AddendumforFamilyHousing(BuckeyeVillage)1.ContractOfferandAcceptance
A. Shouldtheresidentbreakthecontractpriortothebeginningdate,thesecuritydepositwillbeforfeited.Inaddition,monthlyrentwillbechargedtotheresidentuntiltheapartmentcanbereassignedtoanewresident.
B. Iftheapartmentcannotbereassignedimmediately,theresidentwillbechargedmonthlyrentuntiltheapartmentcanbereassigned.Reasonableeffortwillbemadetoreassignallvacantapartmentsassoonaspossible.
C. Iftheresidenthasnotcheckedintothecontractedapartmentby3p.m.ofthebeginningdateofthecontract,theapartmentwillbeautomaticallyreassignedunlesstheresidenthasnotifiedtheBuckeyeVillageofficeinwritingthathe/shewillbe
checkinginatalatertimeordate.
2.ContractDurationA. ContractsmaybeginatanytimeatBuckeyeVillage,butexpireonMay15theachyear.Residentshavetheoptiontorenew
theircontractsforthefollowingyear(May16thtoMay15
th).
B. Thecontractwillcontinueuntilterminatedbytheresidentswithdrawalfromclassesorbytheresidentsgraduationfromtheuniversity.AnIntenttoVacateform,availableattheBuckeyeVillageoffice,mustbeonfileattheBuckeyeVillage
officeatleast45daysinadvanceofthedatetheresidentintendstovacatetheapartment.
C. Iftheresidentgiveslessthantherequired45daysnoticeofintenttovacate,rentwillbechargedfor45daysfromthedatethevacancynoticeisreceived.Intheeventthattheresidentgivesmorethan45daysnoticeofintenttovacate,rentwillbe
chargedthroughthedateonwhichtheapartmentisvacatedandkeysreturned.
D. Iftheresidentisgraduating,theresidentmustvacatethepremisesnolaterthansevencalendardaysaftercommencement,givingtheproperadvancevacatenoticeof45days.
3.TermsofContractA. Theapartmentshallnotbeusedforunlawfulpurposes,foranypurposecontrarytofederal,state,oruniversityguidelines,o
insuchamannerastoconstituteanuisanceorannoyancetotheresidentialcommunity.
B. Whenanon-disabledresidentisassignedtoanapartmentthatcomplieswiththeADAlaws,thelastnon-disabledresidentintotheapartmentwillbethefirstresidentvacatedfromthatapartmentinordertoassignthatapartmenttoadisabled
resident.4.Utilities
A. Theuniversityagreestoprovidereasonableamountsofheat,waterandwastedisposalconsistentwithuniversitypoliciesduringthecontractservicesperiod.
B. Theuniversityagreestoprovideinternetintheassignedapartmentandtoincludethemonthlylocalservicechargeintherentfee.
C. Residentswillberesponsibleforobtainingandpayingdirectlyforallotherutilities,including,withoutlimitation,electricity,telephoneandcableservices,thattheresidentmaydesire.
5.RentandPaymentsA. Rentwillbechargedandprorated(see5Ebelow)fromthedateonwhichtheresidentpicksuptheapartmentkeyorfrom
thebeginningdateofthecontract,whichevercomesfirst.
B. Allmonthlyrentpaymentsaredueonorbythefirstdayofeachmonthandmustbemadeduringthefirstfivebusinessdaysofeachmonth.
C. Rentreceivedorpostmarkedafterthefifthbusinessdaywillbeassessedlatepenaltiesupto$25perpayment.D. AllrentsarepayabletoTheOhioStateUniversity.PaymentsmaybemadewithVisa/MasterCard/Discover/Americanexpress
onlineorbyphoneandwillincludea$2creditcardprocessingfee.Paymentsmaybemadeinpersonbypersonalcheck,
travelerscheck,moneyorder,cash,orVisa/MasterCard/Discover/AmericanExpresswithoutanyprocessingfee.Payments
mayalsobemailedto:UniversityHousing,350MorrillTower,1910CannonDrive,Columbus,Ohio,43210-1290.
E. Rentchargesforoccupancylessthanafullmonthshallbecomputedonthebasisofadailychargeequalto1/30ofthemonthlyrenttimesthenumberofdaysthattheresidentand/orhis/herbelongingsoccupytheapartment.
6.DelinquentPayments

A. Ifrentpaymentisnotmadeasof5p.m.onthefifthbusinessdayofthemonth,itwillbeconsidereddelinquent.Beginninga5p.m.onthefifthbusinessdayofthemonth,alatepenaltyof$15willbeimposedinadditiontotherent,plusanadditional
$2foreachdaythereafter,toamaximumlatepenaltyof$25.
B. Iftheresidentspaymentbypersonalcheckisreturnedbythebankforinsufficientfunds,a$30processingfeewillbecharged.
C. Residentswhoserentpaymentshavebeenreturnedthreetimesforinsufficientfundsincheckingaccountsordeclinedcreditcardswillberequiredtopayfuturerentbymoneyorder.
D. Theuniversityshallhavetherighttorepossesstheapartmentshouldtheresidentsrentbeinarrearsandremainunpaidfor30daysafterthereceiptofnoticeofdefault.Theresidentagreestorecoveranydeficiencyinrentandexpensesforany
damagesthattheuniversitymayhavesustainedasaresultoftheresidentsuseandoccupancyoftheapartment.
E. Ifachangeassessedtoacreditcardischallengedbytheresidentand,afterresearch,isdeemedvalid,a$30chargewillbeassessedtorecoverresearch/processingtime.
F. Paymentsdelinquentformorethanonemonthorremainsdueupondeparturewillbebilledtotheresidentsuniversityaccount.Aholdmayalsobeplacedupontheresidentsstudentrecords.
7.SecurityDepositA. Uponacceptanceofhis/hercontractinBuckeyeVillage,theresidentshallpayasecuritydepositequaltoonemonthsrent.B. Uponproperterminationofthecontract,thesecuritydepositwillbeappliedtotheresidentsrentchargesforthefinal
monthoftheresidentscontract.
C. Theresidentagreesthatuponvacatingtheapartment,he/shewillbeheldfinanciallyaccountableforanyunpaidrentowedbytheresidentaswellasforthecostofrepairsand/orcleaningtheapartment,beyondreasonablewearandtear.
D. Theresidentsliabilitytotheuniversityfordamagesshallnotbelimitedtoanyamount.E. Iftherearenosuchdamagesorlosses,theresidentssecuritydepositshallbeappliedtothelastmonthsrent.
Notwithstandinganysuchapplication,however,theresidentshallremainliableforalldamagesandlossesandallrentand
otherpaymentsuntilpaymentinfullhasbeenmade.Failuretodischargeallsuchliabilitieswillresultinthedenialoffurther
registrationandenrollmentwiththeuniversityandofgraduationandwiththeplacementofafinancialholdonthe
residentsstudentrecords,includingtranscripts.
F. Theuniversitywillprovidetheresidentwithawrittenitemizedlistofanyamountsappliedfortheabovepurposesandwillreturnanyoverpaidfeesaftertheterminationofthecontractanddeliveryoftheapartmentbacktotheuniversity.
8.ActivityFeeA. TheresidentagreestopayanactivityfeeeachsemestertobeusedbytheBuckeyeVillageCouncilforsocialactivitiesor
otheractivitiesthecouncilmayagreeupon.
B. Thefeewillbecollectedwiththerentduringthefirstmonthofeachacademicsemester.C. Allunallocatedactivityfeeswillbedeductedfromtheresidentsoverpaidfeesattheterminationofthecontract.D. ThefeeisestablishedbytheBuckeyeVillagecouncilandmaybechangedbythecouncilinaccordancetoitsconstitutionand
bylaws.
9.ContractTerminationA. Upontermination,theuniversitymaychangethelockstotheapartment,mailbox(es),anddrawer(s)andchargeallcosts
associatedwithsuchachangetotheresident.
B. TheresidentunderstandsthattheuniversitymayalsoterminatethiscontractinaccordancewithSection26oftheTermsandConditionsupondiscoverythattheresidenthasunpaidfeesorcharges,currentorprevious,withtheuniversityorthat
theresidentwasineligibleforacontractofferforcauseoffollowingabehaviorandconducthearing.10.EntryandInspection
A. Theuniversityandresidentagreethatentryandinspectionoftheapartmentwilloccurthreetofourweekspriortodeparturetoidentifyworktobedoneoncetheapartmentisvacated.Inspectionswillbecoordinatedwiththeresidentand
mayincludemaintenanceandhousekeepingstaff.
11.ServicesandMaintenanceA. Theresidentagreesnottowastenorpermitwasteofwaterorheatandagreestotakepropercareofwaterandlightfixture
inthecontractedpremisesandtopayforalldamagessustainedbyhis/herapartmentbyneglect.
B. TheresidentagreesthatnoalterationsorchangeswillbemadeinthecontractedapartmentwithoutfirstobtainingconsentinwritingfromthemanagerofBuckeyeVillage.

C. Allbreaks,damages,andneedforgeneralrepairsshouldbereportedtotheBuckeyeVillageoffice.Nochargeswillbemadeforrepairsthatarisefromnormalwearandtear.Residentswillbeassessedforalldamagesthatareconsideredmorethan
normalwearandtear.Afterregulatorybusinesshours,emergencymaintenance(noheat,noelectricity,stopped-uptoilets,
wateroverflow,etc.)canbereportedbycalling614-292-4357.
D. Requestsformaintenanceservicebytheresidentwillconstituteauthorizationtoentertheapartment.E. Theuniversitywilldofire/safety/healthandpreventativemaintenanceinspectionsperiodically.
12.KeysandSecurityA. Atcheck-in,theresidentwillbegiventhreeapartmentkeysandtwomailboxkeys.Residentsareresponsibleforsecurityof
thekeys.
B. IftheBuckeyeVillageofficeisopen,theresidentispermittedtocheckoutaloanerkeyatnochargetoopenhis/herlockedapartment.ShoulditbenecessaryforBuckeyeVillagestafftolettheresidentintohis/herapartmentwhenthe
BuckeyeVillageofficeisclosed,a$25feewillbeassessed.
13.InventoryA. Uponpickingupkeystohis/herapartment,theresidentwillbeprovidedacheck-InInventoryformthathe/shemust
completeandreturntotheBuckeyeVillageofficenolaterthanaweekafterthemove-indate.Theformshouldbe
completedcarefullyanddamagerecordedbeforeoccupancysincealldamagesnotlistedatthistimewillbechargedtothe
residentwhentheapartmentisvacated.
14.ApartmentTransfersA. Transferfromatwo-bedroomapartmenttoanothertwo-bedroomapartmentorfromaone-bedroomapartmenttoanother
one-bedroomapartmentisnotpermitted.
B. Applicationsfortransferfromaone-bedroomapartmenttoatwo-bedroomapartmentcanbefiledwiththeBuckeyeVillageofficeandwillbeacceptedonlyfromresidentswhohavechildrenintheircustody.Singlegraduate,professional,or
nontraditionalresidentswillbeeligibleforone-bedroomapartmentsonly.
C. Whenatransferisapproved,a$50transferchargewillbeassessedforresidentstransferringfromaone-bedroomtoatwo-bedroomapartment(orviceversa).Eachtransfermustbecompletedwithinthreecalendardaysaftertheapartment
becomesavailable.
15.BehaviorandCareofFurnishingsA. Theresidentagreestoensurethatfamilymembersand/orguestswillnotactinadisruptiveornoisyfashion,andresidents
withchildrenagreetoberesponsiblefortheirchildrensactions.
B. Theuniversityfurnisheseachapartmentwithanelectricrange,electricrefrigerator,electricgarbagedisposal,andairconditioner.C. Residentsareresponsibleforthecareoftheapartmentandproperuseofallequipmentinsideand/orattachedtothe
dwellingunit.ManufacturersinstructionsforpropercareanduseareavailableattheBuckeyeVillageoffice.
D. Allfurnishingsarepermanentandmustnotberemovedbytheresident.16.SurrenderofPremises
A. Allapartmentsmustbeinspectedfordamagesandcleanlinesspriortotheresidentsdeparture.Anappointmentforthisinspectionwillbemadewiththeresident.
B. Theresidentsrentandoccupancywillceasewhenhe/shehasappearedattheBuckeyeVillageofficeandhascompletedthefollowingitemsofbusiness:
i. Surrenderedallapartmentkeysii. Surrenderedonemailkey(residentswithupstairsapartmententrances)iii. Providedinwritingaforwardingaddresswherehe/shemaybecontactedandwhereanyfurther
correspondencemaybesent
C. Iftheapartmentorfurnishingsrequirecleaningortheappliancesorequipmentneedrepair,reasonablewearexcepted,theoutgoingresidentwillberesponsibleforthisexpense.
D. Iftheresidentoranyoneclaimingundertheresidentcontinuesinpossessionoftheapartmentoranypartthereofbeyondtheterminationofthiscontract(thevacatedate),theresidentwillberesponsibleforpayingproratedrentonaday-to-day
basisforeachdayhe/sheremainsintheapartmentbeyondtheterminationofthiscontract.

E. IfnopriorpermissionforanextensionofthevacatedatewasgivenbytheBuckeyeVillageofficeorUniversityHousing,theuniversityreservestherighttoforcetheremovalofaresidentinthecasethatanapartmenthasalreadybeenrentedtoa
newresident,ortoassesstheresident$50perdayholdovercharge.
18.GrievancesA. Complaints/grievancessometimesariseregardingconditionsofoccupancy.Whenaresidenthasacomplaint/concern,
he/sheisencouragedtodiscussthematterwiththemanagerofBuckeyeVillagetoseekresolutiononaninformalbasis.
Whenacomplaint/concernisnotpromptlyresolved,theresidentmayfileaformalgrievancetosecurearesolution.
B. Shouldtheresidentdesiretofileaformalgrievance,he/sheshoulddosoinwritingandpresentthegrievancetothemanagerofBuckeyeVillage.Themanagerwillconductameetingwiththeresident,determineallthefactspertainingtothe
grievance,andadvisetheresidentoftheresolutionwithinfivebusinessdays.Iftheresolutionisnotsatisfactorytothe
resident,he/shemayappealtotheAssistantDirectorofUniversityHousing.Ifthegrievantisnotsatisfiedwiththatdecision
he/shemayappealtotheAssistantVicePresidentofStudentLife.
19.JointandSeveralLiabilityA. Eachresidentthatexecutesthiscontractshallbejointlyandseverallyliableforthepaymentofrentandfordamagesagainst
theuniversityinaccordancewiththeTermsandConditionsofthiscontract.Theuniversitycanatitsoptionproceedagainst
theresidentofitschoicewithoutproceedingagainsttheother(s),and,indoingso,theuniversitywillinnowayrelinquishor
diminishanylegalremediesagainsttheremainingresident(s).
20.EntireAgreementA. Thiscontractcontainstheentireagreementbetweenthepartiesunlessotherwisestatedandsupersedesallprior
agreements.
