Welcome from the Chair – 2014 Queensland Annual State Convention Organising Committee

As Chair of the Queensland State Convention Organising Committee it gives me great pleasure to welcome you to the 2014 Convention.

This year the focus of the Convention is “managing through change”, be it change in the regulatory or compliance environment, in economic conditions or in the way the tax profession is evolving with its consequential impact on each of our practices, coupled with a changing workforce.

The 2014 Convention once again showcases an impressive line-up of local and interstate speakers. The program is comprehensive, covering Div 7A, payroll tax, corporate reconstructions, small business CGT concessions, superannuation and dispute resolution, just to name a few. By popular demand this year’s program also includes a speed update as well as a panel session addressing hot topics concerning trusts.

This year we introduce an inaugural panel session at the conclusion of day one of the convention entitled “The Modern Tax Profession – Embracing a Changing World”. This session offers our delegates the opportunity to hear from experts in the industry addressing some of the biggest issues facing the tax profession as it continues to evolve and change, with a particular focus on equipping you and your practice to steer a course for even greater success in the future.

There could be no convention without the valuable contribution of our illustrious speakers and presenters. We are privileged to have them attend and share their expertise with us.

In this session, we will use practical examples to explore:

PRESENTER PROFILESAn overview of our experts

Paul Banister, CTA,is a Chartered Accountant and a Part-ner at Grant Thornton, leading their tax division in Brisbane. He has over 25 years experience working with clients to help them navigate through complex and potentially risky tax and commercial issues. His expertise includes domestic and international tax planning, transaction advisory and support, superannuation structuring and advice, succes-sion planning and estate planning. Paul has presented at many professional and business forums, both in Australia and internationally. He is also a contributing author to Thomson Reuter’s Financial Planning Handbook.

Hayden Bentley, CTA, a Partner at McCullough Robert-son, acts for corporate groups, both listed and privately held, and high net worth individuals on a range of structur-ing and taxation issues. Hayden has advised on complex tax audits and disputes with the ATO on issues such as Div 7A and private company loans, tax consolidation and cross-border restructures. Described by Australian Legal Business as having a “cool head in complex matters”, Hayden is also recommended in the 2014 Chambers Asia Pacific Directory. Hayden is currently Chair – 2014 Queens-land State Council.

Sarah Blakelock, CTA, is a Partner at McCullough Rob-ertson. Her practice primarily focuses on the resolution of tax disputes with the Commissioner of Taxation or the State Revenue authorities and other regulatory disputes. In this respect Sarah undertakes tax risk reviews for her clients, advises in respect of tax audits, seeks to resolve tax dis-putes (by alternative dispute resolution, litigation or, where available, arbitration) and advises and manages taxpayers’ responses to a regulator’s use of access and information gathering powers (domestically and globally). Sarah also assists clients to manage voluntary disclosures, the nego-tiation and documentation of settlements with the regulator (including negotiating payment arrangement terms, seeking interest and penalty remission and all aspects of tax debt recovery).

Chris Davis, CTA, a Principal of McInnes Wilson Lawyers’ Revenue, Structuring and Succession Group, has been involved in advising clients on Div 7A and associated mat-ters in a variety of contexts, with a particular focus on the SME market. This has included advisory work, assisting tax agents on pre-audit investigations and preparing and lodg-ing objections against Div 7A reassessments.

Michael Flynn, CTA, a Barrister specialising in taxation, is the National President of The Tax Institute. Michael has appeared before the Federal Court and the High Court in many cases on behalf of both taxpayers and the Com-missioner. Before becoming a Barrister, Michael worked in the tax division of a chartered accounting firm. Michael has been a member of various committees of The Tax Institute for many years, including Victorian State Council (he is a past State Chair) and National Council. He has also presented at many seminars and conferences for The Tax Institute, and lectures in the postgraduate program at Melbourne University.

Peter Godber, CTA, is a consultant to Grant Thornton. He has over 30 years experience in giving professional taxation advice and dealing with change to Australian tax laws. Peter provides advice in many areas of taxation including business taxation, business and investment structuring, international tax planning, prudential tax audits and tax risk management. Peter is immediate past State Chair of The Tax Institute’s Queensland Division and is now a member of the Institute’s National Council.

Stephen Holmes, CTA, is a Partner with WMS Char-tered Accountants on the Gold Coast. Stephen has over 20 years experience advising on tax matters. His areas of speciality include the small business concessions, tax consolidation and the structuring of inbound and outbound investment.

Robert Jeremenko, CTA, is Senior Tax Counsel at The Tax Institute and heads the Tax Policy and Advocacy team, leading the Institute’s advocacy activities. Robert joined The Tax Institute after five years at one of Australia’s largest banks, where he held roles including Head of International Government Affairs. Prior to this, Robert was taxation adviser on the personal staff of the Australian Federal Treas-urer, where he worked on the implementation of a broad range of taxation policy over a four-year period. Robert holds degrees in Law and Science from the Australian Na-tional University and is admitted as a Barrister and Solicitor of the High Court of Australia.

Philip Magoffin is a founding director of PPM Tax & Legal Pty Ltd, a boutique indirect tax firm based in Brisbane. Philip has over 17 years of specialist experience in stamp duties and payroll tax (for all states and territories). He advises clients on mergers and acquisitions, group re-structures, payroll tax audits, exemption applications and exclusion orders. Formerly from the Queensland Office of State Revenue and some of the Big 4 global firms, Philip also specialises in operations taxes, such as customs du-ties, fuel tax and long service leave levies for multinational corporate groups, regional businesses and other profes-sional practices.

Alistair Marshall relocated to Australia, after running a successful consulting business in the UK, to join Julian Midwinter & Associates in 2013 and help professional firms attract new clients and win more new business. As a busi-ness development expert, he has worked with leading law firms, accountants, banks and household-name corporates for more than 20 years. He has authored three books on the subject of sales and marketing, the most recent entitled The Complete Business Development Guide for Profes-sional Firms. Prior to establishing his successful consulting practice, Alistair was a blue-chip, FMCG-trained general manager, who held national posts in sales and marketing departments with in multinational corporations, and was responsible for managing budgets over $100 million.

Sam Mohammad is a Senior Manager in KPMG’s Indirect Tax Practice in Brisbane. Sam has over 10 years experi-ence in providing practical GST, payroll tax and stamp duty advice across a broad range of sectors, includ-ing property and development. Sam has been directly involved in major M&A deals and government asset sales (including the provision of tax structuring and optimisation advice), successfully preparing GST private binding ruling requests on complex matters and assisting clients through indirect tax audits and reviews by revenue authorities. During 2010–11, Sam worked for a large consulting firm in London in a managerial VAT role, with a specific focus on financial services and cross-border issues.

Troy Morgan, CTA, is a Partner with Deloitte Private in Brisbane. Troy advises a wide range of clients on various tax and commercial matters including business structuring, restructuring, inbound and outbound investment, tax-effec-tive financing and small business CGT concessions. Prior to joining Deloitte in 2012, Troy undertook a similar role with PwC Private clients for four years and before that worked as a CFO for a funds management and structured property finance group.

Scott Pease is a founding director of PPM Tax & Legal Pty Ltd. Scott has over 10 years of specialist experience in payroll tax, WorkCover and stamp duty (for all states and territories). He specialises in payroll tax audits, prudential reviews, exclusion applications, contractor analysis, group restructures and mergers and acquisitions. Scott spent the first eight years of his career at Big 4 global firms where he gained valuable experience advising on all state taxes. He is a Solicitor of the Supreme Court of Queensland and is actively involved in tax controversy litigation.

James Petterson, ATI, an Account Director at Deloitte Private in Brisbane, advises government and private sector clients in relation to state taxes matters, including stamp duty, payroll tax and land tax matters. James advises on state tax matters across all Australian jurisdictions and has extensive experience in advising clients on stamp duty planning in relation to corporate restructuring and acquisi-tions, advising government on major infrastructure divest-ment projects, and advising clients on transactions across all business sectors. In addition, James is a contributing author to LexisNexis’s Australian Stamp Duties Law.

Ken Schurgott, CTA (Life), is a Tax and Commercial Law Director of Schurgott Noolan Ardagna Lawyers, Sydney. Ken has extensive experience in all aspects of tax (including state taxes and litigation), as well as business structuring, asset protection, succession planning and trust and estate law. He was a member of the Advisory Panel to the Board of Taxation until recently and heavily engages in ongoing consultation in relation to the reform of the taxation of trusts and trust issues generally. Ken is a Past President of The Tax Institute.

Dr Catherine See is the Managing Director at Gravitas Leadership Group, providing strategic advice in relation to business design, organisational strategy and capabil-ity management across public and private environments. Catherine has strong experience working across profes-sional services firms as a consultant and researcher. Recent engagements include strategy, consulting and leadership development engagements for large law firms, health care providers and government agencies, as well as conducting health research projects in Australia and Singapore.

Adele Townsend, CTA, is a Partner at Pitcher Partners. Adele has over 15 years of specialist experience in domes-tic and international corporate tax. Adele gained her skills as a tax practitioner with a combination of 6 years in a “Big 4” international firm’s tax practice and several years as the Australian Tax Manager for The Boeing Corporation.

Mark West, CTA, is a Partner at McCullough Robertson and is qualified both in law and as a Chartered Account-ant. Mark regularly advises clients on trust and company matters, including Div 7A unpaid present entitlement and shareholder loan issues. He advises clients generally on income tax, CGT, GST and payroll tax matters, and has acted in appeals to the AAT and Federal Court.

Karl Wood, FTI, is a Director of KPMG’s Indirect Tax Practice in Sydney and leads the GST offering in real property and infrastructure. Prior to joining KPMG, Karl was Head of Indirect Tax at Stockland, Australia’s larg-est diversified property group where he was involved in providing day-to-day transactional GST advice regarding acquisitions, restructurings and financing in relation to various major property and trust transactions across the Stockland Group. Karl is a member of the Large Business Liaison Group (LBLG), and the current Chair of the Property Council of Australia’s National GST Subcommittee (where he also sits on the Retirement Living Tax Committee), and through this membership has been involved in lobbying on a number of GST issues.

Chris Wyeth, CTA, is a Client Adviser at ipac providing financial and investment advice. His practice focuses on re-tirement planning for senior employees in listed companies, government and the universities as well as exit strategies for SME owners. Chris has extensive practical experience in designing and implementing superannuation strategies and regularly advises both Australians and expats on managing their wealth.

Venue and accommodation InterContinental Sanctuary Cove Resort is tucked away in the beautiful surrounds of Sanctuary Cove. The charm of a 1940s Queensland homestead welcomes you to 243 beautifully appointed guest rooms and suites overlooking tranquil gardens, the golf course or water views.

Accommodation has been reserved for convention delegates at a favourable room rate of $245 (single) and $265 (double) per room per night (all prices are inclusive of GST). This rate is inclusive of breakfast in the Cove Cafe and is only available through The Tax Institute. All additional hotel incidentals remain the responsibility of delegates, and individuals will be responsible for payment

of the balance of their account on check-out. While we are confident that sufficient accommodation will be available, it cannot be guaranteed and delegates are advised to book early to secure their first preference. The Institute reserves the right to charge a nominal administration fee for any accommodation booked for the convention.

Getting thereAir: Delegates arriving by air should fly into either Brisbane or Gold Coast airport.

Parking: InterContinental Sanctuary Cove Resort has over 250 complimentary outdoor parking spaces for guests. A professional valet parking service is available for $15 per day. The car park, with wheelchair access, is accessible 24 hours a day, and is only 50 metres from the hotel foyer.

Convention dinnerThe convention dinner will be held on Thursday 11 September 2014. The cost of this dinner is included in the registration fee and additional tickets can be purchased for $145 per person. This includes a three-course meal and beverages. Please indicate on the registration form if you wish to attend the dinner and if you require additional tickets.

Group discountsPurchase four full registrations and receive a fifth full registration for FREE. This offer cannot be redeemed in conjunction with any other offer, promotional code or discount. All attendees must be from the same firm and all registration forms must be submitted together.

CPD accreditationAttendance at the convention accounts for 13 hours of Continuing Professional Development Accreditation with The Tax Institute.

Alteration and cancellation policyThe Tax Institute reserves the right to alter, amend or cancel all or any of the arrangements contained in the program. It is a condition of acceptance of registration that an administration fee of 20% of the registration fee will be charged for cancellation. No refund will be given for cancellations received within five working days of the convention. A replacement may be nominated. If
