As an industry veteran covering over four decades, Charles Montgomery has been driven to such success. Whether in the capacity as a project superintendent, as Surety Claims Manager at Golden Eagle Insurance Company or as a Division Manager at Roel Construction Company, Mr. Montgomery has never waivered from the core principals instilled in him while working in a family owned construction company, CLIENT SATISFACTION; QUALITY; ENTHUSIASM and an HONEST PROFIT!

In addition to Mr. Montgomery’s vast experience in the construction field, he has also been qualified as an expert witness in both the State and Federal courts, provided deposition testimony in over 150 cases and testified at trial or arbitration over a dozen times in matters ranging from Contract Disputes, Construction Defects and Contractor Standard of Care. While Mr. Montgomery continues to provide litigation support services to both the insurance and contracting communities he has refocused his efforts to promote a re-thinking of the Building Envelope Commissioning and Quality Assurance functions in our industry; emphasizing the critical need to rein in the costly failures due to marginal workmanship and substandard assemblies. With the introduction of new performance standards, complex architectural systems and an ever challenged work force, Mr. Montgomery’s drive for Quality could not be more timely.

Historicaly the construction industry has focused on Budget and Schedule as the defining metrics of a successful project. We have watched the evolution of proactive safety programs and its impact on the bottom line in the form of reduced claims incidents but as an industry we have all but neglected to recognize that a rigourous QUALITY ASSURANCE program is equally important to the overall success or failure of any given project. Mr. Montgomery has worked in the trenches of the industry for over 40 years, has experienced the impact of failed quality management practices in the form of Construction Defect claims, Surety Bond claims and Performance disputes, yet he remains an optimistic believer that the tide is turning and that a proactive approach to prioritizing a projects core objectives can and will lead to a better built environment. A multiple Dicipline Construction Consulting Firm founded in 2010 with a focus on construction claims litigation support, both construction defects and contract claims. Mr. Montgomery’s primary area of expertise lies in the area of complex contract and performance matters with a special focus on Federal Government claims. Mr. Montgomery has represented both contractors and the United States in matters involving delay, performance and change order disputes. Almost immediately after joining Xpera Group, Mr. Montgomery took on the task of broadening the range and scope of services offered by the young company and was instrutmental in Xpera’s acquisition of Roel Consulting Services Inc., his former employer. With this acquisition, Xpera was now positioned to provide direct support to the industry contractors and developers beyond its litigation and claims foundation. These new services included Course of Construction Quality Assurance Management, a Building Envelope Commisioning Service and in 2015 an Owners representation/Construction Management Service. With Mr. Montgomery’s involvement, company wide revenue rose significantly and lead to Xpera Group being named to the San Diego 100 fastest growing companies list in both 2013 and 2014. Xpera’s meteoric growth and its transition from a focused claims consulting firm to a respected industry service provider remains one Mr. Montgomery’s proudest professional achievements to date.

¡ oversight responsibility for all aspects of contract surety claims for a regional property casualty insurance carrier. Responsibilities included risk assessment for defaulted contracts, payment claims analysis and resolution along with take over and completion management for defaulted contracts. In this capacity, Charles was also responsible for case management for all surety-related litigation, including deposition and trial testimony. In January of 1997 Golden Eagle Insurance Company was taken over by the California Department of Insurance. During the following eighteen months the company was sold to Liberty Mutual Insurance and a decision was made to close the Surety Division and re-focus the company in other insurance lines.

projects was to “step into the shoes” of its defaulted Principal, to aggressively manage the projects to mitigate its own losses, as opposed to utilizing outside management consultants.
