The Minutes of the 216th Meeting of the NRC held from June, 27th to 28th, 2013

The 216th Meeting of the Northern Regional Committee (NRC), National Council for Teacher Education (NCTE) was held from June, 27th to 28th, 2013 at Jaipur House ( A Heritage Hotel), Mount Abu Jaipur.

The following were present:-

The Regional Director, NRC apprised the members of Northern Regional Committee about the provision of the NCTE Act, Rules, Regulations and instructions issued from time to time.

With the permission Dr. Ram Kishor (Convener) presented the Agenda before the Committee. Item-wise decisions taken are as follows:-

AGENDA ITEM NO.- 216.1 CONFIRMATION OF MINUTES OF 215th

MEETINGNRC confirmed the minutes of 215th Meeting with the following modifications:-

The decision taken by NRC against Agenda Item No. 215.29.1 (S.No.134) be read as

“ The Northern Regional Committee noted that the NRC in its 163rd meeting had resolved the following:-

“The Committee resolved that in case of Uttrakhand, in place of 2010-11 academic session, 2009-10 academic session may be written for B.Ed. programme. RD is directed to issue corrigendum accordingly.”

The Committee further noted that abiding by the above decision necessary corrigendum were issued in similar nature of cases. One of such corrigendum No.NRC/NCTE/F-7/UR-191/2010/26736-26742 dated 19.8.2010 issued to Pal College of Technology & Management, Nanital, Uttrakhand for conducting B.Ed. programme from the session 2009-2010 perused by the NRC, NCTE.

Keeping in view the above situation and resolution passed by the NRC in its 163rd meeting, the NRC came to the conclusion that earlier the decision taken by the NRC be also applicable to Blue Mountains College of Teachers Education, Village-Dohran Khas, Post- Kandoli, Distt. Dehradoon, Uk (File No. UR-182).

The decision taken by NRC against Agenda Item No. 215.29.3 (S.No.136) be read as:-

The original file of the Institution along with other related documents, NCTE Act, 1993, Regulations and Guidelines of NCTE published from time to time were carefully considered by NRC in detail and following observations was made:-

The NRC noted that the institution, namely, Doon Valley College of Education is being run at Charao by Narayani Educational and Charitable Society, Karnal, without any authority/approval of NRC, NCTE.

The Managing Trust i.e. Doon Valley Trust made applications dated 15.6.2009 and 7.11.2009 seeking merger of the above institution with another institution namely Doon Valley Institute of Education, Outside Jundla Gate, Karnal which had already 300 sanctioned seats in the B.Ed. course.

The Managing Society i.e. Doon Valley Trust vide applications dated 28.8.2008, 20.11.2010 and 1.2.2011 had made request for shifting the college from Village Charao to Sector-7, Near Fire Brigade Station, Karnal, However, the NRC, Jaipur in its 179th meeting held from 18th to 20th February, 2011 rejected the said request.

That vide letter dated 18.11.2011, the parent Trust, namely Doon Valley Trust has requested to NRC for closure of institution, cancellation of recognition. It is supported by the Resolution of the Trust.

At the time of recognition, the college was being run in a rented building at Karnal and no permission has been obtained from the NRC for shifting the college at Charao.

Again the present Trust, namely, Doon Valley Trust has made application to the NRC supported by a resolution of the Trust with regard to shifting of premises to new premises at Sector 17, Near Fire Brigade Station, Karnal but the same is not supported with the essential documents as per provisions of the NCTE Regulations, 2009.

Hence, NRC decided that Show Cause Notice under section 17 of NCTE Act, 1993 be issued to the parent Trust namely Doon Valley Trust on the above points the Institution is directed to submit the reply as per the provisions of NCTE Act, 1993 Rules & Regulations within 30 days from the date of issue of Show Cause Notice.

The NRC also decides to ask a clarification from the affiliating University as to how it has allowed affiliation without approval of the NRC, NCTE to run the institution by Narayani Educational and Charitable Society, Karnal.

The decision taken by NRC against Agenda Item No. 215.6.8 (S.No.56, File Number NRCAPP-2643) be read as follows: The original file of the Institution and visiting team report of the institution along with other related documents, NCTE Act, 1993, Regulations and Guidelines of NCTE published from time to time were carefully considered by NRC and NRC decided to issue letter of intent under clause 7(9) of NCTE Regulations, 2009 for D.El.Ed. Course prior to grant of recognition.

The decision taken by NRC against Agenda Item No. 215.47.1 and 215.47.2 be read as follows:

Hence, NRC decided that Show Cause Notice under section 7 (1) of NCTE, Regulations, 2009 be issued to the Institution before summarily rejection on the above point and direct the Institution to submit the reply as per the provisions of NCTE Act, 1993 Rules & Regulations within 30 days from the date of issue of Show Cause Notice.

B.ED. On the basis of Hon’ble High Court judgement dated 3.7.2012, the institution was directed to apply fresh for recognition of B.Ed. after completion of deficiencies cited in the NCTE order dated 28.10.2010. The institution had submitted its reply. The reply was considered by NRC in it 213th meeting and it was decided to constitute visiting team for inspection of the institution. The inspection was conducted by VT on 14.05.2013. The perusal of Visiting Team Report and the enclosed documents revealed the following deficiencies:-

The institution has not earmarked requisite area for the B.Ed. programme in the building map as required under clause 8 (7) of NCTE Regulations, 2009. Total construction plan of 4566 sq meter has been shown to the VT members

The building completion certificate approved by the competent authority (in original form) has not been submitted to the VT on 14.05.2013. The zerox copy of the building completion certificate issued by on architect dated 16.05.2008 has been produced before VT members. The architect is not the authority to issue building completion certificate. The objection raised on the building completion certificate as referred in the appeal order of NCTE dated 11.03.2011 still prevails. The deficiency regarding building completion certificate has not been removed by the institution .

The size of area shown in the report does not tally with the area shown in the application form.

The visiting team members have reported that the institution has engaged eight teachers including one Reader in the institution. Out of them Five teachers appointment have been approved by the affiliating university. Two teacher’s appointment was approved on 12.03.2007 and three teachers appointment was approved on 28.12.2010. The rest of the three teachers appointment have not been approved so far by the university. There is no Principal appointed at present in the institution. The deficiencies regarding recruitment of teaching staff as pointed out earlier by the NCTE still exist in the institution

No proof is given about salary paid to the existing teaching staff through account transfer/ crossed cheques.

The copy of the accession register of library books reveal that the dates of the purchase of books have not been entered in the register. The bills coloumn remains blanks for entry of large number of books (as shown in the register ).The source of donation of large number of books has not been

clarified.

In view of the Hon’ble High Court order dated 1/3/2013 case No. 10994 of 2013 and the VT report the NRC took the following decisions:-

The withdrawal order dated 28.10.2010 of NRC, NCTE reamins the same. The institution has mislead the NRC, NCTE in one or other pretext from time to tome . The B.Ed. programmes run by the institution during 2010-11, 2011-12 and 2012-2013 sessions are declared unrecognized. Henceforth the NRC, NCTE shall not entertain any application for teacher education programme submitted by the institution in its premises.

The affiliating University is directed not to permit the Institution to admit students.
