This summer, Missouri LICA is partnering with the University of Missourion a large Field Day at the Grace Greenley Farm between Novelty andLeonard, MO. We will be installing a 13-acre retention pond, four (4)replicated drainage test plots, a bio-reactor and buffer strip, andapproximately five (5) acres of drainage which will feed into the bio-reactor and buffer strip. This is Greenley’s 40th Annual Field Day. Inprevious shows, they have had 300-400 landowners tour the site. This year,by adding live construction and new practices to their educational stops,they are expecting the attendance to be even larger.

Attention LLC OwnersWe have recently become aware of a requirementin Missouri’s Workers’ Compensation laws whichapplies to LLCs ... even if you are a single memberof the LLC.
Missouri’s Division of Workers’ Compensationalerted us to Missouri Revised Statute 287.037which addresses the issue of workers’compensation insurance for members of the LLC. As stated below, you can reject the coverage,but keep in mind that your health insurance will notcover work-related injuries.
Here’s the statute’s language:
Member of limited liability company to receivecoverage, rejection of coverage, rescission ofrejection.
287.037. Notwithstanding any other provision oflaw to the contrary, beginning January 1, 1997,those insurance companies providing coveragepursuant to chapter 287, to a limited liabilitycompany, as defined in section 347.015, shallprovide coverage for the employees of thelimited liability company who are not membersof the limited liability company. Members of thelimited liability company, as defined in section347.015, shall also be provided coveragepursuant to chapter 287, but such membersmay individually elect to reject such coverageby providing a written notice of such rejectionon a form developed by the department ofinsurance, financial institutions and professionalregistration to the limited liability company andits insurer. Failure to provide notice to the limitedliability company shall not be grounds for anymember to claim that the rejection of suchcoverage is not legally effective. A member whoelects to reject such coverage shall notthereafter be entitled to workers' compensationbenefits under the policy, even if serving orworking in the capacity of an employee of thelimited liability company, at least until such timeas said member provides the limited liabilitycompany and its insurer with a written noticewhich rescinds the prior rejection of such
coverage. The written notice which rescinds the prior rejection of such coverage shall be on a form developed by the department ofinsurance, financial institutions and professionalregistration. Any rescission shall be prospectivein nature and shall entitle the member only tosuch benefits which accrue on or after the datethe notice of rescission form is received by theinsurance company.

Permit Update
As you know, our Governmental RelationsCommittee has been working for the past coupleof years on securing a blanket over-weightpermit for our Land Improvement Contractors(LIC) tag.
At the time of this newsletter, it looks likeMoDOT is very close to issuing the permits.They will cost $500 per year; need to bereviewed/updated every 90 days (no additionalcharge for updating); and will be linked to theLIC tag. The permit will be valid for a 100-mileradius from the contractor’s base forconservation work or hauling equipment to/froma repair facility, as is the LIC tag.
MoDOT will send a message to the permitholder when a bridge or route has beencompromised. The permit holder will also beable to access this info on the MoDOT site.

On April 3, 2017, President Trump signed HJR 83disapproving OSHA’s 2016 rule that clarified theAgency’s stance on citing employers for not keepingaccurate injury and illness records throughout therequired five-year retention period.
The rule, a move OSHA had taken in response to a2012 court decision, codified the agency’s long-standingpolicy that injury and illness recordkeeping violations are“ongoing” violations that could be cited within the OSHAct’s six-month window from the time an inspector firstdiscovered the violation. (The court ruling said that thesix-month period began when the violation actuallyoccurred, not when OSHA learned of the violation.)
Congress repealed the rule through the use of theCongressional Review Act (CRA). The seldom-usedCRA allows Congress to pass a resolution ofdisapproval to prevent, with the full force of the law, afederal agency from implementing a rule or issuing a substantially similar rule without congressional
authorization. The resolution also prevents futureadministrations from promulgating a similar rule.
The result of the rule’s repeal is that OSHA will no longerbe able to cite recordkeeping violations that occurredearlier than six months from the time an OSHA inspectordiscovers the violation. Realistically, the time period iseven smaller given the length of time it takes forinspectors to actually prepare case files and getcitations issued.
NOTE: The action does not change or take away anycurrent employer requirements with respect to injury andillness recordkeeping. Employers must continue to keepand maintain records under Part 1904 for the entire five-year retention period called for in the regulations.Nevertheless, OSHA may now be hampered inenforcing the requirements for employers who choosenot to comply.

breaking an adjacent fire hydrant supply line and fillingthe trench with water in a matter of seconds.
In February, a Suffolk County grand jury indicted AtlanticDrain and company owner, Kevin Otto, on two countseach of manslaughter and other charges in connectionwith the deaths. OSHA and the department’s RegionalOffice of the Solicitor worked with the department’sOffice of the Inspector General, the Boston PoliceDepartment’s Homicide Unit, and the Suffolk CountyDistrict Attorney’s Office during the course of thisinvestigation.
An investigation by OSHA found that their employer,Atlantic Drain Service Co. Inc., failed to provide basicsafeguards against collapse and did not train itsemployees – including Higgins and Mattocks – torecognize and avoid cave-in and other hazards.
“The deaths of these two men could have and shouldhave been prevented. Their employer, which previouslyhad been cited by OSHA for the same hazardousconditions, knew what safeguards were needed toprotect its employees but chose to ignore thatresponsibility,” said Galen Blanton, OSHA’s NewEngland regional administrator.
OSHA’s inspection determined that Atlantic Drain andowner Kevin Otto, who oversaw the work on the day ofthe fatalities, did not:
s Install a support system to protect employees in an approximately 12-foot deep trench from a cave-in and prevent the adjacent fire hydrant from collapsing.
s Remove employees from the hazardous conditions in the trench.
s Train the workers in how to identify and address hazards associated with trenching and excavation work.
s Provide a ladder at all times so employees could exit the trench.
s Support structures next to the trench that posed overhead hazards.
s Provide employees with hardhats and eye protection.
As a result, OSHA has cited Atlantic Drain for a total of18 willful, repeat, serious and other-than-seriousviolations of workplace safety standards and isproposing $1,475,813 in penalties for those violations.OSHA cited Atlantic Drain trenching worksites for similarhazards in 2007 and 2012.
Atlantic Drain has 15 working days from receipt of thecitations and proposed penalties to meet with OSHA’sarea director, and to contest the citations before theindependent Occupational Safety and Health ReviewCommission.
The walls of an unprotected trench can collapsesuddenly and with great force, trapping and engulfingworkers before they have a chance to react or escape.Protection against cave-in hazards may be providedthrough shoring of the trench walls, sloping the soil, orby using a protective trench box. Employers mustensure that workers enter trenches only after adequateprotections are in place to address cave-in hazards.
“We want to emphasize to all employers that trenchinghazards can have catastrophic consequences if they arenot addressed effectively before employees enter atrench,” said Blanton.

As of February 2020, all entry-level drivers will berequired to meet specific training requirements in orderto obtain a commercial driver's license (CDL). DOTreleased its long-awaited entry-level driver training rulethat establishes minimum training standards forinterstate and intrastate drivers applying for their initialCDL, upgrading their current CDL, or obtaining ahazardous materials, passenger, or school busendorsement for the first time.
Individuals subject to the entry-level driver trainingrequirements must successfully complete a prescribedprogram of instruction provided by an entity listed inDOT's Training Provider Registry. The prescribedtraining includes both theory (knowledge) and behind-the-wheel (range and public road) instruction.
There is no minimum number of hours that driver-trainees must spend on the theory (knowledge)instruction. The rule prescribes specific topics for eachof the five theory curricula, requiring the training providerto cover all topics, and requiring that driver-traineesdemonstrate their understanding of the material byachieving an overall minimum score of 80 percent onthe theory assessment. The rule does not require aminimum number of behind-the-wheel hours. Theproficient completion of the behind-the-wheel portionsof the various curricula is based solely on the traininginstructor's assessment of each driver-trainee'sindividual performance of the required elements ofbehind-the-wheel training on the range and public road.The effective date was February 6, 2017.

EPS Launches A New

The EPA has launched a new website to keep people informed about the progress of the “Waters of the U.S. (WOTUS)” rulemaking process.(http://www.epa.gov/wotus-rule). The agency has beenmeeting with representatives of state and localgovernment and recently reached out to the nation’sgovernors for input on how to craft a new rule to replacethe one now stayed by the courts. EPA and the ArmyCorps of Engineers “intend to follow an expeditious, two-step process” to withdraw the current WOTUS rule andthen replace it, EPA said in announcing the new webpage.
The site replaces the website developed for the 2015rulemaking process, but EPA said that “all the pages,information and documentation from the Clean WaterRule site will remain available in the EPA archived site,archive.epa.gov.” The first proposed rule is currently inthe interagency review process.

We are writing regarding the letter addressed togovernors nationwide from US EnvironmentalProtection Agency (EPA) Administrator Scott Pruittinviting states to weigh in on defining “waters of theUnited States” (WOTUS) under the federal CleanWater Act. When the WOTUS rule was proposed in2014, our organizations were unified in calling for itswithdrawal. We commend the current administrationunder President Donald Trump’s leadership forexpeditiously advancing its repeal or revision.
We recommend for your consideration the followingprinciples pertinent to defining WOTUS:
n Specify clear, objective characteristics that allow private landowners and the public as well as regulatory officials to readily identify and distinguish between WOTUS and state waters;
n Recognize federal jurisdiction does not extend to non-navigable, isolated/intrastate waters and wetlands, and ordinarily dry features, such as ephemeral streams;
n Recognize federal jurisdiction may extend beyond navigable waters to certain waters and wetlands that are likely to directly affect traditional navigable waters and for which clear, objective characteristics make these waters readily identifiable by private landowners and the public as well as regulatory officials;
n Specify “relatively permanent” water features must contain water persistently and frequently, and at a minimum, continuously carry water through the spring season;
n Specify only wetlands that directly touch or share a common border with traditional navigable waters, including wetlands beside
such waters but separated by a man-made or natural berm, can be considered WOTUS; and
n Retain existing codified exclusions from WOTUS and add exclusions for features such as ditches and irrigation structures.
On behalf of our respective members and affiliates, weappreciate your statements in opposition to theWOTUS rule and urge you to actively engage in thisopportunity to turn the clock back on this crowningachievement of an out-of-control federal bureaucracy.We stand ready to assist you and your administrationin this effort.
