WELCOME REMARKS

Welcome to the 2015 Marcellus and Manufacturing Development Conference!In celebration of the West Virginia

Manufacturers Association 100-year anniversary of representing our industry in West Virginia, this years

conference is bigger and better than ever.

To expand our program, we are bringing together the success of our M2M Conference and the tradition of

the WVMA Annual Meeting (Leadership Summit) to celebrate our rich history, while looking toward the bright

future for manufacturing in the Mountain State. West Virginia is poised to enjoy the abundance of shale gas and

long-term benets to the manufacturing sector. The future is bright for manufacturing in West Virginia, and I am

honored to lead the efforts of the WVMA.

Last years conference provided, for the rst time, a venue to host 100 middle school students for a fun

and interactive program, which provided an introduction to careers in manufacturing. This year, this effort

has expanded to nearly double the students, and a full-day program hosted by the BridgeValley Advanced

Technology Center. Thanks to the generosity of the Benedum Foundation, this represents the launch of the

WVMAs Explore the New Manufacturing program, a pilot program to introduce manufacturing careers to

students in RESA 5 counties. If you are interested in learning more, I encourage you to reach out to the WVMA.

Welcome to the 4th Annual Marcellus and Manufacturing Development Conference (MMDC). This years

conference combines the M2M Ethane Development Conference and the WVMA Annual Meeting (Leadership

Summit). The MMDC provides an exciting opportunity to focus on the downstream manufacturing opportunities

in West Virginia while gaining a better understanding of the potential for signicant expansion in the states

chemical industries. With the announcement of the possible construction of an ethane cracker in Wood County,

the hope of a manufacturing upsurge in West Virginia has taken a large step toward becoming a reality.

In cooperation with education, development and government ofcials, this years conference continues as acollaborative effort of upstream, midstream and downstream industry experts. I hope you will nd that your time

at the conference provides an ideal setting for identifying the challenges and opportunities to responsibly and

purposefully develop these new industry resources. In addition, the MMDC provides a way to showcase our

state and regional attributes to companies interested in locating new facilities or expanding current operations.

Please enjoy the diverse agenda presented at this years conference, and take advantage of the many

opportunities to learn and grow from our keynote speakers, panels of experts and seminars as well as

new products, services and technologies exhibited on the trade show oor. I further would like to express

Brent breon

Brent Breoncurrently serves as the Vice President of Business Development for CaimanEnergy II and Blue Racer Midstream. In his current position, he is focused on developing

gas gathering, processing and fractionation opportunities in Ohio and Pennsylvania in the

Utica Shale.

Prior to joining Caiman in 2011, Breon worked for 14 years at Dominion Resources in

various operations, engineer and business development roles. Most recently, he was

responsible for system planning as well as business development from local production

enhancement, non-traditional services and industrial customers.

Breon graduated from The University of Akron with a bachelors degree in mechanical

engineering and a masters degree in business administration. He also is a certied Six

Sigma process improvement Black Belt and an Ohio Oil and Gas Association (OOGA)

Board of Trustees member.

Peter Gross

Peter Grossworks with the Energy Information Administration (EIA) as an analyst in theOfce of Integrated Analysis and Forecasting and has been part of the administration for

nearly three years. He specializes in the biofuels market and policy analysis, as well as

biofuels supply projections.

In addition, Gross has previously worked in the areas of renery energy use and the

impact of climate legislation on the rening industry. Gross holds advanced degrees in

chemistry and statistics and worked as a teacher in New York City before joining EIA.

with a team of award-winning global business journalists in real time to make AutomotiveNews the most comprehensive source of news in the auto industry.

A native of Toledo, Ohio, Nussel began his professional career in West Virginia as a

business reporter and editor at the Charleston Daily Mail from 1987 to 1994. In 1995,

he moved to Detroit to become managing editor of Crains Detroit business and later

served as a business editor at the Detroit News and Free Press. He joined Automotive

News in 2005.

Christopher Smithis Assistant Secretary for Fossil Energy (FE) with responsibilitiesfor ofce operations and managing the oversight of Fossil Energys Research and

Reserves. He was appointed to the Department of Energy in 2009 as Deputy Assistant

Secretary for FEs Ofce of Oil and Natural Gas. Smith served as the Designated Federal

Ofcial for the National Commission on the BP Deepwater Horizon Oil Spill and Offshore

Drilling, established by President Obama to investigate the root causes of the Gulf oil

spill.

Smith holds a bachelors degree in engineering management from the United States

Military Academy at West Point and an MBA from Cambridge University.

academy ExplorE the new manufacturing

Approximately 200 West Virginia middle school students from Wood and Kanawha counties will

join WVMA companies in Charleston Friday to participate in the second annual Explore the New

Manufacturing Academy. The event will be held at BridgeValleys Advanced Technology Center in

South Charleston. The Academy provides a glimpse of todays manufacturing environment, potential for

careers in the industry, and educational pathways for students in pursing these opportunities.

Students will participate in lab experiences hosted by WVMA member companies, including welding

simulation, robotics, 3D printing and more.

The Academy is presented by the WVMA Educational Fund, Inc., in collaboration with the WVMA andBridgeValley Community and Technical College. The WVMA Education Fund, Inc. was recently granted

funding from the Claude Worthington Benedum Foundation to launch a pilot program, Explore the New

Manufacturing, that will help with skilled worker shortages that can be improved through employer

engagement within their schools and communities. The initial pilot efforts are targeted in West Virginias

RESA 5 district.

The WVMA Educational Fund, Inc., and its partners are working to assure the availability of skilled

workers to meet not only current and projected needs of West Virginias existing manufacturing base,

but also ll the thousands of potential new jobs the manufacturing and energy industries will produce in

years to come.

1:10 p.m. Cutting Through Prossers Impenetrable Jungle: The Tort of Nuisance in the Shale Gas Plays Nuisance claims are getting more attention because of a large verdict against a natural gas operator in Texas

last year. This presentation examines the law of nuisance and the types of claims that may be asserted against

hydraulic fracturing operations under this vague tort. Special consideration will be given to defenses and the law

of damages, with an evaluation of how the recent West Virginia decision modifying the law of residential real

property damages may impact nuisance claims.

infrastructure projects are creating plant facilities built for the gathering, processing, fractionation and

transportation of energy. This construction activity, and subsequent operations, has or will capture the attention

of OSHA. This presentation provides an overview of OSHAs jurisdiction, its legal authority for inspections, and

practical information about how to respond to OSHA, from the initial inspection through the contest and appeal.

4:10 p.m. The New Amendments to the Endangered Species Act: The Potential Impact on the Growthand Development of the West Virginia Oil and Gas FieldsThe Endangered Species Act discussion will cover the Multidistrict litigation that resulted in a schedule for the

U.S. Fish & Wildlife Service to make afrmative determinations on whether to list more than 1,000 candidate

species. This session will include an update on the proposals for the Northern Long-Eared Bat, which is

indigenous to WV and 37 other states. An assessment of the Endangered Species Act rulemakings, listing

decisions, and agency funding will also be discussed.
