Made by the Governor in Executive Council.

1. Citation

These regulations are the Transfer of Land Amendment

Regulations 2016.

2. Commencement

These regulations come into operation as follows —

(a) regulations 1 and 2 — on the day on which these

regulations are published in the Gazette;

(b) the rest of the regulations — on the day after that day.

3. Regulations amended

These regulations amend the Transfer of Land

Regulations 2004.

4. Regulation 5A deleted

Delete regulation 5A.

5. Part 3B inserted

After regulation 9AB insert:

Part 3B — Provisions relating to electronic

service

9AC. Electronic service of notices

(1) For the purposes of section 240(1)(d) of the Act, where

a person has specified in a caveat or an approved form

that notices under this Act may be served on the person

by sending the notice to an email address specified by

the person, service is effected by sending the notice to

that email address.

(2) For the purposes of section 240(3)(c) of the Act,

service of a notice that is sent by or on behalf of the

Registrar or the Commissioner under subregulation (1)

sent, unless within that 24 hour period the sender

receives a notice of failure of delivery of the email.

(3) Where the Commissioner or Registrar attempts to serve

a notice by sending it to an email address but receives a

notice of failure of delivery of the email, the

Commissioner or Registrar may direct that the notice

be resent to the email address or served on the person

by any other means specified in section 240(1) of the

Act.

Made by Racing and Wagering Western Australia with the approval of

the Commission under section 120 of the Act.

1. Citation

These rules are the Rules of Wagering Amendment Rules 2016.

2. Commencement

These rules come into operation as follows —

(a) rules 1 and 2 — on the day on which these rules are

published in the Gazette;

(b) the rest of the rules — on the day after that day.

3. Rules amended

These rules amend the Rules of Wagering 2005.

4. Rule 23 amended

In rule 23(1) delete the Table and insert:

Any game of ice hockey or series of games of ice

hockey.

Any game of rugby league or series of games of

rugby league.

5. Rule 24 amended

(1) In rule 24 in the Table delete the item relating to footy tipping

wager.

(2) In rule 24 in the Table in the item relating to sports tipping

(a) delete “not being an Australian Rules Football fixture,”;

(b) in paragraph (c) delete “draw.” and insert:

tie (if such an outcome is offered).

6. Rule 25 amended

(1) In rule 25(1) and (3) delete “footy tipping wagers or”.

(2) In rule 25(4):

(a) delete “footy tipping wager or”;

(b) delete “(including where the totalisator pool was in

respect of footy tipping wagers” and insert:

BUILDING SERVICES (COMPLAINT RESOLUTION AND ADMINISTRATION) REGULATIONS 2011

WAIVER OF BUILDING SERVICES LEVY

I, Jane Vallance, Acting Building Commissioner appointed under section 85 of the Building Services (Complaint Resolution and Administration) Act 2011, do hereby waive the building services levy payable in respect of a building, demolition or occupancy permit or building approval certificate granted for building work or demolition work to be carried out, or carried out, in the local government district of Harvey because of damage caused by the January 2016 fire in that district.

This waiver is made pursuant to regulation 15(1) of the Building Services (Complaint Resolution and Administration) Regulations 2011.

I, Heather Brayford, Chief Executive Officer of the Department of Fisheries Western Australia, in accordance with the Shark Bay Prawn Managed Fishery Management Plan 1993, hereby give notice that I have cancelled Determination No. 4 of 2015 which set out the dates, times and areas that fishing is prohibited in the Shark Bay Prawn Managed Fishery.

I hereby give notice that a new determination (Determination No. 1 of 2016) has been made in accordance with clause 10 of the Shark Bay Prawn Managed Fishery Management Plan 1993, which sets out the dates, times and areas that fishing is prohibited in the Shark Bay Prawn Managed Fishery during the period commencing from the date of gazettal of this notice and ending on 1 June 2017.

Wilson Inlet: All the waters of Wilson Inlet and adjacent rivers excluding the designated Water Ski Area east of Pelican Point as described below—

Those waters of Wilson Inlet bounded by a line from 34°59.297′S, 117°23.986′E (approximately 1.2 kilometres north of Pelican Point) to 34°59.395′S, 117°25.800′E (approximately 2.65 kilometres easterly); thence to 35°00.315′S, 117°25.800′E (1.7 kilometres south); thence to 35°00.227′S, 117°24.178′E (approximately 2.47 kilometres westerly); thence to the point of commencement (approximately 1.74 kilometres northerly). All coordinates based on GDA94.

Acting pursuant to the powers conferred by Regulation 48A of the Navigable Waters Regulations 1958, I hereby cancel Subsection (1)(b)(9) of Notice MH404 as published in the Government Gazette on 25 October 1991 and set aside the following area of water for the purpose of water skiing—

Wilson Inlet: All Those waters of Wilson Inlet bounded by a line from 34°59.831′S, 117°21.374′E (approximately 480 metres south-south-east of Poison Point) to 34°59.586′S, 117°22.166′E (approximately 1.3 kilometres east-north-easterly); thence to 34°59.882′S, 117°22.299′E (approximately 590 metres south south-easterly); thence to 35°00.168′S, 117°21.374′E (approximately 1.5 kilometres west-south-westerly); thence to the point of commencement (approximately 630 metres northerly). All coordinates based on GDA94.

Providing however that the direction of all water skiing shall be in an anti-clockwise direction and water skiing is only permitted within the hours of sunrise and sunset only.

Ocean Beach: All those waters of Ratcliffe Bay contained by lines commencing at 35°01.819′S, 117°19.841′E (on the foreshore at Ocean Beach approximately 65 metres south of the Denmark Surf Club buildings); thence to 35°01.772′S, 117°20.011′E (approximately 275 metres east-north-east); thence due north to the foreshore (approximately 550 metres). All coordinates based on GDA 94.

Wilson Inlet: Those waters of Wilson Inlet bounded by a line from 34°59.297′S, 117°23.986′E (approximately 1.2 kilometres north of Pelican Point) to 34°59.395′S, 117°25.800′E (approximately 2.65 kilometres easterly); thence to 35°00.315′S, 117°25.800′E (1.7 kilometres south); thence to 35°00.227′S, 117°24.178′E (approximately 2.47 kilometres westerly); thence to the point of commencement (approximately 1.74 kilometres northerly). All coordinates based on GDA94.

Providing however that the direction of all water skiing shall be in an anti-clockwise direction and water skiing is only permitted within the hours of sunrise and sunset only.

Acting pursuant to the powers conferred by Regulation 10A (b) of the Navigable Waters Regulations 1958, I hereby close the following area of water to swimming between 8:00pm and 9:00pm on Saturday 26 March 2016—

Bathers Beach, Fremantle: All the waters within a 250 metre radius of the firing point located on a barge positioned at (approximately) 32º03.517′S, 115º44.305′E.

This area is set aside for safety measures during the set up and display of pyrotechnics.
