Historicaly the construction industry has focused on Budget and Schedule as the defining metrics of a successful project. We have watched the evolution of proactive safety programs and its impact on the bottom line in the form of reduced claims incidents but as an industry we have all but neglected to recognize that a rigourous QUALITY ASSURANCE program is equally important to the overall success or failure of any given project. Mr. Montgomery has worked in the trenches of the industry for over 40 years, has experienced the impact of failed quality management practices in the form of Construction Defect claims, Surety Bond claims and Performance disputes, yet he remains an optimistic believer that the tide is turning and that a proactive approach to prioritizing a projects core objectives can and will lead to a better built environment. New building code regualtions, an ever changing work force and escalating production costs pose challenges never before seen in our industry. A multiple Dicipline Construction Consulting Firm founded in 2010 with a focus on construction claims litigation support, both construction defects and contract claims. Mr. Montgomery’s primary area of expertise lies in the area of complex contract and performance matters with a special focus on Federal Government claims. Mr. Montgomery has represented both contractors and the United States in matters involving delay, performance and change order disputes. Almost immediately after joining Xpera Group, Mr. Montgomery took on the task of broadening the range and scope of services offered by the young company and was instrutmental in Xpera’s acquisition of Roel Consulting Services Inc., his former employer. With this acquisition, Xpera was now positioned to provide direct support to the industry contractors and developers beyond its litigation and claims foundation. These new services included Course of Construction Quality Assurance Management, a Building Envelope Commisioning Service and in 2015 an Owners representation/Construction Management Service. With Mr. Montgomery’s involvement, company wide revenue rose significantly and lead to Xpera Group being named to the San Diego 100 fastest growing companies list in both 2013 and 2014. Xpera’s meteoric growth and its transition from a focused claims consulting firm to a respected industry service provider remains one Mr. Montgomery’s proudest professional achievements to date.

Responsibilities included risk assessment for defaulted contracts, payment claims analysis and resolution along with take over and completion management for defaulted contracts. In this capacity, Charles was also responsible for case management for all surety-related litigation, including deposition and trial testimony. In January of 1997 Golden Eagle Insurance Company was taken over by the California Department of Insurance. During the following eighteen months the company was sold to Liberty Mutual Insurance and a decision was made to close the Surety Division and re-focus the company in other insurance lines.

projects was to “step into the shoes” of its defaulted Principal, to aggressively manage the projects to mitigate its own losses, as opposed to utilizing outside management consultants. Mr. Montgomery has therefore functioned as a boots on the ground construction manager in the role of General Contractor, Sub-Contractor and Developer, as the need and bonded obligations might require, managing multiple projects involving multiple disciplines in multiple geographic areas throughout the western United States.
