Pay Equity and How it Impacts Associations and our MembersPresented by Heyke Kirkendall-Baker, Attorney, NW Employer Solutions LLC

Pay equity laws have been in existence for decades, but many were enacted some time ago and lack an emphasis on discriminatory pay practices. As a result, the pay gap continues to exist today. Over the past few years, states have started to proactively examine their laws in an effort to reduce this pay gap.

After evaluating pay practices and current disparities, Oregon passed the Equal Pay Act of 2017—and the law’s most significant components took effect on January 1, 2019. Oregon’s Equal Pay Act of 2017 contains an unprecedented ten protected classifications, a pay history prohibition, and new remedies and damages for employees. Has your company conducted the necessary steps to ensure compliance?

Learning objectives: After attending this session, attendees will be able to: • Identify the requirements of Oregon Equal Pay Act of 2017• Identify the necessary steps to comply with the Act• Identify best practices to remain in compliance with the Act

Heyke Kirkendall-Baker, attorney, proactively counsel’s employers on the best practices in employee relations issues, wage and hour compliance, leave of absences, proper classification of workers, independent contractors, and compliance with federal and state laws. She routinely handles difficult performance problems and high-risk terminations. She has also conducted dozens of workplace investigations and favorably resolved a multitude of disputes with employees before lawsuits were filed. Recently, Heyke created and released an affordable and automated software program, called Parity Software. The program provides employers with consistent analysis and reporting to ensure compliance with the requirements of the Oregon Equal Pay Act. Heyke is licensed in Oregon, she earned her J.D. from Lewis & Clark Law School, and her B.S., Magna cum laude,

from the University of South Carolina-Aiken. She has represented management in all aspects of labor and employment law for more than 20 years. She primarily focuses on providing consultation and representation to employers and management in employment matters. She is a board member with Partners in Diversity, she has four grown children, and she resides in Beaverton, Oregon with her husband, Steve.

Understanding your Members’ Norms – Creating a (Productive, Healthy, Positive?) Culture and WorkforceSantiago Landazuri, Account Executive - Workers Compensation, Durham & Bates Insurance

As an association manager who has members hiring varying generational and cultural teams, non-native English speakers, and those who may look and think differently than others, come to this session to better understand and become more aware of tricky and risky situations. Some of these may include toxic or risk environments, or any area we are unfamiliar with or untrained to navigate. Learn how we can be better professionals ourselves, as well as support our members, when we understand the challenges many are facing with hiring, onboard, retention and safety. This session focuses on creating an understanding around social norms, language differences and many other significant related employer responsibilities that any industry and any organization is facing or will one day soon. Be prepared!

Santiago is a workers’ compensation risk advisor and risk management consultant. He was born and raised in Quito, Ecuador and moved to the U.S. 15 years ago where he graduated from Oregon State University. He has worked on the employer’s side in safety and recruiting, as well as the carrier side for SAIF Corp. as both a Claims Adjuster and a Return-To-Work Consultant. In 2017, he made the move to the agency side where he works with commercial businesses across a variety of industries to improve and optimize their risk management program. In addition to his extensive experience in workers’ compensation, his bilingual and bicultural skills have uniquely positioned him to assist employers in working with their growing Hispanic workforce by providing workshops, presentations, and trainings to employees and employers in both English and Spanish.

Robert is a fifth generation Oregonian with a far-reaching professional history. He has managed for-profit and non-profit organizations. He is an artist with a talent for branding who spent seven years as an art director. He spent another seven years in finance as a manager and commercial banker, helping businesses better understand and manage their resources. Over the past five years, Robert supported businesses both on the board and staff at the Springfield Area Chamber of Commerce. During that time he designed business education programs, consulted with businesses owners on various topics, and led leadership workshops. He is also dedicated to the presentation craft, as evidenced by advancing to the finals of the 2007 World Championship of Public Speaking.

Location & LodgingAll activities of the 2019 conference will take place at the Premier Best Western Boulder Falls Inn, located at 505 Mullins Drive, Lebanon, Oregon 97355. Complimentary onsite parking is available; carpooling is always suggested. The majority of the conference will take place at the Boulder Falls Conference Center, next door to the hotel.

RegistrationSpace is limited and early registration is encouraged. Discounted registration fees are available until November 15. Consult the registration form for more information. Registration confirmations will be emailed to attendees upon processing in the OSAM office, so ensure to list a current email address. Discounted registration is offered to individual members from the same organization. Memberships are on an individual basis and will be verified in the OSAM office at the time of processing. If you are not a current member but wish to receive the discounted member rate, a completed membership application and payment must be submitted with the conference registration form.

Member and Non-Member registration includes all education sessions and electronic materials (as provided by the speaker; see below), continental breakfast, breaks, lunch, exhibits, and the two receptions (Wednesday evening and Thursday). Please indicate on the registration form if you plan to attend the receptions; there is no additional cost, but is helpful for planning/food ordering purposes.

Handout InformationOSAM will provide handouts for the presentations (as supplied by the speaker) via our website osam.org. Handouts will be available approximately one week prior to the conference. Registered attendees will receive an email with information on how to access handouts, as well as additional conference details. Each individual will be responsible for printing and bringing handout materials on-site if so desired.

Continuing Education (CE) CreditsAttendees who attend the entire conference are eligible for up to 4 continuing education (CE) hours. A certificate of participation will be available for individual’s own record keeping. OSAM does not submit hours on behalf of the individual attendee. Attendees should only claim credit commensurate with their level of participation in the conference.

OSAM is an official CAE Approved Provider. We will maintain records of your participation in accordance with CAE policies. This program may be applied for up to 4 credits toward your CAE application or renewal professional development requirements (specific domain areas depend on session attended).

CancellationsCancellations received on or before November 15 will receive their total registration fees minus a $50 administrative processing fee. Cancellations received after November 15 are not eligible for refunds. No-shows and same-day cancellations will not be refunded any registration fees. There is no reduction in fees for partial attendance.

Event RestrictionsSpace is limited and early registration is encouraged. In the event that room space becomes filled to capacity, some registrants will not be able to be accommodated, and will be notified. Registrations will be accepted on a first-come, first served basis. In the event of inadequate registration, weather problems or other events beyond OSAM’s control, the conference may be moved or canceled. Should this occur, an attempt will be made to contact all registrants, but there may not be any refunds.
