Rules of Racing No entry will be received except upon the condition that all disputes, claims, and objections arising out of racing or with respect to the interpretation of the conditions of any race shall be decided by the Stewards, and their decision upon all matters shall be final. The NYRA SVP of Racing Operations, the NYRA Racing Secretary or the NYRA Chief Examining Veterinarian has the right to refuse the entry of any horse with which they have any nature of concern. At the discretion of the Stewards, and without notice, the entries of any person, or acceptance of transfer of any entries, may be refused. The Stewards reserve the right to withdraw or scratch any horse which, in their opinion, does not qualify for the race in which it is entered. The rules of racing in the State of New York require that all racing personnel including owners, trainers and jockeys must be eligible for a license, and have the required application on file with the New York State Gaming Commission prior to their active participation in racing or training. Partners, Stable Names, Authorized Agents and Racing Colors must be registered with the Jockey Club before entries are made. Trainers employing unlicensed help will be subject to disciplinary fines. Employees with expired licenses will be held accountable and will be subject to fines, in addition to their employer. Entries Owners and trainers must be careful to claim allowances and state penalties at time of entry and are solely responsible if a horse starts with the incorrect weight and is therefore disqualified. Entries close at 10:30 am daily or at such time as the Racing Secretary deems that entries have been taken, unless otherwise specified in the condition book. No person shall enter or attempt to enter a horse for a race unless such entry is a bona fide entry made with the intention that such horse is to compete in the race for which the entry is made. Horses on the also-eligible list are not in today horses. Such horses may enter for the succeeding day and receive any preference to which they may be entitled; however if such horse gets in a succeeding race it will be scratched automatically from the race from which said horse was an also-eligible. Stakes races excluded. The status of such horses (AE) should be noted at time of entry.

In all Allowance/Optional claiming races allowance horses will be preferred.

Horses 10 years of age or older will not be eligible to run at the 2021 Belmont Spring/Summer meet or later.

In allowance/optional claiming races, if it is deemed a racing office error regarding the horse’s entry status (allowance conditions vs claiming tag), a change in status can be remedied, upon stewards’ approval, as long as the change is reflected in the official track program and the Daily Racing Form. A horse whose managing owner is a partnership cannot be entered or run in the name, whether real or stable, of an individual partner unless that individual’s interest or property in the racing qualities of that horse is equal to at least 25%. All First Time Starters must have papers on file in order to be eligible to start. Additionally, registration papers will not be released from Horse ID without trainer approval. In all overnight races no trainer or owner may enter more than two horses per race per designated surface, excluding stakes. Two additional entries may be made for an alternate surface. If a race is to be divided a trainer may enter two additional horses.

In-today horses may not be entered back without the Racing Secretary’s permission. Any in-today horse entered back will automatically be scratched from the first race entered and expected to run in the second race entered. Main Track Only (MTO) entries will be expected to run if a race comes off the turf. If an MTO has entered back in a subsequent race; the horse is first expected to honor his MTO engagement. Said horse will be released from that engagement if the race in question remains on the turf. Any horse entered at a NYRA track and subsequently re-entered at a different racetrack without permission from the Stewards or Racing Secretary shall be required to fill the NYRA obligation.

In all overnight races no same trainer entry will be allowed to draw into the body of a race to the exclusion of a different trainer entrant. At time of entry, trainers must designate a “different owner 1st choice (DO1) and a “different owner 2nd choice (DO2).” Stakes races are excluded from this rule.

Stakes races are excluded from this rule as condition eligibility, high weights, and gross lifetime earnings will establish preference.

A different owner 2nd entry (DO2) is preferred over a same owner 2nd entry (S02). In today horses are always least preferred.

Any horse entered at a NYRA track in an overnight race must obtain permission from both the NYRA Racing Secretary and the Stewards to re-enter at a different racetrack. Failure to do so will result in a fine and placement on the NYRA Steward’s list for a period of 10 days. It may also result in loss of stall space.

4026.7 Assignments restricted. After a horse is drawn into a race, there shall be no transfer nor assignment of any ownership interest in such horse until after such race or until such horse is scratched from the race, if sooner. No member of a partnership that owns a horse, leases the racing qualities of a horse, or is designated a managing owner for a horse shall assign his or her share or any part of or interest in it without written consent of the other partners being filed with the Jockey Club/NYRA Clerk of Course. No assignment of an interest in a partnership which, by ownership or lease, controls the racing qualities of a horse, shall be accepted if the effect of the assignment would be to create a partnership that would not qualify for filing under the terms of section 4026.2 of this part. A notarized bill of sale will be required by the NYRA Clerk of the Course signed by all parties in any change of ownerships.

SilksThe managing partner must notify the NYRA Clerk of Course, Kelly Gecewicz, by time of entry as to which silks will be worn for a specific race for the first initial start at a NYRA track or if a change in silks is to be made. Owners will be accommodated with a silk change after the overnight is out if the final proof for the program has not gone to print. Silk changes after the program has gone to print may be accommodated with permission from the Board of Stewards and will be announced to the public before post time but may result in a fine.

All silks must be registerable with the Jockey Club for usage at a NYRA track.

Preference (date) System The preference (date) periods will regenerate three times a year for all categories. 1st day of Aqueduct Spring, 1st day of Saratoga, 1st day of Aqueduct Winter. All horses under the care of a trainer that has been allotted stalls at NYRA at the beginning of a preference date period will receive the initial preference date. All other horses will receive a date when a stall application has been approved or when registration papers are submitted. All shippers may receive the beginning preference date if their foal papers or a copy of the foal papers are turned into the racing office on or before the first day of entries. After the first day of entries, shippers will receive a preference date based off of the entry date when the papers are turned in. A horse with an assigned NYRA date that runs out of town regardless of surface or condition will receive that date for all categories. Separate dates will be maintained for dirt, turf and New York breds. A scratch date will be used for all categories. Order of Preference. Earliest date prevails. If the race in question overfills with horses of equal date preference, the order of preference shall be entry, run, scratch. A horse that has been drawn on the also-eligible list may retain its date only if there is not an opportunity to draw into the race the day before. A horse that runs above its allowance condition will retain its date. A horse that runs in a NYRA Stake will retain its date. Date preference does not supersede the rules specified in the conditions of a race. All horses in the body of a race that is cancelled will receive a special preference for the category they were entered in. Eligibility “Closed races” are considered as those restricted to “Which Have Never Won $10,000 Four Times Other Than Maiden, Claiming, Starter or State Bred” or less. (Three Times, Two Times, One Time) For purposes of determining eligibility in closed races, a win in any Group/Graded race in any Part I or II country, regardless of purse value, shall be considered a win at or above the qualifying amount of $10,000. Starter Stakes or Starter Handicaps shall be considered starter races for eligibility purposes.Stalls will not be allotted nor entries accepted on any horses which have broken their maidens and have started for $7,500 or less and has not won a race for $8,000 or more in 2020-2021 or has not finished 2nd, 3rd, 4th, or 5th for $8,000 or more since starting for $7,500 or less.

Maidens which have started in a maiden race of $14,000 or less will not be eligible, unless after such start, that horse finishes 2nd, 3rd or 4th in a race greater than $14,000. Maidens which have started in a maiden race for a value of $20,000 or less at any time and have not finished 2nd, 3rd, 4th, or 5th in a maiden race greater than $14,000 within their last four starts will not be eligible. Non-claiming maiden races will be disregarded when applying this rule, unless the horse placed 2nd, 3rd, 4th or 5th. Horses must start in at least four maiden claiming races for this rule to apply. Once a horse has started at the current race meet it may not lose its eligibility. However, any eligible horse which leaves during the meeting to race elsewhere must again satisfy the original eligibility requirements before being approved to return. For eligibility purposes, all 2-year-old and 3-year-old State Bred Stake races (including New York Stallion Stakes) will not count against eligibility in open allowance races.

MAIDEN AUCTION ALLOWANCE ELIGIBILITY 1. Horse must have been purchased for $45,000 or less in the horse’s most

recent sale.

2. RNA’s are eligible as long as the reserve price was $45,000 or less in the horse’s most recent sale.

3. The sale must be a recognized sale by the Society of International Thoroughbred Auctioneers (Fasig-Tipton, OBS, Keeneland etc.)

4. Any and all discrepancies will be decided by the Board of Stewards.

CHANGE OF SURFACE – TURF TO DIRT

If the NYRA Racing Secretary considers it inadvisable to run any carded race on the turf, the race will be transferred to the main track and run at the following distance:

• 6 Furlong turf events will be run at 6 Furlongs • 7 Furlong turf events will be run at 7 Furlongs • 1 Mile turf events will be run at 1 Mile • 1 1/16 Mile turf events will be run at 1 1/16 Miles • 1 1/8 Mile turf events will be run at 1 1/8 Miles • 1 1/4 Mile turf events will be run at 1 1/8 Miles • 1 3/8 Mile turf events will be run at 1 1/4 Miles • 1 1/2 Mile turf events will be run at 1 1/4 Miles

CLAIMING RACES

There will be a 1.5% Aftercare Assessment on all claims. The 1.5% must be on account at time of claim or the claim will be considered void. These funds will go to accredited Thoroughbred Aftercare Facilities.

4038.3 If a horse is claimed it shall not start in a claiming race for a period of 30 days from the date of the claim for less than 25% more than the amount for which it was claimed. 4038.4 If a horse is claimed it shall not be sold or transferred to anyone wholly or in part, except in a claiming race, for a period of 30 days from the date of the claim. A claimed horse shall not, unless reclaimed, remain in the same stable or under the control or management of its former owner or trainer for a like period. A claimed horse shall not race outside of New York state for a period of 30 days or the end of the meeting at which it was claimed, whichever period of time is longer, except that said horse may run in a sweepstake elsewhere for which it was nominated by its former owner or trainer, or by permission of the Stewards. 4038.5 All claims shall be in writing, sealed in an envelope and deposited in a locked box in the racing office at least 10 minutes before post time. Claim slips must be completely filled out and accurate. All monies must be on account with the Horseman’s Bookkeeper prior to dropping the claim (Owners and Trainers are solely responsible to make sure enough money is on account). 4038.6 No person shall claim more than one horse in a race. As a courtesy to horsemen involved in multiple claims for a specific horse, the Racing Office will wait at least 3 minutes after said race is declared official

before commencing with the shake. It is the horsemen’s responsibility to have a representative at the shake in a timely manner. Non-representation is not grounds for voiding a claim and may be subject to penalty. All partners involved in the claim of a horse must be written on the claim slip with their corresponding percentage of ownership at the time of the claim; partners cannot be added or changed in any other manner until the 30 day period has elapsed.

Waiver Claiming Option – Claiming Races At time of entry into a claiming race an owner/trainer may opt to declare a horse exempt from being claimed provided:

i. The horse has not started for 180 days since its last start. ii. The horse is entered for a claiming price equal to or greater than the

price it last started for. iii. Failure to declare the horse exempt at the time of entry may not be remedied. iv.The waiver rule can only be applied to said horse’s first start following each such layoff.

Claiming – Who May Claim Claims may be made by an owner licensed for the current year, or his duly authorized agent, if the owner is presently registered in good faith for the current race meeting and has had a starter in the previous or current race meet of the licensed or franchised racing association, up to or including the race in which the claim is made. The trainer for the approved owner making the claim must be stabled on the NYRA grounds and have an approved stall application for the current race meet on file. If the above conditions are not fully met, the claim shall be void.

Claiming – Use of Funds Owners and Trainers, please be advised that horsemen who do not have the required paperwork: i.e. signature card, tax forms and photo I.D., on file with the Horsemen’s Bookkeeper will not be able to use or withdraw any earned purse money until said paperwork is on file. Therefore, earned purse money cannot be used towards the claim of a horse until all of the above stated documentation is on file.

Voiding Claims 4038.5 (a)(iii) a claim is voidable at the discretion of the new owner, for a period of one hour after the race is made official, for any horse that is vanned off the track after the race. The new owner shall void a claim by completing and turning in a Void a Claim form to the state steward. The form must be turned in during the allotted time and be signed by representatives of the new owner. Upon examining the facts the claim will be voided by the Stewards. The Stewards may void a claim without a Void a Claim form upon their discretion. Upon the voiding of a claim the former owner and trainer shall immediately resume responsibility for the horse. A claim shall be void for any horse that dies during a race or is euthanized on the track following a race.

Jockey Engagements 4025.33 – Each horse to be drawn into the main body of a race or as an also-eligible shall have its jockey named by the time established by the Racing Secretary for drawing of post positions and prior to the publication of the overnight. No jockey may be named to ride more than one horse in the body of the race except that a jockey may be named to ride a horse drawn into the main body of the race and also a horse drawn as an also-eligible in such race, or a jockey may be named to both parts of a coupled entry where only one starter from such entry will start. All jockeys shall be named by scratch time and no jockey shall be named or changed thereafter except by the Stewards for good cause. It shall be the responsibility of the trainer to ensure compliance with this rule. In this regard, upon request, the racing secretary’s office shall notify the trainer of the availability of specific jockeys when taking entries. Should a jockey remain unnamed at the time prescribed herein such naming shall be made by the Stewards or their designee. No jockey, once named, shall change except for good cause by the Stewards. It shall be the responsibility of both the jockey and the trainer to fulfill their engagements. An apprentice allowance may only be claimed before entries have closed and only if the apprentice has been engaged. 4028.2 – Change of Jockey. Any change of jockey must be sanctioned by the stewards and if no satisfactory reason is given for the change the board of stewards may suspend or fine any person found culpable in the matter.

Scratches Scratch time will be 10:00 am on the day of the race. Scratches must be called into the Racing Office at extension 4241. All scratches must be approved by the Steward on scratch duty that day. In all overnight races the field may scratch down to ten betting interests by scratch time with no penalty. In the event that there are multiple scratches in a race vet scratches will be taken out first, non-vet scratch horses will be given second preference to be released from running. If there are multiple non-vet scratches a draw will be held to determine who is scratched from the race. All scratched horses will receive a scratch date in all categories. Scratches that bring an overnight race below ten betting interests will result in the scratched horse being placed on a stewards list for 10 days.

Horses on the also-eligible list or main track only entries can be held in a race past the designated scratch time at the Steward’s discretion.

Veterinarian Scratches Unsoundness requiring a Veterinary Scratch at the starting gate or observed post-race: the horse shall be placed on the Veterinarian’s List for a minimum of 10 days. On the 11th day or thereafter the horse is eligible to work at least one-half mile in an official time of :52 or better and demonstrate racing soundness to the NYRA Veterinarian. A post-work blood sample shall be taken by the NYRA Vet following the work. Only medications allowed on race day may be used and the medication levels may not exceed those permissible on race day. This rule will apply to all horses identified by the NYRA Veterinarian at the gate as being sore or declared unsound by the jockey, even if the problem is not obvious to the NYRA Veterinarian. This rule shall not apply to horses at the gate scratched for trauma; horses scratched at the gate for trauma shall be permitted to enter future races at the discretion of the NYRA Veterinarian who shall evaluate the horse’s soundness on a case-by-case basis.

Illness or Injury requiring a Veterinary Scratch: horses placed on the Veterinarian’s List as sick or injured shall stay on the Veterinarian’s List for 10 days. The horse can be entered to race while on the Veterinarian’s List provided sound health has been satisfactorily demonstrated to the NYRA Veterinarian and the race in which it is entered is on the 11th day or thereafter. Such horses are least preferred in overfilled races. Horses vanned off the racetrack, after unsaddling or from the test barn, may be designated as “injured” and will need to satisfy the same requirements for removal from the Veterinarian’s List as horses designated as “unsound”.

Removal from the Veterinarian’s List: Horses to be removed from the Veterinarian’s list for unsoundness must work for the NYRA Veterinarian (or for a regulatory veterinarian in another racing jurisdiction, e.g. association or commission) at least one-half mile in a time of :52 or better demonstrating racing soundness to the satisfaction of the Veterinarian. Blood will be taken at the conclusion of the work. All horses on a Veterinarian List for unsoundness must meet this requirement regardless of the time placed on the Vet’s List.

Recency Lists

More than 180 Days: Horses which have not started in more than 180 days or less than 365 days must be presented to the NYRA Veterinarian prior to racing.

More than 365 Days: Horses which have not raced in 365 days will automatically be added to the Veterinarians’ List and must satisfy the same requirements for removal from the Veterinarians’ List as horses designated as “unsound.” If a start has not been made within 60 days of the NYRA Veterinarians’ clearance then the horse will be placed back on the Veterinarians’ list.

Horses making their first start after Feb. 1 of their 4 year old year: Horseswhich have not made a start prior to Feb. 1 of their 4 year old year will automatically be placed on the Veterinarians’ List and must satisfy the same requirements for removal from the Veterinarians’ List as horses designated as “unsound.” If a start has not been made within 60 days of the NYRA Veterinarians’ clearance then the horse will be placed back on the Veterinarians’ List.

All works for removal from the Vet’s List shall be by appointment only on race days. All horses working to get off of the Vet’s List will be tested for the presence of medications. Horses found to test positive will remain on the list.

Horses placed on the Vet’s List as injured, lame, sick or unsound may not workout for 72 hours after being placed on the List without permission from the NYRA Veterinarian.

Stabling A stall application is required for every person seeking to be stabled at NYRA facilities. The New York Racing Association reserves the right to refuse stabling space, to reduce the number of stalls assigned and/or change the location of stalls assigned, or to refuse the acceptance of an entry in any race for any reason or cause, and without notice to the trainer. Trainers agree to abide by all rules and regulations of the New York Racing Association and the New York Gaming Commission. Trainers agree to vacate stalls and move all horses, equipment and personnel, upon request, from NYRA property within a reasonable time. The New York Racing Association reserves to itself the exclusive right and sole discretion to enter, modify, alter or change the physical condition or use of any of its facilities, wherever located on its premises. Permission granted to any owner, trainer or jockey or his agents, servants or employees to use NYRA’s facilities does not constitute a lease of such facilities. NYRA maintains the sole interest in and exclusive control of its premises and said facilities. Surveillance – By entering any horse(s), owner, trainer, their respective agents, employees and affiliates (“Entrant”) acknowledge and agree that NYRA has the right to inspect and maintain surveillance on all horses located at NYRA facilities, including, without limitation, horse’s stall, barn and all grounds in general proximity to the physical location of the horse as NYRA selects and deems appropriate in its sole discretion.

Shipping In Trainers are advised that all horses shipped to any NYRA track must have permission from the Racing Secretary’s office before they will be admitted on the grounds. Before shipping to a NYRA facility please contact the stable superintendent for stabling information. All horses shipping to a NYRA facility must have a current health certificate (within 3 days) and a negative Coggins test dated within 12 months of entry. Horses will not be permitted entry without such proof. All horses vanning in to race must be on the grounds no later than 9 A.M. Earlier arrival may be required with the use of race day Lasix or pre-race vet check. Horses shipping in from a farm to race must meet all race day requirements. Foal certificates must be on file with Horse Identification no later than the arrival date of said horse. In the case of unnamed two-year-olds, photocopies will be accepted.

Blinker Changes Blinker changes should be reported at time of entry and will be published on the overnight and in the official program. Should a change of blinkers fail to appear on the overnight, it is the trainer’s sole responsibility to immediately notify the Racing Secretary’s office of the discrepancy no later than 10:00 am on the day of the race. Failure to do so will result in no change in blinkers or the horse will be scratched and the trainer will be subject to a fine.

Shoes Dirt Tracks -A Queen’s Plate or a toe grab up to 4mm will be allowed on the front shoes. No other traction device will be allowed. Hind shoes will be limited to a ¼ inch bend. Bar shoes and aluminum pads will be permitted all around.

Turf Tracks - Queen’s Plate or Queen’s Plate XT will be the only shoes allowed on the turf. A violation of the shoe policy will result in a fine and possible suspension. Horses that report to the paddock not in compliance with shoe regulations will be scratched. Changes - Any shoe change involving bar shoes and aluminum pads should be reported at time of entry. These changes will be published on the overnight and in the official program. Should a change of shoes fail to appear on the overnight, it is the trainer’s sole responsibility to immediately notify the Racing Secretary’s office of the discrepancy no later than 10:00 am on the day of the race. Failure to do so will result in a possible scratch and the trainer with be subject to a fine at the discretion of the Stewards.

Equipment All articles of equipment in which a horse races with must be in their proper position when the horse leaves the paddock for the post.

Safety helmet required. Section 4006.7 Every jockey, apprentice jockey, pony person, outrider or exercise rider whether in a race or on any NYRA training surface in the morning, shall wear a safety helmet of a type that has been approved by the stewards; no change can be made in this equipment without approval of the Stewards. Safety vest required. Section 4006.8 Every jockey, apprentice jockey, pony person, outrider or exercise rider whether in a race or on any NYRA training surface in the morning, shall wear a safety vest of a type that has been approved by the stewards; no change can be made in this equipment without approval of the Stewards.

NYRA Workout Criteria

Entries will not be accepted for any horse requiring a workout.

All horses entering the track must be identified by name (unnamed by dam), distance to be worked and name of trainer. Failure to report this information to the gap attendant may result in a fine. All first time starters: at least 3 works in the last 45 days; one of which must be at least ½ mile. This rule also applies to two-year-olds. All horses must be gate approved. Horses which have not started in 90 days will be required to have 3 works within 90 days of their start date. At least 2 of those works must be within 60 days; one of the works must be at least a ½ mile. There must be at least one 3/8 mile work or farther within 30 days of the start date. Horses which have not started in 60 days will be required to have 2 works within 60 days of their start date. One of the works must be at least ½ mile. There must be at least one 3/8 mile work or farther within 30 days of the start date. Horses which have not started in 30 days will require 1 work 3/8 mile or farther within 30 days of their start date. Horses put on the poor performance list (beaten 25 or more lengths, at stewards’ discretion) must work a ½ mile in 53 seconds or less to be taken off the list and be eligible to enter. Imported horses: The workout requirements will be waived for horses entering in a race within 7 days of clearing the USDA quarantine, provided that the country of origin’s racing jurisdiction has no provision for timed workouts on a regular basis

Altering Sex of Horse Any alteration to the sex of a horse from the sex recorded on the certificate of foal registration shall be reported to the Racing Secretary’s office and the NYRA Horse ID department, if the horse is entered to race at any NYRA race meet. If a racehorse is gelded or castrated on the premises of any NYRA racetrack, or under the jurisdiction of the State of New York, the trainer shall report the alteration within 72 hours. If a racehorse is gelded or castrated off the premises of a licensed racing association, or other facility under the jurisdiction of the State of New York and the horse has previously entered to race at any NYRA race meeting, the owner and/or trainer shall report the alteration before the horse is next entered to race. A report of gelding or castration will include the name of the veterinarian performing the alteration and the date of the alteration, and shall be recorded on the foal certificate and the official horse identification record of the horse. A trainer who enters a horse, or who causes a horse to be entered on his behalf, is responsible for ensuring that the true sex of the horse entered is correctly stated on the foal certificate on file with the NYRA Horse ID department. If the true sex of a horse is not correctly stated in the official program for the race in which the horse is entered, the trainer of the horse shall be subject to a minimum fine of $1,000. This fine is at the discretion of the Stewards if mitigating circumstances can be demonstrated by the trainer. Report of Altering of Sex of Horse forms are available in the Racing Office and with the Clerk of the Course. They are also available online on the NYRA website in the horsemen’s section.

Horsemen’s Bookkeeper The Horsemen’s Bookkeeper’s office will be open on racing days from 9:00 am until the running of the last race. The office is located in the Racing Secretary’s office. Owners and trainers are required to file their complete address information, U.S. Tax reporting numbers, jockey fees, jockey insurance fees and all stakes engagement fees prior to post time of their race. The following documents are required for operating your racing account: Signature Card (signed and notarized), Tax Forms (W9 for US Citizens, W8ECI for foreign accounts) and a copy of valid driver’s license (US Citizens) or a copy of passport (foreign accounts). Purse monies will be available two days after the date of the race. Please note that all requests for checks must be done in writing, and an owner’s signature card, or an authorized agent form must be on file with the Jockey Club before purse money will be released. Once your account is set up and in good standing we encourage you to request web checks online through Incompass Financial solutions, the easiest and fastest way to receive funds. Check requests may be made by fax with a signed request sent to (718) 659-3582. ACH transfers (takes 2-3 days) are available for funds in excess of $25,000. MEDICATION & TESTING Horsemen and practicing veterinarians are advised to review all medication rules on the New York State Gaming Commission website with regards to proper usage and administration of all medications while racing in the State of New York. Please feel free to contact New York State Equine Medical Director, Dr. Scott Palmer with any questions at (908) 672-0965 or Director of NYRA Veterinarians, Dr. Anthony Verderosa at (718) 659-4230. A negative Coggins test required for each calendar year – On January 1st each year, all horses stabled at NYRA facilities will be required to have an updated Coggins test for the new year. This test will be valid January 1st through December 31st at all NYRA tracks.

Drug Testing 4012.3 The Stewards may require at any time that any horse be sent to the testing enclosure for the taking of such specimens of blood, urine or other materials as shall be directed, as well as examination for “sponging” and such additional examinations as directed.

TOBA Supertesting Each graded stakes race run at a NYRA racetrack shall be subject to the TOBA guidelines for supertesting under the enforcement of the New York State Gaming Commission.

Out-Of-Competition Testing The New York Racing Association will conduct an extensive out-of-competition drug testing program at all NYRA facilities. As a condition precedent to stabling, training or entering any horse in any race at any NYRA racetrack, all trainers and owners irrevocably agree and consent without condition that all horses on the grounds of facilities operated by NYRA are subject to testing or inspection by NYRA. Full details of the out-of-competition testing program are available at nyra.com or upon request from the Racing Secretary’s office.

TCO2 Testing In accordance with rule 4043.8 TCO2 testing will be conducted at all NYRA racetracks under the enforcement of the New York Gaming Commission. All horses must report to the assembly barn no less than 45 minutes prior to their designated post time. TCO2 sampling will take place in the assembly barn prior to the horses being escorted over to the paddock. A fine or scratch may be issued by the Stewards at their discretion if horses are late to the assembly barn.

Requalification Testing A horse which has tested positive for the presence of a drug shall have to work for the stewards to their satisfaction; and thereafter test negative for all race day medications before said horse will be permitted to enter and start again.

Pre-Race NYRA Veterinarian Exams All starters will be subject to a pre-race morning examination by NYRA Veterinarians.

Joint Injections: NYSGC rule 4043.4(b): Trainers shall maintain accurate records of all corticosteroid joint injections to horses trained by them. The record(s) of every corticosteroid joint injection shall be submitted, in a form and manner approved by the commission, by the trainer to the commission within 48 hours of the treatment. The trainer may delegate this responsibility to the treating veterinarian, who shall make the reports when so designated. The reports shall be accessible to the examining veterinarian for the purpose of assisting with pre-race veterinary examinations.All horses on the corticosteroid list are ineligible to race for a period of 14 days.

Shock Wave Therapy All Shock Wave treatments on NYRA property must be done between the hours of 11:00 am and 4:00 pm Monday through Friday. NYRA security personnel must be present at the time of the treatment. Appointments must be set up in advance with NYRA Steward Brook Hawkins. Possession and use of Shock Wave Therapy equipment on NYRA property is limited to licensed veterinarians. All such equipment must be registered with the NYRA Chief Examining Veterinarian.

4043.14 Restrictions on shock or pulse wave therapy. The use of extracorporeal shock wave therapy, radial pulse wave therapy or similar treatments shall not be permitted unless the following conditions are met:

(a) The use of extracorporeal shock wave therapy, radial pulse wave therapy or similar treatments within the State:

1. Is limited to veterinarians licensed to practice by the commission; and

2. May only be performed with machines that are:

i. Registered with and approved for use by the commission; and

ii. Used at a pre-disclosed location that is approved by the commission.

(b) Any extracorporeal shock wave therapy, radial pulse wave therapy or similar machine, whether in operating condition or not, must be registered with and approved by the NYRA Chief Examining Veterinarian before such machine is brought to or possessed on the grounds of a licensed race track.

(c) Trainers shall report all extracorporeal shock wave therapy, radial pulse wave therapy or similar treatments that are administered to horses trained by them, using ESAL, no later than the day after the treatment (24 Hours). The trainer

may delegate this responsibility to the treating veterinarian, who shall make these reports when so designated. A horse that is so treated shall be added to a list of ineligible horses. Such list shall be kept in the race office and be made accessible to jockeys and their agents during normal business hours. The commission may share this information with other racing jurisdictions.

(d) A horse that receives any such treatment is not permitted to race or breeze for a minimum of ten (10) days following treatment.

(e) A horse that receives any such treatment without full compliance with this section and any similar rules in any other jurisdiction in which the horse was treated shall be placed on the steward’s list.

(f) Any person who violates this section may be subjected to a fine, exclusion from all New York racetracks, and the suspension or revocation of any occupational license held by such person.

Eligibility For The Administration Of Lasix (Furosemide)

All TWO YEAR OLD RACES AND STAKES RACES WILL BE RUN LASIX FREE NO LASIX PERMITTED WITHIN 48 HOURS OF RACE

A horse may qualify by any one of the following means:

(a) The horse has bled visibly during a race or a workout, as determined by the association veterinarian; or (b) The horse has bled during a race or workout, as determined by an attending veterinarian based upon his/her clinical assessment of the horse which may or may not include an endoscopic examination after the race or workout; or (c) The horse has been qualified by the State veterinarian or veterinarians employed by the racetrack for the administration of furosemide in another racing jurisdiction; or (d) The horse has raced on furosemide in its last start in another racing jurisdiction with rules substantially similar to New York State.

For those horses which have never run on Lasix shipping in from out-ofstate, the certification form must be filed with the Lasix Coordinator located in the Racing Office PRIOR TO DAY OF ENTRY.

If determined that a horse has qualified, the horse shall be placed on a list and shall not be permitted to race for the following periods of time: 1st time - 10 days 2nd time - 30 days 3rd time - 90 days 4th time - 1 year A horse which is eligible for the administration of furosemide may be removed from the list, upon authorization from the stewards. Certification must be filed with the Lasix Coordinator PRIOR TO DAY OF ENTRY.

NYRA veterinarians will be administering Lasix (furosemide). A SINGLE INTRAVENOUS injection of Lasix from 3cc’s – 10cc’s, 4-4 ½ hours before post as prescribed by New York State law. If at the time of administration the trainer or a representative does NOT communicate the desired dose of Lasix when asked by the NYRA veterinarian then a default dose of 5cc’s (250mg) will be administered.

Any horse which is eligible for the administration of furosemide must be present on the grounds of the racing association no less than four hours prior to scheduled post time of the race in which the horse is scheduled to compete. Trainers are strongly urged to make all of the necessary arrangements when shipping in to run. A horse which is not present at least four hours prior to post time or which has not received the administration of furosemide pursuant to this rule shall be ineligible to start.

Workers’ Compensation Trainers are responsible for workers’ compensation insurance to cover stable employees (grooms, hot walkers, foreman, assistant trainers, etc.). The policy must be on file with the New York State Gaming Commission office. Trainers and owners are responsible for worker’s compensation to cover all exercise riders and jockeys at NYRA race tracks through the New York Jockey Injury Compensation Fund.

The New York Jockey Injury Compensation Fund (NYJICF) 2021 Workers' Compensation Premium Assessment and Formula

 This is the NYJICF’s Assessment Plan for 2021 (2021 Assessment Plan) and, consistent with the last few years, continues to be structured on New York Racing Association (NYRA)-based horsemen contributing 86% of the NYJICF’s annual cost, which is estimated to equal $6,059,480.88, and Finger Lakes Gaming and Racetrack (FLRA)-based horsemen contributing 14% of the NYJICF’s annual cost, which is estimated to equal $986,427.12. The NYJICF has the authority (i) to use up to $2 million from the 2021 NYRA purse cushion fund and (ii) to deduct and use 2% of purses from an owner's share of purses.

NYRA Owners assessment and payment is a $1,000 base premium, plus 2% of purses earned.

FLRA Owners assessment and payment is a $2,550 base premium, plus 2% of purses earned. Each race with a purse over $1,000,000 will be capped at $1,000,000 for Workers' Compensation assessment purposes only.

NYRA Trainer assessment and payment is a $1,000 base premium plus: NYRA trainers will pay a per stall charge of $1.60 per day for each stall allotted and accepted during each stall allotment period as designated by the track where each trainer races, provided that the first 12 stalls allotted and accepted will be free and the per stall charge for each stall allotted and accepted in excess of 12 will be $1.60 per day.

FLRA Trainer assessment and payment is a $2,550 base premium plus: FLRA trainers will pay a per stall charge of $1.50 per day for each stall allotted and accepted during each stall allotment period as designated by the track. These premium charges will be due as follows:

NYRA and FLRA Owners and Trainers base premium charge is due: a. At NYRA, for those trainers already stabled on the grounds: $1,000 on or before January 1, 2021. b. At NYRA, for those owners already stabled on the grounds: $1,000 before they run their first horse in 2021. c. For those trainers shipping in: upon entering the horse on the grounds based on the “shippers” per start schedule set forth below. d. For those owners shipping in: before they run their first horse in 2021 based on the “shippers” per start schedule set forth below. e. At FLRA, for trainers: upon entering the horse on the grounds: $1,500 on or before April 1, 2021, and an additional $1,050 (for a total of $2,550) to be paid on or before June 1, 2021.

f. At FLRA, for owners: $1,500 before they run their first horse in 2021 through May 31, 2021, and an additional $1,050 (for a total of $2,550) to be paid on or before June 1, 2021. Anything in this 2021 Assessment Plan to the contrary notwithstanding, FLRA’s 14% of the NYJICF’s cost, which is estimated to equal $986,427.12, will be paid by FLRA in eight equal installments in the amount of $123,303.39 between April 2021 and November 2021.  

 NYRA and FLRA Owners and Trainers The stall charges will be due on the last day of the first month of each allotment period, for example: January 31 for winter 2021 at NYRA and thirty days after the opening of the stable area for the spring meeting at FLRA. If the trainer accepts stalls for the summer meeting but ships in three weeks before that meeting begins, that trainer will be responsible for the entire summer meeting plus $1.60 per day ($1.50 at FLRA) times the number of stalls allotted, times the number of days that the trainer occupied the stalls prior to the summer meeting, provided that the first 12 stalls allotted and accepted at NYRA tracks will be free.

Owners/Trainers will be required to pay the base premium charge of $1,000 at NYRA and $2,550 at FLRA, plus 2% of purses earned, plus the stall allotment charge.

Private Trainers will be responsible for the base premium of $1,000 at NYRA and $2,550 at FLRA. The owner employing that trainer (whose payroll the exercise riders are on) will be responsible for the stall charge plus 2% of purses earned.

Shippers. At NYRA, owners and trainers will be charged $100.00 each per start for their first ten starts (for a maximum of $1,000 for 2021). At FLRA, owners and trainers will be charged $150.00 each per start for their first ten starts (for a maximum of $1,500 for 2021). Owners will also be charged 2% of purses earned. Shipping trainers will only be charged a stall fee if they are assigned stalls. A suitable stall count to be determined by the racing secretary at the current stall assessment rate ($1.60 at NYRA tracks (except the first 12 stalls allotted and accepted will be free for 2021) and $1.50 at FLRA) will be assessed to those horsemen stabled off of the racetrack proper and who have daily access and use of the racetrack facilities.

Surcharge. Each trainer, upon such trainer’s second claim and any subsequent claim filed with the workers’ compensation insurance carrier in 2021, shall be charged a per-claim handling surcharge based upon the total number of horses then currently trained on the date of such claim(s) (as measured by the number of stalls allocated statewide as of the date of the claim for which a surcharge is to be collected), as follows: 1 to 10 horses: $200; 11 to 30 horses: $400; and 31 or more horses: $600.

General Information Should NYJICF determine that the amounts which are actually collected from (i) NYRA is inadequate to cover 86% of the NYJICF’s annual cost, which is estimated to equal $6,059,480.88 and and/or (ii) FLRA is inadequate to cover 14% of the NYJICF’s annual cost, which is estimated to equal $986,427.12, respectively, then the NYJICF will seek additional funds pursuant to the Racing, Pari-Mutuel Wagering and Breeding Law Section 221 (7).

* For determining the responsibility for payment of workers' compensation, an owner is the person whose account would be debited or credited when a horse runs. In the case of multiple ownership, this would be the managing partner.

Any equipment which may be used for hypodermic injection or stomach tubing shall not be permitted to be brought inside a stall which at the time is occupied by a horse that is scheduled to race in the next 24 hours, except under the supervision of a NYRA Veterinarian or a New York State Gaming Commission Official. Every horse must be saddled in the paddock. All two-year-olds must be properly schooled and approved by the starter before being allowed to start. All trainers and accompanying stable personnel should be neatly dressed when taking horses to the paddock. All dogs must be registered and tagged with NYRA security. Manure removal at NYRA tracks is a result of a contract calling for the use of straw only. Do not place any materials other than straw in the manure pits. Stable locations and dormitory space are assigned to trainers. All damage and debris, as a result of employees or neglect, will be adjusted and invoiced back to the trainer. All water hoses should be fitted with a working nozzle, such that water will not flow from the hose unless the nozzle is engaged. Check Cashing Policy: Any person who is responsible for a check that is returned for “insufficient funds” will receive a warning in the 1st instance and be responsible for paying said funds and administrative fees before check cashing privileges are reinstated. If a second offense occurs, check cashing privileges shall be revoked.

Television Rights NYRA may televise (film or tape), or authorize or license the televising of certain horse racing to be conducted in its racing facilities from time to time, and accordingly, it hereby reserves television rights, whether in connection with any race, preparations therefore, or ceremonies or proceedings thereafter or training at the track. This application is accepted on the condition that, if required, consent is hereby given, and the owner, jockey, trainer, groom and all other employees of the owner coming within the view of the television picture hereby agree to sign and deliver to NYRA, upon demand, releases permitting such television and the exhibition thereof.

NYRA Anti-Slaughter Policy Any owner or trainer stabled at a NYRA facility found to have knowingly sold a horse for slaughter will have his or her stalls permanently revoked from all NYRA tracks. NYRA requires its horsemen to do due diligence in the release of horses from their care. NYRA along with NYTHA encourages all owners and trainers to support rescue and adoption efforts and to find humane ways of dealing with horses unable to continue racing.

Federal Fair Credit Reporting Act In making an application for employment or to otherwise participate in thoroughbred racing, it is understood that an investigative report may be made whereby information is obtained through personal interviews with third parties, such as family members, business associates, financial sources, friends, neighbors or others with whom you are acquainted. This inquiry includes information such as your character, general reputation, personal characteristics, and mode of living, where it may be applicable. You have the right to make a written request within a reasonable period of time for a complete and accurate disclosure of additional information concerning the nature and scope of the investigation.

Release And Indemnification The applicant assumes the risk of and releases and waives NYRA for any and all claims for loss, loss of use, injury or damage to horses owned or under the control of the applicant or the applicant’s invitees incurred while on any NYRA premises, including when such horses are being vanned by NYRA between its facilities unless such injury, loss or damage is caused by NYRA’s negligence; releases and waives NYRA from any and all claims for injury personally suffered by the applicant while galloping/ponying horses on the premises; and the parties hereto further agree that each shall be responsible for their own negligent acts and omissions as well as those of their employees, agents and express invitees to the same extent as provided by the law. The provisions of the preceding paragraph shall not be deemed waived or affected in any way by the fact that NYRA does or does not presently or may or may not in the future, carry insurance coverage against claims or losses caused by or resulting from damage or injury to property, persons and/or horses while competing on the racetrack, using the training tracks, stables, roads or any facilities or while on the premises of NYRA or in transit in vehicles owned, leased, contracted for, operated or controlled by NYRA.

NYRA SAFETY RULES and PROCTOLS DURING TRAINING

Safety Protocols

1) When the siren and warning lights are on, the track is closed for training and all horses and riders during a breeze, gallop or workout should ease their horse to the best of their ability while exiting the track as safely as possible.

2) NYRA will inform all trainers via text of the track being closed and re-opened.

3) Outriders will communicate all training incidents to First Responders, Security and Safety Personnel.

4) When there is a human or equine ambulance on the track no rider or horse should proceed past or around the location of the incident.

5) No cell phone use while mounted on horseback.

6) Both exercise riders and trainers will be subject to fines and suspensions for violations by order of the Stewards.

Training Rules

1) Outriders are in charge of the racetrack at all times.

2) All Outriders, exercise riders, jockeys, trainers, assistant trainers and pony people must wear a fastened safety vest and a fastened helmet at all times while on ANY TRACK.

3) On days when the gate is open jogging the wrong way past the gate will be prohibited.

4) No galloping the wrong way, no jogging the wrong way four across or abreast, and no ponying (Belmont Park TT).

Track Rules

1) ALL horses working or breezing should do so on the INSIDE portion of the track.

2) All horses galloping should do so in the MIDDLE portion of the track;always aware of horses to the inside.

3) ALL horses jogging should stay to the OUTSIDE portion of the track;always aware of horses to the inside.

4) ALL backtracking going to the gaps should stay to the OUTSIDE portion of the track.

5) ALL turf workers should stay OUTSIDE of the Dogs.

6) When the Dogs are out on the dirt (during rain or when the track is sealed), all riders are to stay OUTSIDE of the Dogs.

Under 20’s Claiming Challenge

Overview: The Under 20’s Claiming Challenge is open to all trainers stabled at NYRA facilities

with a total number of horses not to exceed 20 in their care nationwide at the start of the contest. The contest will run during the Spring/Summer Meet at Belmont Park. The contestants will earn points in all winners’ claiming races. Trainers who wish to participate must sign up prior to the start of the meet and agree to abide by the rules of the contest.

Rules:1. A trainer shall be eligible if the initial total number of horses in their care equals to no

more than 20 nationwide and the trainer is stabled at NYRA facilities. Any trainer allotted 21 stalls or more will be ineligible for the contest.

2. Stall allotments for the 2021 Belmont Spring/Summer Meet will be used to determine eligible trainers.

3. Eligible trainers must then fill out a contest application and turn it into the racing office by 3:30 pm Sunday, April 18th, 2021. The application will contain the roster of horses that the trainer wishes to make eligible for the contest.

4. On Thursday, April 22nd, the racing office will post all eligible trainers in the contest and will give each trainer back a copy of their approved eligible contest horses. There can be no more than 20 horses on the roster at any given time. Only roster horses can earn the trainer points. Thus, a trainer’s stable may grow above 20 horses but not all will be eligible for the contest.

5. Trainers can grow their roster list by claim only. After a horse is claimed, he will be added to the trainer’s roster at the trainer’s request. This is not done automatically. The roster once again cannot grow above 20 for contest purposes.

6. A trainer may replace a claimed horse who was on their roster with another claimed horse that was claimed in their name. The trainer must request the horse to be added to his/her roster; this is not done automatically.

7. The request to add a horse to the roster must be done before the next race of said horse. Points will not be applied retroactively.

8. A trainer may replace an injured horse on the roster up until Monday, June 14th, 2021 via the claim box in his/her name. To be considered an injured horse, the horse must show no workouts or races between the day of injury and August 11th, 2021.

9. The contest starts Thursday, April 22nd, 2021 and ends Sunday, July 11th, 2021. Points will be tallied and records will be checked by August 13th, 2021 after which awards will be granted.

10. Points will only be earned in claiming races for winners. Horses in for a tag in an allowance optional claiming race will qualify for contest points. Points are not earned in maiden, allowance, starter allowance, or stakes races.

11. A horse that ends up on the stewards’ list for poor performance (beaten 25+ lengths) will not earn the trainer points for that race.

12. A dead heat will result in points paid out according to the same method as purse structure. For example, a dead heat for 2nd place would result in points for 2nd and 3rd

place being added together, then divided equally between the two horses that dead heated.

13. Horses that are running for 50% or less of the claiming price from their most recent start will only be eligible to earn 50% of the typical points for that race.

14. Horses can only earn contest points for 2 races within a given 30 day time span. A horse may enter in additional races during that timeframe, but will not earn contest points for those additional races.

15. Trainers may be declared ineligible if they do not abide by the rules of the contest.

Standings will be updated on the overnight The Senior Vice President of Racing Operations and Board of Stewards retain the right to review any actions pertaining to this contest that are detrimental to racing.
