    NAY PYI TAW , 17 AugAccording to the 12.30 hr M.S.T observationtoday, the water level of Thanlwin River at Hpa-an 782 cm has exceeded by 32cm (about one foot) above its danger level. It may decline its danger level 750cm during the next 48 hours.

    The water level of Shwegyin River at Shwegyin 718 cm has exceeded by18 cm (about 0.6 foot) above its danger level. It may decline its danger level700 cm during the next 24 hours.

    The water level of Ngawun River at Ngathainggyoung 1176 cm hasexceeded by 46 cm (about 1.5 feet) above its danger level. It may remain aboveits danger level 1130 cm during the next three days, announced by theMeteorology and Hydrology Department. MNA

    (2) The Investigation Commission is to investigate the following matters so as to exposethe incident and present suggestions along with reviews.

    (a) the causes of the conflict that undermines peace and stability(b) casualties, property losses and other damages due to the conflict(c) measures taken for restoring peace and stability(d) rescue and rehabilitation tasks(e) Short- and long-term measures to be taken for ending the conflict(f) finding out the ways for peaceful coexistence between different creeds and

    ethnic groups(g) suggestions for law enforcement(h) suggestions for economic and social development

    (3) President Office and Rakhine State Government are to make arrangements for security and administrative affairs while the Investigation Board is on duty.(4) While making investigations into the incident, the Investigation Commission has therights to probe into the incident in accord with Code of Criminal Procedures and EvidenceAct as well as to summon the witnesses, see documents and have access to the necessary

    places. The investigation report is to be submitted directly to the President by 16 November, 2012.

    Zomi Congress for Democracy to register aspolitical party

    The Union Election Commission announced today that Zomi Congress for Democracy Party headquartered at No.203, Room 18, 3 rd Floor, Pansodan Street,Kyauktada Township, Yangon Region, is allowed to register as a political party as of 17 August, 2012 in line with Section 9 of Political Parties Registration Law.

    The partys registration number is 59.

    In addition, accordingto the section 54 of the MicroFinance Law says that no bodycan run micro finance business

    without license, and if thosewho fail to follow it, wouldhave to face fines or to serve

    jail term no more than fiveyears or both. So, actionswould be taken againstunlicensed money lenders,according to The MoneyLenders Act (1945) and MicroFinance Law. So, these lawshave given protections to

    At the reportsubmitting session, membersof Bill Committee U KhinMaung Nyo and U Soe Soesubmitted the committees

    report on Bill revoking theMyanmar Five Stars LineCorporation Law (1964) andBill revoking the State CropsMarketing Board Act .

    At proposal discussionsession, U Thein Swe of AnConstituency made his the

    pro posal on calling onrespective Union-levelbodies which are organizedin accordance with the StateConstitution to adopt rules,rules, laws and proceduresand laws which had beenenacted by the PyidaungsuHluttaw within 90 days afterthe President has signed ordeclared them on theduration set by the Hluttaw.

    pro ced ure s, ord ers anddirectives continue to beannounced. Rules prescribethe ways of how a prescribedlaw comes into effect.

    Therefore, it is knownto all that how important arule and regulation is. TheHluttaws are amending thenecessary laws as much as theycan. But, it has been assessedthat the relevant Union levelorganizations are hesitant inthe promulgating of rules over the relevant laws. Therefore, asuggestion is that theministries and the UnionAttorney-General Office areto appoint enough skilled

    personnel, to consult withother qualifies lawyers asnecessary, to introduceeffective management and to

    take systematic steps. Onlythen, will the people beinformed about complete lawsand rules as soon as possible.

    As to the proposal,Deputy Attorney-General UTun Tun Oo of the UnionAttorney-General Officeclarified that necessary rulesand regulations, notifications,orders, instructions and

    procedures for an already

    necessary although they have been promulgated but for somelaws, only notifications, ordersand instructions areannounced. There are somecases that need to be handledas appropriate according to thesubjects. There were many lawswhose rules havent beenannounced among the laws

    prescribed in successive eras.According to Section

    13 (B) of the 1973 law ondefining the words, if there wasno prescribed date of enforcement for a law, the lawwas in force on the day when itwas announced. Althoughrules havent been announced,a law can be in force and its

    protection and rights can beenjoyed. It means that law can

    be in force although its rules

    are announced.All in all, it cannot be

    surely said that theannouncement of rules isrequired for every laws

    pro mul gat ed by thePyidaungsu Hluttaw. Rulesare announced only whenthe subjects of original lawsare needed. In defining theoriginal laws, definition must

    be in real terms according tothe rule of law policy.Therefore, it is stated in the

    provisions that rules can beannounced instead rulesmust be announced. That waswhy, the original law is inforce although the ruleshaven been announced.

    Matters can beaddressed smoothly by theearly announcement of rulesfor a law whose provisionscan be implemented throughthe announcement of rules.But the relevant Union levelorganizations have to taketimes in scrutinizing, draftingand submitting the laws step

    by step and announcementof rules for a law is not alwaysneeded. Thus, only rules andregulations for the necessary

    laws should be announced.There can be problems for theUnion level organizations toannounce rules andregulations in 90 days. As it isalready stated that a law is inforce when it has beenannounced, coordination isto be made on whether thereis necessary to announce therules or not. And the proposal

    should be put on record.U Thein Swe who

    submitted the proposal saidthat at a time when changes

    are taking place there requirerules and regulations and theoriginal law alone is notenough for a law capable of

    protecting the people. Onlythen, can the people enjoythe rights. Thus, he soughtthe decision of the Hluttawwhich approved the proposalwith 273 votes, 68 against,and 18 in absentia.
