Identification of Ozone Areas Attainingthe 1-Hour Standard and to Which the1-Hour Standard Is No LongerApplicable

AGENCY: Environmental ProtectionAgency (EPA).ACTION: Final rule.

SUMMARY: On January 16, 1998, the EPApublished a direct final rule to identifyozone areas where the 1-hour standardis no longer applicable. The 60-daycomment period concluded on March17, 1998. A total of ten adversecomment letters were received inresponse to this direct final rule.Therefore, on March 16, 1998, theAgency published a withdrawal of thedirect final rule, thus converting thedirect final rule to a proposal.Independent of the comments received,the EPA identified typographical errorsof certain areas listed in its regulationson designation of areas for air qualityplanning purposes. I. Public Comments and EPA Responses

The following discussion summarizesand responds to the comments receivedon the direct final rule published onJanuary 16, 1998 (63 FR 2726), whichwas withdrawn due to adversecomments by a document published onMarch 16, 1998 (63 FR 12652), thusconverting the direct final rule to aproposal (63 FR 2804, January 16, 1998).

General Comment: The commentervoiced four major concerns: (1) the rulecontradicts the requirements of theClean Air Act (Act), (2) the rule uses anarbitrary and inconsistent methodologyto determine where the 1-hour standardshould be determined not to apply, (3)the rule discriminates againstdownwind areas affected by transportedozone and nitrogen oxides (NOX), and(4) the rule imposes uncertain andunfair burdens on small entities andothers in southwestern Pennsylvania.The EPA should revoke the 1-hourstandard everywhere, for the entirecountry.

Comment: The Act does not give EPAthe authority to establish differentstandards for different areas of thecountry, nor does it give EPA theauthority to selectively revokepreviously established standards insome areas of the country but not others.

Response: The procedure fordetermining that the ozone nationalambient air quality standards (NAAQS)no longer applies was established in theNAAQS rulemaking promulgated in July1997. Since the rule for the new ozoneNAAQS has been promulgated, effectiveSeptember 16, 1997, (62 FR 38856, July18, 1997), it is too late to raise issues in

this rulemaking concerning thecontinued applicability of the 1-hourozone standard to areas not attainingthat standard.

Comment: Although southwesternPennsylvania attained the 1-hourstandard for 6 straight years from 1989through 1994, EPA refused toredesignate the region because of adispute with the Commonwealth ofPennsylvania over whether the otherrequirements for redesignation had beenmet. When the Growth Alliancechallenged EPA’s illegal delay in actingon Pennsylvania’s request to redesignatethe region and its inappropriateconsideration of 1995 emission data,EPA asserted that it would refuse toredesignate the region regardless of thedecision about the appropriate airquality data to use because of the otherrequirements for redesignation. Byrevoking the standard in areas that maynot have met the requirements forredesignation, EPA is now attempting tocircumvent the same requirements ofthe Act that it has previously been soadamant to enforce in southwesternPennsylvania.

Response: On May 1, 1996, EPAdisapproved the Commonwealth ofPennsylvania’s request that EPAredesignate the Pittsburghnonattainment area to attainment forozone because the area violated the 1-hour ozone NAAQS and did not meetother Act requirements for redesignation(61 FR 19193). This decision waschallenged. In an opinion filed on July28, 1997, the U.S. Court of Appeals forthe Third Circuit denied theSouthwestern Pennsylvania GrowthAlliance’s petition for review andupheld EPA’s decisions to disapprovePennsylvania’s redesignation request forthe Pittsburgh area. Furthermore, thePittsburgh area was not in attainmentfor 6 straight years. Compliance with theozone NAAQS is determined using 3consecutive years of data to account foryear-to-year variations in emissions andmeteorological conditions. The area firsthad air quality data that met theNAAQS in 1992, considering the years1990–1992, and continued to meet thestandard in 1993 and 1994. Then, in1995, the area once again violated theNAAQS. The area continues to be out ofcompliance with the 1-hour ozoneNAAQS.

As this action is not a redesignation,but rather a determination that the 1-hour NAAQS no longer applies tocertain areas, pursuant to theregulations promulgated in July 1997 aspart of the rulemaking regarding theozone NAAQS, the redesignationrequirements of section 107(d)(3)(E) donot apply to this action. This action is

not an attempt to circumvent therequirements of redesignation, butinstead simply follows the regulationspreviously adopted by EPA.

Comment: There is a pending suitwhich challenges EPA’s ability toredesignate upwind areas to attainmentwhen their States have not compliedwith the requirements of section110(a)(2)(D) of the Act, which requiresthat every State impose emissioncontrols sufficient to prevent negativeimpacts on downwind areas. Byrevoking the 1-hour standard in areasthat have attained it, but not requiringthat the other requirements forredesignation be met, EPA appears to beattempting to escape a potentiallyadverse ruling.

Response: The Agency views theprocess of determining where the 1-hourstandard no longer applies as not beingsubject to the requirements forredesignation. The regulations adoptedby EPA that govern this process set forthonly one criterion—attainment of the 1-hour standard. Section 110(a)(2)(D)continues to apply to upwind Statesregardless of the applicability of the 1-hour standard to areas in those States.Therefore, a determination that the 1-hour standard does not apply in anupwind State has no bearing on theobligation of such a State to satisfy therequirements of section 110(a)(2)(D) asto any significant contribution fromsources in that State to a downwind areathat is not attaining the 1-hour NAAQS.This action is not an attempt to avoidany potentially adverse court ruling butis simply the carrying out of theregulations promulgated in July 1997.

Comment: This method arbitrarilyselects the 1994–1996 period of time todetermine where the 1-hour standardwill be revoked; an area that happens toexperience meteorological conditionsthat were favorable for ozone during1996 or early 1997 would be doomed toremain subject to the 1-hour standard,while an area that experienced the samemeteorological conditions a year laterwould not. This arbitrariness isparticularly unfair because a violationcan occur at a particular time, notbecause of an inappropriate level ofemissions, but because of variations inweather and temperature.

Response: The 1994–1996 period waschosen because it was the most recent3-year period that existed at the time ofthis rule for which EPA and the Stateshad complete data. Attainment of theozone NAAQS is determined using 3consecutive years of data to account forvariations in meteorological conditions,as well as variations in volatile organiccompounds (VOC) and NOX emissions.The Ozone NAAQS is designed to take

into account such variations. Since EPAcannot control the weather, it mustcontrol levels of ozone in the breathableair by controlling the concentration ofNOX and VOC in the air. EPA’s goal isto ensure that everyone is breathinghealthy air, regardless of the weather.Later periods will be used in futureactions. For instance, on May 18, 1998,the Agency proposed that the 1-hourstandard would no longer apply in 6additional ozone areas based upon1995–1997 air quality data (63 FR27247).

Comment: The EPA is removing thestandard in some areas, not becausethere are no violations of the ozonestandard, but because there are no ozonemonitors to measure ozone. Thisdiscriminates against areas that havemore ozone monitors.

Response: The Agency has in placeprocedures to review all past monitoringand sources that contribute toviolations, thus enabling the Agency tolocate monitors in areas that are likelyto violate. The EPA believes that themonitoring network in place for the 1-hour ozone standard adequatelyrepresents the Nation’s air quality.Using past air quality monitoring andmodeling data, EPA has locatedmonitors in areas where violations ofthe 1-hour standard are likely to occurand has not located monitors in areaswhere the likelihood of violation is low.The design of the ozone network can befound in 40 CFR part 58.

Comment: The EPA is proposing torevoke the 1-hour standard in upwindareas, while leaving it in place indownwind areas, despite the fact that ithas been proven to be impossible fordownwind areas to attain the 1-hourstandard without additional emissioncontrols in upwind areas. The EPA hasfailed to enforce section 110(a)(2)(D)which requires that every State imposeemission controls sufficient to preventnegative impacts on downwind areas.

Response: The EPA is addressing thisissue in the Eastern United Statesthrough the NOX State implementationcall (SIP) call, which EPA has proposed(62 FR 60318, November 7, 1997). Theproposal would place uniform controlsfor NOX emissions in large geographicupwind areas that contain bothattainment and nonattainment areas.The controls would reduce NOX

emissions and, as a result, ozone levels.The EPA has also been petitioned,under section 126(b) of the Act, to placecontrols on upwind stationary sourcesof NOX emissions. More generally, itshould be noted that upwind sourcesare subject to section 110(a)(2)(D)regardless of whether the 1-hourstandard continues to apply to them.

Accordingly, a determination that the 1-hour standard does not apply to upwindareas does not preclude additionalreductions in the upwind areas.

Comment: The NOX SIP call will notbe in effect until, at the earliest, 2002;southwestern Pennsylvania willcontinue to suffer from the effects oftransported pollution for at least 5additional years. As a result, under themethodology that EPA has proposed, itis unlikely that the 1-hour standardcould be revoked for southwesternPennsylvania or other areas of thecountry that are affected by transportuntil well into the 21st century.

Response: The Agency acknowledgesthat some areas will remain innonattainment and subject to the 1-hourstandard. Under the Act, areas aredesignated nonattainment as long astheir air quality fails to meet theNAAQS, even if they are the victims oftransport from upwind areas that maybe designated attainment. The EPA iscontinuing this approach even when the1-hour standard ceases to apply forareas that are attaining, but EPA is notthereby creating any inequities.

Comment: Photochemical modelingconducted for southwesternPennsylvania and approved by EPAdemonstrated that even if all manmadeemissions in southwestern Pennsylvaniawere eliminated the Pittsburgh areawould still experience exceedances ofthe 1-hour standard.

Response: The EPA has completed apreliminary review of the submittedmodeling but has not issued any formalapproval or disapproval. The modelingfor Pittsburgh suggests that the area’s airquality is affected by transport, but thatmanmade emissions from the Pittsburgharea also contribute to the area’snonattainment problem.

Comment: The continuation of thestandard in southwestern Pennsylvaniameans that this region will be bumpedup to a serious nonattainmentdesignation and be subject to additionalcontrols during 1998.

Response: According to section181(b)(2), if a nonattainment area fails tomeet it attainment date, then thenonattainment area is subject to bump-up to the next higher classification. TheAgency is considering administrativemechanisms to soften the regulatoryburden that may be imposed on areasaffected by overwhelming transport.

Comment: It is impossible todetermine exactly how the rule willaffect any area or entity because EPAhas not stated what the implications ofthe rule will be. In other words, evenEPA does not yet know what theimplications of its rule are, so it isimpossible for it to certify that the rule


will not have a significant impact on asubstantial number of small entities.

Response: The Regulatory FlexibilityAct (RFA), 5 U.S.C. 601(a), provides thatwhenever an agency is required topublish a general notice of rulemaking,it must prepare and make available aRFA. An RFA is required only for smallentities that are directly regulated by therule (see Mid-Tex Electric Cooperative,Inc. v. FERC, 773 F.2d 327 (D.C. Cir.1985)). Determining that the 1-hourstandard ceases to apply does notsubject any entities to additionalrequirements. Accordingly, theAdministrator is justified in certifyingthat the rule will not have a significanteconomic impact on a substantialnumber of small entities.

Comment: This new regulation willarbitrarily and inappropriately harmsouthwestern Pennsylvania by imposinga stricter ozone standard in our regionthan in any other community within200 miles and by forcing southwesternPennsylvania businesses tounnecessarily suffer higher regulatorycosts than businesses in areas to oursouth and west. The rule will havepotentially serious negative impacts onboth air quality and economicdevelopment in our region.

Response: The Agency acknowledgesthat some areas will remain innonattainment and subject to the 1-hourstandard regardless of the determinationthat the 1-hour standard ceases to applyelsewhere. Under the Act, areas aredesignated nonattainment as long astheir air quality fails to meet theNAAQS. The goal of the Act, and thegoal of EPA in implementing it, is toensure that everyone is breathinghealthy air. The Agency is examiningadministrative ways of reducing theregulatory burden that may be imposedon areas affected by overwhelmingtransport. It should also be noted thatsouthwestern Pennsylvania wouldremain subject to controls under section184 as part of the Ozone TransportRegion (OTR) even if the 1-hourstandard ceased to apply for the area.

Comment: The commenter believesthat the 1994–1996 data set used forpurposes of revoking the 1-hour NAAQSis appropriate because the revisions tothe NAAQS occurred in July 1997, andall moderate and lower classified areasshould have recorded no violations forthe 1994–1996 timeframe. Thus, thecommenter urges EPA not to revoke the1-hour NAAQS based on a data set thatincludes 1997.

Response: The EPA intends todetermine that the 1-hour standardceases to apply for areas that attain the1-hour NAAQS on an annual basis in aneffort to transition from the 1-hour

standard to the new 8-hour standard.Consequently, on May 18, 1998, EPApublished a proposal to determine thatthe 1-hour NAAQS no longer applies toa number of areas based on complete,quality-assured air monitoring data forthe timeframe 1995–1997 (63 FR 27247).Subsequently, such determinations willbe based on the most recent 3 years ofcomplete, quality-assured monitoringdata, i.e., 1999 determinations will bebased on 1996–1998 monitoring data,etc. The commenters’ rationale forlimiting determinations to 1994–1996monitoring data is unclear given thepurpose of this and similar subsequentactions in transitioning to the new 8-hour ozone standard.

Comment: The EPA has failed toconsider data collected from earlierperiods which is ‘‘most recent’’ for someareas. During 1991, data which werecollected as part of the Lake MichiganOzone Study support maintainingapplicability of the 1-hour standard forseveral counties in Michigan, namelyBenzie, Delta and Oceana. Thecommenter provides 1991 data fromthese three counties: Benzie County—3exceedances in 1991; Delta County—2exceedances in 1991; and OceanaCounty—4 exceedances in 1991.

Response: The EPA is making thesedeterminations based on areas havingair quality meeting the 1-hour standard.The 1994–96 average expectedexceedance in Benzie County was 0.3with 3 years of complete data.Therefore, Benzie County is clearlymeasuring attainment and for thisreason, EPA is determining that the 1-hour standard no longer applies.

Delta County had 2 exceedances in1991 and no data at that monitor since.Since the monitor recorded less than 3.2total number of estimated exceedancesover a 3 year period, there is noviolation. Furthermore, another monitorin the county had 2 years of data in1992 and 1993 with no exceedances.Therefore, the 1-hour standard no longerapplies to Delta County.

Oceana County had 4 exceedances ofthe 1-hour ozone standard in 1991 andhas collected no data since. This was aclear violation of the 1-hour standard. Inaddition, the two monitors immediatelyto the south and north of OceanaCounty—Muskegon County and MasonCounty, respectively, currently monitorviolations of the 1-hour standard. Forthese reasons, EPA believes that there isa strong likelihood that the air qualityin Oceana County continues to violatethe one-hour standard. Thus, the 1-hourstandard will still apply in OceanaCounty.

Comment: The commenter states thatair quality data alone are insufficient to

determine attainment since Congressmandated redesignation requirements insection 107(d)(3)(E) of the Act. It isimperative that areas designatednonattainment meet these requirementsbefore revocation of the 1-hour NAAQS,including an attainment demonstrationwith fully implemented rules andsection 110(k)(5) issues addressed.

Response: The criteria used toredesignate areas from nonattainment toattainment mandated by Congress are insection 107(d)(3)(E) of the Act. The firstcriteria is to demonstrate attainment ofthe NAAQS. For ozone, ambient airquality data have been used exclusivelyto demonstrate actual attainment of theozone standard to meet the first criteriafor redesignation. The otherredesignation requirements of section107(d)(3)(E) are to ensure that themeasures that contributed to attainmentof the NAAQS remain in place, that alevel of emissions is established thatwould ensure continued maintenance ofthe NAAQS, and that a contingencyplan is in place in the event the NAAQSis violated in the future. Adetermination that the 1-hour standardno longer applies is intended, in part, tobe a process to transition to the newlypromulgated 8-hour ozone standard forwhich EPA will designate areas in 2000.Thus, requiring areas to satisfy the otherredesignation requirements in light of anew standard is not practical since theirpurpose is to continue maintenance ofthe 1-hour standard.

Comment: Any areas covered byEPA’s NOX SIP call need to take actionto mitigate interstate transport of ozone.Consequently, the commenter urgesEPA to withdraw dropping the 1-hourNAAQS in these States. Furthermore,EPA should withdraw dropping the 1-hour NAAQS in States that have beenshown to contribute to ozone transportsuch as Texas, Louisiana, and Arkansas.

Response: The EPA believes it is nota question as to whether or not the 1-hour standard applies, but that areassignificantly contributing to transportmust take action to mitigate such effects.The EPA proposed to apply the NOX SIPcall (62 FR 60318, November 7, 1997) tothe appropriate States regardless ofdesignations with respect to the 1-hourstandard within these States. The SIPcall is based on one of the generalprovisions of the Act, section110(a)(2)(D)(I), which requires that a SIPbe designed so that emissions from aState do not contribute significantly tononattainment or interfere withmaintenance of any primary orsecondary NAAQS. Therefore, whetheror not to continue the 1-hour standardin these States will have no effect on theimpact of the NOX SIP call. Determining


that the 1-hour NAAQS does not applyfor a State subject to the proposed NOX

SIP call has no effect on that State’sresponsibility to respond to the SIP call.The November 7, 1997, proposalindicates that the NOX reductions willreduce ozone transport and,consequently, contribute towardattainment of the 1- and 8-hourstandards. It should also be noted thatin the proposed NOX SIP call, EPAproposed to determine that Louisiana,Arkansas and Texas do not contributesignificantly to nonattainment ormaintenance problems downwind.

Comment: The commenter objects tothe EPA’s proposal to revoke the 1-hourNAAQS in portions of the ConsolidatedMetropolitan Statistical Areas (CMSAs)of Evansville-Henderson, Indiana-Kentucky, Grand Rapids-Muskegon-Holland, Michigan, and Longview,Texas. Since EPA has determined thatthe 1-hour NAAQS remains applicablein other portions of these CMSAs(Warrick, Indiana; Muskegon, Michigan;and Gregg, Texas), the NAAQS shouldremain applicable to the entire CMSA.The CMSAs are identified as follows:Posey, Warrick, Henderson andVanderburgh Counties in the Evansville-Henderson, Indiana-Kentucky CMSA;Ottawa, Muskegon, Kent and AlleganCounties in the Grand Rapids-Muskegon-Holland, Michigan CMSA;and Gregg, Harrison and Upshur Countyin the Longview, Texas CMSA.

Response: The geographic boundariesof the area for which the 1-hourstandard no longer applies is basedupon the established nonattainment/attainment area boundaries. DefaultCMSA boundaries are not mandatory formoderate and lower-classified areas forSIP planning purposes, but instead arediscretionary and based upon manyfactors. With respect to the Evansville-Henderson, Indiana-Kentucky area, atthe time of the 1991 designations, theEPA agreed with the State of Indiana tolimit the nonattainment area toVanderburgh County due to the lack ofvalid ambient monitoring data showingviolations of the 1-hour standard.

The EPA is not determining that the1-hour standard no longer applies forthe Grand Rapids-Muskegon-Hollandarea in today’s action. Furthermore,when the current designations werepromulgated in 1991, the EPA basedthem on the most recent MSA-CMSAinformation available from the CensusBureau at that time. As a result, theGrand Rapids area, Muskegon area andAllegan County (Holland) weredesignated as separate areas. Morerecent census information merges thesethree areas into one. However, EPAbelieves that it is neither appropriate

nor necessary to change its treatment ofthese areas at this time. Nonattainmentarea boundaries may be redefined withdesignations based on the new 8-hourozone NAAQS. Therefore, when GrandRapids (Kent and Ottawa Counties),Muskegon County or Allegan Countyhave air quality meeting the 1-hourozone NAAQS, then they will qualifyseparately for a determination that the1-hour standard no longer applies.

The Tyler/Longview area presents aunique situation to the Agency.Although the Gregg County ozonemonitor recorded a violation of theozone standard in 1995, EPA did nottake action to designate the areanonattainment. Instead, a FlexibleAttainment Region Memorandum ofAgreement (MOA) was developed forfive counties in the Tyler/Longviewarea. This MOA requires that additionalozone control strategies be put in placeto reduce ambient ozone levels. Theonly ozone monitor present in thisregion operates in Gregg County. Sincethe Tyler/Longview CMSA isconsidered to be in attainment withrespect to the 1-hour ozone standard,the 1-hour ozone standard will onlyapply to the county with the monitoredviolation. However, even thoughUpshur, Harrison, Smith and RuskCounties are no longer required to meetthe 1-hour standard under thisapproach, these counties must continueto meet the ozone control strategyoutlined in the MOA.

Comment: The commenter is troubledby EPA’s labeling of areas as attainmentfor the 1-hour standard where the 1-hour standard is still applicable.Instead, areas such as Grand Rapids-Muskegon-Holland and Detroit-AnnArbor should be bumped-up to serious.LaPorte, Indiana should be included inthe Chicago-Gary nonattainment areaand designated severe-17.

Response: Again, the purpose oftoday’s notice is not to designate,reclassify or bump-up areas for the 1-hour standard but to transition into thenew 8-hour NAAQS by determining thenonapplicability of the 1-hour NAAQSin areas that have air quality meetingthe 1-hour standard in recent years. TheDetroit-Ann Arbor area (Livingston,Macomb, Monroe, Oakland, St. Clair,Washtenaw, and Wayne Counties) andthe Grand Rapids area (Kent and OttawaCounties) satisfied the section107(d)(3)(E) requirements and wereredesignated to attainment by noticesdated March 7, 1995 and June 21, 1996,respectively. One of the redesignationrequirements is that the areademonstrate attainment of the 1-hourstandard. Furthermore, as previouslydiscussed, the Grand Rapids area

consists of Kent and Ottawa Countiesand does not include Muskegon andAllegan Counties. Moreover based on1995–1997 data showing attainment ofthe 1-hour standard, EPA has proposeda determination that the 1-hour standardshould no longer apply to the GrandRapids and Detroit areas (63 FR 27247,May 18, 1998). Finally, LaPorte,Indiana, was not designated with theoriginal 1991 designations since it didnot have data showing a violation of the1-hour standard and the area was and isnot part of the Chicago CMSA.

Comment: The commenters requestedthat eastern Kern County be included inthe list of areas attaining the 1-hourozone standard and to which the 1-hourstandard is no longer applicable. Theycontend that, in 1991, EPA erroneouslyincluded eastern Kern County in theSan Joaquin Valley seriousnonattainment area when it should havebeen excluded as a rural portion of theMetropolitan Statistical Area (MSA);that eastern Kern County is now underthe jurisdiction of the Kern County AirPollution Control District while westernKern County and the rest of the SanJoaquin Valley nonattainment area isunder the jurisdiction of the SanJoaquin Valley Unified Air PollutionControl District; and that ambient airquality monitoring data show thateastern Kern County meets the 1-hourozone standard.

Response: This comment involves twoissues: a change to the nonattainmentarea boundary originally established in1991, and a finding that eastern KernCounty is not violating the 1-hour ozonestandard. Both issues are outside thescope of this rulemaking.

Furthermore, with respect to thequestion of whether or not eastern KernCounty is violating the 1-hour ozonestandard, there are monitoring dataindicating that eastern Kern County is infact violating the 1-hour ozone standard.In EPA’s review of AerometricInformation Retrieval System data, wefound that two exceedances of the 1-hour standard were registered at theTehachapi monitoring station whichoperated only during 1995. Theseexceedances indicate that eastern KernCounty is in violation of the 1-hourstandard. The California Air ResourcesBoard, in a March 9, 1998 letter to theDepartment of the Navy, confirmed thatthese ‘‘exceedances indicate that[eastern Kern County] has notdemonstrated compliance with the one-hour ozone standard.’’

Comment: The commenters urgedEPA to revise its proposal so that the 1-hour standard either is retained for theentire Nation or revoked in alldesignated attainment and maintenance


areas. They believe that EPA’s proposalleads to unfair treatment of the SanFrancisco Bay Area, a maintenance areathat is currently proposed forredesignation to nonattainment of the 1-hour ozone standard. They contend thatthe EPA incorrectly interpreted thePresident’s ‘‘Implementation Plan forRevised Air Quality Standards’’ (Plan)with regard to identification of areas towhich the 1-hour ozone standard willcease to apply. They believe that thePresident directed EPA to revoke theone-hour standard for all existingmaintenance areas and nonattainmentareas that have attained the standard,emphasizing that the revocation shouldapply, regardless of current air quality,if at some point in the past EPAdetermined the area to be attaining andredesignated the area to attainment.They interpret the Plan’s requirementthat areas be ‘‘not violating’’ or‘‘meeting’’ the standard (in the presenttense) as referring only to designatednonattainment areas.

Response: The EPA is following theclear language of 40 CFR 50.9(b), whichprovides that the 1-hour standard nolonger applies ‘‘once EPA determinesthat the area has air quality meeting the1-hour standard.’’ This language clearlystates that an area is to have air qualitymeeting the standard at the time of thedetermination. Second, EPA disagreesthat the memorandum called for EPA todetermine the nonapplicability of the 1-hour ozone standard for all areascurrently designated as maintenance orattainment areas. The Memorandumclearly indicates that current air qualityshould be the basis of EPA’sdetermination in all areas, not justdesignated nonattainment areas. Theintroductory paragraph of the section inthe Memorandum labeled ‘‘Phase-out of1-hour standard’’ states that ‘‘the 1-hourstandard will continue to apply to areasnot attaining it’’ (62 FR 38424). The useof the term ‘‘attaining’’ refers to anarea’s air quality relative to the standardand not to an area’s current designationunder the Act section 107. This isclarified later when the Memorandumstates that ‘‘for areas where the airquality does not currently attain the 1-hour standard, the 1-hour standard willcontinue in effect’’ (62 FR 38424). TheEPA’s action to determine thenonapplicability of the 1-hour standardonly in areas whose air quality showsthat they are not currently violating thestandard is consistent with theMemorandum and follows the languageof 40 CFR 50.9(b), which EPA must do.Because the San Francisco Bay Areamonitoring data show that the area iscurrently violating the 1-hour ozone

standard, it is not eligible to be includedin the list of areas to which the 1-hourstandard no longer applies.

Comment: Retention of the 1-hourstandard in maintenance and attainmentareas will not promote early attainmentof the new 8-hour standard.

Response: The Agency is retaining the1-hour NAAQS for the San FranciscoBay Area, not because it may facilitateattainment of the 8-hour NAAQS, butbecause the area is currently violatingthe 1-hour NAAQS. The Agencybelieves that progress toward meetingthe 1-hour NAAQS will contribute toattainment of the 8-hour NAAQS priorto the due date of the SIP for the 8-hourNAAQS. The decision to retain the 1-hour standard was explained when theAgency promulgated the ozone NAAQSon July 18, 1997 and issued guidance forimplementing the 1-hour ozone and pre-existing particulate matter (PM–10)NAAQS on December 29, 1997.

Comment: A number of commenters,contend that EPA does not have thelegal authority to determine that the 1-hour ozone NAAQS no longer applies toan area without satisfying therequirements of section 107(d)(3)(E) forredesignation to attainment, includingthe requirement of an approvedmaintenance plan under section 175A.The commenters further contend thateven if EPA had the legal authority toremove the nonattainment designationof areas as it has proposed, its actionwould be unlawful since it is arbitraryand capricious, an abuse of discretionand is procedurally flawed.

Response: The EPA’s authority forthis action is based on the regulatoryprovisions adopted when itpromulgated the 8-hour ozone NAAQSin July 1997 (62 FR 38856 (July 18,1997)). Those regulations, in 40 CFR50.9(b), provide that the ‘‘1-hourstandard set forth in this section will nolonger apply to an area once EPAdetermines that the area has air qualitymeeting the 1-hour standard.’’ Thoseregulations specify a single criterion forthe revocation of the standard—thedetermination by EPA that an area hasair quality meeting the 1-hour standard.The EPA believes that is the onlycriterion that may be applied in thisrulemaking, and that it has beensatisfied in the case of all the areascovered by this action. This view ismade clear by the memorandum fromPresident Clinton to the Administratoroutlining a strategy for implementingthe revised PM and ozone NAAQS thatwas published on the same day as therevised NAAQS (62 FR 38421 (July 18,1997)). That memorandum stated that‘‘to streamline the process and minimizethe burden on existing nonattainment

areas, the 1-hour standard will cease toapply to an area upon a determinationby the EPA that an area has attained airquality that meets the 1-hour standard.In light of the implementation of thenew 8-hour standard, which is morestringent than the existing 1-hourstandard, States will not have to preparemaintenance plans for those areas thatattain the 1-hour standard’’ (62 FR38424 (July 18, 1997)). Thus, it wasabundantly clear when EPApromulgated the regulation, on whichtoday’s action is based, that it would notbe requiring maintenance plans as aprerequisite to its determination that the1-hour standard no longer applies. Inessence, the commenters’ complaint,properly viewed, is not with the actionbeing taken at this time, but with theregulatory provision on which thisaction is based. That regulation waspromulgated in July 1997, however, andthe commenters’ attempt to raise theseissues at this point is simply too late.Moreover, EPA is not bound to followthe provisions of section 107(d)(3)(E)when a NAAQS has been revised andthe NAAQS on which a nonattainmentdesignation was based has beenreplaced by a new NAAQS, whoseimplementation will supersede theimplementation of the old NAAQS. Asfor the fact that certain areas will stillbe subject to conformity, while otherswill not, that is simply a consequenceof the conformity provisions of thestatute, which make it applicable onlyto areas that are designatednonattainment or that have maintenanceplans approved under section 175A.Such a result is not arbitrary orcapricious nor an abuse of discretion.Any areas that do violate the new ozoneNAAQS will be designatednonattainment for that NAAQS andsubjected to conformity requirements atthat time.

Similarly, the commenters’ contentionthat this action is procedurally flawedbecause it does not conform to aproposed policy published in theFederal Register in December 1996 iserroneous. The rule finalized in thisaction is being taken pursuant to 40 CFR50.9(b), which was promulgated afterthe proposed policy referred to by thecommenters was published. Thatproposed policy was not the proposalon which this final action is based, andthe reason it is not being followed herewas evident in the proposal that didunderlie this action—the existence of 40CFR 50.9(b).

Comment: The commentersquestioned the Agency’s authority andthe basis for retaining the 1-hourstandard. They oppose the imposition oftwo ozone standards.


Response: These issues were dealtwith in the final promulgation of theozone NAAQS (62 FR 38856) on July 18,1997. Specifically, EPA discussed itsbasis for retaining the one-hour standardat (62 FR 38885). Consequently, thecommenters’ attempt to raise theseissues in this rulemaking, which simplycarries out the provisions of 40 CFR50.9(b), is too late.

Comment: The commenters questionwhether the Act provides EPA theauthority to reclassify areas from‘‘nonattainment’’ to ‘‘not applicable’’when section 107(d)(1) of the Act onlyprovides for designations of‘‘nonattainment,’’ ‘‘attainment,’’ and‘‘unclassifiable.’’

Response: The Agency is not alteringdesignations, per se, rather the Agencyis determining the nonapplicability ofthe 1-hour standard in areas attainingthe 1-hour NAAQS and is applying theterm ‘‘Not Applicable’’ to so indicate.

II. Discovered Errors in 40 CFR Part 81Ozone Table

AlabamaThe EPA recognized that the county

of ‘‘Cherokee’’ was inadvertentlyomitted from the January 16, 1998document. Therefore, part 81 for ozonehas been amended to reflect thiscorrection.

AlaskaThe EPA recognized that the

Boroughs of ‘‘Denali’’ and ‘‘Lake andPeninsula’’ were inadvertently omittedfrom the January 16, 1998 document,under AQCR 9 and AQCR 10,respectively. Therefore, part 81 forozone has been amended to reflect thesecorrections.

CaliforniaThe EPA recognized that the county

of ‘‘Santa Clara’’ was incorrectly spelledas ‘‘San Clara’’ in the January 16, 1998document. In addition, the descriptionfor Sonoma County (part) wasinadvertedly omitted and has beenadded. Therefore, part 81 for ozone hasbeen amended to reflect thesecorrections.

MississippiThe EPA recognized that the county

of ‘‘De Soto’’ was incorrectly spelled as‘‘DeSota’’ in the January 16, 1998document. Therefore, part 81 for ozonehas been amended to reflect thiscorrection.

Puerto RicoThe EPA recognized that four

municipios in Puerto Rico listed in theJanuary 16, 1998 document wereincorrectly spelled. Specifically, ‘‘Caba

Rojo Municipio’’ should be corrected toread ‘‘Cabo Rojo Municipio’’; ‘‘CoamaMunicipio’’ should be corrected to read‘‘Coamo Municipio’’; ‘‘ComeriaMunicipio’’ should be corrected to read‘‘Comerio Municipio’’; ‘‘Trujilla AltoMunicipio’’ should be corrected to read‘‘Trujillo Alto Municipio.’’ Therefore,part 81 for ozone has been amended toreflect these corrections.

South CarolinaThe EPA recognized that two of the

South Carolina counties listed in theJanuary 16, 1998 document wereincorrectly spelled. Specifically,‘‘Manon County’’ should be corrected toread ‘‘Marion County’’ and that ‘‘SalodaCounty’’ be corrected to read ‘‘SaludaCounty.’’ Therefore, part 81 for ozonehas been amended to reflect thesecorrections.

III. Final Rulemaking ActionThe ozone tables codified in today’s

action are significantly different fromthe ozone tables now included in 40CFR part 81. The current 40 CFR part 81designation listings (revised as ofNovember 6, 1991) include, by State andNAAQS pollutant, a brief description ofareas within the State and theirrespective designation. Today’s actionincludes completely new tables forozone which indicate areas where the 1-hour standard no longer applies, as wellas where the 1-hour standard remains ineffect. Also, the ozone tables codifiedtoday include the corrections from theproposed rulemaking noted above insection II. Discovered Errors in 40 CFRpart 81 Ozone Table.

IV. Other Regulatory Requirements

A. Executive Order 12866The Office of Management and Budget

has exempted this regulatory actionfrom Executive Order 12866 review.

B. Rule Effective DateThe EPA finds that there is good

cause for this action to become effectiveimmediately upon publication because adelayed effective date is unnecessarydue to the nature of this action, whichis a determination that the 1-hour ozonestandard no longer applies. Theimmediate effective date for this actionis authorized under both 5 U.S.C. 553(d)(1), which provides that rulemakingactions may become effective less than30 days after publication if the rule‘‘grants or recognizes an exemption orrelieves a restriction’’ and section553(d)(3), which allows an effective dateless than 30 days after publication ‘‘asotherwise provided by the agency forgood cause found and published withthe rule.’’

C. Regulatory Flexibility Act

Under the Regulatory Flexibility Act,5 U.S.C. 601 et seq., EPA must preparea regulatory flexibility analysisassessing the impact of any proposed orfinal rule on small entities (5 U.S.C. 603and 604), unless EPA certifies that therule will not have a significant impacton a substantial number of smallentities. Small entities include smallbusinesses, small not-for-profitenterprises, and government entitieswith jurisdiction over populations ofless than 50,000. The EPA is certifyingthat this rule will not have a significantimpact on a substantial number of smallentities, because the determination thatthe 1-hour standard ceases to apply doesnot subject any entities to anyadditional requirements.

D. Unfunded Mandates

Under section 202 of the UnfundedMandates Reform Act of 1995 (UMRA),EPA must prepare a budgetary impactstatement to accompany any proposedor final rule that includes a Federalmandate that may result in estimatedcosts to State, local, or tribalgovernments in the aggregate; or toprivate sector, of $100 million or more.Under section 205, EPA must select themost cost effective and leastburdensome alternative that achievesthe objectives of the rule and isconsistent with statutory requirements.Section 203 requires EPA to establish aplan for informing and advising anysmall governments that may besignificantly or uniquely impacted bythe rule.

The EPA has determined that today’sapproval action, as promulgated, wouldnot include a Federal mandate that mayresult in estimated costs of $100 millionor more to either State, local, or tribalgovernments in the aggregate or to theprivate sector. This Federal actionimposes no new requirements.Accordingly, no additional costs toState, local, or tribal governments, or tothe private sector, result from thisaction.

E. Submission to Congress and theGeneral Accounting Office

Under 5 U.S.C. 801(a)(1)(A), as addedby the Small Business Regulatoryenforcement Fairness Act of 1996, EPAsubmitted a report containing this ruleand other required information to theU.S. Senate, the U.S. House ofRepresentatives and the ComptrollerGeneral of the General AccountingOffice prior to publication of the rule intoday’s Federal Register. This rule isnot a ‘‘major rule’’ as defined by 5U.S.C. 804(2).


F. Petitions for Judicial Review

Under section 307(b)(1) of the CAA,petitions for judicial review of thisaction must be filed in the United StatesCourt of Appeals for the appropriatecircuit by August 4, 1998. Filing apetition for reconsideration by theAdministrator of this final rule does notaffect the finality of this rule for thepurposes of judicial review nor does itextend the time within which a petitionfor judicial review may be filed, andshall not postpone the effectiveness ofsuch rule or action. This action may notbe challenged later in preceedings toenforce its requirements (see section307(b)(2)).

G. Applicability of Executive Order(E.O.) 13045

On April 21, 1997, the Presidentsigned an Executive Order (13045)entitled ‘‘Protection of Children fromEnvironmental Health Risks and SafetyRisks.’’ This is the primary directive toFederal agencies and departments thatFederal health and safety standards nowmust include an evaluation of the healthor safety effects of the plannedregulation on children. For rules subjectto the Executive Order, agencies arefurther required to issue an explanationas to why the planned regulation ispreferable to other potentially effectiveand reasonable feasible alternativesconsidered by the Agency.

This final rule is not subject to E.O.13045, entitled ‘‘Protection of Childrenfrom Environmental Health Risks and

Safety Risks’’ (62 FR 19885, April 23,1997), because this is not aneconomically significant regulatoryaction as defined by E.O. 12866, and itdoes not involve decisions onenvironmental health risks or safetyrisks that may disproportionately affectchildren.
