Gurugram MLA to raise homebuyers concern at justice meet
Rakesh Daultabad, Member of Legislative Assembly from Badhshahpur, which covers
70% of the Gurugram city, has decided to bring all the stakeholders at a common
platform and promises step-wise solution.
Residents of posh housing societies of Gurugram facing issues such as high maintenance cost,
bad quality of construction and lack of infrastructure, will get a chance to raise the matter with
authority convened, who will solve the issue within stipulated time.
Rakesh Daultabad, Member of Legislative Assembly from Badhshahpur, which covers 70% of
the Gurugram city, has decided to bring all the stakeholders at a common platform and promises
step-wise solution.
Daultabad has planned a justice for homebuyers meet on July 26, where representatives from
local authority and police will be present to provide solution to homebuyers.
“A lot of builders are not providing services as per the agreement and homebuyers have been
raising the issue at several platforms. We don’t want the homebuyers to suffer any further and
run to get the problem solved. Responsibility will be fixed at the common platform,” Daultabad
told ET.
The MLA said that representation from 73 housing societies have been received so far and more
are expected to come. The issues that homebuyers are raising include maintenance charge, lack
of service by builder and high electricity charges.
Homebuyers said that due to Covid, a lot of builders are facing financial crunch and increasing
maintenance charge.
“Connectivity is another issue in many societies as authority has not constructed sector road. In
some societies, power and water connection has not been provided. Due to multiplicity of
authority, it is difficult to get the work done in Gurugram,” said Pradeep Rahi, president of
Ramprastha city.
The problem of infrastructure is more in New Gurgaon, as over 36,000 residents hope basic
amenities in their area will improve.

expressway, the main concerns of the residents are broken water pipelines, damaged roads, poor
connectivity to the main highway and lack of permanent electricity connections.
The residents have been contacting politicians and asking them to include the issue of the area’s
development in their election manifestos and keep it as a priority for the new government. The
politicians, keeping the vote bank in mind, have visited the area and promised to expedite the
matter.
Last week, residents of Ireo Victor Valley condominiums in Gurugram had protested against the
developer for lack of promised amenities by the builder.

Property tax set to go up in Bengaluru from April 2021
The directive to the civic body comes following a letter from the Ministry of Housing and
Urban Affairs (MoHUA) to adopt uniform tax measurement mechanism in all urban local
bodies across the state.
There’s a bit of not-so-good-news for property owners in Bengaluru. Come April next year, property tax and water charges for all types of buildings is set to increase.
The Urban Development Department (UDD) has directed the Bruhat Bengaluru Mahanagara Palike (BBMP) to dump the traditional ‘unit area value’ method and adopt the ‘guidance value’
method to calculate property taxes.
Experts believe the move is likely to see two to five-fold increase in tax collection, putting many property owners, especially senior citizens, in a fix.
The directive to the civic body comes following a letter from the Ministry of Housing and Urban Affairs (MoHUA) to adopt uniform tax measurement mechanism in all urban local
bodies across the state. While corporations in rest of Karnataka have already adopted guidance value linked property tax collection system, the BBMP continues to follow a different method that measures the property tax based on the rental demand.
“What BBMP follows is a complicated system. It has to be set right. Property tax in HSR
Layout is much lower than in Kengeri. Other than BBMP, all the corporations in the state have property tax payment linked to guidance value. The new mechanism will also allow the government to increase market borrowings from 3% of the state GDP to 5%,” Rakesh Singh,
Additional Chief Secretary at UDD told Bangalore Mirror. Meanwhile, the UDD assured the MoHUA that the guidance-value linked tax measurement
system will be put in place by end of this year. The Centre has also suggested periodic increase in property tax.
The new mechanism will also allow the government to increase market borrowings from
3% of the state GDP to 5%–Rakesh Singh, Additional Chief Secretary, UDD
Sapna Karim, member of the executive committee at Janaagraha Centre for Citizenship and
Democracy, a non-profit, welcomed the proposal. “While BBMP annual budget is around Rs
10,000 crore, the money raised from property tax stands less than Rs 3,000 crore. From building
enumeration to tax structure, the corporation needed a better system,” she said.

Some, however, were not happy with the timing of the change. Abdul Wajid, opposition leader
in the council, said it’s not the right time to increase taxes when the people are in deep trouble
due to the pandemic.
NS Mukunda of Citizens Action Forum said the new proposal will deal a big blow on property
owners who have no income, especially senior citizens. “Not all owners have rented out their
property. Some may have built houses several years ago but they may not have any income
now. The BBMP should first put up the proposal in the ward committees and later take it to the
council and government,” he urged.
Meanwhile, the Bengaluru Water Supply and Sewerage Board (BWSSB), on its part, has sought
a revision in the water and sanitary charges.

Rajasthan government to reserve 2% of RHB flats for transgenders
The notification was released by the Urban Development and Housing (UDH ) department
on Monday, to reserve houses for transgenders whose income is less than Rs 12 lakh per
annum.
The state government has decided to reserve 2% houses for transgenders in all the housing
schemes to be launched by Rajasthan Housing Board (RHB), development authorities and urban
improvement trusts (UITs).
The notification was released by the Urban Development and Housing (UDH ) department on
Monday, to reserve houses for transgenders whose income is less than Rs 12 lakh per annum.
The UDH department has also amended the Urban Land Disposal Rules, 1974 to make
provision for 2% reservation for transgenders in housing schemes that will be launched on
government land.
An official at UDH told TOI, “The department received a proposal in 2017 from the
transgender community. After amending the rules, the provision of reservation was made for
them. Earlier, reservation was also made in housing schemes for the differently abled. ”
Other than this, the department has also complied the allotments done at concessional rates in
the last six-month tenure of the BJP government. Sources at the department said, across the
state there were 56 land allotments made on concessional rates.
Earlier, directions were issued to the development authorities, urban improvement trusts (UITs)
and Rajasthan Housing Board (RHB) by the minister to prepare a list mentioning the size of the
land and date on which these plots were allotted.
As allotment at concessional rates to public and charitable institutions is considered as “primary
attempt” to woo a particular section of voters or certain influential sections, the Congress
government will carry out a scrutiny of such land deals.

Punjab to approve building plans for independent floors
The decision would help the department fetch more than Rs 60 crore through various
charges which would be paid by the builder. It will also help small builders who are facing
big financial crunch due to Covid-19.
Punjab local government department on Tuesday allowed approval of building plans for G+2,
G+3 and S+4 independent floors under the Punjab Municipal Building Byelaws 2018 and
subsequent amendments which provide for independent floors.
Cabinet minister Brahm Mohindra said the instructions were issued to all urban local bodies
regarding this order and they have been asked to immediately implement it.
The decision would help the department fetch more than Rs 60 crore through various charges
which would be paid by the builder. It will also help small builders who are facing big financial
crunch due to Covid-19.
Mohindra said it was found that some urban local bodies were not clearing the building plans of
G+3 and S+4 on the pretext of a previous letter. It is now clarified that there is no ban on G+3
and S+4 building plans and they will be given clearance in accordance with Punjab Municipal
Building Byelaws 2018 as amended from time to time, including the amendments notified in
2019.
The minister clarified that no ban ever imposed on G+2, as far as G+3 and S+4 are concerned
the building byelaws are very clear on this. He said that in all these approvals there would be no
violations of the building byelaws and the project must be registered with the Punjab Real
Estate Regulatory Authority.

Chandigarh housing board starts issuing notices for illegal
constructions
According to the procedure, in case the allottee does not stop the illegal constructions, they
will be demolished the very next day.
The CHB has issued notices to 10 violators who raised fresh constructions in their dwelling
units or on government land in sectors 44 and 45 and Manimajra and other areas, an exercise
that was at halt during the coronavirus lockdown.
The enforcement wing of the CHB has demolished over 100 illegal constructions in the city till
date.
According to the procedure, in case the allottee does not stop the illegal construc tions, they will
be demolished the very next day. However, if the they are stopped, the allottee will be given
three days to remove the violations. CHB officials will conduct a fresh inspection and in case of
non-removal of the violations, a demolition drive, at the risk and cost of the allottee, will be
scheduled.
A senior CHB official said that though necessary precautions are taken during the demolition,
there is still a possibility that adjoining structures may get damaged and the allottee will be
responsible for such extra damage to their own or adjoining units.
The committee dealing with need-based changes found that about 90% of the CHB dwelling
units had some or the other structural violation. The changes include additional rooms and
toilets, conversion of balconies into rooms and of courtyard, and building stairs on government
land.
For availing benefit of regularisation scheme for need-based changes in CHB flats, the UT
administration has made submission of certificate of structural stability fro m a qualified
empanelled structural engineer registered with it mandatory. The administration order said,
“Allottee/occupant is required to submit a certificate of structural stability from a qualified
empanelled structural engineer registered with the Chandigarh administration in the interest of
safety of the occupants and in the interest of public safety. During this period, the
allottee/occupant himself/herself will be responsible for any loss/injury/ public safety because
of such violations”.
The order further stated, “The allottee/occupant is required to remove all violations on his/her

risk and cost, at the earliest, within the period being permitted with the penalty. In case of non-
removal of the violations, the allotment may be cancelled and possess ion of the dwelling unit
may be resumed.”
