The lease between sub-landlord (Adelaar Development) and applicanUsubtenant (Catskill Resorts TRS) gives the sub-landlord 30% of gross revenues exceeding $30,000,000. The lease between the landlord (EPR Properties) and the sublandlord gives half of that percentage to the landlord. Applicant states that [1] aggregate percentage of rent will not exceed 10% of total gross revenues; and [2] landlord (EPR Concord II), sublandlord and subtenant are all subsidiaries of EPR Properties. (2) Sublease does not run the length of the license period.

Description of Premises: Premises is a 7-story freestanding Hotel with indoor Waterpark with a maximum capacity of 1,500. The premises consist of 324 guest rooms, 8 restrooms, bowling lane, 3 bar areas, dining areas, waterpark area, changing area, lobby, vestibule, ballroom, kitchen, offices, conference area, storage rooms and mezzanine overlooking waterpark area, Outdoor licensed deck and yard with an occupancy of 70. The dining areas will have 158 tables with seating for 389. The three bars will have total seating for 51 .

Premises will operate with different OBA Names for each of the bar/dining areas located within the hotel -Harvey's Wallbanger; Eat, Eat, Eat; Bixby's Derby Taproom, Bar Mezz.

Method of Operation: Hotel serving beer, wine and liquor with 450 employees. The applicant will hire a manager to oversee operations. Applicant's staff will be responsible for safety and security. Entertainment will consist of recorded & live music, DJ, Karaoke and patron dancing. The application states that the premises will not use event promoters but the notice to the municipality stated that promoters would be used.

Description of Premises:

Current: The premise is located on the ground floor of a single-unit structure. Premises consists of a retail area, storage area, one restroom and an office. The alcohol will be stored in the retail area and in the storage area on the main floor. 614 square feet of the premises is dedicated to retail space while 180 square feet is dedicated to storage space.

Proposed: The addition of 375 square feet of retail space on the 1st floor and 743 square feet of storage space on the 2nd floor to be licensed. The applicant proposes to remove the shed/staircase from the side property and add an addition with a new bathroom and storage space on the 1st floor. The existing bathroom and storage space on the 1st floor will be removed and used for additional retail space. The applicant is also licensing the 2nd

floor for additional storage and an office. Construction of a new interior stairway from the 1st and 2nd floor will be built.

Method of Operation: Liquor Store selling liquor and wine. The principal currently operates the store with a manager and 7 employees.
