Background: OSCE in the context of the ACRWC

Article27oftheCharterspecificallyaddresseschild

sexualexploitation.ItstatesthatStatesParties“shall

undertaketoprotectthechildfromallformsofsexual

exploitationandsexualabuseandshallinparticular

takemeasurestoprevent:

(a)theinducement,coercionorencouragementof

achildtoengageinanysexualactivity;

(b)theuseofchildreninprostitutionorothersexual

practices;

(c)theuseofchildreninpornographicactivities,

performancesandmaterials.”

AtthetimewhentheCharterwasdrafted,

thephenomenonofOnlinechildsexualexploitation

(OCSE)waslargelyunknownandhenceguidance

toStatePartiesandtotheCommitteeonthistopic

islimited.OCSEencompassesseveraldistinctbut

relatedmanifestations,includingchildsexualabuse

materials,live

streamingofsexualabuse,sexting,onlinegrooming

ofchildrenforsexualpurposesandsexualextortion.

Ittakesever-evolvingformswitheachadvance

inthequalityandspreadofinternetconnectivity.

Policymakerstypicallyhavealimitedawarenessand

understandingoftheseformsofcriminality.

Duetoalackofreportingsystemstheextent

ofOCSEinAfricaislargelyunknown.However

expertsbelievethatasnewtechnologyandinternet

connectivityisrapidlydevelopinginAfrica,soisOCSE.

AlegalreviewconductedbyECPATInternationalin

nineAfricancountries,revealedseriouslimitations

inlegislativeframeworksandinlawenforcement

infrastructuretoidentifyandrespondtoOCSE.The

combinationofrapidlyincreasingconnectivity,limited

regulation,littleawareness,andpovertytogetherhold

thepotentialforanexplosivegrowthinOCSEandthus

athreattothechildreninthisContinent.Atthesame

time,successesthathavebeenachievedinfighting

OCSEinsomeotherregionsmightinducefacilitators

andperpetratorstoshifttoregionssuchasAfricaif

theyknowthatthereislessriskofdetection,arrest,

andpunishment.

AlegalreviewconductedbyECPAT

InternationalinnineAfricancountries,revealedserious

limitationsinlegislativeframeworksandinlaw

enforcementinfrastructuretoidentifyandrespond

toOCSE.Thecombinationofrapidlyincreasing

connectivity,limitedregulation,littleawareness,and

povertytogetherholdthepotentialforanexplosive

growthinOCSEandthusathreattothechildrenin

thisContinent.Atthesametime,successesthathave

beenachievedinfightingOCSEinsomeotherregions

mightinducefacilitatorsandperpetratorstoshiftto

regionssuchasAfricaiftheyknowthatthereisless

riskofdetection,arrest,andpunishment.

Howeverthereareeffortstotacklethevicein

theContinent.OCSEwasoneoftheissuesincluded

inthefirstAfricanForumonCybercrimethatwas

organizedbytheAfricanUnionCommissioninOctober

2018.

Furthertothis,sixAfricancountrieshave

signedtheWePROTECTGlobalAllianceStatement

ofAction.TheAU’sConventiononPersonalData

ProtectionandCybersecurity(MalaboConvention)has

beensignedalsobyelevencountries.TheInternational

TelecommunicationsUnion,someAfricanregulators,

Facebook,UNICEF(inMadagascar,Namibia,Uganda,

Kenya,andAlgeria),ECPAT,andtheInternetWatch

Foundationhaveongoinginitiativesrelatedto

addressingOCSEinAfrica.

Inordertoacceleratetheongoingeffortsin

addressingOCSEinAfrica,AfricanUnionCommission

throughtheDepartmentofSocialAffairsin2018,

commencedatwo-yearprojectthataimsto:build

evidenceandunderstandingofOCSEinAUMember

States;developcapacitiestoaddressthesituation;

andmobilisepoliticalcommitmentstowardsaction.

CommonwealthFund,whichaimsatstrengthening

OCSEinAfrica.

Aspartofthisproject,theACERWCintends

tohaveaDayofGeneralDiscussion(DGD)duringits

33rdSessioninMarch2019onCombattingOCSEin

Africa.TheDGDisaforumthatwillbringtogether

relevantofficialsfromMemberStates,UNagencies,

experts,academicinstitutionsandcivilsociety

organisationstodeepenunderstandingonvarious

issuesrelatingtoOCSE

TheDayofGeneralDiscussionwillsupport

theProjectthatAUCanditspartnershavestarted

onstrengtheningregionalandnationalstrategies

againstOCSE.FollowingthisDiscussion,theACERWC

willdiscussandconsidervariousoptionswithin

itsmandatebywhichitcanstrengthenitsrole,

giveopinionandprovideguidancetoStateParties

andotherStakeholdersonEndingChildSexual

Exploitation.Thismayincludebutwillnotbelimited

toaDeclarationonEndingOnlineChildSexual

ExploitationinAfrica.

Objective of the Day of the General Discussion

TheobjectivesoftheDiscussionare:

- Todeepentheunderstandingofthe

ACERWC,theAUCandAUMemberStatesonOnline

ChildSexualExploitation;

- ToidentifygapsininformationonOCSEin

Africaandstrategiestoaddressthem;

- ToassessthecurrentsituationofOCSEin

Africaasitrelatestotherightsandwelfareofchildren

asdefinedintheACRWC;

- Toprovideaplatformfordialogueamongst

participantsandtheexchangeofknowledge,good

practicesandexperiencesrelatedtoOCSE;

- Toprovidesubstantiveinformationthat

willfacilitatetheCommittee’sdialoguewithand

recommendationstoStatespartiesonissuesrelated

toOCSE;and

- ToprovideguidancetoStatePartiesonhow

toprotectchildrenfromonlinechildsexualexploitation

throughpolicies,legislation,lawenforcementand

programmes.

EXPECTED OUTCOMES FollowingthisDiscussion,theACERWCwilldiscuss

andconsidervariousoptionswithinitsmandateby

whichitcanstrengthenitsrole,giveopinionandpro-

videguidancetoStatePartiesandotherStakeholders

onEndingChildSexualExploitation.Thismayinclude

butwillnotbelimitedtoaDeclarationonEnding

OnlineChildSexualExploitationinAfrica.
