Terms and Conditions

The firearms dealer or firing range operator identified at the bottom of this document by name and address (in either case, “Range Operator”), hereby agrees to the following terms and conditions as a condition to its participation in the 2018 Rock Island Armory Range Program (the “Program”):

Rock Island Armory reserves the right to change any terms of this Program at any time, or cancel this Program at any time.

In order to qualify for continued participation in the Program, Range Operator must maintain a physical retail store as well as an on-site firing range, and fulfill the obligations set forth below as determined by Rock Island Armory in its sole discretion.

For so long as Range Operator qualifies for participation in the Program, Range Operator may order a minimum of five (2) Rock Island Armory firearms every one (1) year. No more than two (2) of any individual SKU or a total of ten (10) firearms may be ordered via the Program.

For so long as Range Operator qualifies for participation in the Program, Range Operator may order a minimum of zero (0) Armscor Ammunition every one (1) year. No more than two (2) of any individual SKU or a total of ten (10) cases of ammunition may be ordered via the Program. Note Ammunition is optional add on to program, however, it can not be ordered by itself, it has to be ordered in line with firearms (i.e. if buying two firearms, can buy two cases of ammunition).

All Rock Island Armory Range Guns must be properly maintained by Range Operator as public range pistols at the address set forth below for a period of nine (9) months. The Rock Island Armory Range Guns shall not be sold within this nine (9)-month period without Rock Island Armory prior written approval. All Rock Island Armory Range Guns will carry the standard Rock Island Armory limited warranty.

Orders for Rock Island Armory Range Guns will be processed by a Rock Island Armory Distributor of the Range Operator’s choice, and may be subject to additional terms and conditions of the Distributor. Program orders will be billed at 30% off the chosen Distributor Dealer Price. Distributor will ship the product to Range and manage the Program until firearms are purchased and packet is submitted to Rock Island Armory.

Range Operator agrees to strictly adhere to the highest standards of commonly observed firearm safety rules and regulations at all times, including without limitation the proper use of eye and hearing protection. Range Operator agrees to be solely liable to the public for violation of this paragraph. No representative of Rock Island Armory or the Range Operator can waive the provisions of this paragraph.

Range Operator will use only new commercial factory ammunition manufactured to North Atlantic Treaty Organization (NATO) or Sporting Arms and Ammunition Manufacturers’ Institute (SAAMI) specifications in the Rock Island Armory Range Guns. Range Operator agrees to not use either reloaded or remanufactured ammunition in any of the Rock Island Armory Range Guns. Violation of this paragraph may void the Rock Island Armory standard warranty on the Rock Island Armory Range Guns, and subject Range Operator to replacement at full price.

The Rock Island Armory logo, and the Armscor logo are registered trademarks of Rock Island Armory, and Rock Island Armory reserves the right to approve any and all use of such logos. Rock Island Armory will provide POS display materials for range enhancement and any alteration or modification of these materials or misuse of the Rock Island Armory logos is strictly prohibited and may preclude Range Operator from further participation in the Program.

Range Operator will not represent itself as a Rock Island Armory agent or entity in any agreement, either written or oral. Nothing in the Program shall be construed to make either Rock Island Armory or the Range Operator partners, joint venturers, principals, agents or employees of the other.

Range Operator agrees that Rock Island Armory Distributors and/or Sales Managers may conduct random periodic inspections of the Rock Island Armory Range Guns purchase through the Program.

Range Operator will not sell any Rock Island Armory Range Guns purchased via the Program within the nine-month period specified above without prior written approval.

Range Operator must keep Rock Island Armory furnished with a copy of its current Federal Firearms License (“FFL”), and immediately inform Rock Island Armory of any investigation by any government or quasi-government agency, or any revocation, suspension or other adverse action with respect to its FFL.

Range Operator agrees to, and hereby indemnifies and holds harmless Rock Island Armory, its parents, affiliates, agents and employees, from and against all legal claims and causes of action regarding the use and/or misuse of the Rock Island Armory Range Guns purchased under the terms of the Program. Use and/or misuse includes but is not limited to use of reloaded or remanufactured ammunition in the Rock Island Armory Range Guns, and/or operating an unsafe range.

Range Operator agrees that the laws of the State of Nevada shall govern all aspects of the Program, other than the purchase and sale transaction between Range Operator and the Distributor of its choosing. Any additional or different terms and conditions contained in the Range Operator’s purchase order and other documents are hereby disclaimed and are not be binding on Rock Island Armory unless specifically accepted in writing by Rock Island Armory. Range Operator consents to the personal jurisdiction of the courts of the State of Nevada for the adjudication of any matter arising out of, or related to this Program. Further, Range Operator agrees to pay all expenses incurred by Rock Island Armory, including attorneys’ fees, in attempting to enforce the terms of this Program.

The participation of Range Operator in this Program shall begin on the date these Program Terms and Conditions are signed by its authorized representative and approved by a designated internal Rock Island Armory representative.

These Terms and Conditions contain the entire agreement between the parties with respect to the Program, and Range Operator acknowledges that no other terms or obligations shall be binding on Rock Island Armory. Should any of these Terms and Conditions be interpreted or adjudicated by a controlling authority to be unenforceable or to violate public policy, all other portions shall remain valid and enforceable.

This agreement requires sign off from Distributor for the Distributor to give you discounted pricing. Rock Island Armory will not be billing nor drop shipping the product to your location.

*Note to Distributor, all items within this packet, along with credit memo from payables/accounting for discounts given per this program, need to be sent to personnel noted on front page of program. Rock Island Armory will send credit within 3 business days for completed information sent.
