This chapter states the m inim um requirem ents that help you protect the safety and health
of your em ployees d uring a response to a hazardous substance release in your
w orkplace or any other location.
This chapter applies if your em ployees are, or could becom e, involved in responding to
uncontrolled releases of hazardous substances in your w orkplace or any other location.
U se the scope flow chart, and definitions that follow, to determ ine if this chapter applies
to your w orkplace(s). D efined w ords are italicized in the flow chart.
Exemption:
This chap ter doesn’t apply to you if your w orkplace is a hazardous
w aste site. If you aren’t sure about your site classification, see chapter
296-62 W A C , Part P, H azardous w aste operations and treatm ent,
storage, and disp osal facilities.
If your w orkplace is a treatm ent, storage, and disposal site this chapter
m ay apply.
Note:
R eq uirem ents in other chap ters m ay also apply to your w orkplace. You

Danger area - areas w here conditions pose a serious danger to
em ployees, such as areas w here:

Emergency response - a response to an anticipated release of a

Hazardous substance - any biological, radiological, or chem ical
substance that can have adverse effects on hum ans (see W A C 296-824-
800 for a m ore specific definition).
Immediately dangerous to life or health (IDLH) - any
atm ospheric condition that w ould:
C ause an im m ediate threat to life
C ause p erm anent or delayed ad verse health effects
Interfere w ith an em ployee’s ability to escape.

Incidental release -a release that can b e safely controlled at the
tim e of the release and doesn’t have the p otential to b ecom e an
uncontrolled release .
Exam ple of a situation that results in an incidental release:
A tanker truck is receiving a load of hazardous liquid w hen a leak
occurs. The d river know s the only hazard from the liquid is m inor skin
irritation. The em ployer has trained the driver on proced ures and
provided equipm ent to use for a release of this q uantity. The driver puts
on skin protection and stops the leak. A sp ill kit is used to contain,
absorb, and pick up the spilled m aterial for disposal.
Limited action - action necessary to:
Secure an operation during em ergency responses
OR
Prevent an incident from increasing in severity.
Exam ples include shutting dow n p rocesses and closing em ergency
valves.
Release -a spill, leak, or other type of hazardous substance discharge.

Uncontrolled rele ase - a release w here significant safety and
health risks could be created . Releases of hazardous sub stances that
are either incidental or couldn’t create a safety or health hazard (i.e., fire,
explosion or chem ical exposure) aren’t considered to be uncontrolled
releases.
Exam ples of conditions that could create a significant safety and health
risk:
Large-quantity releases
Sm all-releases that could be highly toxic
Potentially contam inated individuals arriving at hosp itals
A irborne exposures that could exceed a W ISH A perm issible exp osure
lim it or a published exposure lim it and em ployees aren’t adequately
trained or equipped to control the release.
Exam ple of an uncontrolled release:
A forklift driver knocks over a container of a solvent-based liquid,
releasing the contents onto the w arehouse floor. The driver has b een
trained to recog nize the vap or is flam m ab le and m od erately toxic w hen
inhaled. The d river hasn’t been trained or provided appropriate
equipm ent to address this type of spill. In this situation, it isn’t safe for
the driver to attem pt a response. The d river need s to notify som eone of
the release so an em ergency resp onse can be initiated .

A fixed facility

A tem porary location (such as a traffic corridor)

Develop an emergency response plan
Note:
You m ay already have an em ergency response plan, such as required
by chapter 296-62 W A C , Part P,Hazar Hazar Hazar Hazar Hazar dous dous dous dous dous w aste w aste w aste w aste w aste op erations and
treatm ent, storage and disp osal facilities or by state and locally
coordinated response efforts (Section 303 of Sup erfund A m endm ents
and R eauthorization A ct (SA R A ), Title III). You m ay use those plans to
com ply w ith this section, if they include the item s listed below.
B efore a w ritten em ergency resp onse plan can be develop ed , you w ill
need to anticipate the types of uncontrolled releases that em ployees
could encounter in your w orkplace(s).

• Preem ergency planning and coordination w ith additional responders (including

substances.
Videos and autom ated training m ethods (for exam ple: Interactive
com puter-based prog ram s) m ay be used in training ; how ever,
instructors m ust m ust m ust m ust m ust be readily available to:
- Encourag e and provide resp onses to questions for the benefit of the
group.
- E valuate em ployee understanding of the m aterial.
- Provide other instructional interaction to the g roup.

A forklift driver knocks over a container of a solvent-based liquid, releasing the
contents onto the w arehouse floor. The driver has been trained to recognize the
vapor is flam m able and m oderately toxic w hen inhaled. The driver hasn’t been
trained or provided appropriate equipm ent to address this type of spill. In this
situation, it isn’t safe for the driver to attem pt a resp onse. The driver needs to
notify som eone of the release so an em ergency response can b e initiated .

Step 2. Make sure all potential participants are involved in planning,whether the response involves only your employees or other
employees at the site. Make a written agreement covering all of the
following:

seq uence of contact).
