TheMINIMaintenance Program

The MINI Maintenance Program is a benefitdesigned to help reduce the cost of scheduled andunscheduled maintenance. The program has beendevised with the following objectives: to maximizevehicle safety, reliability, and resale value byminimizing breakdowns resulting from wear, andminimizing cost and inconvenience by computingmaintenance intervals based upon the specificmanner in which each individual vehicle is driven.

MINI Cooper, MINI Cooper S and MINI JohnCooperWorks passenger cars purchased fromany authorized MINI dealer in the United Statesare covered by the MINI Maintenance Programfor 36 months or 36,000 miles, whichever occursfirst. Coverage begins on the date of first retailsale or the date the vehicle is first placed intoservice as a sales demonstrator, AftersalesMobility Program (AMP) Vehicle or companyvehicle, whichever is earlier.Any authorized MINI dealer in the United Stateswill perform the scheduled or additionalmaintenance services on your vehicle at noexpense to you.

Coverage

The MINI Maintenance Program covers allfactory recommended maintenance, asdetermined by the Condition Based Service(CBS) system. Additional specific items thatneed replacement due to normal wear and tear,and that are not covered by the original MINI NewPassenger Car Limited Warranty - such as brakepads, brake rotors, and wiper blades - areincluded, provided wear and tear exceeds MINIspecifications. Any applicable adjustmentsrequired due to normal operating conditions arealso included. See pages 6 - 8 of this Booklet foradditional information.

Exclusions from coverage include the following:� Items reimbursable under your MINI New

Passenger Car Limited Warranty

� Gasoline and gasoline additive� Windshield washer additive (except when in

conjunction with scheduled maintenance)� Tires, wheel alignment, tire balance and

rotation� Reset Run Flat Indicator� Wear and tear of soft trim items, such as:

seats, carpets, moldings, headliner, doorpanels and all chrome trim

� Damage which results from negligence,improper operation of the vehicle, wear andtear or deterioration due to driving habits orconditions, improper repair, environmentalinfluences, flood, accident or fire damage, roadsalt corrosion, alteration, installation ofnon-genuine MINI accessories, or use ofimproper, poor quality or contaminated fuel

� Altered or unreadable Vehicle IdentificationNumber (VIN) or odometer irregularities orvehicles where the true mileage cannot bedetermined

� Maintenance or repair after the vehicle isdeemed a total loss

� Maintenance or repairs performed by otherthan an authorized MINI dealer within theUnited States

� “Topping off” low fluids (e.g., engine oil,antifreeze, washer fluid, etc.) except whendone in conjunction with a scheduledmaintenance or other required maintenancework (as outlined in the customizedmaintenance checklist printout) that isperformed during an applicable MaintenanceProgram period

� Vehicles used in competitive events� Oil changes performed outside the

recommended maintenance intervals asindicated by the CBS

Maintenance UpgradeOption

Please contact your authorized MINI dealer forinformation and availability on the optionalMaintenance Program Upgrade for coverage upto 6 years or 100,000 miles, whichever occursfirst.

Intervals

Time intervals should be followed using themaintenance interval as indicated by theCondition Based Service data.

Maintenance intervals on motor vehicles haveconventionally been specified based uponaccumulated mileage. However, drivingconditions have a major influence on routinemaintenance requirements; distance traveled isonly one of the significant factors. A vehicledriven for 50,000 miles of short trips in the citywith numerous cold starts, prolonged periods ofidling, stop-and-go driving, and high enginespeeds during acceleration requires morefrequent maintenance intervals than a vehicledriven for 50,000 miles for long distances at lowengine speeds primarily at operatingtemperature.

The advanced technologies at MINI have led tothe development of the Condition Based Service(CBS) system which computes the actualoptimummaintenance requirements based notonly upon the accumulated mileage, but takinginto account important factors such as high orlow engine speeds, short or long trip driving.

Condition Based Service (CBS)

CBS is a further development of the ServiceInterval Indicator System. Sensors andsophisticated algorithms take even more detailedaccount of the various conditions of vehicle use.

The remaining times for selected maintenancetasks as well as any legally prescribed dates aredisplayed to you individually:� Engine oil� Brakes - front and rear separately� Brake fluid� Vehicle check� Required State Inspection(s)

CBS thus determines the current and futuremaintenance requirements.

The vehicle’s current service status isautomatically saved in the remote control key.The MINI Service Advisor at your MINI dealer hasa device called a key reader. When your MINIService Advisor inserts your key into the keyreader, all pertinent vehicle and servicing data willbe available, and a customized maintenancechecklist is printed out based on the specificoperations called for by the Condition BasedService.

Have maintenance and repair work performed byyour MINI dealer. Make sure that themaintenance work is stamped in this Service andWarranty Information Statement. These entriesare the evidence of regular maintenance of yourvehicle and are a requirement for warrantyclaims.

Disconnecting the battery during periods oflong-term storage will interrupt the

calculation of time-based services. Have all itemsrequiring time-based maintenance, such asbrake fluid, and possibly also the engine oil andmicrofilter, brought up to date by your MINIdealer. Also see the section on battery care onpage 10 of this Booklet.

Service Required Display

The remaining driving distance and the date ofthe next scheduled service are displayed brieflyimmediately after you start the engine or switchon the ignition.

For specific maintenance operations, you canview the respective distance remaining or duedate individually in the tachometer.

1. With the engine running, press the button inthe turn indicator lever repeatedly until“SET/INFO” appears.

2. Keep the button pressed until the displaychanges.

3. Briefly press the button until thecorresponding symbol and “SERVICE-INFO”appear.

4. Keep the button pressed until the displaychanges.

5. Briefly press the button to display theindividual service requirements.

Special Note –Maintenance Intervals

The maintenance requirements for your vehicleare determined dynamically by the ConditionBased Service (CBS) system. The maintenanceitems stated herein reflect the latest informationavailable at the time of the printing of thisBooklet, and are subject to change.

The completion of certain subsequentmaintenance items or services, as required bythe MINI New Passenger Car Limited Warranty,will be specified at intervals computed by theMINI Condition Based Service system as follows:� Oil Service: Engine oil should be changed with

the engine at operating temperature.

Your MINI is factory-filled with MINI HighPerformance Synthetic oils. We recommendMINI High Performance 5W-30 Synthetic Oil(MINI part number 07 51 0 143 829) for regularscheduled engine oil changes.

MINI recommends that you check your engine oillevel whenever you add fuel to your vehicle. If youneed to add oil between oil changes and MINIHigh Performance Synthetic Oil is unavailable,you may top up the oil level with one of thefollowing approved synthetic oils. For informationon checking your engine oil level, refer to yourvehicle’s Owner’s Manual.

The synthetic oils listed below meet MINI USA, aDivision of BMW of North America, LLC’sLong-life rating LL-01:� Castrol Syntec European Formula SAE 0W-30� Mobil 1 SAE 0W-40� Pennzoil Platinum European Formula Ultra

SAE 5W-30� Valvoline SynPower SAE 5W-30

The choice of the right SAE grade is based onthe climatic conditions in the region in which younormally drive your MINI. To best determinewhich SAE grade is best suited for your vehicle,contact an authorized MINI dealer.

If you are unable to obtain MINI HighPerformance Synthetic Oil or an approvedsynthetic oil from the list above, use only asynthetic oil with an API rating of SM or higher.

The following maintenance services must beperformed at the mileage/time stated (timeintervals begin from the vehicle’s productiondate):� Brake Fluid Service: Change brake fluid every

two years, or when specified by CBS. Theventilation system microfilter is also changedat the same time.

� Oxygen Sensor Service: The oxygen sensordeteriorates strictly on a mileage basis andmust therefore be replaced at the followingintervals to maximize vehicle fuel economy andminimize exhaust pollution. Replace at120,000 miles (replace every 150,000 miles ifeligible for the California Emissions Warranty)

� Spark Plug Service (connected to specificEngine Oil Service):Replace at the following intervals:

Cooper and Cooper S: At every 6th Engine OilService (approximately 60,000 miles)John CooperWorks: At every 3rd Engine OilService (approximately 30,000 miles)

� The engine coolant has a long-term rating anddoes not need to be changed except forsystem repairs.

For your convenience, you may also wish to haveyour MINI dealer perform any necessaryoperations to fulfill any state inspectionrequirements in your area concurrent with themaintenance services specified above duringother repairs. Should you requestmorefrequentmaintenance service, the cost ofthese services will not be covered by theMINIMaintenance Program.

MINI has applied the most modern technologicaladvances not only to the design and productionof your vehicle, but also to computing of theoptimummaintenance interval for your type ofoperations and driving style. Your MINI dealer hasmade a substantial investment in unique MINIspecial service tools to enable its MINI factorytrained service technicians to perform qualityrepairs on your MINI in minimal time to helpmaximize your satisfaction with your MINI, itslongevity, and resale value.

QualityCertification I

For a detailed list of items inspected, refer to theQuality Certification I form provided to the Ownerat time of delivery. A copy of the form is on file atthe selling MINI dealer.

Fuel Quality – Gasoline

Only use fuels advertised to have adequatedetergency and low alcohol (such as ethanol)content. Please refer to your Owner’s Manual forimportant information on the fuel recommendedfor use in your vehicle. Use of fuels withinsufficient detergent and/or excess alcohol cancause driveability problems that necessitatecleaning intake valves and fuel injection valves,and, when applicable, adjusting the engine idle.We suggest having this work performed by yourauthorized MINI dealer, perhaps while regularmaintenance is performed. Your MINI dealer canalso recommend a gasoline additive that willprovide sufficient detergency. While thisrecommended unscheduled maintenance is notrequired in order to maintain the emissionwarranty, cleaning of intake valves or, whenapplicable, fuel injection valves, or adjustment ofengine idle, necessitated by use of inappropriatefuel, it is not covered by warranty because nodefect in material or workmanship or componentfailure is involved.

Maintenance Service Summary

The Condition Based Service (CBS) system willdetermine the requirement for performing themaintenance services described in this section,ending on page 8 (excluding items noted as “notshown in CBS”). These services may be requiredeither individually or in conjunction with othermaintenance services.

Maintenance services are performed as outlinedin this section, based on intervals of either time,mileage or after performing a specified numberof previous services. These intervals correspondto the latest information available when thisBooklet was printed. Maintenance intervals aresubject to change with newer vehicles or mayalso apply retroactively. Your MINI dealer willadvise and perform maintenance services asrequired by the most recent information thatapplies to your vehicle.

Unscheduledmaintenance

Only use fuels advertised to have adequatedetergency and low alcohol content. Use of fuelswith insufficient detergent and/or excess alcoholcan cause driveability problems that necessitatecleaning intake valves and fuel injection valves,and, when applicable, adjusting the engine idle.We suggest having this work performed by yourauthorized MINI dealer, perhaps while regularmaintenance is performed. Standard operations

Maintenance work:� Verify Check Control messages.� Check indicator and warning lights.� Reset CBS display.� Lubricate tailgate hinges.� Inspect tires, adjust tire pressures and reset

Tire Pressure Monitor.

Engine oil

Maintenance work:� Change the engine oil and oil filter. We

recommend MINI High Performance 5W-30Synthetic Oil P/N 07 51 0 143 829.

� At every 5th engine oil change: Intake aircleaner: replace air filter element (reducereplacement interval in dusty operatingconditions).

� Parking brake: Check function and burnishpads.

Front brake

Maintenance work:� Replace brake pads, clean brake pad contact

points in calipers.� Brake discs: Check surface and thickness; if

necessary, replace at extra charge.*

Rear brake

Maintenance work:� Replace brake pads, clean brake pad contact

points in calipers.� Brake discs: Check surface and thickness; if

necessary, replace at extra charge.*� Parking brake: Check condition, brake lining

thickness and function; if necessary, replace atextra charge.*

*Unless covered byMaintenance Program.

Vehicle check

Maintenance work:� Check operation of horn, headlight flasher and

hazard warning flashers.� Check instrument and control lighting, and

heater/air-conditioning blower.� Check lighting system: turn signals, back-up,

license plate, interior (incl. map, readinglights), glovebox, luggage area lights.

� Safety belts: check condition and function.� Check windshield wiper and washer jet

positions.

� Tires: check tread depth, wear pattern, outercondition, inflation pressure. If necessary,correct pressure.

� Battery: check state of charge (magic eye) andcharge if required.

� Visually inspect all SRS airbag units for torncovers, obvious damage or attachment ofstickers.

BatteryCare

If your car is driven only for short distances ofless than 10 miles over a prolonged period oftime, without an occasional drive at highwayspeeds, the engine’s charging system will notmaintain the battery. Insufficient use of thevehicle could result in short-term startingproblems and in the long term could damage thebattery.

In case the car is not operated for more than fourweeks, it is advisable to:� consider using a proper trickle charger,

following the charger manufacturer’sinstructions, to maintain the battery’s state ofcharge; or

� consult your MINI dealer regarding batteryremoval. Once removed, the battery must becharged and stored in a cool, dry place whereit can be protected from freezing. If the batterywill be stored for over 3 months, it must berecharged every 3 months, or else it willbecome damaged and useless.

Please consult with your MINI dealer for furtherguidance and information.

Corrosion Protection

Extensive corrosion protection measures nowmake it possible to offer a 12-year unlimitedmileage anti-corrosion warranty against rustperforation on your vehicle provided that thevehicle is maintained in accordance with theprovisions of the MINI New Passenger CarLimited Warranty as outlined in the WarrantySection of this Booklet (page 19).

The major degree of corrosion protection is dueto the electrophoretic dip painting process whichcathodically deposits paint particles on all bodyparts, attracting paint particles into the minutestcavities or seams. Body parts are designed toprovide optimum corrosion protection.

During manufacture, exterior body parts receivean additional corrosion protection coat. Hood,trunk, doors and other body parts with metalfolds are coated with PVC and sealed from theoutside.

All floor panels receive a resilient coating of PVCfor maximum protection against damage due tostones, etc.

Corrosion protection materials tested over manyyears are applied to the surfaces of cavities andto the entire underside of the vehicle during andafter assembly.

For additional information on the 12-yearunlimited mileage anti-corrosion warranty, seethe Warranty Section of this Booklet (page 20).

Restoring Corrosion Protection

Please take care that anti-corrosion material isreplaced when your car is repaired after body orchassis damage.

MINI will not accept any liability for any partsand accessories not approved by theMINIUSA, a Division of BMWNorth America, LLC.

UnderbodyMaintenance

The underbody has to be cleaned at least once ayear, in Spring, with plain water in order toremove mud, chemical sediments and otherdeposits. If those materials are not removed,corrosion (rust) will occur.

Your MINI dealer will do this anti-corrosionservice for you.

Do not apply additional undercoating orrust-proofing on or near the exhaust

manifold, exhaust pipes, catalytic converter orheat shields. During driving, the substance usedfor undercoating could overheat and causea fire.

The MINI Roadside Assistance Program reflectsMINI USA, a Division of BMWNorth America,LLC’s commitment to your complete satisfactionwith the MINI ownership experience.

Lock-Out

Please contact MINI Roadside Assistance forlockout situations. MINI Roadside Assistance willattempt to reunite the owner with a spare key bycalling someone at the customer’s residence orby sending a taxicab to pick you up. (Cost of thetaxi is not reimbursable.) Be sure the vehicle is ina safe location in the above situations. As a lastresort, we will have your MINI towed to adealership. The MINI dealership can assist withkey replacement. Towing services will beprovided up to a maximum of $100.00 perincident. The cost for replacement keys is theresponsibility of the owner/driver.

Towing Service

In the event of a mechanical breakdown normallycovered under the MINI New Passenger CarLimited Warranty, your vehicle will be transported(at no cost) to the nearest authorized MINI dealer,or to the MINI dealer of your choice, provided thatthe dealer is within a 50 mile radius of the closestdealer. Your vehicle is also covered in the event ofan accident or collision.

If a breakdown occurs after normal businesshours, your vehicle will be transported to a securelocation and transported to the nearestauthorized MINI dealer on the next business day.

If you request that the vehicle be taken to alocation other than the nearest authorized MINIdealer, any additional expense will be yourresponsibility.

Towing requests for vehicles disabled because ofcasualty, fire, act of God, acts of war (declared orundeclared), or violation of law (federal, state orlocal) are accepted at the expense of theowner/driver.

If it is necessary for you to have your vehicletowed through your own arrangements, youmust contactMINI Roadside Assistance forprior authorization and instructions on claimprocedures. All claims must be submitted withinsixty (60) days of the disablement or occurrence,accompanied by the original receipts. Claimsreceived after that time period may not behonored and are subject to the full discretion ofMINI Roadside Assistance. If MINI Roadside

Assistance is not contacted for “prior”authorization, the maximum coverage for towingsituations is $50.00.

Sign-and-Drive

In most instances, services provided under theMINI Roadside Assistance Program do notrequire immediate payment.

Usually, you will be able to sign a receipt, so theprovider of the service can be reimbursed directlyby MINI Roadside Assistance.

Parts, materials, and fuel should be paid for byyou directly to the provider of the services.

Trip Interruption Benefits

Trip interruption benefits are provided formechanical breakdowns as follows:� Breakdowns that are warranty related, and;� Must occur in excess of 100 miles from the

driver’s primary residence, and;� Repairs cannot be completed during normal

business hours on the same day ofbreakdown.

Reimbursements will be made for meals, lodging,car rentals, and alternate transportation to bringthe driver and the MINI passenger car togetherafter the vehicle has been repaired by anauthorized MINI dealer. Original receipts and acopy of the vehicle repair order must accompanyall reimbursement requests.

Trip interruption coverage is limited to $1,000.00per incident, for a maximum of five days perincident.

Always contact MINI Roadside Assistance for tripinterruption benefits. They will assist in makingall the necessary arrangements.

Safety belts are covered under the MINI NewPassenger Car Limited Warranty for defects inmaterial or workmanship for a period of 10 years,

unlimited mileage from the date of purchase. Inorder to be eligible for this coverage, the vehiclemust be a new vehicle retailed in the State ofKansas and the repair must be performed by anauthorized MINI dealer in Kansas.

Other Items

Wheel alignment, balancing and wiper bladeinserts are covered up to the first 2,000 miles onthe vehicle.

Itemswhich are subject to wear and tear ordeterioration due to driving habits orconditions, such as brake pads/linings, brakediscs, clutch disc, pressure plate, filters,upholstery, trim and chrome items, paintfinish, drive belts, glass, and similar items,are specifically limited to defects inmaterialorworkmanship.

What is not covered:

Remote control transmitter battery replacement.

Damage, including consequential, which resultsfrom negligence, improper operation of thevehicle, improper repair, lack of or impropermaintenance, environmental influences, flood,accident or fire damage, road salt corrosion, oruse of improper or contaminated fuel.

Damage to the engine, transmission or anyrelated component caused by improper shiftingof the transmission.

Maintenance services and parts when replacedduring maintenance such as spark plugs,lubricants, fluids, engine tune-up parts,replacement of filters, coolant, and refrigerant.

Failure to maintain the vehicle properly inaccordance with the instructions in the Owner’sManual or the Service section of this Statement,that results in the failure of any part of the vehicle.

Modification of the vehicle or installation of anyperformance accessories or componentsattached to the vehicle which alters the originalengineering and/or operating specifications orwhich result in damage to the other originalcomponents, electrical interference, electricalshort, radio static, water leaks, or wind noise.

Driving over rough or damaged road surfaces,as well as debris, curbs and other obstaclescan cause serious damage towheels, tiresand suspension parts. This ismore likely tooccurwith low-profile tires that provide lesscushioning between thewheel and the road.Be careful to avoid road hazards and reduceyour speed, especially if your vehicle isequippedwith low-profile tires.

Non-genuine MINI Parts - While you may elect touse non-genuine MINI parts for maintenance orrepair services, MINI USA is not obligated to payfor repairs that include non-genuine MINI parts orfor any damage resulting from the use ofnon-genuine parts.

This limited warranty applies only to U.S.-specification vehicles distributed byMINI USA, aDivision of BMWNorth America, LLC.

In accordance with the defect warrantyprovisions of section 207(b) of the Clean Air Act,MINI warrants to the first retail purchaser, andeach subsequent purchaser, that the passengercar: (a) was designed, built and equipped so as toconform, at the time of sale, with all regulationsof the U.S. Environmental Protection Agencyapplicable at the time of manufacture; and (b) isfree from defects in materials and workmanshipwhich would cause it to fail to conform withapplicable regulations for a period of 2 years or24,000 miles, whichever occurs first, except for

specific emission control components (as listedon page 24), for which the warranty period is8 years or 80,000 miles, whichever occurs first.

Coverage begins on the date of first retail sale orthe date the vehicle is first placed into service asa sales demonstrator, Aftersales MobilityProgram (AMP) Vehicle or company vehicle,whichever is earlier.

Warranty claims must be made as soon asreasonably possible after a defect is discovered.To make a claim, the car must be brought to anyauthorized MINI dealer during normal businesshours.

The MINI dealer will, without charge for parts orlabor (including diagnosis), either repair or replacethe defective part, if any. The decision whether torepair or replace said parts is solely the prerogativeof MINI USA, a Division of BMWNorth America,LLC and must be expected to correct the failure ofthe warranted part. Parts for which replacementsare made become the property of the MINI USA. Inall cases, a reasonable time must be allowed forwarranty repairs to be completed after the car isreceived by the MINI dealer.

For assistance in determining which specific partsor components of your vehicle are covered underthis warranty, please contact your MINI dealer.

It is the owner’s responsibility to have allscheduled inspection and maintenance servicesperformed (at the owner’s expense), asprescribed in the maintenance schedule for theMINI Emission Control System. Service intervalsare computed by the onboard MINI ConditionBased Service system and displayed on theinstrument panel. The instructions for propermaintenance and use can be found in theOwner’s Manual. It is strongly recommended thatany replacement parts used for maintenance,repair or replacement of emission controlsystems be certified MINI Service Parts or MINIAuthorized Remanufactured Parts. Withoutinvalidating this warranty, the owner may elect tohave maintenance, repair or replacement of theemission control systems performed by anyautomotive repair establishment, or elect to useparts other than certified MINI Service Parts.However, the cost of such service or parts will notbe covered under this warranty, except inemergency situations. In an emergency situation,where an authorized MINI dealer or a warranty

replacement part is not reasonably available(within 30 days), repairs may be performed at anyavailable service establishment using anyequivalent part. MINI USA, a Division of BMWNorth America, LLC will reimburse the owner forsuch emergency repairs (including labor, partsand diagnosis not to exceed the MINI USA’s ratesfor labor, parts, and diagnosis in said area) thatare covered under this warranty. Replaced partsand paid invoices must be presented at anauthorized MINI dealer as a condition ofreimbursement for emergency repairs notperformed by an authorized MINI dealer.

The use of replacement parts, which are not ofequivalent quality, may impair the effectivenessof the emission control system. If other thancertified MINI Service Parts or MINI AuthorizedRemanufactured Parts are used for maintenance,repair or replacement of components affectingemission control, the owner should obtainassurances that such parts are warranted by theirmanufacturer to be equivalent to genuine MINIparts in performance and durability. MINI USA, aDivision of BMWNorth America, LLC assumesno liability under this warranty with respect toparts other than genuine MINI parts.

However, the use of non-genuine MINIreplacement parts or non-EPA certified partsdoes not invalidate the warranty on othercomponents, unless non-genuine MINI parts ornon-EPA certified parts cause damage towarranted parts.

What Is NotCovered

This warranty does not cover malfunctions causedby any of the following: accident, flood, misuse,improper adjustment, modification, alteration,tampering, disconnection, improper or inadequatemaintenance, use of leaded fuel or fuels containingmore than 10% ethanol, or other oxygenates withmore than 2.8% oxygen by weight (i.e., more than15%MTBE or more than 3%methanol plus anequivalent amount of co-solvent).

The replacement of maintenance parts, such asspark plugs, filters and similar items used inrequired maintenance services, the repair orreplacement of maintenance parts beyond the

first required inspection/maintenance, or if thepart has been replaced earlier for reasons otherthan it being defective.

The car or any part of the car unless a failurecauses the car to fail to conform to applicableemission regulations.

Any car on which the odometer has beenreplaced or altered and the true mileage cannotbe determined.

The car, if the Vehicle Identification Number (VIN)is altered or cannot be read, or if the car has beendeclared a total loss or sold for salvage purposes.

In those states and jurisdictions that haveestablished periodic vehicle emissions tests toencourage proper vehicle maintenance andrequire the vehicle to pass an emissions testapproved by the U.S. Environmental ProtectionAgency and:

1. The passenger car was distributed byMINIUSA, a Division of BMWNorth America, LLC;and

2. The car has been maintained and operated inaccordance with the instructions for propermaintenance and use set forth in the Owner’sManual supplied with the car; and

3. The car fails to conform to the applicableemissions standards of the EPA as judged byan EPA approved emissions test; and

4. The failure to conform results or will result inthe owner of the car having to bear a penaltyor other sanction (including the denial of theright to use the car) under local state orfederal law if the non-conformity is notremedied within a specified period of time.

Then, in accordance with the provisions ofsection 207(b) of the Clean Air Act, MINI USA, aDivision of BMWNorth America, LLC warrantsthat if the car is eligible for coverage under thiswarranty, any non-conformities in the car, whichcause it to fail an EPA-approved emissions testwill, without charge for parts or labor (includingdiagnosis), be adjusted, repaired, or replaced, atthe option of MINI USA, a Division of BMWNorthAmerica, LLC to proper specifications, in order tomake the car comply with applicable emissionsstandards. The decision to adjust, repair orreplace parts is solely the prerogative of MINIUSA and must reasonably be expected to correctthe failure of the warranted part.

Coverage begins on the date of first retail sale, orthe date the vehicle is first placed into service asa sales demonstrator, Aftersales Mobility

Program (AMP) Vehicle or company vehicle,whichever is earlier. This limited warrantycontinues for a period of 2 years or 24,000 miles,whichever occurs first, except for specificemissions control components (as listed onpage 24), for which the warranty period is 8 yearsor 80,000 miles, whichever occurs first.

This limited warranty is made subject to theterms and conditions that apply to the EmissionControl SystemWarranty and the MINI NewPassenger Car Limited Warranty.

No claim under this warranty will be denied onthe basis of use of a properly installed EPAcertified emission part for maintenance andrepair.

A vehicle manufacturer may deny an emissionperformance warranty claim on the basis of anuncertified replacement part used in themaintenance or repair of a vehicle only if thevehicle manufacturer presents evidence that theuncertified replacement part is either defective inmaterials or workmanship or not equivalent froman emission standpoint to the original equipmentpart.

Maintenance, replacement, or repair ofemission control devices and systemsmaybeperformed by any automotive repairestablishment or individual using anycertified part.

Immediately after the car has failed an EPAapproved emission short test, your claim can bemade at any authorized MINI dealer. The MINIdealer will honor or deny your claim within thetime period specified by local or state laws (not toexceed 30 days), to avoid further penalties orsanctions. If the claim is denied, the MINI dealerwill notify you in writing of the reason(s). Theauthorized MINI dealer is required by law tohonor the claim if notice of denial is not receivedby the owner within the specified time period.

The California Air Resources Board and MINIUSA, a Division of BMWNorth America, LLC arepleased to explain the emission control systemwarranty on your 2013 vehicle. In California, newmotor vehicles must be designed, built, andequipped to meet the State’s stringentanti-smog standards. MINI USA, a Division ofBMWNorth America, LLC must warrant theemission control system on your vehicle for theperiods of time listed below provided there hasbeen no abuse, neglect, or impropermaintenance to your vehicle.

Your emission control system may include partssuch as the fuel injection system, the ignitionsystem, catalytic converter, and enginecomputer. Also included may be hoses, belts,connectors, and other emission-relatedassemblies.

Owner’sWarrantyResponsibilities:– As the vehicle owner, you are responsible forthe performance of the required maintenancelisted in your Owner’s Manual. MINI USArecommends that you retain all receiptscovering maintenance on your vehicle, but MINIUSA cannot deny warranty solely for the lack ofreceipts or for your failure to ensure theperformance of all scheduled maintenance.

– You are responsible for presenting your vehicleto an authorized MINI dealer as soon as aproblem exists. The warranty repairs should becompleted in a reasonable amount of time, notto exceed 30 days.

– As the vehicle owner, you should also be awarethat MINI USA may deny your warrantycoverage if your vehicle or part has failed due toabuse, neglect, improper maintenance, orunapproved modifications.

California Emission ControlSystem LimitedWarranty*

This limited warranty applies to Californiacertified vehicles distributed byMINI USA, aDivision of BMWNorth America, LLC registeredand operated primarily in California.

MINI USA, a Division of BMWNorth America,LLC warrants to the original purchaser and eachsubsequent owner that the vehicle is:

a. designed, built and equipped so as toconform with the applicable California AirResources Board emission standards.

b. free from defects in materials andworkmanship which cause any part that canaffect emissions to fail to conform withapplicable requirements or to fail a CaliforniaSmog Check test or EPA approved short testfor a period of 3 years or 50,000 miles,whichever occurs first.

c. free from defects in materials andworkmanship in emission related parts, whichare contained in the California EmissionControl System Limited Warranty Parts List onpage 29, for a period of 8 years or100,000 miles, whichever occurs first.

Coverage begins on the date of first retail sale orthe date the vehicle is first placed into service asa sales demonstrator, Aftersales MobilityProgram (AMP) Vehicle or company vehicle,whichever is earlier.

To obtain service under this warranty, the vehiclemust be brought, upon failure of a Smog Checktest or upon discovery of the defect, to theworkshop of any authorized MINI dealer, duringnormal business hours. The MINI dealer willhonor or deny your claim within 30 days. If theclaim is denied, the MINI dealer will notify you inwriting of the reason(s). The MINI dealer isrequired by law to honor the claim if notice is notgiven to the owner within 30 days.

The MINI dealer will, without charge for parts orlabor (including diagnosis), either adjust, repair orreplace the defective part and other partsaffected by the failure of the warranted part, ifany. If your vehicle failed the California SmogCheck test or an EPA approved short test, thenMINI USA will repair your vehicle so that it willpass this test. Items that require scheduledreplacement are warranted up to thereplacement interval specified in the Servicesection of this Statement. MINI USA may repair apart in lieu of replacing it when performingwarranty repairs. Parts for which replacementsare made become the property of MINI USA.After 3 years or 50,000 miles, and in accordancewith paragraph (c) above, such repairs are limitedto the repair or replacement of those partsidentified in the California Emission ControlSystem Limited Warranty List.

If your California registered vehicle is between 7and 8 years old and has been driven less than80,000 miles, then your vehicle is eligible foradditional warranty coverage under the FederalEmissions Warranty.

A repair performed as the result of a Smog Checktest failure due to a defect in a part, which iswarranted for 8 years or 100,000 miles, iscovered.

In all cases, a reasonable time, not to exceed30 days, must be allowed for a warranty repair tobe completed, after the car is received by theMINI dealer.

It is the owner’s responsibility to have all requiredmaintenance services performed (at the owner’sexpense), as prescribed in the maintenanceschedule for the MINI Emission Control System.Service intervals are computed by the ConditionBased Service system and displayed on theinstrument panel.

However, MINI USA will not deny your warrantyrepair claims solely because you do not havemaintenance records or you did not perform therequired maintenance unless MINI USAdemonstrates that such lack of requiredmaintenance is a direct cause of the emissioncontrol system failure. The instructions forrequired maintenance and use can be found inthe Owner’s Manual and in the Service section ofthis Statement.

It is strongly recommended that any replacementparts used for maintenance, repair orreplacement of emission control systems begenuine MINI Service Parts or MINI AuthorizedRemanufactured Parts. Without invalidating thiswarranty, the owner may elect to havemaintenance, repair or replacement of theemission control systems performed by anyautomotive repair establishment, or elect to useparts other than MINI AuthorizedRemanufactured or genuine MINI Service Parts.However, the cost of such service or parts will notbe covered under this warranty, except inemergency situations. In an emergency situation,where an authorized MINI dealer is notreasonably available or a warranty replacementpart is not available within 30 days, repairs maybe performed at any available serviceestablishment or by any individual using anyreplacement part.

A repair not completed within 30 daysconstitutes an emergency. MINI USA, a Divisionof BMWNorth America, LLC will reimburse theowner for such emergency repairs (includinglabor, parts and diagnosis not to exceed MINIsuggested retail price for all warranted partsreplaced and labor charges based on themanufacturer’s recommended time allowance forthe warranty repair and the geographicallyappropriate hourly labor rate) that are coveredunder this warranty. Replaced parts and paidinvoices must be presented to an authorizedMINI dealer as a condition of reimbursement foremergency repairs not performed by anauthorized MINI dealer.

The use of replacement parts, which are not ofequivalent quality, may impair the effectivenessof emission control systems. If other thangenuine MINI Service Parts or AuthorizedRemanufactured Parts are used for maintenance,repair or replacement of components affectingemission control, the owner should obtainassurances that such parts are warranted by theirmanufacturer to be equivalent to genuine MINIparts in performance and durability. MINI USA, aDivision of BMWNorth America, LLC assumesno liability under this warranty with respect toparts other than genuine MINI parts.

However, the use of non-genuine MINIreplacement parts does not invalidate thewarranty on other components, unlessnon-genuine MINI parts cause damage towarranted parts.

What is not covered

This limited warranty does not covermalfunctions caused by any of the following:accident, flood, misuse, modification, alteration,tampering, disconnection, improper orinadequate maintenance, except if performed byan authorized MINI dealer doing warranty repairwork, use of leaded fuel or fuel other than asspecified in the Owner’s Manual.

The replacement of maintenance parts, such asspark plugs, filters and similar items used inrequired maintenance services or the repair orreplacement of maintenance parts beyond thefirst replacement interval.

Any car on which the odometer has beenreplaced or altered and the true mileage cannotbe determined.

The car, if the Vehicle Identification Number (VIN)is altered or cannot be determined, or if the carhas been declared a total loss or sold for salvagepurposes.
