H .Schorel-Hlavka O.W.B. to Denis Napthine Re GENERAL ELECTION TO BE HELD NOW-etc Sir, in my view it would be appropriate in the circumstances for the Governor to prorogue the Parliament and dissolve the Houses and have writs is sued for a general election. While Mr Bruce Atkinson President of the Legislative Council indicated to me that he hold my 30 writing to the Governor amusing  I do not hold this view. As I indicated you clearly must have misled the office of the Governor to have Members of Parliament appointed into an Office of Profit i n violation of the constitution act 1975. In my view this is a very serious matter. I view it also very serious that the Office of the Governor acted in violation of the constitution 35 act 1975. Indeed, why have a former judge appointed as governor and provide him with staff when there is no compliance with the constitution act 1975, something I without such staff and without any payment can detect merely by reading the constitution act 1975, and this with my self-professed crummy English . Even if there were to be 2 writs issued for a by-election for the legislative Council the problem 40 would be as to which seats became vacant? After all, while there appear to be freshly appointed on 17 March 2014 two members of the Legislative Assembly who may not have been entitled to this on the other hand if any Minister already held a portfolio in breach of the constitution act 1975 then this Minister and not both newly appointees would likely be subject to a by-election.
