Pursuant to the Motion introduced by the Council on June 22, 2012, and its subsequent action executed under Section 245 of Article II of the Charter of the City of Los Angeles, the Department of Building and Safety (LADBS) respectfully submits the record of the Board of Building and Safety Commission's action ("Board File") regarding the appeal to the Board concerning the property located at 12970 West San Vicente Boulevard.
The Board's action taken on June 12, 2012 was a denial of the request (with prejudice) to allow an indefinite extension of time ('life tenancy') to comply with LADBS' 'Substandard Order to Compli (# A-1984528), regarding the unapproved conversion of an attached garage, therein creating a second dwelling unit within the RE-15 Zone, without the required permits, inspections, and approvals.

FINDINGS:
1. TI1e request does not meet the spirit and intent of the Code inasmuch as the converted spaces were not inspected or approved as habitable living space, and by granting such a request would exempt this property from adhering to the well reasoned codes governing residential structures for the purpose of living, while affording the inhabitants of those spaces, a reasonable degree of safety.
2. The request, as stated, is not a slight modification of the code inasmuch as granting such a request exempts the property from the Building and Zoning codes and further, the surrounding property owners have an expectation that zoning and building code violations affecting their living will be enforced by appropriate city officials.
DATE OF STAFF CONFERENCE: April I 7, 2012 via telephone.

DISCUSSION I BACKGROUND:
The property consists of a one-story, Single Family Dwelling with an attached one-car garage separated from the house by a covered breezeway. The garage has been converted to habitable space with a bathroom added within the garage consisting of a shower, lavatory, and toilet. The breezeway has been enclosed to create interior space, with a raised floor and an additional bathroom with a shower, lavatory, and toilet. The garage and breezeway habitable space is independent from the house, each with their own entry doors. There is no access to the interior of the single family dwelling from these areas.
In October 2008, as a result of a complaint about a garage being used as a dwelling, a code enforcement inspector visited the site verifYing the validity of the complaint and subsequently issued a Substandard Order to Comply A-1984528, which addressed the unapproved conversion and use of the garage and breezeway as habitable space.
In March 2009, the owner submitted plans and applied for a permit in an effort to legalize the construction listed in the order to comply. There has been no advancement of the permit process since this initial application.
In November 2009, a second Order to Comply was issued (A-2398529) citing the failure to comply with a valid order. This action prompted a response from the owner which initiated con·espondence between city council deputy Mr. Jim Horowitz and inspectors with code enforcement. Mr. Horwitz, acting as a liaison, discussed the options that the owner has in satisfYing the order.
December 2009, Sr. Inspector Andy Chalmers granted an indeterminate extension oftime, at the behest of Council Deputy Mr. Horwitz, allowing the owner to resume the permit application process.
December 06, 2010, Code Enforcement Inspector Dale Schwartz responded to another customer service request addressing the unapproved construction and occupancy of the garage. An inspection was conducted with the owner lla Hirsh and Council Deputy Mr. Horwitz present. There was a brief discussion about the open case written against the property.
December 14, 2011, Inspector Pedro Rivera conducted a compliance inspection. Unapproved construction remained. Inspector Rivera reviewed options with Ila Hirsh, the owner.

January 06,2012, the case was senttothe.legal liaison within the department to prepare for an administrative hearing, because the owner does not wish to comply with the order.
Januaty 19, 2012, the owner, Jla Hirsh, filed an appeal to be heard before the BBSC for a "life tenancy" with respect to the unapproved construction as stated in the order and is the subject presently before. the Board.
February 2012, Stafflnspector J. T. Christian met with owner Ila Hirsh and Council Deputy Mr. Horwitz at the subject property to discuss the upcoming BBSC hearing. Photographs were obtained. The garage and breezeway remain as habitable space. Observed during the inspection was a microwave cooking appliance and miscellaneous food items stored in a closet. The area which is patt of the order to comply appears to be 0ccupied. This would be consistent with a recent complainant's observation.
CODE:
SECTION 12.03 DEFINITIONS
HABITABLE SPACE. A space in a building for living, sleeping, eating or cooking. Bathrooms, toilet rooms, closets, halls, storage or utility spaces and similar areas are not considered habitable spaces.
SECTION 12.08. "R1" ONE-FAMILY ZONE.
The following regulations shall apply in the "Rl" One-Family Zone:
A. Use. No building, structure or land shall be used and no building or structure shall be erected, structurally altered, enlarged or maintained except for the following uses, and when a "Supplemental Use District" is created by the provisions of Article 3 of this chapter, for such uses as may be permitted therein:
1. One-family dwelling.
SECTION 12.21 - GENERAL PROVISIONS
A. Use. I. Conformance and Permits Required.
(a) Permits and Licenses. No building or structure shall be erected, reconstmcted, structurally altered, enlarged, moved, or maintained, nor shall any building, structure or land be used or designed to be used for any use other than is petmitted in the zone in which such building, structure or land is located and then only after applying for m1d securing all permits and licenses required by all laws and ordinances.

SECTION 91.103- VIOLATIONS
91.103.1 General. No person shall construct, alter, repair, demolish, remove, move, use, occupy or maintain, within the city, any building or structure or any portion thereof, except as provided by this Code. No person shall grade, excavate or fill any land except as provided by this Code. The permissive provisions of this Code shall not be presumed to waive any limitations imposed by other statutes or ordinances of the state or City. All ofthe provisions of this Code shall be limitations for safeguarding life, limb, health, property and public welfare.
SECTION 91.106- PERMITS
91.106.1 Permits Required.
91.106.1.1 Building Permits. No person shall erect, construct, alter, repair, demolish, remove or move any building or structure, nor shall any person commence any liquid washing, compressed air cleaning or steam cleaning of exterior surfaces of any building unless said person has obtained a permit thereof from the department. A separate permit shall be obtained for each separate building or structure except a group of temporary structures erected on one site for a limited period oftime be included on one pe1mit.
SECTION 91.8105- ILLEGAL BUILDINGS, CONSTRUCTION AND USE Every existing building, structure. or portion thereof constructed without a building permit shall be made to conform to the provisions of this code or shall be demolished and removed. Any use or occupancy existing in a building without authorization of a building permit shall be discontinued and removed or shall be made to conform to the provisions of this code.
SECTION 12.26. DEPARTMENT OF BUILDING AND SAFETY. A. Enforcement. The Department is granted the power to enforce the zoning ordinances of the City.
E. Certificate of Occupancy. No vacant land shall be occupied or used, except for agricultural uses, and no building erected or sttuctnrally altered shall be occupied or used tmtil a certificate of occupancy shall have been issued by the Superintendent of Building.
