AN ACT TO REZONE CERTAIN PROPERTIES IN TRACT 227 AND OTHER AREAS IN THE MUNICIPALITY OF AGAT.
1 BE IT ENACTED BY THE PEOPLE OF THE TERRITORY OF GUAM:
2 Section 1. Legislative statement and intent. When the Legislature 3 enacted Title XXI of the Government Code of Guam, part of its intent was to
cause the creation of guidelines and a mechanism by which residents could
rezone their property in order to realize the fullest sodo-economic return and
financial gain fmm such property. While the Legislature intended the ori@
Territorial Land Use Commission ('TLUC") mechanism to be efficient, helpful
and inexpensive, the bureaucracy of TLUC has turned the system into an
expensive nightmare designed to discourage a l l but the monied interests.
Where the Legislature intended the system to be helpful, bureaucratic
roadblocks and discouragement have prevailed. Where the Legislature
intended the system to be cost effiaent, residents are now advised to retain
the s e ~ c e s of expensive land use consultants and are required to conduct
their own research into various areas where the Legislature intended for
those gove&ent agencies to perform the research and to extend services to
applicants in an effort to make the process as expeditious, economical and
effective as possible.
The Legislature developed TLUC because it wanted the benefit of long-
range rational planning instilled in the zoning process. It intended the TLUC
system to be even more expeditious than the legislative route; The
bureaucratic penchant to make simple matters overly complex again defeated
legislative intent, and the people, after exploring the process established to
effectuate rezoning efforts, came back to the Legislature because of both
financial and professional hardship. In view of this the Legislature finds it
again necessary to assist residents desiring to utilizing their private property
to the highest and best uses. The Legislature finds it necessary to be
responsive to the needs and desires of all residents of Guam and to assist
those residents, seeking to better their economic future, who are being
blocked or discouraged by the bureaucratic maze associated with TLUC,
toward the realization of the highest and best use or uses of their property.

Section 2. Lot NO. 19-1 rezoned. Lot No. 19-1, Tract 227 in the
Municipality of Agat, consisting of approximately 1,479 square meters,
owned by Johnny Q. and Aida S. Luces, as identified in Certificate of Title No.
24877, and recorded by the Department of Land Management as Document
No. 93880, is hereby rezoned from Single Family Residential ("R-1") to
Commeraal ("C").
Section 3. Lot No. 203 rezoned. Lot No. 203, Muniapality of Agat,
consisting of 4,821 square meters, owned by Antonio C. Babauta, as identified
9 in Certificate of Title No. 35345, is hereby rezoned from Multi-family

Section 7. (a) Legislative statement. Jim Kessler owns and lives on a
one acre lot in the Talisay area of Agat. He is interested in subdividing out of
that parcel another parcel to contain 1,000 square meters which he would be
able to lease out or on which he could build a rental unit. Because of the
discouraging and costly requirements and time element involved with the
TLUC process, as well as with the process specified in Public Law 21-82, Mr.
Kessler has approached the Legislature requesting that his property be
rezoned from Agricultural ("A") to Single Family Residential ("R-1"). Because
the area around Mr. Kessler's property consists only of single family
residences with a few multi-family dwellings, the rezoning of Mr. Kessler's
property would not be incompatible with surrounding land uses and would
permit Mr. Kessler to utilize his property to the highest and best uses.
(b) Rezoning. Lot No. 402-R10-2A-4, said to contain 4,131~ square
meters, situated in the Talisay area of the Muniapality of Agat, as delineated

BE IT ENACTED BY THE PEOPLE OF THE TERRITORY OF GUAM:
SECTION 1. LEGISLATIVE STATEMENT AND INTENT.
When the Guam Legislature enacted Title 21 of the
Government Code of Guam, part of its intent was to cause
the creation of guidelines and a mechanism by which
residents could rezone their property in order realize the
fullest socio-economic return and financial gain from such
property. While the Guam Legislature intended the original
Territorial Land Use Commission mechanism to be efficient,
helpful and inexpensive, the bureaucra'cy has turned the
system into an expensive nightmare designed to discourage
all but the monied interests. Where the Legislature intended
the system to be helpful, bureaucratic roadblocks and
discouragement have prevailed. Where the Legislature
intended the system to be cost efficient, residents are now
advised to retain the services of expensive land use
consultants and are required to conduct their own research
into various areas where the Legislature intended for those
government agencies to perform the research and to extend
services to applicants in an effort to make the process as

Section 2, Lot Rezoned. Lot No. 19-1, Tract 227
in the Municipality of Agat consisting of approximately :479
square meters owned by Johnny Q. and Aida S. Luces as
identified in Certificate of Title No. 24877 and recorded by
the Department of Land Management per Document No.
93880 is hereby rezoned from Single-Family Residential (R-1)
to Commercial (C).
Section 3. Lot Rezoned. Lot No. 203, Municipality

I. In t roduc t ion
The Committee on Housing, Community Development, Federal and Foreign Affairs conducted a public hearing Wednesday, July 29, 1992 at the residence of Mr. and Mrs. Johnny Luces, R.R. Cruz Sub-Division in Agat, to receive public comments and input on Bill No. 904. The said hearing was called to order 7:30 P.M. by Senator Frank Santos, Committee Chairman, with Senator John Perez Aguon, Member, in attendance.
Bill No. 904, "An Act to Rezone Certain Properties in Tract 227 and Other Areas in the Municipality of Agat" was introduced by Senator Frank Santos at the request of numerous families residing ' in the R.R Cruz Subdivision of Agat. The Bill's primary purpose is to allow homeowners residing in the area to build multiple dwelling units on residential lots which they own and now occupy. Secondly, with the ever increasing awareness of the housing shortage crisis faced by both the civilian and military families arriving on Guam many property owners wish to realize economic gain from the construction of homes that can be placed on the rental market for civilian and military families relocating to Guam. The residents of R.R.Cruz Subdivision hope to assist by providing the necessary homes to lessen the market void by making reasonable rental units available.
11. Summary of Testimony
A. In Favor
Mayor Antonio C. Babauta testified in favor of the Act citing the high cost of land and the demand for multi-family
home units in the area as the driving force behind the intent of the Bill. Also, the economic growth occurring in the Municipality of Agat warrants some change in the zoning configuration in many places in the village. The last land-use masterplan was adopted approximately twenty-five years ago and since then the community has undergone major social and physical change. Patterns of land uses back then are not what they are today and already the forces of change are causing landowners to seek the highest and best use or uses of their property. Given that the provisions contained in Bill 904 would assist the some of Agat's residents with land problems, the Mayor of Agat reiterated his support for the Bill.
Mr. and Mrs. Johnny Luces of the R.R. Cruz Subdivision, Agat, expressed their support for the Bill and provided the committee members with examples of the bureaucracy encoulitejed when they sought renewal of a commercial variance 'for a retail store which they own. Aside from the time element required to obtain the zone variance, there are financial and technical considerations to be met most of which are beyond the capability of the common resident. Such requirements more often than not frustrate the rezoning applicants to the point that they take no action at all or resort to legislative assistance as an alternative course of action. With the aid of Bill 904, the Luces' hope to have designated as a commercial zone property where their retail store is located at and also on other properties, construct affordable housing units for the rental market.
Mr. Aurel io Sol idum, a resident of Agat, appeared before the Committee to register support for Bill 904. Like preceeding witnesses, Mr. Solidum discussed his desire to provide safe and affordable housing for members of his family. Without ownership or access to large parcels of land however, the next viable alternative for him is to construct additional units adjacent to existing structures within the context of an R12 zone. There is now sufficient water, power and sewer services afforded the area in question and rezoning
. from an R-1 to R-2 remains as the final issue for
consideration. Mr. Solidum thanked the Committee for being responsive to the community's needs and particularly for having the hearing at the R. R. Cruz Subdivision for public convenience .
Mr. Evangelis Babauta registered his support for the Bill stating that the rezoning request was a move in the right direction. The individuals that are present at the hearing are speaking to the problem of affordable land, housing, and preservation of the extended family values so Bill 904 is more than just a rezoning issue but rather a package of issues for the Committee to consider. The advantages afforded land owners in RR Cruz should 904 become law have been explained earlier. What was not mentioned earlier however, are the gains government would realize if the Act succeeds i.e., higher taxes (property), jobs in construction, dwelling u n i t s t f o r the community and revenue to the existing businesses area.
Mr. Ruben Perez testified in support of Bill 904 stating that higher density and uses of property would allow families to build homes near one another. Children who wish to reside in the neighborhood where they were raised would benefit from the Act. Mr. Perez stated that he would like to divide his property in Agat so that each of his children would be able to build a home in the future however, rezoning to R-2 may be necessary if the land is to accomodate all his kids. According to past effort, Mr. Perez states that the fast track zoning process was not working and that such process was just as cumbersome and as costly as the "old TLUC process".
Other property owners appearing before the Committee to testify in favor of the Bill were Romero a n d Julita Flores, Abe S. Devera, Pacifico E. Tanalgo, Aurelio Solidum, Bernardo Solidum, Aljean Piolo, Milagros Dolor and Unvencion Pimentel.
B. Test i fying Against ... Mr. Randal l Sablan, a resident of Agana Heights,
appeared before the Committee in opposition to Bill No. 904. Mr. Sablan cited the most appropriate mechanism for rezoning property to be the Territorial Land Use Commission and that property owners should take the opportunity to have their proposals reviewed and approved by this body. Land matters and in particular rezoning of property can be done by the TLUC with the help of the Department of Land Management. The planning staff as well as other agency personnel would then be given the chance to review all land proposals and determine what implications exist if any. Though this process is costly and in many cases time consurying, it might be well worth our while.

With no further individuals requesting to testify, the Chairman adjourned the hearing (9:30 P.M.).
111. Committee Findings and Recommendat ions
The Committee finds that the intent and structure of Bill No. 904 Meets the approval of the Mayor and practically all the residents of the R.R. Cruz Subdivision in Agat particularly those who are affected by the provisions of the proposed law. Further, it is the impression of the Committee that the rezoning of property in or adjacent to ~ r a c t 227, Municipality of Agat, would not have any adverse impact socially or physically on the area or the residents of the community as a whole.
As such, the Committee recommends that Bill No. 904 be
amended and substituted to incorporate certain corrections pertaining to lot numbers and corresponding owners. Since no major change to the structure or substance of the Bill was found necessary, the Commit tee fur ther recommends approva l a n d transmit ta l o f the Bil l No . 904 a s A m e n d e d a n d S u b s t i t u t e d by t h e C o m m i t t e e on H o u s i n g , C o m m u n i t y D e v e l o p m e n t , F e d e r a l a n d Foreign Affairs to the Twenty-First G u a m Legis lature for passage.

The Government of Guam is hereby authorized to sell C
Government of Guam real property described as Lot $13, Map 18,
Unit 1, containing an area of approximately one (1) acre,
situated in As-Umang in the municipality of Agat, to Ms.
Joaquina B. Herrera who is presently a land-use permittee on
the property. The price offered f ~ r the property shall be at
fair market value.
The Director of the Department of Land Management and the
Office of the Attorney General shall take necessary action to
effectuate the provisions in this section.
Ileation 2. The provisions of Section 3 of Public Law 12-
61, as amended, shall not apply to the land sale authorized by
this Act.

An Act to Rezone Certain Properties in Tract 227 and Other Areas in the
Municipality of Agat.
BE IT ENACTED BY THE PEOPLE OF THE TERRITORY OF GUAM:
SECTION 1. LEGISLATIVE STATEMENT AND INTENT. C
When the Guam Legislature enacted Title 21 of the
Government Code of Guam, part of its intent was to cause
the creation of guidelines and a mechanism by which
residents could rezone their property in order realize the
fullest socio-economic return and financial gain from such
property. While the Guam Legislature intended the original
Territorial Land Use Commission mechanism to be efficient,
helpful and inexpensive, the bureaucracy has turned the
system into an expensive nightmare designed to discourage
all but the monied interests. Where the Legislature intended
the system to be helpful, bureaucratic roadblocks and
discouragement- have prevailed. Where the Legislature
intended the system to be cost efficient, residents are now
advised to retain the services of expensive land use
consultants and are required to conduct their own research
into various areas where the Legislature intended for those
government agencies to perform the research and to extend
services to applicants in an effort to make the process as
expeditious, economical and effective as possible..
The Legislature developed the Territorial Land Use
Commission because its members wanted the benefit of long-
range rational planning instilled in the zoning process. But i t
intended for the alternative system to be even more
expeditious than the legislative route. The bureaucratic
penchance towards making simple matters overly complex
again defeated legislative intent and the people, after
exploring the process established to effectuate any rezoning
effort, came back to the Legislature with concerns regarding >
both financial and professional hardship. In view of this the
Legislature finds it again necessary to assist residents desiring
to utilizing their private property to the highest and best
uses. The Legislature finds it necessary to be responsive to
the needs and desires of all residents of Guam and to assist
those residents, seeking to better their economic future, but
are being blocked or discouraged by the bureaucratic maze
associated with the TLUC, towards the realization of the
highest and best use or uses of their property.
Section 2. Lot Rezoned, Lot No. 19-1, Tract 227
in the Municipality of Agat consisting of approximately 1479
square meters owned by Johnny Q. and Aida S. Luces as
1 identified in Certificate of Title No. 24877 and recorded by
2 the Department of Land Management per Document No.
3 93880 is hereby rezoned from Single-Family Residential (R-1)
4 to Commercial (C).
5 Section 3. Lot Rezoned. Lot No. 203. Municipality
6 of Agat, consisting of 4,821 square meters owned by Antonio
7 C. Babauta as recorded on Certificate of Title No. 35345 by the
8 Department of Land Management is hereby rezoned from
9 Multi-Family Residential (R-2) to Commercial (C).

An Act to Rezone Certain Properties in Tract 227 and Other Areas in the
Municipality of Agat.
BE IT ENACTED BY THE PEOPLE OF THE TERRITORY OF GUAM:
SECTION 1. LEGISLATIVE STATEMENT AND INTENT.
When the Guam Legislature enacted Tit le 21 of the
Government Code of Guam, part of its intent was to cause
the creation of guidelines and a mechanism by which
residents could rezone their property in order realize the
fullest socio-economic return and financial gain from such
property. While the Guam Legislature intended the original
Territorial Land Use Commission mechanism to be elficient,
helpful and inexpensive, the bureaucracy has turned the
system into an expensive nightmare designed to discourage
all but the monied interests. Where the Legislature intended
the system to be helpful, bureaucratic roadblocks and
discouragement have prevailed. Where the Legislature
intended the system to be cost efficient, residents are now
advised to retain the services of expensive land use
consultants and are required to conduct their own research
into various areas where the Legislature intended for those
government agencies to perform the research and to extend
services to applicants in an effort to make the process as
expeditious, economical and effective as possible..
The Legislature developed the Territorial Land Use
Commission because its members wanted the benefit of long-
range rational planning instilled in the zoning process. But i t
intended for the alternative system- to be even more
expeditious than the legislative route. The bureaucratic
penchance towards making simple matters overly complex
again defeated legislative intent and the people, after
exploring the process established to effectuate any rezoning
effort, came back to the Legislature with concerns regarding
both financial and professional hardship. In view of this the
Legislature finds it again necessary to assist residents desiring
to utilizing their private property to the highest and best
uses. The Legislature finds it necessary to be responsive to
the needs and desires of all residents of Guam and to assist
those residents, seeking to better their economic future, but
are being blocked or discouraged by the bureaucratic maze
associated with the TLUC, towards the realization of the
highest and best use or uses of their property.
Section 2. Lot Rezoned. Lot No. 19-1, Tract 227
in the Municipality of Agat consisting of approximately 1479
square meters owned by Johnny Q. and Aida S. Luces as
identified in Certificate of Title No. 24877 and recorded by
the Department of Land Management per Document No.
93880 is hereby rezoned from Single-Family Residential (R-1)
to Commercial (C).
Section 3. Lot Rezoned. Lot No. 203, Municipality
of Agat, consisting of 4,821 square meters owned by Antonio
C. Babauta as recorded on Certificate of Title No. 35345 by the
Department of Land Management is hereby rezoned from
Multi-Family Residential (R-2) to Commercial (C).
Section 4. Lots Rezoned . Certain lots situated in
Tract 227, Agat are hereby rezoned from Single-Family
Residential (R-1) to Multi-Family Residential (R-2). Said lots
are as follows:
