty claims that become necessary, andlater on as evidence that your car has been giventhe correct and regular maintenance that justi-fies its resale or trade-in value.

Unscheduled Maintenance

Only use fuels advertised to have adequate de-tergency and low alcohol content. Use of fuelswith insufficient detergent and/or excess alco-hol can cause driveability problems that neces-sitate cleaning intake valves and fuel injectionvalves, and, when applicable, adjusting the en-gine idle. We suggest having this work per-formed by your authorized BMW center, per-haps while regular maintenance is performed. Your BMW center can also recommend a gaso-line additive that will provide sufficient detergency.While this recommended unscheduled mainte-nance is not required in order to maintain theemission warranty, cleaning of intake valves or,

when applicable, fuel injection valves, or adjust-ment of engine idle, necessitated by use of in-appropriate fuel, is not covered by warranty be-cause no defect in material or workmanship orcomponent failure is involved.

Check rear axle for leaks. •

 Visually check fuel tank, lines and connections for leaks. •

Check condition, position, and mounting of exhaust system. Examine for leaks. •

Check power steering system for leaks. Check power steering fluid level; add fluid if necessary. •

Check steering for absence of play, condition of suspension track rods, front axle joints, steering l inkage and joint disc. •

Remove and install front and rear disc brake pads, check overall thickness. Examine brake disc surfaces.Clean brake pad contact points in calipers. Grease wheel centering hubs •

Check front control arm bushings for wear. •

Check brake system connections and lines for leaks, damage and incorrect positioning. •

Check for free movement of the parking brake cables. Adjust parking brake if necessary. •

If your car is driven only for short distances of lessthan 10 miles over a prolonged period of time,without an occasional drive at highway speeds,the engine’s charging system will not maintain thebattery. Insufficient use of the vehicle could resultin short term starting problems and in the long

term could damage the battery.

In case the car is not operated for more than fourweeks it is advisable to:

a) consider using a proper trickle charger, follow-ing the charger manufacturer’s instructions, tomaintain the battery’s state of charge; or

b) consult your BMW center regarding battery re-moval. Once removed, the battery must be

charged and stored in a cool, dry place whereit can be protected from freezing. If the bat-tery will be stored for over 3 months, it mustbe recharged every 3 months, or else it willbecome damaged and useless.

Please consult with your BMW center for furtherguidance and information.

Extensive corrosion protection measures imple-mented by BMW now make it possible to offer asix-year limited anti-corrosion warranty against rustperforation on your vehicle provided that the ve-hicle is maintained in accordance with the provi-sions of the New Vehicle Limited Warranty as out-

lined in the Warranty Section of this Statement(page 33).

 The major degree of corrosion protection is dueto the electrophoretic dip painting process whichcathodically deposits paint particles on all bodyparts, attracting paint particles into the minutestcavities or seams. Body parts are designed toprovide optimum corrosion protection.

During manufacture, exterior body parts receive

an additional corrosion protection coat. Hood,trunk, doors and other body parts with metal foldsare coated with PVC and sealed from the out-side.

 All floor panels receive a resilient coating of PVCfor maximum protection against damage due tostones, etc.

Corrosion protection materials tested over manyyears are applied to the surfaces of cavities andto the entire underside of the vehicle during and

after assembly.

Requirements for maintaining the six-year limitedanti-corrosion warranty are outlined in the War-ranty Section of this Statement (page 33).

Restoring corrosion protection

Please take care that anti-corrosion material is re-placed when your car is repaired after body orchassis damage.

BMW will not accept any liability for any partsand accessories not approved by BMW.

Underbody maintenance

 The underbody has to be cleaned at least once ayear, in spring, with plain water in order to remove

mud, chemical sediments and other deposits. If those materials are not removed, corrosion (rust)will occur.

 Your BMW center will do this anti-corrosion ser-vice for you.

WARNING

Do not apply additional undercoating or rust-proof-ing on or near the exhaust manifold, exhaust pipes,catalytic converter or heat shields. During driv-

ing, the substance used for undercoating couldoverheat and cause a fire.

During a specific period (usually the earlier of 12months or 12,000 miles, though this periodvaries by state), some states require us or ourauthorized BMW center, to repair in a reason-able number of attempts, any defect or condi-tion which substantially impairs the use, value,

or safety of a new vehicle sold, leased or regis-tered in that state.

 A “reasonable number of attempts” is generallydefined as (i) two or more attempts to repair thesame defect (the number of attempts may varyby state) or (ii) that the same defect has causedthe vehicle to be out of service by reason of repairfor more than 30 days (this period may vary bystate), except for delays created by conditionsbeyond our control.

In a few weeks you will receive a permanent BMWRoadside Assistance ID card by mail. The date of purchase and the vehicle identification number(VIN) are embossed on the card.

 This card should be carried by the driver of yourBMW automobile.

Calling For Assistance

 The toll-free BMW Roadside Assistance numberis answered by a BMW Roadside Assistance ser-vice representative. In order for you to receive quick and reliable services, it is essential that you shouldprovide detailed and accurate information to theservice representative.

Be prepared to give:

1. Your name and address.

2. Your complete Vehicle Identification Number(found on your vehicle registration or your per-

manent BMW Roadside Assistance ID card).

3. Model description of your vehicle.

4. Date of purchase.

5. License plate number of your vehicle.

6. Vehicle location (including nearby crossroads/ intersections, highway mile markers, streetnumbers, landmarks, etc.).

Dispatch Service

 A service vehicle or a flatbed tow truck will be dis-patched to the site of your disabled vehicle.

On-Site Assistance

On-site service for vehicle disablements such asflat tires, dead batteries, and out of fuel condi-tions is provided up to a maximum of $50.00 perincident by BMW Roadside Assistance.

 The cost for parts and fuel, when used on-site,are the responsibility of the owner/driver. The New Vehicle Limited Warranty does not cover any of the above on-site services.

Lock-Out

For security purposes, the driver will need to proveownership by presenting proper documentation,i.e., a valid drivers license, registration, etc. Lock-out service will be provided up to a maximum of $100.00 per incident.

Sign-and-Drive

In most instances, services provided under theBMW Roadside Assistance Program do not re-quire immediate payment.

Usually, you will be able to sign a receipt, so theprovider of the service can be reimbursed directlyby BMW Roadside Assistance.

Parts, materials and fuel should be paid by youdirectly to the provider of the services.

Services

Towing Service

In the event of a mechanical breakdown normallycovered under the New Vehicle Limited Warranty,your vehicle will be transported (at no cost) to thenearest authorized BMW center. Your vehicle is

also covered in the event of an accident or colli-sion.

If a breakdown occurs after normal businesshours, your vehicle will be transported to asecure location and transported to the near-est authorized BMW center on the next businessday.

If you request that the vehicle be taken to a loca-tion other than the nearest authorized BMW center,any additional expense will be your responsibil ity.

However, you may request (at no cost) to be takento a different BMW center as long as it is within 50additional miles of the "nearest" BMW center.

 Towing requests for vehicles disabled because of casualty, fire, act of God, or violation of law (fed-eral, state or local) are accepted at the expenseof the owner/driver.

If it is necessary for you to have your vehicle towedthrough your own arrangements, you must con-tact BMW Roadside Assistance for prior au-thorization and instructions on claim proce-dures.  All claims must be submitted within sixty

Trip Interruption Benefits

 Trip interruption benefits are provided for mechani-cal breakdowns as follows:

– Breakdowns that are warranty related, and;

– Must occur in excess of 100 miles from thedriver’s residence, and;

– Repairs cannot be completed during normalbusiness hours on the same day of break-down.

Reimbursements will be made for meals, lodging,car rentals, and alternate transportation to bringthe driver and the BMW automobile together af-ter the vehicle has been repaired by an autho-rized BMW center.

 Trip interruption coverage is limited to $750.00 perincident, to a maximum of five days per incident.

 Always contact BMW Roadside Assistance for tripinterruption benefits. They will assist in making allthe necessary arrangements.

Car Rental Discounts

Discounts of up to 30% are available from Alamo, Avis, Dollar, Hertz and National car rental compa-nies. Benefits may vary with each company andlocation.

Simply display your BMW Service Card (showingthe applicable Plan number) during reservation andat the time of rental to secure your discount.

Exclusions

Specifically excluded from coverage are:

– Fines, taxes, or impound towing fees causedby a violation of local or state law.

– Expenses related to hazardous weather con-ditions (removal from snow, ice, etc.).

– Expenses for the removal of snow tires, andmounting or removal of snow chains.

Warrantor

BMW NA warrants 2000 U.S. specification ve-hicles distributed by BMW NA or sold throughthe BMW NA European Delivery Programagainst defects in materials or workmanship to

the first retail purchaser, and each subsequentpurchaser.

Warranty Period

 The warranty period is 48 months or 50,000miles, whichever occurs first.

Warranty Begins

This warranty begins on the date of firstretail sale, or the date the vehicle is firstplaced in service as a demonstrator orcompany vehicle, whichever is earlier.

Warranty Coverage

 To obtain service under this warranty, the ve-hicle must be brought, upon discovery of a de-fect in material or workmanship, to the work-shop of any authorized BMW center, during nor-mal business hours. The BMW center will, with-out charge for parts or labor, either repair or re-

place the defective part(s) using new or autho-rized remanufactured parts. The decision torepair or replace said part(s) is solely the pre-rogative of BMW NA. Parts for which replace-ments are made become the property of BMWNA.

In all cases, a reasonable time must be allowedfor warranty repairs to be completed after thevehicle is received by the BMW center.

 Adjustment Period

Battery

Items which are subject to wear and tear or

deterioration due to driving habits or condi-tions, such as brake pads/linings, brake discs,clutch disc, pressure plate, filters, upholstery,trim and chrome items, paint finish, drive belts,glass, and similar items, are specifically lim-ited to defects in material or workmanship.

This warranty does not apply to thefollowing:

Damage which results from negligence, improperoperation of  the vehicle, improper repair, lack of or improper  maintenance, environmental influ-ences, flood, accident or fire damage, road saltcorrosion, or use of improper or contaminated fuel.Damage to the engine, transmission or any re-lated component caused by improper shifting of the transmission.

Maintenance services and parts when replacedduring maintenance such as spark plugs, lubri-cants, fluids, engine tuneup parts, replacement

of filters, coolant, and refrigerant.

Failure to maintain the vehicle properly in accor-dance with the instructions in the Owner’s Manualor the Service section of this Statement, thatresults in the failure of any part of the vehicle.

Modification of the vehicle or installation of anyperformance accessories or components at-tached to the vehicle which alters the original en-gineering and/or operating specifications or whichresult in damage to the other original components,electrical interference, electrical short, radio static,

water leaks and wind noise.

 Tires are warranted by their respective manu-facturer as detailed in the applicable tiremanufacturer’s warranty statements. Instruc-tions for proper tire care and maintenance arecontained in the Owner’s Manual. Should you ex-perience difficulty in obtaining warranty servicefrom a tire manufacturer, your authorized BMWcenter will assist you in resolving the difficulty.

Non-BMW Parts – While you may elect to usenon-genuine BMW parts for maintenance or re-pair services, BMW NA is not obligated to pay forrepairs that include non-genuine BMW parts orfor any damage resulting from the use of non-genuine parts.

REQUIRED MAINTENANCE:

BMW NA warrants to the first retail purchaser,

and each subsequent purchaser, that the car(a) was designed, built and equipped so as toconform, at the time of sale, with all regulationsof the U.S. Environmental Protection Agency ap-plicable at the time of manufacture and (b) isfree from defects in materials and workmanshipwhich would cause it to fail to conform withapplicable regulations for a period of 2 years or24,000 miles, whichever occurs first, except forspecific emission control components (as listedon page 39), for which the warranty period is 8years or 80,000 miles, whichever occurs first.

 This warranty begins on the date of first retail sale,or the date the vehicle is first placed in service asa demonstrator or company vehicle, whichever isearlier.

Warranty claims must be made as soon as rea-sonably possible after a defect is discovered. To make a claim, the car must be brought toany authorized BMW center during normal busi-ness hours.

 The BMW center will, without charge for parts orlabor (including diagnosis), either repair or replacethe defective part, if any. The decision whether torepair or replace said parts is solely the preroga-

tive of BMW NA and must be expected to correctthe failure of the warranted part. Parts for whichreplacements are made become the property of BMW NA. In all cases, a reasonable time mustbe allowed for warranty repairs to be completedafter the car is received by the BMW center.

For assistance in determining which specificparts or components of your vehicle are cov-ered under this warranty, please contact yourBMW center.

It is the owner’s responsibility to have all sched-uled inspection and maintenance services per-formed (at the owner’s expense), as prescribedin the maintenance schedule for the BMW Emis-sion Control System. Service intervals are com-puted by the onboard BMW service interval in-

dicator and displayed on the instrument panel. The instructions for proper maintenance anduse can be found in the Owner’s Manual. It isstrongly  recommended that any replacementparts used for maintenance, repair or replace-ment of emission control systems be certifiedBMW Service Parts or BMW AuthorizedRemanufactured Parts. Without invalidating thiswarranty, the owner may elect to have mainte-nance, repair or replacement of the emissioncontrol systems performed by any automotiverepair establishment, or elect to use parts otherthan certified BMW Service Parts. However, thecost of such service or parts will not be cov-ered under this warranty, except in emergencysituations. In an emergency situation, where an

authorized BMW center or a warranty replace-ment part is not reasonably available (within 30days), repairs may be performed at any avail-able service establishment using any equiva-lent part. BMW NA  will reimburse the owner forsuch emergency repairs (including labor, parts

and diagnosis not to exceed BMW NA  rates forlabor, parts, and diagnosis in said area) that arecovered under this warranty. Replaced parts andpaid  invoices must be presented at a BMWcenter as a condition of reimbursement for emer-gency repairs not performed by a BMW center.

 The use of replacement parts, which are not of equivalent quality, may impair the effectivenessof the emission control system. If other thancertified BMW Service Parts or Authorized Re-manufactured Parts are used for maintenance,

repair or replacement of components affectingemission control, the owner should obtain as-surances that such parts are warranted by theirmanufacturer to be equivalent to genuine BMWparts in performance and durability. BMW NA assumes no liability under this warranty with re-spect to parts other than genuine BMW parts.

However, the use of non-BMW replacement partsor non-EPA certified parts does not invalidate thewarranty on other components, unless non-BMWparts or non-EPA certified parts cause damageto warranted parts.

What is not covered

 This warranty does not cover malfunctions causedby any of the following: accident, flood, misuse,improper adjustment, modification, alteration, tam-pering, disconnection, improper or inadequatemaintenance, use of leaded fuel or fuels contain-ing more than 10% ethanol, or other oxygenateswith more than 2.8% oxygen by weight (i.e., morethan 15% MTBE or more than 3% methanol plusan equivalent amount of co-solvent).

 The replacement of maintenance parts, such asspark plugs, filters and similar items used in re-quired maintenance services, the repair or replace-ment of maintenance parts beyond the first re-quired inspection/maintenance, or if the part hasbeen replaced earlier for reasons other than it beingdefective.

 The car or any part of the  car unless a failurecauses the car to fail to conform to applicable

emission regulations.

 Any car on which the odometer has been replacedor altered and the true mileage cannot be deter-mined.

 The car, if the vehicle identification number is al-tered or cannot be read, or if  the car has been

declared a total loss or sold for salvage purposes.

In those states and jurisdictions that have estab-lished periodic vehicle emissions tests to encour-age proper vehicle maintenance and require thecar to pass an emissions test approved by theU.S. Environmental Protection Agency and:

1. The car was distributed by BMW of North America, Inc., (BMW NA), or sold through theBMW NA European Delivery Program; and

2. The car has been maintained and operated inaccordance with the instructions for propermaintenance and use set forth in the Owner’sManual supplied with the car; and

3. The car fails to conform to the applicable emis-sions standards of the EPA as judged by anEPA approved emissions test; and

4. The failure to conform results or will result inthe owner of the car having to bear a penaltyor other sanction (including the denial of theright to use the car) under local state or fed-eral law if the non-conformity is not remediedwithin a specified period of time.

 Then BMW NA warrants that if the car is eligiblefor coverage under this warranty, any non-confor-mities in the car, which cause it to fail an EPA-approved emissions test, will, without charge forparts or labor (including diagnosis), be adjusted,

repaired, or replaced, at the option of BMW NA  toproper specifications, in order to make the carcomply with applicable emissions standards. Thedecision to adjust, repair or replace parts is solelythe prerogative of BMW NA  and must reasonablybe expected to correct the failure of the warrantedpart.

 This warranty begins on the date of first retail sale,or the date the vehicle is first placed in service asa demonstrator or company vehicle, whichever isearlier. This warranty continues for a period of 2years or 24,000 miles, whichever occurs first, ex-cept for specific emissions control components(as listed on page 39), for which the warrantyperiod is 8 years or 80,000 miles whichever occursfirst.

 This warranty is made subject to the terms andconditions that apply to the Emission ControlSystem Warranty and the New Vehicle LimitedWarranty.

No claim under this warranty will be denied on thebasis of use of a properly installed EPA certifiedemission part for maintenance and repair.

 A vehicle manufacturer may deny an emissionperformance warranty claim on the basis of anuncertified replacement part used in the mainte-nance or repair of a vehicle only if the vehicle

manufacturer presents evidence that theuncertified replacement part is either defective inmaterials or workmanship or not equivalent froman emission standpoint to the original equipmentpart.

Maintenance, replacement, or repair of emis-sion control devices and systems may beperformed by any automotive repair estab-lishment or individual using any certifiedpart.

Immediately after the car has failed an EPA ap-proved emission short test, your claim can bemade at any authorized BMW center. The BMWcenter will honor or deny your claim within the timeperiod specified by local or state laws (not to ex-ceed 30 days), to avoid further penalties or sanc-

tions. lf the claim is denied, the BMW center willnotify you in writing of the reason(s). The BMWcenter is required by law to honor the claim if no-tice of denial is not received by the owner withinthe specified time period.

 The California Air Resources Board and BMWof North America, Inc. (BMW NA) are pleased toexplain the emission control system warranty onyour 2000 vehicle. In California, new motor ve-hicles must be designed, built and equipped tomeet the State’s stringent anti-smog standards.BMW NA must warrant the emission control sys-tem on your vehicle for the periods of time listedbelow provided there has been no abuse, neg-lect or improper maintenance of your vehicle.

 Your emission control system may include partssuch as the fuel injection system, the ignitionsystem, catalytic converter, and engine com-puter. Also included may be hoses, belts, con-nectors and other emission-related assemblies.

Where a warrantable condition exists, BMW NA 

will repair your vehicle at no cost to you includ-ing diagnosis, parts and labor.

1. If your vehicle fails a Smog Check inspec-tion, all necessary repairs and adjustmentswill be made by BMW NA to ensure that yourvehicle passes the inspection. This is your

emission control system PERFORMANCEWARRANTY.

2. If any emission-related part on your vehicleis defective, the part will be repaired or replacedby BMW NA.  This is your short-term emissioncontrol system DEFECTS WARRANTY.

– For 7 years or 70,000 miles whichever occursfirst:

If  an emission-related part listed in this WarrantySection specially noted with coverage for 7 yearsor 70,000 miles is defective, the part will be re-paired or replaced by BMW NA. This is yourlong-term emission control system DEFECTSWARRANTY.

Owner’s Warranty Responsibilities:

– As the vehicle owner, you are responsible

for the performance of the required mainte-nance listed in your Owner’s Manual. BMWNA recommends that you retain all receiptscovering maintenance on your vehicle, butBMW NA cannot deny warranty solely forthe lack of receipts or for your failure to en-sure the performance of all scheduled main-tenance.

– You are responsible for presenting your ve-hicle to an authorized BMW center as soonas a problem exists. The warranty repairs

should be completed in a reasonable amountof time, not to exceed 30 days.

– As the vehicle owner, you should also beaware that BMW NA   may deny your war-ranty coverage if your vehicle or part hasfailed due to abuse, neglect, improper main-tenance or unapproved modifications.

 This warranty applies to California certified ve-hicles distributed by BMW of North America,Inc. (BMW NA) or sold through the BMW NA European Delivery Program, registered and op-erated primarily in California.

BMW NA warrants to the original purchaser andeach subsequent owner that the vehicle is:

(a ) designed, built and equipped so as to con-form with the applicable California Air Re-sources Board emission standards.

(b) free from defects in materials and workman-ship which cause any part that can affectemissions to fail to conform with applicablerequirements or to fail a California SmogCheck test or EPA approved short test for a

period of 3 years or 50,000 miles, whicheveroccurs first.

(c ) free from defects in materials and workman-ship in emission related parts, which are con-tained in the California Emission WarrantyParts List on page 43, for a period of 7 yearsor 70,000 miles, whichever occurs first.

 This warranty begins on the date of first retailsale, or the date the vehicle is first placed inservice as a demonstrator or company vehicle,whichever is earlier.

 To obtain service under this warranty, the ve-hicle must be brought, upon failure of a Smog

Check test or upon discovery of the defect, tothe workshop of any authorized BMW center,during normal business hours. The BMW centerwill honor or deny your claim within 30 days. If the claim is denied, the BMW center will notifyyou in writing of the reason(s). The BMW centeris required by law to honor the claim if notice isnot given to the owner within 30 days.

 The BMW center will, without charge for parts orlabor (including diagnosis), either adjust, repairor replace the defective part and other partsaffected by the failure of the warranted part, if any. If your vehicle failed the California SmogCheck test or an EPA approved short test, thenBMW NA will repair your vehicle so that it willpass this test. Items that require scheduled re-placement are warranted up to the replacement

interval specified in the Service section of thisStatement. BMW NA may repair a part in lieu of replacing it when performing warranty repairs.Parts for which replacements are made becomethe property of BMW NA. After 3 years or 50,000miles, and in accordance with paragraph (c)above, such repairs are limited to the repair orreplacement of those parts identified in the Cali-fornia Emissions Warranty List.

If your California registered vehicle is between 7and 8 years old and has been driven less than

80,000 miles, then your vehicle is eligible foradditional warranty coverage under the FederalEmissions Warranty.

 A repair performed as the result of a smog check test failure due to a defect in a part, which iswarranted for 7 years/70,000 miles, is covered.

In all cases, a reasonable time, not to exceed30 days, must be allowed for a warranty repairto be completed, after the car is received by theBMW center.

It is the owner’s responsibility to have all requiredmaintenance services performed (at the owner’sexpense), as prescribed in the maintenanceschedule for the BMW Emission Control Sys-tem. Service intervals are computed by the ser-vice interval indicator and displayed on the in-strument panel.

However, BMW NA will not deny your warranty

repair claims solely because you do not havemaintenance records or you did not perform therequired maintenance unless BMW NA dem-onstrates that such lack of required maintenanceis a direct cause of the emission control systemfailure. The instructions for required maintenanceand use can be found in the Owner’s Manualand in the Service section of this Statement.

It is strongly recommended that any replace-ment parts used for maintenance, repair orreplacement of emission control systems begenuine BMW Service Parts or BMW Autho-rized Remanufactured Parts. Without invali-dating this warranty, the owner may elect to

have maintenance, repair or replacement of the emission control systems performed byany automotive repair establishment, or electto use parts other than BMW AuthorizedRemanufactured or genuine BMW ServiceParts. However, the cost of such service orparts will not be covered under this warranty,except in emergency situations. In an emer-gency situation, where an authorized BMWcenter is not reasonably available or a war-ranty replacement part is not available within30 days, repairs may be performed at any

available service establishment or by any indi-vidual using any replacement part.

 A repair not completed within 30 days consti-tutes an emergency. BMW NA will reimbursethe owner for such emergency repairs (includ-ing labor, parts and diagnosis not to exceed BMWsuggested retail price for all warranted parts re-placed and labor charges based on themanufacturer’s recommended time allowancefor the warranty repair and the geographicallyappropriate hourly labor rate) that are coveredunder this warranty. Replaced parts and paidinvoices must be presented to a BMW center asa condition of reimbursement for emergencyrepairs not performed by a BMW center.

 The use of replacement parts, which are not of equivalent quality, may impair the effectivenessof emission control systems. If other than genu-ine BMW Service Parts or Authorized Remanu-factured Parts are used for maintenance, repairor replacement of components affecting emis-

sion control, the owner should obtain assurancesthat such parts are warranted by their manufac-turer to be equivalent to genuine BMW parts inperformance and durability. BMW NA assumesno liability under this warranty with respect toparts other than genuine BMW parts.

However, the use of non-BMW replacementparts does not invalidate the warranty on othercomponents, unless non-BMW parts causedamage to warranted parts.

What is not covered

 This warranty does not cover malfunct ionscaused by any of the following: accident, flood,misuse, modification, alteration, tampering, dis-connection, improper or inadequate mainte-nance, except if performed by an authorizedBMW center doing warranty repair work, use of leaded fuel or fuel other than as specified in theOwner’s Manual.

 The replacement of maintenance parts, suchas spark plugs, filters and similar items used inrequired maintenance services or the repair orreplacement of maintenance parts beyond thefirst replacement interval.

 Any car on which the odometer has been re-placed or altered and the true mileage cannotbe determined.

 The car, if the vehicle identification number isaltered or cannot be determined, or if the carhas been declared a total loss or sold for sal-vage purposes.

General

 The warranty gives you specific legal rights, and

you may also have other rights which vary fromstate to state.

 THE DURATION OF ANY IMPLIED WARRAN- TIES, INCLUDING THE IMPLIED WARRANTY OF MERCHANTABILITY, IS LIMITED TO THEDURATION OF THE EXPRESS WARRANTIESHEREIN. BMW OF NORTH AMERICA, INC.,HEREBY EXCLUDES INCIDENTAL AND CON-SEQUENTIAL DAMAGES, INCLUDING LOSSOF TIME, INCONVENIENCE, OR LOSS OF
