TOKYO, MARCH 30 India and Japan on Monday reaffirmed their strong defence ties, as vis- iting Defence Minister Manohar Parrikar called on Prime Minister Shinzo Abe and also met his coun- terpart Gen Nakatani. According to an official statement, while calling upon Abe, Parrikar said Japan was the first country he was visiting after assuming office, which clearly conveys the impor- tance India attaches to strengthening bilateral defence and security coop- eration. He said he would like to see a strong partnership with Japan in defence equipment and technology. A Delhi court has refused to setaside the sentence of a driver of acommercial vehicle for causing deathof a person by driving negligently andinjuring another 15 years ago.

However, the court took a lenientview and modified the six-month-jailterm to three months while taking intoaccount the protracted trial.

"Considering the fact that appellanthas a family to support comprising ofthree kids besides his wife; that he isthe sole bread earner of his family; hehas faced the agony of trial since 2000and that he is not a previous convict, Iam inclined to take a lenient viewtowards him," Special Judge PraveenKumar said.

The court, while upholding the con-viction of truck driver Kamal KumarPandey, maintained the compensationof Rs one lakh to be paid by him to thevictim's family members as directedby a magisterial court.

"The compensation as ordered by

the trial court is maintained.Appellant(Pandey) be taken into cus-tody and sent to jail," it said.

The court disposed of Pandey'sappeal against conviction and sen-tence of six months for the offencesunder sections 279 (rash driving), 337(endangering life or personal safety ofothers) and 304A (causing death bynegligence) of the IPC.

It rejected the defence taken by himthat the brake of his vehicle had failed,saying it was an "afterthoughtdefence".

The court, while upholding his con-viction, also relied on the testimony ofthe investigating officer, an eye wit-ness, mechanical inspection report ofthe vehicle and post-mortem report ofthe victim. According to the prosecu-tion, on June 17, 1999, Pandey wasdriving his light truck near LawrenceRoad in north-west Delhi here in arash and negligent manner hitting acycle from behind on which oneJoginder was riding pillion.

A bench of justices G S Sistaniand Sangita Dhingra Sehgalissued the direction while uphold-ing the life term awarded toUmesh Kumar, an auto driver,who had murdered a 30-year-oldmarried women on account of herrefusal to live with him.

Holding that the trial court hasrightly convicted and sentencedKumar, the high court said "noeffort has been made during inves-tigation to investigate the sourcefrom where the acid was procuredby the appellant."

"Throwing of acid on helplessvictims, mostly women, is on the

rise, which is a dastardly and cow-ardly act and the same is to becontrolled with an iron hand. Itsometimes leaves them disfigured,blind and, as in this case, death,"the court said.

It also said that the investigatingofficer had not performed his duty"with sincerity as efforts shouldhave been made to ascertain thesource of acid and to take neces-sary steps against the sale of acidillegally."

"Accordingly, we deem it appro-priate that a copy of this order bebrought to the notice ofCommissioner of Police, who willensure that strong action is takenagainst the persons, who sell acidillegally and a circular be issuedto the Department to ensure thatevery effort should be made tocurb sale of acid illegally and,those found guilty should be pun-ished with a heavy hand," thejudges added.

Interacting with media atPadma awards function atRashtrapati Bhavan, DelhiChief Minister ArvindKejriwal today said the pilotproject will be implementedwithin a month and the cost ofthe project is being workedout.

"Delhi Jal Board chief hadgone to Singapore to study thesystem. Singapore also lives onrecycled water as there is nonatural source of fresh water. Ifthis project is successful wewill start it in 15-20 more loca-

tions," he said.Kejriwal said fine points of

the project will be discussedwhich will include the fundingof it.

He said the project will recy-cle the water in such a way thatwater from toilet goes back totoilet while the kitchen water issent back to kitchen after beingrecycled which will ensure amineral water-like quality.

The Chief Minister said theplants will be set in the clustersof 100-200 houses and willhave lesser cost than the devel-opment charges incurred onsewage system by residents.

He also said the effort is tomake the national capital self-sustainable in water supply.

Kejriwal said governmentwill also initiate a major anti-corruption mechanism in thenational capital to fulfill itselectoral promise.

NEW DELHI, MARCH 30A special court on Monday pulled

up the CBI for not serving summonsto witnesses properly, saying this haddelayed trial in a disproportionateassets (DA) case involving formerHaryana Chief Minister Om PrakashChautala.

Irked over non-service of sum-mons to four prosecution witnesses,the court observed that reportsregarding unexecuted summonsgiven by CBI were "unsatisfactory"and this has led to wastage of judicialtime. "Out of six summons issued,four were received unexecuted withunsatisfactory reports. It leads towastage of court time and delay intrial. Public prosecutor assures thatthis will not happen in future and hewill take up the matter with seniorofficials," Special CBI Judge SanjayGarg-I said.

Summons were served to only twoprosecution witnesses who appearedin court and recorded their state-ments.

The court, in its order, noted that itwas not satisfied with the reportgiven by the process server of CBI,saying no effort was made to get thepresent addresses of the witnesses.

The court is currently recordingstatements of CBI witnesses in thecase. 80-year-old Chautala, who islodged in jail after being sentencedto a 10-year jail term in another case,was also present in the court duringthe hearing.

Chautala is serving 10-year impris-onment for illegally recruiting 3,206JBT teachers in Haryana in 2000.

CBI had registered three separatedisproportionate assets cases againstChautala and his two sons Ajay andAbhay, on a complaint by HaryanaCongress leader Shamsher SinghSurjewala.

The agency had on March 26, 2010chargesheeted Chautala indictinghim for allegedly possessing assetsworth Rs 6.09 crore, far exceedinghis legal income between 1993 and2006.

Two such separate cases are alsogoing on against his sons, Ajay andAbhay. (more) Earlier, all the threecases, being heard in different

courts, were transferred to onecourt on CBI's plea that these casesbe put up before a single judge astheir trials in different courts wouldlead to inordinate delay in conclud-ing them.

In its chargesheet, the CBI hadalleged that Chautala's wealth was189 per cent more than his income ofRs 3.22 crore during the period.

The CBI had also said that Ajaywas possessing assets exceeding hislegal income by 339.27 percent. Hislegal income between May 1993 andMay 2006 was Rs 8.17 crore, but hadacquired assets worth Rs 27.7 crore,the agency had alleged.

Abhay owned assets worth overfive times his income of Rs 22.89crore as per income tax records dur-ing the 2000-2005 period. Theagency claimed to have found Rs119.69 crore worth of assets.

to set aside the convictionand sentence of a man fordriving in an inebriatedstate, observing that severalvaluable lives are lost everymonth due to drunken driv-ing. Additional SessionsJudge Raj Kumar Tripathi,however, granted relief toHaryana resident RajeshKumar by reducing the 10days jail term to five daysconsidering that he is a firsttime offender with no crimi-nal records and his drivinglicence has already beensuspended for six months bythe order of trial court.

"It was highly probablethat a driver like the appel-lant being under the influ-ence of alcohol and to thatextent, could cause serious

accidents. Driving in thismanner, appellant had putthe life of road users to therisk as well as his own life indanger.

"It is a matter of commonknowledge that due todrunken driving severalvaluable lives are being lostevery month," the courtsaid.

It said the alcohol contentin the blood of the appellantwas 30 times more than thepermissible limit and therewas no "illegality, infirmityor perversity in the orderpassed by the trial court".

Kumar had appealedagainst the trial court order,saying he had pleaded guiltybefore it as he was misledby his counsel and was notaware that he will be sen-tenced to jail.

The court, however,refused to agree with hiscontention, saying that hewas explained the conse-quences of pleading guiltyby the metropolitan magis-trate in vernacular.

It also rejected Kumar'scontention that his bloodtest was not conducted inthe hospital by police offi-cials, saying there is norequirement under any lawthat the police official mustget the drunken driver med-ically examined or his bloodtest conducted in any hospi-tal. The trial court in itsorder had awarded him 10days simple imprisonmentand Rs 2000 fine. Kumar'sdriving licence was also sus-pended and he was alsodirected not to drive anyvehicle for six months.

The court also said, "We are afraid, thispetition in public interest is being pursuedwithout regard to the law which has comeinto force and the provisions thereof. We thusdid not feel any need to entertain this petitionand dismiss the same."

It also took note of Delhi government'ssubmission that a communication has beensent to the Joint Secretary in Civil AviationMinistry to circulate a direction to all airlinesoperating from Delhi and the NCR to consti-tute Internal Complaints Committees andtake steps to create awareness.

The issue was transferred as a PIL to thebench by another court which was dealingwith the plea of an Indian woman, employedwith Sri Lankan Airlines, seeking actionagainst the carrier and its official whom shehad accused of sexual harassment.

The Australian privacy commissioner wascontacted by the director of the visa servicesdivision of Australia's Department ofImmigration and Border Protection to informthem of the data breach on November 7,2014, and seek urgent advice.

But the newspaper claimed that it was notconsidered necessary to inform the worldleaders of the privacy breach.

In the email, obtained under Australia'sfreedom of information laws, the breach isattributed to an employee who mistakenlyemailed a member of the?local organisingcommittee of the Asian Cup - held inAustralia in January - with the personal infor-mation.

"The cause of the breach was human error.(Redacted) failed to check that the auto-fillfunction in Microsoft Outlook had enteredthe correct person's details into the email 'To'field. This led to the email being sent to thewrong person.

"The matter was brought to my attentiondirectly by (redacted) immediately after

receiving an email from (the recipient)informing them that they had sent the emailto the wrong person. The risk remains only tothe extent of human error, but there was noth-ing systemic or institutional about thebreach," the officer wrote.

The immigration officer then recommend-ed that the world leaders not be made awareof the breach of their personal information.

Given that the risks of the breach are con-sidered very low and the actions that havebeen taken to limit the further distribution ofthe email, I do not consider it necessary tonotify the clients of the breach," the officerwrote. The recommendation not to disclosethe breach to the world leaders may be atodds with privacy law in some of their coun-tries. Australia's deputy opposition leader,Tanya Plibersek, called on Prime MinisterTony Abbott, to explain why the world lead-ers were not notified of the breach.

"There is no presumption that every suicidecommitted by a married woman in her in-laws' house or at her parents' house has to bebecause she was suffering harassment at thehands of her husband or her in-laws," thecourt said.

It noted that the material placed on recordby the prosecution does not suggest any"overt act" on part of the accused, indicatingthat he had abetted his wife's suicide.

According to prosecution, Jagmohan waschargesheeted for offences under sections498 A (cruelty), 304-B (dowry death) and306 (abetting the commission of suicide) ofthe IPC.

It said that after being subjected to crueltyand dowry harassment, Jagmohan's wife had

allegedly tried to slit her wrist before hangingfrom ceiling in her matrimonial house.

During trial, the man had denied the allega-tions levelled against him and claimed inno-cence.

The court said the span of matrimonial lifeshould also be taken into account and, in thiscase, the marriage between the deceased andthe accused had taken place in 2008.

"Marriage had taken place in 2008 andminor quarrel or one or two stray incidentspread over a period of six years would notmake it to be a case falling within the ambitof cruelty or dowry death," the court said.

The court noted that if the alleged incidentof cruelty

The court said that merely because theaccused, with the help of others, had broughtthe deadbody down, would not be a reason tofeel apprehensive and suspicious about him.

"It is generally experienced that in suchtype of matters, when there is a suicide whichhas nothing to do with the demand of dowry,husband and other relatives of husband tendto flee away due to panic," it said, adding thatno adverse inference could be drawn fromthe said act.

He said that handing over the "ways andmeans" of the bank to RBI by the previousgovernment was a major setback to the insti-tution of autonomy of the state.

"We will try to renegotiate the terms withthe Government of India, but from thisHouse I want to say that we stand behindJammu and Kashmir Bank, we completelysupport the bank," he said.

Reading the judgment, one istempted to ask this question:Is it a landmark judgment or

just a great one? To appreciate thedifference between “great” and“landmark”, it is necessary to beginwith some very fine distinctions. Agreat judgment is one that restoresthe constitutional values of a polityfrom the waywardness into which itmay have fallen, while a landmarkjudgment is one which opens up newdirections in our constitutional think-ing and, in the process, adds newdimensions to what are regarded asestablished constitutional principles.If “great” restores the centrality ofconstitutional values, “landmark”revitalises them. For many commen-tators, the judgment — striking downas unconstitutional Section 66A ofthe IT Act of 2000 — by the SupremeCourt Bench of Justices J.Chelameswar and R.F. Nariman inthe Shreya Singhal case, is seen as alandmark judgment. It is regarded asheralding the birth of new freespeech jurisprudence and restoringthe public space for dissent in India.

A distinction

With respect to the judgment’scomments on free speech, I plan hereto go against the current. It is a greatjudgment, not a landmark one. Theseare my reasons. I see the analyticaldistinction made in the judgment ofthree forms of free speech andexpression, i.e., discussion, advocacyand incitement, as preliminary to afine distinction being worked out butone which was not done. The distinc-tion is inadequately executed since itdoes not provide for the societaldynamics of each form. Hence, thedistinction, while a good startingpoint, does not protect free speechenough since it allows for situationswhere the “discussion” entered intoby one can be used by another to“incite” simply by quoting the dis-cussion and saying “this is what hehas said”. Repeating a discussion, inanother context, is enough to bringthe wrath of the mob on the unsus-pecting person’s head. WriterPerumal Murugan had to face suchire in January 2015 in Tamil Nadubecause of a novel he wrote as did

T.J. Joseph, a lecturer in Kerala, whohad his hand cut off in 2010 for aquestion he had set in an examina-tion.

Second, the judgment does notmake the important distinctionbetween “speech” and “expression”and, therefore, while it elaborates on

the need to protect speech and thewritten word, it has little to say onexpression especially in its manyforms of photographs, paintings,films, cartoons, etc. So, while aFacebook post gets protection, apainting does not. The third infirmityis the judgment’s acceptance of thedistinction between the print and dig-ital media, or rather between the oldmainstream and the new socialmedia. It appears to accept this dis-tinction on quantitative grounds, i.e.,how many people can be reached andhow fast, rather than on qualitativegrounds, i.e., what is being said. Thisis an untenable distinction especiallyin the digital age when we have e-papers, e-books, e-lectures, etc.These few areas of weakness shouldnot, however, detract from the judg-ment’s significant contribution tofree speech especially in these darktimes of censorship. It is withoutdoubt a great judgment and will soonbecome the touchstone for new freespeech jurisprudence in India. Thehecklers will be in retreat.

As landmark judgment

I do consider it a landmark judg-ment, however, but for its other sec-

tions and not those specifically relat-ing to free speech. The implicationsof these sections are that they givepowerful legal weapons to thosefighting the tyranny of the state. So,what were offered by the honourableJustices as supporting props for themain issue, i.e., the striking down ofSection 66A, have, I believe, become

key clauses in my reading of thelandmark judgment. They diminishthe arrogance of government, resur-rect the principle of limited govern-ment, and reinstate the ‘genuine’ ruleof law. After a long time, the govern-ment — and this is cause for celebra-tion — has again become subject tothe rule of law.

There are three manoeuvres per-formed by the Honourable Justicesthat have produced this splendid out-come. The first is their dismissal ofthe assurances given by governmenton the ground that the law cannot bebased on the assurances of anyregime in power. The law cannot bebased on even the bona fide inten-tions of a government and has toexist independent of these intentions.The second is the role the judgmentperforms in educating the publicabout the government’s mind byplacing the key aspects of the gov-ernment’s submission in the publicdomain. And the third relates to theirobservation that “vagueness” in theformulation of laws produces a tyran-ny of power. This has “chilling”(their word) consequences for civilliberties.

When the Additional SolicitorGeneral sought to assure the courtthat even if certain portions of thelaw — 66A — were vague, the gov-ernment, being committed to freespeech, would not use the section tocurb free speech. The Justices wrotein response: “Governments maycome and Governments may go but

Section 66A goes on forever. Anassurance from the present govern-ment even if carried out faithfullywould not bind any successor gov-ernment. It must, therefore, be heldthat Section 66A must be judged onits own merits without any referenceto how well it may be administered”(paragraph 92). Assurance from thegovernment is not enough. The lawmust stand on its own. Similarly,when the Additional SolicitorGeneral asked that parts of Section66A be saved under the Doctrine ofSeverability, the Honourable Judgesheld “that no part of Section 66A isseverable and the provision as awhole must be declared unconstitu-tional” (paragraph 96). By dismiss-ing both requests of the government,the Court achieved two major out-comes. It established the fact that thelaw must be delinked from theagency and intentions of the govern-ment. It must be read independentlyof the intentions of those who admin-ister it. And, second, the court dis-tanced itself from the common per-ception that it normally acts in a gov-ernment-friendly manner. The courtis friendly only to the Constitution.

As public educator

On its role as a public educator, theCourt chose to place at great lengththe written submission of theAdditional Solicitor General with thefollowing words: “It was argued bythe learned Additional SolicitorGeneral that a relaxed standard ofreasonableness of restriction (empha-sis mine) should apply regard beinghad to the fact that the medium ofspeech being the Internet differs fromother mediums on several grounds.To appreciate the width and scope ofhis submissions we are setting out hiswritten submission verbatim” (para-graph 27). This is a brilliant strategyto educate an engaged public on thenature of the government’s argu-ments. Hence, we learn that [point(ii)] “the recipient of free speech andexpression used in a print media canonly be literate persons while internetcan be accessed by literate and illiter-ate both since one click is needed todownload an objectionable post orvideo” or [point (v)] “by the mediumof internet, rumours having a seriouspotential of creating a serious socialdisorder can be spread to trillions ofpeople without any check which isnot possible in case of other medi-ums”.

Such pop sociology continuesthrough the 11 points made by thegovernment. If we overlook the “tril-lions” of people whom the govern-ment is concerned about, the wordcomes again twice in point 11, thenwe can focus on the empirical claimsmade with respect to literacy,rumour, and privacy.

These are in fact only the opinionsof the Additional Solicitor Generalsince no evidence using social sci-ence is given for them. Yet, they areoffered as the empirical basis for cen-sorship and prosecution underSection 66A. Opinions cannot be thebasis of laws. The HonourableJustices, by presenting the submis-sion verbatim, wanted us to see thepoor quality of the government’sarguments. Such a cavalier attitudemust be punctured at least a trilliontimes.

Vagueness of words

But it is in the discussion on thevagueness of words used in Section66A(b) i.e., inconvenience, danger,insult, injury, etc., that the Court is atits legal best. It takes each word,examines its dictionary meaning,offers judgments from Indian andAmerican legal history to establishits precise meaning, and then showswhy these words in Section 66A havebeen casually introduced into the law.In a brilliant section on vaguenessand overbreadth, the learned Justicesstate that “In point of fact, Section66A is cast so widely that virtuallyany opinion on any subject would becovered by it, as any serious opiniondissenting with the mores of the daywould be caught within its net. Suchis the reach of the Section and if it isto withstand the test of constitution-ality, the chilling effect on freespeech would be total” (paragraph83). It is this vagueness of operativewords that must be disallowedbecause of its “chilling effect on freespeech”. Vague words are vehiclesfor state tyranny. For freedom, preci-sion is required. This section on thevagueness of words in our laws,especially in government orders, cannow be cited by civil libertarians tostrike down badly framed laws inlower courts.

All three manoeuvres, I expect,will infuse a new strength in the liti-gant’s fight for citizenship rights. Itwill make those who draft laws cau-tious and increase parliamentaryscrutiny of articles and clauses. Itwill make law officers realise thattheir submissions will be subject topublic scrutiny. And, finally, it will, Ihope, also change the habit of thecourt, which is normally soft on gov-ernment. As the custodian of theConstitution, the court has to fighttyranny. The judgment has struck apowerful blow for limiting govern-ment. This is what makes it a land-mark judgment.

The latest official figuresindicate that India is wellshort of meeting the

Millennium Development Goalsthat pledged to reduce the coun-try’s maternal mortality ratio(MMR) by three quarters and theinfant mortality rate (IMR) bytwo-thirds. The SampleRegistration System (SRS),2013, records MMR at 167 per1,00,000 live births and IMR at40 per 1,000 live births with amajority of these infants dyingwithin seven days of birth.

India’s high MMR and IMRare partly due to delayed diagno-sis and limited access to healthcare. Additionally, rest during orafter pregnancy is not an optionfor most women who are unor-ganised workers. According tothe District Level HouseholdSurvey 3, nearly a quarter ofwomen in India do not receiveany antenatal care and over 50per cent do not receive any post-natal care for up to two weeks.

In 2010, the Ministry ofWomen and Child Development(MWCD) launched the IndiraGandhi Matritva Sahyog Yojana(IGMSY) to address this criticalsituation. Leveraging theIntegrated Child DevelopmentScheme’s (ICDS) platform, theprogramme was piloted in 53districts across the country.

The IGMSY provides partialwage compensation to pregnantand lactating women in order topromote rest and healthy feedingpractices, as well as increaseutilisation of healthcare services.Under the scheme, all pregnantwomen of 19 years and above,except those employed by thegovernment (Central or State) orPublic Sector Undertakings, forthe first two live births wereentitled to Rs. 4,000 per livebirth, in three instalments. Thescheme is conditional on timelyregistration, complete vaccina-tion, attending counselling ses-

sions and exclusive breastfeed-ing of the child.

In September 2013, theIGMSY cash incentive wasincreased from Rs. 4,000 to Rs.6,000 to comply with the mini-mum maternity entitlement pro-vision of the National FoodSecurity Act (NFSA), 2013.Additionally the payment time-line was revised to two instal-ments of Rs. 3,000. However,the coverage and conditionswere unaltered.

Poor implementation

Implementation of the IGMSYhas been neglected since itslaunch. Official data show thatbetween the years 2010 and2013, approximately only 28 percent of the targeted beneficiarieswere covered. At the end of2014, the MWCD announced aproposed scale up of the IGMSYto 200 additional ‘high burden’districts in 2015-16. Though thisexpansion did not comply withthe NFSA’s mandate of maternalentitlements for the entire coun-try, the willingness of the gov-ernment to increase coverage ofthe IGMSY was seen by civilsociety as a step in the rightdirection.

However, the government’slack of commitment to expan-sion of the IGMSY is betrayedthrough this year’s budget allo-cation of Rs. 438 crore, anincrease of Rs. 80 crore from2014-15. Given the absence ofCentre-State cost sharing, thisincreased allocation of approxi-mately one-fifth of last year’sbudget is disproportionate to theproposed expansion of nearlyfour times the current coverage.This indicates the government’sdecision to not scale up theIGMSY, which is a clear viola-tion of the NFSA.

A qualitative study of theIGMSY was conducted by theCentre for Equity Studies, New

Delhi, in 2014, in Bihar,Chhattisgarh, Jharkhand andMadhya Pradesh. The studyrevealed widespread neglect ofthe scheme over three years,with teething trouble still beingfaced in some districts.

It was found that most benefi-ciaries were unaware or misin-formed about the scheme. Onemother in Jharkhand believedthat she was entitled to a maxi-mum amount of Rs. 1,500.Without the government’s atten-tion to awareness building,women fail to demand their enti-tlements. Several Anganwadiworkers stated that a three-yeargap between the first two chil-dren or sterilisation of the moth-er was essential for receivingIGMSY money for the secondchild. Such misinformation is aresult of inadequate and improp-er counselling of women andtraining of workers.

Under the IGMSY, cash isonly deposited into an account.Opening and accessing accountsis often expensive and time con-suming because banks and postoffices are often far from vil-lages. In Madhya Pradesh andChhattisgarh, banks and postoffices were situated as far as17-30 kilometres — a difficultterrain to traverse in some areas— and some of them are ineffi-cient. IGMSY guidelines specifythat the accounts should have tobe zero-balance no-frillaccounts. However, no womanreported having such an account.Initial deposits demanded fromthem ranged from Rs. 50-200 inpost offices and Rs. 500-1,000 inbanks. Such costs disincentiviseparticipation in the programme.

The IGMSY guidelines rec-ommend creation of State anddistrict implementation cells.These cells were either absent ornot fully staffed at the time ofthe study. This failure combinedwith no provisions for block-level cells, and frequent transfer

of officials, negatively impactsIGMSY implementation, moni-toring and quality record-keep-ing. The study also revealed thatno system of IGMSY-relatedcomplaint filing, time-boundinvestigation or appeals systemexists in Bihar, Jharkhand andChhattisgarh.

Delayed payment was a trendacross the four States with nosampled beneficiary receivingthe first instalment of IGMSYcash during pregnancy. In Biharand Jharkhand, the completeamount was generally receivedwhen the child was around one-year-old. Such delays underminethe objective of the scheme — toprovide partial wage compensa-tion during pregnancy to enableadequate rest.

Improving effectiveness

Despite various issues plagu-ing the IGMSY, there is signifi-cant scope to improve imple-mentation and effectiveness ofthe programme through compli-ance with the guidelines. Insteadof focussing on the existinggaps, the MWCD aroundSeptember 2014 proposed limit-ing the IGMSY to AntyodayaAnna Yojana and priority house-holds i.e., the eligibility criteriafor the Public DistributionSystem (PDS) under the NFSA.This proposal fails to account forthe fact that maternal and childhealth is not merely an econom-ic issue. It is as much a matter ofimproper practices, misinforma-tion regarding care and delayeddiagnosis. For this reason, hav-ing initial eligibility criteria thatare largely economic are inade-quate. tion for the aviation industry: can it determine with finali-ty that a pilot is fit in all respects before a flight? Despitethe rigorous physical and psychological testing processesin place, that may not be possible. Civil aviation is amongthe most regulated sectors because of the risks that flyingentails for everyone — the passengers, crew and people onthe ground. The revelation that Andreas Lubitz, the co-pilot of the Germanwings aircraft, had mental health issuesthat he concealed from his employer raises disturbingquestions. It underscores the fragility of the human factorwhich is truly the critical element in the rigorous process-es required for aviation. The Lubitz issue showed that theannual medical examination of pilots done under strictEuropean Union regulations can fail to identify psycholog-ical problems such as depression. Significantly, last year’smysterious Malaysia Airlines MH 370 disappearance alsoinvolved a captain who may have been disturbed. Had theEU a ‘two-person’ cockpit rule such as in the U.S., whichrequires two crew members to be present in the cockpitalways, this act of mass murder could have been stopped.The EU and the European Aviation Safety Agency are nowconsidering the introduction of a similar rule. Flight safetyhas so far focussed on threats from the passenger side, andthe 9/11 terror episode led to fortification of the cockpit. Inexceptional circumstances, such as an emergency affectingthe pilot and the cockpit area, the crew can use a code thatopens the cockpit door briefly, or it even opens automati-cally if the pilots are immobilised due to depressurisation.But if they are in a position to act, pilots can override thismechanism. The crash in the Alps has launched the searchfor a solution to this problem, of accessing the cockpitfrom outside, if the plane has been commandeered fromwithin. The quest now includes a technological solution —one that enhances ground control of aircraft features,including the cabin door, remotely. On the human factoraspect that cannot be overemphasised, the solution liespartly in destigmatising mental health issues. This is par-ticularly relevant to the present-day workplace, where theemphasis is on productivity. Stress and aviation do not gotogether, and pilot recruitment tests are designed toexclude those who crack under pressure. Preliminary evi-dence shows that Andreas Lubitz was indeed stressed, andthat in spite of medical advice pursued his deadly course.It is tragic that a failure to factor in the possibility ofhuman errors has led to tragedies of this proportion in theskies.

ital of Andhra Pradesh, com-ing up in Vijaywada region, islikely to be ready by June.

The Singapore governmentagencies, which are helpingthe AP government by prepar-ing the master plan for free,on Monday made a presenta-tion before Chief Minister NChandrababu Naidu, who ison a visit to Singapore.

Naidu suggested somechanges in the plan.

"The capital city masterplan will be refined by incor-porating these suggestionsand modifications in the nextsix to eight weeks," a stategovernment release said here.

The delegation from AndhraPradesh gave a detailed pres-entation on the land poolingprocess and various timelinesfor making the capital ready.

The state government haspooled around 32,000 acresfor developing the capital.

The AP and Singapore dele-gations have decided to meetin the next six to eight weeksby the time the Singaporegovernment comes up with arevised version of the masterplan.

"The next stage, however,would be the seed capitalplanning," the release said.

Naidu began his day inSingapore by reading a note inremembrance of Singapore'sFounding Father Lee KuanYew.

Master plan for Andhra Pradeshcapital likely to be ready in June

VADODARA, MARCH 30A new terminal for starting interna-

tional flights from Harni Airport inthe city of Vadodara is likely to beready by March 2016, a senior offi-cial has said.

"About 50 per cent constructionwork of the new terminal is over andthe remaining work will be completedbefore the end of this year. The workfor creating other facilities as perinternational standards will be doneby March next year," Director,Airport Authority of India, VadodaraAirport, Santosh Dhoke told PTItoday.

The project is part of the Centre'sefforts to modernise the existing air-ports and develop them on par withinternational airports.

The existing domestic terminal atVadodara airport is small and cannothandle a large number of passengers.

The foundation stone for the newterminal was laid on February 26,2009. The construction work started

in May 2011 and is expected to becompleted by next year.

The new terminal will have an areaof 18,120 sq metres with the ability tohandle 700 passengers (500 domesticand 200 international) per hour. Itwill have 18 check-in counters, offi-cial sources said.

Gujarat Finance and Civil AviationMinister Saurabh Patel had last yearrequested the Centre for declaringVadodara and Surat flight terminalsas international airports.

Mr Patel had also requested UnionCivil Aviation Minister for startingdirect flights to Dubai from Vadodaraand Surat.

Meanwhile, the regular operation ofMumbai and Delhi-bound flightsfrom the airport resumed yesterdayafter completion of resurfacing workof runway, Mr Dhoke earliersaid.

As many as 16 flights operateeveryday from the Harni airport,located on the city outskirts.

The ICC team features fiveNew Zealanders, includingMcCullum, despite their seven-wicket loss to Australia in thesummit clash yesterday. India,the defending champions, hadbowed out after a semifinal lossto Australia.

"McCullum was chosen as thecaptain following his aggressive,innovative and inspirational lead-ership during the 44-day tourna-ment that was the cornerstone ofhis team's progression to the finalwhere it lost to Australia byseven wickets," the ICC said in astatement.

McCullum also scored 328runs in nine matches with fourhalf-centuries at a strike-rate of 188.50.

Hollywood-style release!Vidhu Vinod Chopra’s international film

Broken Horses will be getting a starryHollywood premiere.

The cast and crew of the film will be walkingdown the red carpet at the premiere. BrokenHorses stars Vincent D’Onofrio, Anton Yelchin,Chris Marquette and Maria Valverde.

Vidhu Vinod Chopra is currently busy with pro-motions of Broken Horses in the internationalmarkets. His B-Town friends will also be attend-ing the premiere of the film in Los Angeles. Someof the big names who will be attending BrokenHorses’ premiere are James Cameron and AlfonsoCuaron.

Broken Horses has created a lot of buzz aheadof its release. It’s trailer was launched byBollywood bigwigs, Amitabh Bachchan andAamir Khan, who might also be attending the pre-miere of the film in Los Angeles.

Broken Horses is completely a Hollywood filmwhich marks Chopra’s debut as a Hollywoodfilm-maker. He is the first Indian to have pro-duced, directed and written a full-fledgedHollywood film. It will get a worldwide releaseon April 10.
