CONDITIONS OF ENTRY

I/We (the Vendor hereinafter named) hereby nominate the horses appearing on this form for inclusion in the 2018 Melbourne Spring Thoroughbred Sale to be conducted by William Inglis & Son Limited (the Auctioneer) in accordance with the Conditions of Sale (which can be viewed at www.inglis.com.au/cos) and also other provisions appearing on this form.

The Vendor warrants the truth and accuracy of the details and other information furnished on this form and hereby agrees to indemnify the auctioneer in respect of any loss or damage it may suffer by reason of any false or erroneous or inaccurate matter being inserted on this form.

The Vendor hereby acknowledges that he/she has carefully read and understands the Conditions of Sale and other provisions contained in or appearing on this form; and agrees to be bound by such Conditions of Sale and other provisions.

The Auctioneer may in its absolute discretion accept or reject any nomination and its decision shall be final and binding on the parties. The Auctioneer shall not be bound to give any reason for its decision.

A lot entered for sale at the auction may be sold outside the auction only in accordance with the following provisions:

(a) No lot shall be sold privately prior to the auction without the prior written consent of Inglis.(b) In the event of any prior sale, Inglis shall be entitled to commission as if the lot was sold under the hammer, and the vendor shall provide Inglis with

full details of any such sale.

The following charges will be deducted from the Vendor's sale advice:

(a) Commission at the rate of 8.5% plus GST of the sale price up to $250,000 and 6.5% plus GST thereafter for the remaining balance on each lot, whether sold by auction, private contract, bought in or otherwise.

(b) This is a reserved sale and any Lot not sold will not be subject to pass in commission.(c) A promotional fee of 1% will be deducted from all bloodstock sold. 0.35% will be passed on to assist the funding of Thoroughbred Breeders

Australia. 0.65% will be used to fund an inward buyers programme to this sale.(d) Full commission is payable on any Lot catalogued and sold prior to auction.(e) Any Lot nominated for the Sale cannot be withdrawn by the Vendor, after the assigning of the horse's lot number for the Sale Catalogue, without

the forfeiture of the Entry Fee (entry), except in the event of injury, death of illness of the Lot. Apart from death of a Lot (in which case the Entry Fee shall be refunded in full), in all cases of alleged injury or illness if the Vendor at his expense produces a Veterinary Certificate, within thirty (30) days from the completion of the Sale, confirming the existence of the injury or illness alleged, 50% of the Entry Fee shall be refunded. Should the Vendor not produce an acceptable Veterinary Certificate, the Vendor will, on demand being made by Inglis, be liable to pay the Auctioneer 5% (plus GST) of the median sale price for the Selling Session in which the withdrawn Lot was listed, as liquidated damages, in addition to the Entry Fee.

The Vendor warrants that all security interests or other encumbrances including but not limited to foal shares, leases, PMSI's, Stud Book COPs (certificate of paternity), general and specific security agreements which affect the horse(s) will be disclosed to the Auctioneer upon lodgement of this form and will be discharged on or prior to the sale.

The Vendor hereby acknowledges that prior to the sale all Registration Documents will be lodged with the Auctioneer and all Stud Book requirements will be complied with and all racing leases cancelled. This form must be signed by the Vendor or some party lawfully authorised by him/her to execute this form on his/her behalf and such party is able to transfer good title to the Lot free from any mortgage, lien, charges or other adverse interests.

Where a purchaser qualifies to have a lot exported from Australia on a GST free basis, the Vendor appoints the Auctioneer to sign the Export Declaration form on their behalf.

AUSTRALIAN STUD BOOKASB issued Documents of Description (passport or foal identification card) for each horse nominated should accompany this entry form. It is a requirement that all hors es entered for sale be branded and microchipped in accordance with the new identification process from the ASB. This procedure must be completed prior to commencement of sale.

VETERINARY REPORTS ON BROODMARESVendors of maiden or barren mares are encouraged to have their veterinarian complete a “veterinary report on broodmare for the sale” and lodge it with the sale day office prior to the sale. These reports will be available for viewing by prospective purchasers during the course of the sale. Mares in foal must be tested within seven (7) days prior to the sale. Please contact the office if you require your mare(s) to be tested at Newmarket on the day of the sale.

BLOOD TESTING FOR STEROIDSUnder our Conditions of Sale all horses sold at this sale (excluding broodmares and foals at foot) are eligible for a post-sale blood test for anabolic androgenic steroids and receptor modulators. This test will be conducted at either the purchaser's or Racing NSW Stewards request and expense. For further information please read Condition 14 of the Terms and Conditions of Sale as listed on our website.

DEFECTS AND BANSRoarers, windsuckers, wobblers, bleeders or horses which have been or are under any racing ban must be stated on this form.

RACING LEASESAll horses subject to a Racing Lease must have that lease cancelled prior to the sale. For further information please see www.racingnsw.com.au/regoseach.asp.

PROMOTIONS ON Prior to the sale, all horses entered will have their auction availability promoted on Bloodstock.com.au. All passed in lots will have extra promotional activity on the website 30 days after the Auction.
