Petition: Once a petition is requested, the Township prepares a formal

legal petition that includes: a preliminary estimate, a description of improvements and a legal description of the district.

Petitioner circulates petition and obtains signatures of residents (who’s name appear on the deeds) within the S.A.D. district who approve of having an S.A.D. established.

Residents should be aware that by signing the petition, they are making a commitment to be in the S.A.D. district. They cannot take their name off the petition, once committed.

It takes 51% of residents’ signatures (by land area) to be considered a valid petition (51% of road frontage for Road projects).

Once the petition is turned back in, the signatures are verified, and the percentages are calculated. If over 51%, the petition is sent to the Township Board for tentative establishment of the S.A.D.

Hearing #1: Tentative Establishment of District (approximately 1 month after petition is returned)

Township Board considers petition, and if valid, authorizes the Township Engineers (Giffels-Webster) to proceed with the project.

The Township Engineers prepare the plans, submit for permits, prepare cost estimates, and publicly bid out the project.

Once the contractor’s qualifications are check, the expected costs for the project are calculated and Township is informed that the project is ready for the first public meeting.

Hearing #2: (First Public Hearing)(Typically 3-6 Months after Hearing #1) A public hearing is held where the residents have an

opportunity to review the expected costs and the particulars of the project, and to voice their opinion why they are, or are not, in favor of the S.A.D. continuing forward.

Although your signature cannot be officially removed from the petition, this is the opportunity for residents no longer in favor of the project to voice their opinion.

The Township Board will then vote on whether or not to continue with the project.

Hearing #3: Hearing of the Roll(Second and Final Public Meeting, Typically One Month after Hearing #2)

A hearing of the roll is held that is open to the public.

The exact district is formally established. The costs per parcel are finalized. Typically, a contractor is chosen and awarded

the contract following this hearing.

S.A.D. Payments

• The Township will automatically assess residents over a 10-year period to pay for the costs of the S.A.D.

• Residents may chose to pay off the balance of the S.A.D. at any time.

• If the balance is paid in full at the first payment, no interest is charged.

• Since this project is planned to be funded by the Township without issuing bonds (therefore saving approximately 4%-6% of total costs) an 8% interest rate is charged to any unpaid balance remaining after the first installment of the S.A.D.

Differences between RCOC and Township SAD’s

• There are three main differences:– Benefit amount (cost):

• RCOC uses a calculation based on average lot frontage plus additional frontage over the average.

• Commerce see the benefit as equal amongst all parcels, and therefore the charge is equal.

– Warranty:• Commerce requires the contractor to provide a two-year

maintenance and guarantee bond.• RCOC provides a 20-year maintenance guarantee (which

they are supposed to maintain anyways)

– Requirement for Valid Petition:• RCOC requires at least 51% of frontage signatures for each

road in the SAD.• Commerce Township requires 51% of frontage signatures in

the SAD as a whole (not each street).
