IntroductionIt has been a long journey for (tax) travelersavoiding the hazards of direct and indirecttaxes,slipperysocialsecuritycontributions,andregistrationandsuccessionsdutiesbeforetheyfinallyreachtheir(tax)havenor(tax)heaven.Manywere lost in the battle, crushed by themultiple and repeated military operations ofthe combined tax administrations – oftengathered in regional or even internationalcoalitions.Mostneverevenengagedintheconfrontation,unarmed and unprepared for an unbalancedconflict between law-weaponized taxadministrations, with prolific legislatorswatching their back, possessing the mostpotent deterrent armament of all times: TAXKNOWLEDGE.Nowletusleavethismadworldoftaxclashes,with greedy and suspicious officialspreoccupied with their own wages andpensions,andcomebacktoourDREAM.Whenonedreamsofataxhaven(ifnotataxheaven),oneconsiderschangingone’sdomicileorseatoffortune.Intheabsenceofbeingabletoreachsuchadesirablestate,onemightfeeldoomed to suffocate in a burning hell ofconfiscatorytaxes.This short, brain-teasing – and hopefullyenlightening–articlebasicallyaimstopresentamiddle-way desirable position through a 4-stepsmethod:the4Ws.Howcanoneavoidthetwoextremes:illusorytax-freehavensandenslaving,unjustlygreedyWesternstatesandtheirtaxcollectors?

Who bears the costs/What are thedeductiblecosts?Askingeachofthese4questionsrevealsrealmsof tax opportunities to get us closer to thesurprisinggoaloflovingtopayourtaxes!Let us consider this original method as arepertory, an entire range of skills andaptitudes used in a particular field : Tax (&SocialSecurity)optimization.These4questionswillstructuretheapproachof any taxpayer who may or may not haveaccesstotwo,threeorallfourtaxoptimizationopportunities, as maybe only one would beaccessible or feasible. One question and itsanswermayalreadytriggersubstantialtax(andsocialsecurity)savingsbutthemodelunleashes

Considérons cette méthode originale comme unrépertoire, une gamme de compétences etd’aptitudes utilisées dans un domaine particulier :l'Optimisationdestaxes(etdelasécuritésociale).

Ces 4 questions vont structurer l’approche de toutassujettifiscal,qu’ilaitaccèsàuneseule,deux,troisouaux quatre univers d’optimisations. Un seul domainepeut en règle générer des économies considérables(d’impôts et de cotisations de sécurité sociale) maisl’abondancedumodèle,etdoncdelaméthode,dévoileson plein potentiel en croisant et en articulant les

itspotentialandgreatnesswhencrossingandarticulatingtheanswersto2ormoreofthe4questionsorsteps.The4Wsmayeitherbeconsideredfromtoptobottom(1to4)–fromthemoreabstracttothemoreconcreterealityofthetaxpayer–ortheotherwayround(4to1), takingoff fromtherunwayofprofessionalcostsandascendingtotheopenblueskiesofinternationaltaxation.In this article we have opted for a practical“take-off”approach(startingwithQuestion4,then – for ease of exposition – Question 3followedbyQuestion2,beforeconcludingwithQuestion 1), as we consider a “catch-all”concrete example covering all four taxoptimizationopportunities.

QUESTION4:Whobearsthecosts(thecompanyortheindividual)?A similar question – “What are the costs?” –draws our attention to the key principle thattaxpayers,whether legalentitiesor flesh-and-bloodhumanbeings,areonly taxableonNETincomes.TheBelgian IncomeTaxCode (ITC–Article6)statesitclearly:“ThetaxableincomeconsistsofthesumofallNetIncomeslessdeductibleexpenses.TheTotalNetIncomeisequaltothesumofthefollowingfournetincomecategories:1.incomefromimmovableproperty;2.incomefrommovablecapitalandproperty;3.professionalincome;4.miscellaneousincome.”

Les4questionspeuventêtreposéesdehautenbas(1à4)–delasituationducontribuablelaplusabstraiteàlaplusconcrète–ouàl’inverse(4à1),endécollantdelapistedesfraisdéductiblespouratteindrelescielsazursdelafiscalitéinternationale.

Nous avons opté dans cet article pour une approchepragmatiquede style «décollage» (en commençantdoncparlaQuestion4–SuivieparlesQuestions3et2avant de conclure avec la Question 1). Nousclôtureronsparunexemplecompréhensifquipermetd’appliquer les 4 questions ou démarches à unesituation assez ordinaire d’une famille decontribuables.

QUESTION4:Quisupportelesfrais(l’entrepriseoulapersonnephysique)?

Une question très proche – « Quels sont lesfraisdéductibles»-nousrappelleleprincipecléquelescontribuables, entités juridiques et donc fictionslégalesouêtresdechairetdesang,nesonttaxésquesurlasommedeleursrevenusNETS.Lecodebelgedel’impôtsurlesrevenus(CIR–Article6)l’exposetrèsbien:

«Lerevenuimposableestconstituédel'EnsembledesRevenusNets,diminuédesdépensesdéductibles.L'EnsembledesRevenusNetsestégalàlasommedesrevenusnetsdescatégoriessuivantes:

1°lesrevenusdesbiensimmobiliers;2°lesrevenusdescapitauxetbiensmobiliers;3°lesrevenusprofessionnels;4°lesrevenusdivers.”

Thereare2basicdeductibleexpenses:

1) Expenditure proven by supportingdocuments8;

2) Lump sums or flat rates or fixedamountsbasedonlegalprovisions.

Within each category of income9, differentrulesmay apply concerning1)what costs aredeductible, and also 2) various standardamounts of deductible expenses that areapplicable, and finally: 3) which otherdeductiblesexpenses,favorabletaxregimesortaxcutsaregranted.Here are some figures unveiling the hugedisparities in lump-sum costs per category ofincome:1. 40% for income generated by immovable

property10;2. 50%onthefirstbracketofEUR15,360for

royalties11, 15% on other incomes fromrenting or usingmovable property & nolump-sum costs for other incomes frommovablecapitalandproperty;

3. 3%oftheprofessionalincomeofadirectoror30%uptoEUR8,450foranemployee12;

4. variousratesformiscellaneousincome13.Hence,initiatinga“cost-huntingexpedition”ispractically a national sport inmost (business)jurisdictions.

Leschargesfiscalementdéductiblessontde2ordres:

1) Chargesdontlecontribuablejustifielaréalitéetle

montantaumoyendedocumentsprobants74;2) Forfaits, pourcentages ou encore montants

monétaires fixés par des lois, arrêtés ourèglements.

Pour chaque catégorie de revenus75, des règlesdifférentestrouventàs’appliquerquantà1)quelsfraissontdéductibleset2)quels forfaits/pourcentagesouencore montants fixes de charges sont fiscalementacceptés et finalement : 3) quelles autres dépensesdéductibles76, régimes fiscaux favorables77 ouréductionsd’impôts78sontaccordés.Voici quelques forfaits déterminés en pourcentagesdesrevenusquirévèlent lagrandedisparitéentre lescatégoriesderevenus:

1. 40%ou10%pourlesrevenusimmobiliers79;2. 50%pourlapremièretranchede15,360euros

pour les redevances80, 15% pour les autresrevenus de la location, de l'affermage, del'usageetdelaconcessiondebiensmobiliersmaispasdeforfaitspourlesautresrevenusdescapitauxetbiensmobiliers;

3. 3% pour les rémunérations des dirigeantsd'entrepriseou30%pourlapremièretranchedeEUR8,450pourunemployé81;

La«chasseauxfraisdéductibles»estdèslorsunsportnational dans la plupart des juridictions (et surtout

Interestingly enough, this cost-based race forhumble net incomes will trigger differentresultswithineachofthe3followingWs:

1) As stated above, we should note thattheanswertothe3rdquestion(3.Whichof the 4 types of taxable income forindividualincometaxshouldIreceive?)willimpacttheacceptablecostsandanypossible lump-sum amount of finaltaxes;

2) Question2:WhatIncomeTaxshouldIpay?alsohasstrongtieswithQuestion4.DifferentDirectIncomeTaxregimesmayacceptorrefusethedeductibilityofthesamecostor,onthecontrary,applythe same rules to costs treateddifferently in other income taxes. Atypicalexampleisthequasi-absenceofdeductible costs for the Legal EntityIncome Tax, as, in principle, thebusiness profits or, say, the incomegenerated by commercial activities, isnot taxed. Another casewould be therejectionofcertaindeductibleexpensesfornon-residenttaxpayers14or,onthecontrary,additionalandexclusivecostsattributable to the non-resident orhis/her employer/company.15 Finally,costs may only be deductible for

Des ImpôtsDirects différents peuvent accepter, ou aucontraire, rejeter la déductibilité d’un mêmefraisoud’unemêmedépense83.Al’inverse,desImpôts Directs peuvent appliquer les mêmesrèglesàdesrevenustraitésdifféremmentpard’autresImpôtsDirects84.Untrèsbelexempleest l’absence de frais professionnelsdéductiblesà l’ImpôtdesPersonnesMorales,puisqu’enprincipelesrevenusgénérésparlesactivitéscommercialesnesontpastaxablesàcet Impôt Direct. Un autre exemple est lerégime spécial pour cadres étrangers réservéauxnon-résidentsbelges85.Enfin,certainsfraisoudépensesnesontdéductiblesqu’à l’impôtdespersonnesphysiquesetnonàl’impôtdessociétésouinversement86.

Non-resident Income Tax is usually similar tothe Individual Income Tax of nationals.However,advantagesmaybegrantedtonon-residents22or,onthecontrary,notavailabletothem.23Thebenefitsof(partially)leavingtheIndividualIncome Tax regime to join the CorporateIncome Tax regime by simply incorporating acompanyorbuyingsharesarewell-known,butone should also consider setting up orassociating with a non-profit-seeking legalentity.
