Brexit must build not erode the UKrsquos world-leading safety and health systemrsquo the Institution of Occupational Safety and Health (IOSH) has urged recently

A transition period until 31 December 2020 will follow the UKrsquos departure from the European Union with trade and other negotiations taking place in the coming months and years

The EU (Withdrawal) Act 2018 transfers EU-derived laws into UK law meaning workers continue to have the same workplace protections The Health and Safety (Amendment) (EU Exit) Regulations 2018 came into force on Friday 31st January 2020 at 2300 hours (Brexit-day) to ensure existing protections and regulatory frameworks and The EU (Withdrawal Agreement) Act 2020 gives effect to the transition period

Richard Jones IOSH Head of Policy and Regulatory Engagement said ldquoDuring this transition period there should be minimal effect on occupational safety and health law given the UK Governmentrsquos commitment to maintain and enhance workersrsquo rights and that the UKrsquos risk-based system is both fit for purpose and well-respected worldwide

Launch of lsquoSafety Stepsrsquo - Working at Height Guidance

The chairman of the Grenfell Tower inquiry has backed a request from firms that refurbished the building that evidence they give should not be used against them in criminal prosecutions

Some firms had threatened to stay silent in the inquiry into how Grenfell was covered in flammable claddingSir Martin Moore-Bick said he had asked Attorney General Geoffrey Cox for the assurance ldquoas a matter of urgencyrdquo

The Application

1 On Thursday last week Mr Jonathan Laidlaw QC made an application on behalf of

certain persons who are expecting to be called to give evidence in Module 1 of Phase

2 of the Inquiry seeking to persuade the Panel that we should invite the

Attorney-General to give a formal undertaking that nothing said by a witness in the

course of giving evidence to the Inquiry would be used in furtherance of a prosecution

against that person In the course of his submissions Mr Laidlaw made it clear that in

the absence of an undertaking those whose interests he represented would be likely to

claim privilege against self-incrimination in response to any question which touched

on the way in which they performed their functions in relation to the design of the

refurbishment the choice of materials used in it or the way in which the work was

carried out It now appears likely that others who were involved in the refurbishment

are likely to adopt a similar position

Privilege against self-incrimination

2 It is a fundamental rule of law that with certain limited exceptions none of which

applies in relation to the Inquiry a person cannot be required in any legal proceedings

other than criminal proceedings to answer any question or produce any document or

thing if to do so would tend to expose that person to proceedings for an offence The

rule is of ancient origin but is now enshrined in section 14 of the Civil Evidence Act

On 17 January 2020 HSE published a revised version of EH402005 lsquoWorkplace exposure limitsrsquo

This has been updated in order to implement amendments to the Carcinogens and Mutagens Directive (200437EC) which introduces or revises 13 binding occupational exposure limit values for a number of carcinogenic substances

Occupational exposure limits are implemented in the UK via the Control of Substances Hazardous to Health (COSHH) Regulations as Workplace Exposure Limits (WELs) via Table 1 of EH402005 lsquoWorkplace exposure limitsrsquo for use with COSHH

COSHH requires exposure to carcinogenic substances to be reduced to lsquoas low as is reasonably practicablersquo

IMPORTANT NOTE The WELs listed in Table 1 of EH402005 lsquoWorkplace Exposure Limitsrsquo supersede any limits contained in other HSE guidance or publications

Part 1 The Importance of Mentally Healthy Workplaces

Mental health problems can stop people from performing at their best Ensuring that mental health and wellbeing is a priority can have wide-ranging positive effects for an organisation These can include the following

- More efficient productive and innovative staff- Increased profits and reduced costs- Better morale and performance- Reduction in sickness absence presenteeism and staff turnoverOrganisations perform better when staff are healthy motivated and focussed The relationship between wellbeing motivation and performance is called lsquoemployee engagementrsquoThe bottom line is that open and supportive workplaces benefit employees and employers Simple steps including prevention and early identification of problems can save money

When employees feel their work is meaningful when they feel valued and supported they tend to have higher levels of wellbeing be more committed and perform better

Employee engagement and good mental health go hand in hand Research shows that when staff wellbeing is not supported employee engagement lessens

According to Mind 1 in 6 British workers experience conditions such as depression anxiety and unmanageable stress every year This statistic is hugely under-estimated by the majority of employers and has a big impact on businesses costing them up to pound26 billion each year

A study by the Sainsbury Centre for Mental Health looks to identify the correlation between mental ill health in the workplace and the financial effects Staff turnover lower productivity and lost working days due to mental health problems can come at a high price

When employees leave their jobs due to poor mental health organisations incur high costs in recruiting selecting and training new staff members There is also a risk of legal action under health and safety legislation which can damage an organisationrsquos reputation Staff turnover can cost around 24 billion a year

lsquoPresenteeismrsquo is the loss in productivity that occurs when employees come to work but function at less than full capacity because of ill health Workers may come to work despite being unwell because they fear that sharing their mental health problem will cause prejudice or discrimination It has been suggested that presenteeism actually accounts for 15 times as much working time lost as absenteeism This appears to be more common amongst higher-paid staff and therefore costs more to employers

70 million working days are lost each year due to stress and other mental health problems

Wellbeing at Work is a vast topic There is a wealth of information and for any organisation just getting to grips with mental health support in the workplace it can be difficult to know where to start We are going to look at this important topic in six parts across this year

There is also a strong link between mental ill-health and physical ill health including conditions such as heart disease stroke cancer diabetes and asthma

Neglecting mental health at work is simply too high a price to be ignored

Castings company fined after a workerrsquos hand was crushed in a machineOn 6th January a foundry company who cast parts for the automotive industry has been fined after an employee had two fingers amputated while attempting to clear a blockage in a moulding machine

Chesterfield Justice Centre heard that on 28 February 2018 an employee of William Lee Ltd was attempting to clear a blockage of sand in a moulding machine using a length of metal rod at the company site on Callywhite Lane Dronfield The blockage cleared without warning and the employeersquos right hand was crushed between the rod and the machine resulting in two fingers being amputated and a number of fractured bones

An investigation by the Health and Safety Executive (HSE) revealed that had a suitable and sufficient risk assessment been completed the company should have identified that there was a risk to employees created by intervention in the machine when blockage clearance was required Specific procedures should therefore have been created for blockage clearance

The company could then have developed appropriate instruction training and information related to the task

William Lee Ltd pleaded guilty of breaching the Health and Safety at Work etc Act 1974 section 2(1) The company was fined pound60000 and ordered to pay costs of pound6000

Roofing company fined after worker fallOn 6th January a roofing company has been fined after a worker suffered serious back injuries when he fell from a ladder whilst transporting a bucket full of broken tiles

Folkestone Magistratesrsquo Court heard that on 2 October 2018 AU Roofing and Building Ltd workers were working on a roof in Elmes Avenue Ramsgate Kent where they were required to carry buckets of materials by hand down the scaffold access ladder Davey Battams aged 31 was unable to maintain a constant three points of contact with the ladder resulting in the fall

An investigation by the Health and Safety Executive found the contractor had not provided basic lifting aids such as a wheel and

pulley which would have eliminated this risk

AU Roofing and Building Services Ltd pleaded guilty to breaching Section 2(1) of the Health and Safety at Work Etc Act 1974 The company has been fined pound2880000 and ordered to pay costs of pound421370

Company fined after airport baggage handler suffers skull fractures and brain injuryOn 6th January a company providing a range of airline ground support services has been fined after an employee fell from a height of more than two metres

Luton Magistratesrsquo Court heard that on 24 December 2016 Rebecca Smith of Menzies Aviation (UK) Limited was injured during the loading of luggage onto an aircraft during an aircraft turnaround at London Luton Airport Ms Smith fell through a gap in the railing at the top of a luggage belt-loader whilst kneeling upon it to fasten cargo straps when the belt loader was struck by a passing vehicle She fell 22m (7 feet) on to the tarmac below The fall resulted in a loss of consciousness Ms Smith suffered a brain injury fractures of the skull

and cheekbone She also suffered permanent hearing loss in her right ear

An investigation by the Health and Safety Executive (HSE) found Menzies Aviation (UK) Limited had foreseen the risk of a collision between the various vehicles operating in a congested space around the aircraft during a turnaround but had failed to implement measures to guard against the risk of driver error when manoeuvring vehicles around aircraft The investigation also found the company was aware that belt-loaders had a gap in the railings between the aircraft and the barriers but failed to put in place any meaningful measure to control the risk that someone might fall through

Menzies Aviation (UK) Limited pleaded guilty to breaching section 2(1) of the Health and Safety at Work etc Act 1974 and has been fined pound181500 and ordered to pay costs of pound21043

Farming Business fined after employee crushed by concrete beamOn 7th January a farming business has been fined after one of its employees fell from a trailer and

was crushed to death by a concrete beam that fell with him

Folkestone Magistratesrsquo Court heard that on 13 March 2018 Trevor lsquoTedrsquo Elson of AA Clifton Limited Burmarsh was working with other employees to move six-metre-long concrete beams from the farmyard to the farmhouse where an extension was under construction at the site at Haguelands Farm Each beam weighed more than 300 kg and needed to be lifted by a mechanical telehandler Whilst on the trailer attaching lifting chains to unload a beam the deceased tripped and fell from the edge catching one of the beams which was unstable from the way previous beams had been removed This beam then fell from the trailer landing on his upper body and crushing him to death

An investigation by the Health and Safety Executive (HSE) found that the operation to move the beams was carried out at short notice and had not been properly planned The employees were left to decide how to do it themselves leading to an unsafe system of work None of them had been trained in lifting and slinging operations

AA Clifton Limited pleaded guilty to breaching Section 2 (1) of the Health and Safety at Work Act 1974 and were fined pound30000 with full costs of pound544650

Sole trader fined after worker injuredOn 8th January Duffy Skylining has been fined following an incident when a worker suffered serious injuries after being struck by a tree

Fort William Sheriff Court heard that on 4 February 2016 Malcolm Duffy and three employees were felling trees on land adjacent to the A82 north of Fort William contracted by the Forestry Commission While dealing with a taller tree around eight metres in height Mr Duffy made preparatory cuts and then checked with the rest of the team to ensure they were in a safe place Mr Duffy thought his colleagues understood that he was about to fell the tree After the initial cut was made Mr Duffy made his felling cut at the same time as Mr Strachan dragged a large branch from the brash pile into the path of the felling tree The tree stuck him on the left side of his helmet and left shoulder

An investigation by the Health and Safety Executive (HSE) found that the exclusion zone normally used which requires that no one would be positioned within two tree lengths of a tree being felled was not adhered to on this occasion Had there been a clearly defined system of communication it would have prevented the misunderstanding where Mr Duffy thought that workers appreciated the tree was about to be felled That particular tree being taller steps should have immediately been taken to identify and enforce a wider exclusion zone preventing any person from entering within two tree lengths of that tree

Malcolm Duffy trading as Duffy Skylining pleaded guilty to breaching Sections 2 and Section 33 (1) (a) of the Health and Safety at Work Act etc 1974 and was fined pound8000

Steel fabrication company fined after steel cages fall onto employeeOn 10th January a steel fabrication company has been fined after steel cages fell onto a workerrsquos leg resulting in multiple fracturesChelmsford Magistratesrsquo Court heard that in November 2017 an employee of Lemon Groundwork

Solutions Limited was using a gantry crane to lift a steel cage from a stack of cages at the company site in Wickford Essex These steel cages were free-standing on the floor each weighing 1188kg and were stacked between 2-4 cages high in an unstable pyramid formation without chocks to support the load When the employee used the gantry crane to lift the top cage from the stack two cages at the bottom rolled onto his left foot and leg fracturing his tibia and fibula bones As a result the worker had to undergo reconstructive surgery where metal rods plates and pins were inserted into his leg

An investigation by the Health and Safety Executive (HSE) found that prior to the incident Lemon Groundwork Solutions Limited had failed to implement a safe system of work for storing cages and had not provided their employees with sufficient information instruction training and supervision to store and handle cages safely The company had additionally failed to determine the maximum height that the cages could be stacked and suitable means to secure the cages to prevent movement and collapse The task of stacking cages was also not adequately risk assessed

Lemon Groundwork Solutions Limited pleaded guilty to breaching Section 2(1) of the Health and Safety at Work etc Act 1974 The company was fined pound130000 and ordered to pay costs of pound558999

Lemon Groundwork Solutions Limited had previously been served Improvement Notices by HSE regarding the safety of its lifting operations and the management of vehicles and pedestrians in its yard In November 2018 the company was fined pound100000 for a breach of Section 2(1) of the Health and Safety at Work etc Act 1974 following an incident in 2016 in which an employee was struck by a bundle of steel rebar that fell off a forklift causing multiple fractures to his leg

Sheffield company fined pound700000 after worker killedOn 10th January Chesterfield Special Cylinders Ltd was fined pound700000 today for safety breaches after a 64-year-old worker was fatally wounded by shrapnel ejected from testing equipment

Sheffield Crown Court heard that on 10 June 2015 John Townsend was leak testing eight 1500 litre cylinders by applying compressed

air inside to create pressure at the companyrsquos Sheffield site Whilst in the process of venting the air through the test manifold it catastrophically failed and fatally injured Mr Townsend

An investigation by the Health and Safety Executive (HSE) found that prior to installing the fittings 15 litres of a mineral oil-based corrosion inhibitor had been placed into each of the cylinders The incident occurred because the inhibitor contaminated the leak test manifold during venting of cylinders and was subjected to enough pressure inside the manifold to ignite and cause the test equipment to fail

Chesterfield Special Cylinders Ltd was found guilty of breaching Section 2 (1) of the Health amp Safety at Work etc Act 1974 The company was fined pound700000 with full costs of pound16949882

Construction company fined after worker killed during demolition workOn 10th January a construction company was fined half a million pounds after a father-of-two was killed when a reinforced concrete slab collapsed underneath him

during a demolition project

Southwark Crown Court heard that on 14 April 2014 33-year-old labourer Dainius Rupsys from Lithuania was working with an excavator operator at the site on Grosvenor Square in London as part of the operation to demolish the existing multi-storey building before 31 residential flats could be built

Mr Rupsys had been burning through reinforcing steel bars with an oxy-propane lance to assist the excavator operatorrsquos efforts to remove part of the reinforced concrete slab Another worker had alerted the supervisor that their work had made the structure unsafe and the demolition was halted However the supervisor then ordered the removal of props supporting the remaining slab and less than ten minutes later it collapsed The Court heard that the 360 excavator may have moved back onto the slab after the props were removed

Mr Rupsys the 360 excavator and its operator in the cab all fell with the slab Mr Rupsys suffered severe head injuries and died at the scene while the excavator operator injured his back

An investigation by the Health and Safety Executive (HSE) found that in the weeks before the incident CCTV from overhead cameras showed demolition work had been carried out unsafely that Mr Rupsys was not adequately trained to use the oxy-propane lance and that he had no training on using the safety harness which was not attached when the incident occurred

McGee Group Limited (McGee) who was the Principal Contractor for the project pleaded guilty to a breach of Regulation 22(1)(a) of the Construction (Design and Management) Regulations 2007 The company was fined pound500000 with pound6623622 in costs

Shipping company fined after worker fell from height and suffered life changing injuriesOn 14th January a shipping company was fined for safety breaches after a worker was paralysed from the waist down when he fell 34 metres to the bottom of a shiprsquos hold

Beverley Magistratesrsquo Court heard that on 15 May 2017 the 28-year-old worker a stevedore employed by Thor Shipping and Transport UK Ltd was unloading Merchant Vessel

An investigation by the Health and Safety Executive (HSE) found that for the stevedores to inspect all the cargo from port to starboard it was custom and practice for them to step over an access ladder gap on the walkway to get to the other side The stevedore made his way along the walkway and went to step over the gap He was astride the gap holding onto the guard rail when his high-vis jacket got caught on an eyebolt on the rails He took his hand off the rail and turned to free his jacket when he lost his footing and fell through the gap to the bottom of the hold

Thor Shipping and Transport UK Ltd pleaded guilty to breaching Regulation 6(3) of the Work at Height Regulations 2005 and to Regulation 3(1)(a) of the Management of Health amp Safety at Work Regulations 1999 The company has been fined pound120000

College fined for asbestos failingsOn 15th January Newnham College has been fined for failings that exposed employees and subcontractors to asbestos during

refurbishment of a flat owned by the college

Cambridge Magistratesrsquo Court heard that in March 2018 employees of Newnham College and subcontractors were carrying out a refurbishment of a flat on Grange Road Cambridge when asbestos insulation debris was discovered in the floor voids after work had been carried out in them No asbestos refurbishment survey was carried out prior to insulation debris being found One employee who contaminated his gloves and clothing with loose asbestos debris did not have asbestos awareness training and spread asbestos from his clothing outside the flat

An investigation by the Health amp Safety Executive (HSE) found that there was inadequate planning and management of the refurbishment work of a flat on Grange Road Cambridge

Newnham College pleaded guilty to breaching Regulations 5 and 16 of the Control of Asbestos Regulations 2012 It has been fined pound12000 and ordered to pay costs of pound445028

Client and construction company sentenced after failing to control the removal of asbestos

On 16th January Property owner Michael Cutmore and building contractors B and S BM Limited have both been sentenced after a refurbishment project of an old hotel was found to contain asbestos containing materials (ACMs) on site while work was still taking place

Truro Crown Court heard that during September 2017 a property in Island Crescent Newquay was to be partially demolished and refurbished under the control of one of its owners Michael Cutmore The hotel had been left derelict for several years allowing it to be subject to vandalism and squatting and had been soft stripped by its owner Asbestos surveys identified the presence of ACMs but these were not managed appropriately nor removed prior to the work Local building contractors B and S BM Limited were appointed by the hotelrsquos second co-owner to carry out works in half of the property while Mr Cutmore himself also stripped asbestos from within the former hotel

During a proactive inspection the Health and Safety Executive (HSE) identified that the former hotel was being refurbished and partially demolished whilst ACMs remained

in-situ Some of these ACMs were licensable products (eg asbestos insulating board which contains amosite) Due to the extent of the spread of asbestos dust and debris throughout the building and the lack of adequate control measures workers and visitors to the properties were at risk of exposure to asbestos fibres

B and S BM Limited pleaded guilty to breaching Sections 2(1) and 3(1) of the Health and Safety at Work Act 1974 The company was fined pound22000 and ordered to pay costs of pound5000

Michael Cutmore of pleaded guilty to breaching S3(2) of the Health and Safety at Work Act 1974 and has been ordered to carry out 120 hours unpaid work and ordered to pay costs of pound7500

Plumbing and heating contractor fined for carrying out illegal gas work

ON 17th January an unregistered plumbing and heating contractor have been fined for carrying out illegal gas work that put a number of homes at risk

Truro Crown Court heard that

from January 2017 to October 2018 Darren Masters trading as D Masters Plumbing and Heating Limited carried out gas work at four homes in Newquay Cornwall despite not being registered as a Gas Safe engineer

Registration with Gas Safe Register ensures engineers are qualified for the work they intend to carry out ensuring that gas work is carried out to an appropriate standard and the public are not put at risk of serious harm

An investigation by the Health and Safety Executive (HSE) found that Mr Masters falsely asserted he was Gas Safe Registered in the course of dealing with customers including signing off documentation with false Gas Safe registered engineer numbers The investigation concluded Mr Masters also misrepresented himself as sufficiently competent to carry out the services

Darren Masters pleaded guilty to breaching Regulations 3(1) 3(3) 3(7) and 26(1) of the Gas Safety (Installation and Use) Regulations 1998 and consequently Section 33 (1) (c) of the Health and Safety at Work etc Act 1974

Masters was sentenced to 22 and a half months in prison suspended for two years He was ordered to carry out 200 hours of unpaid work He was also ordered to pay pound1190200 in compensation and full costs of pound906850

Carlisle company fined after customer fatally crushedOn 17th January a Carlisle auto-salvage company was fined after a customer was trapped and fatally crushed when a lift truck he had purchased was being loaded onto his own recovery vehicle

Carlisle Crown Court heard that on 15 February 2018 a lift truck purchased from Michael Douglas Auto Salvage Ltd was lifted using the companyrsquos skip lorry onto a recovery vehicle at Stainton Road Etterby The metal ring on the lift truck that the winch wire was attached to failed causing the lift truck to fall and trap Mr Paul Spence against the skip lorry

An investigation by the Health and Safety Executive (HSE) found that the company had failed to ensure that this complex lifting process was properly planned by a competent person and that it had failed in its duty not to expose customers to

risk A competent person would have identified that this loading method with this equipment was fundamentally unsafe

The Company Michael Douglas Auto Salvage Ltd pleaded guilty to a breach of Section 3(1) of the Health and Safety at Work etc Act 1974 The company was fined pound23000 and ordered to pay costs of pound8000

Company fined after vehicle struck an overhead power cableOn 17th January Fairhurst Stone Merchants Ltd has been fined for safety breaches after a vehicle made contact with an uninsulated overhead electric power lineLeeds Magistratesrsquo Court heard that on 25 July 2018 a wagon delivering materials to the companyrsquos ready-mix plant in Settle was directed to tip its load close to the overhead power lines During the tipping procedure the vehicle moved forward and made contact with the power lines which were live at 111000v Nobody was injured in the incident

An investigation by the Health and Safety Executive (HSE) found that two years previously a wagon had made contact with the same power lines No one was injured

but the electricity supplier gave advice regarding avoiding a repeat incident The only action taken by the company was to put up two small warning notices that the driver failed to see In addition the first incident was not reported to HSE as required by the RIDDOR regulations

Fairhurst Stone Merchants Ltd pleaded guilty to breaching Regulation 3 of the Electricity at Work Regulations 1989 and Regulation 7 of the Reporting of Injuries Diseases and Dangerous Occurrences Regulations 2013 The company has been fined pound50000 and ordered to pay pound62142 in costs

Contractor fined for failing to provide minimum welfare facilitiesA principal contractor has been fined after repeatedly failing to provide minimum welfare facilities at a construction site in Burton on Trent

Newcastle-under-Lyme Magistratesrsquo Court heard that for a period up to August 2018 Mr Jevgenijs Sondors of J S Services failed to provide minimum welfare facilities for workers on the site of a residential

refurbishment on Shakespeare Road Burton on Trent despite being served Improvement Notices to put such facilities in place An inspection by the Health and Safety Executive (HSE) found there were no welfare facilities available for workers on the site for at least four and a half months The site lacked hot water a toilet washing facilities and rest facilities

Following a concern being raised HSE served two Improvement Notices and a Prohibition Notice on Mr Sondors who was acting as Principal Contractor for the refurbishment Mr Sondors then installed a toilet in the property but it was not linked to the water supply A watering can had to be used to ldquoflushrdquo the toilet Water in the property was provided via a single cold water pipe attached to a wall with a bucket underneath No cleaning or drying facilities were provided Follow up visits to the site after the compliance date for the notice expired found that the necessary improvements had not been made

Mr Jevgenijs Sondors of St Paul Street West Burton on Trent was found guilty in his absence

of breaching Regulation 13(4)(c) of the Construction (Design and Management) Regulations 2015 and Section 21 of the Health and Safety at Work etc Act 1974 A warrant had been issued for his arrest Mr Sonders was arrested taken into custody and held for 24 hours before appearing before the Magistratesrsquo Court He was fined

pound300 and ordered to pay full costs of pound385106

Speaking after the hearing HSE inspector Katherine Cotton said ldquoThe welfare facilities available for those working at the site fell far below the legally required standard Construction workers should be provided with a minimum standard

of welfare facilities including clean flushing toilets and cleaning and drying facilities

ldquoDutyholders should be aware that HSE will hold to account those who do not comply with health and safety legislation or who do not comply with enforcement notices served on themrdquo
