Aloys Ntabakuzewas arrested n Kigali by Rwandanauthoritieson chargesof "genocidedenial".On 3l May 2010, ollowing that arrestandprior to Aloys Ntabakuze'smotion to order heRegistrar to take immediate action to secure he releaseof Peter Erlinder, the Registraraddressed Note Verbaler to the Rwandan Ministry of Foreign Affairs and Cooperationrequestingclarification on the motives of Mr. Erlinder's arrest. In the Note Verbale, theRegistrar nquiredwhether herewas a possible ink betweenhe arrestof Mr. Erlinderand hemandate onferredon him as a DefenceCounselat the ICTR. The Note Verbale also recalledthatprivileges nd mmunities pply o ICTR DefenceCounseln the contextof their mandatewith theTribunal.In a conespondenceated2June2010 addressedo the Registrar, heProsecutorGeneralof theRepublic of Rwanda,Mr. Martin Ngoga, respondedo the Note Verbale indicating hat thearrestof Mr. Erlinder"is not at all related o his assignmentst the ICTR".2

8. Uponreviewof that decision, n 9 June2010, he Registrar entanotherNoteVerbalestoheRwandanMinistry of Foreign Affairs and Cooperationequesting he Rwandanauthorities oprovidehim with a formal copy of the chargesevelledagainstMr. Erlinder.

9. It is following the delivery of that Note Verbale that the Registry received the AppealsChamber'sdecision instructing the same diligence.This instruction has been immediatelytransmittedo the Rwandanauthoritiesvia a third Note Verbale6,along with copies of theAppealChamber's ecision.

10.The Registrars awaitinga responserom the Rwandan uthorities s well as he formal copyofthe charges roughtagainstMr. Erlinder.The Registrarwill report o the AppealsChamber, ssoonaspossible,he outcomeof his follow-up regarding hismatter.
