EXECUTIVE SUMMARY

1. Islamic Republic of Pakistan has received a loan, “Jalalpur Irrigation Project”, from Asian Development Bank (ADB) loan No.3599 PAK with the cost of US$ 274.63 Million for construction of Main Canal of 379 RDs length, 23 distributaries, 7 minors and 16 Flood Carrier Channels (FCCs) for Jalalpur Irrigation Project (JIP). The Project is expected to increase agricultural production with development of sustainable agriculture to alleviate poverty in Pind Dadan Khan and Khushab Tehsils of Districts Jhelum and Khushab by providing regular canal irrigation supplies during Kharif season and reduce the land degradation by minimizing the use of marginal quality ground water. About 170,000 acres of land will be irrigated.

2. The Main Canal would off-take from the right bank of the Rasool Barrage, for which provision for the canal head regulator already exists. The Main Canal of 1,350 cusec capacity will be about 116 km long and traverses along the foothills of the Salt Range.

3. The Project will primarily benefit over 315,000 rural people of more than 114 Mouza

falling under the three International Contract Biddings (ICBs) as mentioned below: JIP/WKS/ICB-P1 RD 0+000 to RD 52+000: Main Canal, 01 Distributary, 01 Escape and

03 FCCs. JIP/WKS/ICB-02 RD 52+000 to RD 225+500: Main Canal, 14 Distributaries, 02 Minor

Canals and 07 FCCs. JIP/WKS/ICB-03 RD 225+500 to RD 379+750: Main Canal, 8 Distributaries, 08 Minor

Canals and 06 FCCs.

4. This Internal Social Safeguard Monitoring Report # 06 is a Bi-Annual report and reflects the progress made on LARP implementation in Package-1 (Batch-1, 2 & 3) from RD 5+000 to RD 52+000 and part of Package-2 (Batch-4, 5 & 6) RD 52+000 to RD 158+000 only. The reporting period is November 2019 to March 2020.

5. Land measuring 8,730 acres is being acquired for the project (Package-1, 2 & 3). Due to land acquisition, 22 residential structures, 236 livestock sheds & tube well fixtures, 9,431 wood trees, 93 fruit plants, 02 public schools and 51 WAPDA electricity poles will also be affected. There are 127,171 DPs under project impact, amongst them, 278 found vulnerable.

6. For ICB Package-1 (RD 5+000 to RD 52+000), village wise Qabzal Wasool registers

were prepared for 6,023 DPs (1,393 for Batch-1, 2,774 for Batch-2 and 1,856 for Batch-3) from 13 Mouza falling in Tehsil Jhelum and Pind Daden Khan. Up to 31 March 2020, land compensation at Batch-3 could not be started by LAC PD Khan due to COVID-19 situation. During the reporting period, out of 4,167 DPs (Batch-1 and Batch-2), 2,520 DPs received their land compensation amounting to Rs. 117.65 million out of total compensation Rs. 178.36 million.

7. The LACs made exhaustive efforts to pay land compensation to all DPs. However, there

are 2,149 DPs (707 from Batch-1 and 1,442 from Batch-2) of ICB-P1 who could not receive their payments with the following reasons:

8. The documentation of un-paid 707 DPs of 03 Mouza falling in Tehsil Jhelum (Batch-1) have been completed and the documentation of un-paid 1,442 DPs of 10 Mouza falling in Tehsil PD Khan (Batch-2) is in process by LAC PD Khan. Still, the un-paid DPs can receive their payments any time from LAC offices. Some more combined efforts (PMO Canals and LAC office) will be made after proper advertisement in the area, for the payment to non-paid DPs.

9. Summary of the payment of land compensation and non-land affected assets in

Package-1 (Batch-1 and Batch-2) by end March 2020 is given below:

10. The Batch-1 & 2 of Jalalpur Irrigation Project have different type of project impacts

which are summarized as below:

11. For part of ICB Package-2 (RD 52+000 to RD 158+000), village wise Qabzal Wasool

registers were prepared for 18,845 DPs (9,595 for Batch-4, 7,230 for Batch-5 and 2,020 for Batch-6) from 37 Mouza falling in Tehsil Pind Daden Khan. Land Award under Section 11 has been announced for Batch-4. However, land compensation could not be started due to COVID-19 situation. Land Award for Batch-5 is expected in April 2020.

12. DPs losing residential structures have received compensation except one, who is

presently living abroad. The LAC has given Notices to vacate right of way (ROW) to affected residential structure’s owners. Accordingly, the DPs have started dismantling their affected residences to start construction at relocated sites in order to vacate Right of Way (RoW) of Main Canal.

13. Work on relocation of public primary schools started by the Contractors at both sites.

Buildings Department assured to complete construction work within 06 month time period. The Commissioner Rawalpindi directed to make interim arrangements for Boys Primary School in a rented building, if the construction delays. The DC Jhelum assured to arrange rented building within one month, if required. Buildings of the existing schools

will be demolished by Buildings Department Jhelum upon completion of relocated buildings.

14. The Grievance Redress Mechanism (GRM) with 3 tier structure; one at village level (V-

GRC), second at tehsil level (T-GRC) and, third at project level (P-GRC) has been established to address grievances arising from environmental & social impacts. Complaint registers have been placed at Contractor’s office and Project Implementation Consultants (PIC) Field Office Khewra. During the month of February 2020, only 01 complaint was received from a DP belonged to Mouza Maryala. The complaint was redressed with intimation to the complainant concerned. No complaint was received during March 2020.

15. By the end of March 2020, 63 persons have got the employment with the project

contractor. This is positive impact of the project implementation.

1 BACKGROUND

16. Islamic Republic of Pakistan has received a loan, “Jalalpur Irrigation Project”, from Asian Development Bank (ADB) loan No.3599 PAK with the cost of US$ 274.63 Million for construction of Main Canal of 379 RDs length, 23 distributaries, 7 minors and 16 FCCs for Jalalpur Irrigation Project (JIP). The Project is expected to increase agricultural production with development of sustainable agriculture to alleviate poverty in Pind Dadan Khan and Khushab Tehsils of Districts Jhelum and Khushab by providing canal irrigation supplies during Kharif season and reduce the land degradation by minimizing the use of marginal quality ground water. Output of the Project envisages construction of a new irrigation system including a Main Canal & its system and appurtenant structures to irrigate about 170,000 acres of land in Tehsil Pind Dadan Khan and Khushab area. It also included the construction of 16 Flood Carrier Channels (FCCs) network to carry saline flood water of hill torrents (debouching over the command area) directly to Jhelum River. The project area map is shown as Figure 01 for ICB Package 1 & 2 and Figure 02 for ICB Package 3.

17. The command area of JIP is in the form of long strip of land bounded by the salt range hills on northern side and right bank of the Jhelum River on its southern side. The Main Canal would off-take from the right bank of the Rasool Barrage, for which provision for the canal head regulator already exists. The Main Canal of 1,350 cusecs capacity will be about 116 km long and traverses along the foothills of the Salt Range.

18. The Project will primarily benefit over 315,000 rural people of more than 114 Mouza falling under the three International Contract Biddings (ICBs). Its direct beneficiaries will be small farmers who would get regular irrigation supplies during Kharif season and increased agricultural production. The Project would reduce land degradation and salinization being caused due to saline flow from many hill torrents. Other beneficiaries will include farm laborers and women through enhanced farming activities.

19. Punjab Irrigation Department (PID) is the Executing Agency (EA). Feasibility study of Jalalpur Irrigation Project was prepared by NESPAK–ICS Joint Venture Consultants under grant ADB PPTA (8404-PAK) in 2015. As part of feasibility study in August 2017, PDA Consultants prepared Draft LARP for the whole project on the basis of detailed design and was submitted to ADB for Approval. Later on, JIP works were divided into three International Contract Packages (ICBs) and was agreed with ADB that LARP shall be prepared for each contract package as detailed below:

JIP/WKS/ICB-P1, RD 0+000 to RD 52+000: Main Canal, 01 Distributary, 01 Escape and 03 Flood Carrier Channels (FCCs).

JIP/WKS/ICB-P2, RD 52+000 to RD 225+500: Main Canal, 12 Distributaries, 02 Minor Canals and 05 Flood Carrier Channels (FCCs).

JIP/WKS/ICB-P3, RD 225+500 to RD 379+750: Main Canal, 10 Distributaries, 05 Minors and 08 Flood Carrier Channels (FCCs).

20. The length of the Main Canal and its distribution system has been designed to cover maximum area under command. Tehsil wise length of all water channels including Main Canal, its distribution system and FCCs is provided in the Table 1-1 below:

21. The scope of works under ICB-PI, P2 & P3 includes civil works of Main Canal, 23 numbers of distributaries, 07 minors and 16 FCCs. Package wise civil works structures to be constructed are shown in each ICB- Package.

2.1 Package-wise and Segment-wise Land Acquisition

2.2 Synchronization of Land Acquisition Process with Construction Activities

23. In order to synchronize land acquisition process with construction activities, it has been agreed with the Land Acquisition Collectors (LACs) that award under Section 11 will be announced in batches comprising 10 to 12 villages in each batch. Their DPs have also been kept in mind while preparing batches. In this way, area in batches will be awarded by the LACs, payment to compensation will be made to DPs and the batch will be handed over to the Contractor by PMO (Canals). Package-wise, segment-wise and batch-wise table on land acquisition is given as Table 2-2 below:

2.3 Package wise Project Impacts

24. As already mentioned, for the construction of Main Canal from RD 0+000 to RD 379+750, 23 distributaries, 07 minors and 16 FCCs under JIP, land measuring 8,730 acres is being acquired. Resultantly 127,171 impacted persons were categorized as DPs. Out of these, 22 DPs will also lose residential structures in ICB-P1 & P2. The other DPs will lose crops, cattle sheds, boundary walls, irrigation pipes, trees, sump well/water course and tube well rooms etc.

25. The project impacts have been documented in the ADB approved LARP-P1, P2 & P3. The summary of the project impacts is being provided in the following table Table 2-3 while Table 2-4 shows the Award announced and payment of compensation status.

3 INTERNAL MONITORING & EVALUATION

26. With reference to the Chapter 9 and section 9.1 of LARP-P1, Internal monitoring will be carried out routinely by the SEU at / upon completion of payment of compensation and provision of allowances to DPs in sections that are proposed for clearing and handing over for civil works. Indicators set for the internal monitoring will be those relating to process and immediate outputs and results. This information will be collected directly from the field and reported monthly to the PMO-Canals to assess the progress and results of this LARP implementation and to adjust the work program, if necessary. The monthly reports will be consolidated semi-annually in the standard supervision reports to ADB. Specific monitoring will be:

A. Information campaign and consultation with DPs; B. Extent of requirement for clearing the ROW; C. Payment / Compensation for affected land, structures and other assets; D. Payment against loss of income; E. Payment to vulnerable DPs and F. Income restoration activities.

27. The following sections cover the above-mentioned indicators of Internal Monitoring & Evaluation of the LARP implementation.

3.1 Reporting Period

28. This Internal Social Safeguard Monitoring Report # 06 is a Bi-Annual report and reflects the progress made on LARP implementation in Package-1 (Batch-1, 2 & 3) from RD 5+000 to RD 52+000 and Package-2 (Batch-4, 5 & 6) RD 52+000 to RD 158+000. The reporting period is November 2019 to March 2020.

4 STATUS ON LARPs IMPLEMENTATION

4.1 LARP for JIP/WKS/ICB-P1

29. Package 1 included the following batches (refer Table 2-2): Batch-S0-Main Canal RD 0+000 to RD 5+000 (Govt. land except 15 Kanal and 10 Marla

private land) falling in Tehsil Jhelum; Batch-1-Main Canal RD 5+000 to 33+750 falling in Tehsil Jhelum; Batch-2-Main Canal from RD 33+750 to RD 52+000 falling in Tehsil PD Khan and; Batch-3-FCCs 1 to 3 falling in Tehsil PD Khan.

31. Batch wise progress on implementation of LARP for JIP/WKS/ICB-P1 is given as under:

4.1.1 Batch-S0: Main Canal RD 0+000 to RD 5+000 – Tehsil Jhelum

32. The land between RD 0+000 and 5+000 is free of any encumbrances. There is no outstanding issue regarding the land acquisition and payment of compensation to DPs. The whole land is Govt. land, except 15 Kanal and 10 Marla private land. All the DPs of private land have received their entitled compensation. Now, the whole land falling between RD 0+000 to RD 5+000 is under possession by the Irrigation Department. The External Monitor has submitted the report to ADB and the ADB has approved the report on 31 March 2020. The area has been handed over to the Contractor for construction activities.

4.1.2 Batch-1: Main Canal RD 5+000 to RD 33+750 -Tehsil Jhelum

a) Preparation of Revenue Record and Announcement of Award

33. After publication of Declaration under of Section-6, the Social and Revenue JIP/PIC teams started on preparation of village wise Qabzal Wasool registers comprising DP details, land under impact and land compensation amount to be paid to each DP along with notices to the DPs. However, these activities had already completed before the reporting period. The summary of the revenue record prepared and award announced are shown in the following Table 4-3.

34. During the reporting period, the LAC Jhelum continued disbursement of the land compensation to the DPs as shown in the following Table 4-4 below.

35. The LAC made exhaustive efforts to pay compensation to the non-paid DPs. The remaining 707 DPs who could not receive their payments have been documented by the office of LAC Jhelum, with the reasons for not getting payment of compensation. However, the non-paid DPs can receive their payments any time from LAC office. When the lockdown is over, combined efforts (PMO Canals and LAC office) will be made, after proper advertisement in the area for the payment of disbursement. The summary table is given below:

c) Payment of Compensation of Non-Land Affected Assets

36. The LAC of Tehsil Jhelum has got completed all verifications of non-land affected assets from the concerned departments during the reporting period. The DPAC Jhelum has approved assessed cost of no-land affected assets i.e. residential & other structures, crops, wood trees and fruit plants amounting to Rs. 9.91 million during its meeting held on 4th December 2019. The LAC Jhelum requested Head/PD PMO (Canals) to provide requisite funds. The Project Director JIP has released the funds of Rs. 9.91 million to LAC Jhelum for the payments to the DPs against their affected assets. Status on payment to DPs on account of affected residential & other structures, crops, wood trees and fruit plants up to March 2020 is given in Table 4-5 below:

37. There are 20 DPs who have not received the payment and they have gone to the court of law for legal remedy against the District Price Assessment Committee (DPAC) decision.

d) Relocation of Public Schools

38. Progress on relocation of public schools is given in the Table 4-6 below:

39. The Commissioner Rawalpindi directed to make interim arrangements for Boys Primary School in a rented building if the construction work delays. The DC Jhelum assured to arrange rented building, within one month, if required.

e) Relocation of Residential Structures

40 Out of 11 DPs of Tehsil Jhelum, 3 are farmers, 4 are laborers, 2 are in service sector,1 is working abroad and 1 is housewife. All relocating households will be supported for 6 month transition period to ensure that they are able to properly adjust with their relocation. Payment of compensation has been paid to all DPs for their affected residential structures except one Mr. Raja Saqib who is presently abroad. The LAC has given Notices to vacate right of way (ROW) to affected residential structure’s owners. Accordingly, the DPs have started dismantling their affected residences to start construction at relocated sites. Detailed Consultation has been conducted regarding their relocation plans. Status on relocation plan is given in Table 4-7 below:

f) Payment of Allowances to Entitled DPs

41. During Socio-Economic and Resettlement surveys, vulnerable DPs were recorded having monthly income below OPL (Official Poverty Line) These DPs are shown in the LARPs as applicable to individual DP. The total number of DPs of this category existing in RD 5+000 to RD 33+750 are identified as 30 and each is entitled to receive Rs.45000/-per head with a total outlay of Rs. 1,350,000/- (refer LARP for P1)

42. The compensation of land is being paid directly by the LAC while entitled allowances which includes shifting, livelihoods restoration, relocation and vulnerability will be paid by the PMO-Canals. No compensation has been paid so far due to lock down of COVID-19. It is informed by PMO that immediately upon clearance of lock down it will be speedily processed further.

4.1.3 Batch-2: Main Canal RD 33+750 to RD 52+000 -Tehsil PD Khan

a) Preparation of Revenue Record and Announcement of Award

43. After notification of declaration under Section-6, the Social and Revenue JIP/PIC teams started on preparation of village wise Qabzal Wasool registers comprising DP details, land under impact and land compensation amount to be paid to each DP along with notices to the DPs. During the reporting period, the following revenue record was prepared and award under Section 11 was announced, as shown in the following Table 4-8.

44. During the reporting period, the LAC Pind Daden Khan started the disbursement of land compensation to the DPs and continued. The progress is shown in the following Table 4-9 below:

45. The table indicates that out of 3276 DPs, 1442 DPs could not receive their payments

amounting to Rs. 37.84 million, with the following reasons:

- Meager amount - DPs residing outside the area - DPs residing out of country - DPs expired - Mutation issue - Court case/disputed land

46. Documentation of these un-paid DPs is in process by LAC office PD Khan.

c) Payment of Compensation of Non-Land Affected Assets of 10 Mouza-P1

47. After verification of all types of non-land affected assets i.e. residential & other structures, crops, wood trees and fruit plants, the compensation cost has been compiled by the respective departments and forwarded to LAC PD Khan for approval by the DPAC. However, the DPAC could not be held due to COVID-19 situation. The actual number of DPs and budget will be collected after the final approval from DPAC, Jhelum. The tentative time is end of May 2020.

d) Payment of Allowances to Entitled DPs

48. Vulnerable DPs identified during Socio-Economic and Resettlement surveys, having monthly income below OPL (Official Poverty Line) are included in the LARP for P1. The compensation of land is being paid directly by the LAC, while payment of allowances (including shifting, livelihood restoration, relocation and vulnerability) will be paid by the PMO-Canals. 50. Due to COVID-19, the disbursement of land compensation could not be started. However, the PMO (Canals) has requested District Collector Jhelum for immediate start of disbursement of land compensation, for which requisite funds are available with LAC PD Khan.

4.2 LARP for JIP/WKS/ICB-P2

4.2.1 Batch-4: Main Canal RD 52+000 to RD 87+000 -Tehsil PD Khan

a) Preparation of Revenue Record and Announcement of Award

51. After publication of Declaration under Section-6, the Social and Revenue JIP/PIC teams started preparation of village wise Qabzal Wasool registers comprising DP details, land under impact and land compensation amount to be paid to each DP along with notices to the DPs. 4.2.2 Batch-5: Main Canal RD 87+000 to RD 131+000 -Tehsil PD Khan

a) Preparation of Revenue Record and Announcement of Award

53. After publication of Declaration under Section-6, the Social and Revenue JIP/PIC teams started on preparation of Qabzal Wasool registers comprising DP details, land under impact and land compensation amount to be paid to each DP along with notices to the DPs. During the reporting period, the following revenue record was prepared and award was announced, refer Table 4-12.

54. After award of section-6, the Social and Revenue JIP/PIC teams is preparing Qabzal Wasool registers comprising DP details, land under impact and land compensation amount to be paid to each DP along with notices to the DPs. The expected date of completion of Batch-6 is 17-4-2020. Progress up to March 31, 2020 is shown in the following Table 4-13.

4.3 LARP for JIP/WKS/ICB-P3

55. Implementation on LARP for P3 yet not started.

5 GRIEVANCE REDRESS MECHANISM (GRM) AND COMMITTEES

56. In compliance with the institutional requirements of the Land Acquisition and Resettlement Plans (RAPs) for 03 Packages and Environmental Management Plan (EMP) for Jalalpur Irrigation Project, a Grievance Redress Mechanism (GRM) with 3 tier structure; one at village level, second at tehsil level and, third at project level has been established to address grievances arising from environmental & social impacts.

57. The Grievance Redress Committees (GRCs) at village level (V-GRCs) have been established for the all 13 villages falling in Package 1 (up to RD 52+000 of Main Canal) vide PMO Notification No. PMO/ID/JIP/R&E/9705 dated 21-01-2020. The notification covers TOR of the village level committees also. V-GRCs for the next batches will be established as soon as Award under Section 11 is made by the Land Acquisition Collector (LAC) for that batch. Tehsil Level GRCs (T-GRCs) for Jhelum, PD Khan and Khushab Tehsils have been established vide PMO/ID/JIP/R&E/9705 dated 19-03-2020. Whereas, Project Level GRC (P-GRC) was established vide PMO/ID/JIP/R&E/9783 dated 19-02-2020.

5.1 Complaint Registers

58. Complaint registers have been placed at Contractor’s office and Project Implementation Consultants (PIC) Field Office Khewra. Both the offices will properly guide the complainants regarding GRM. The Contractor will segregate the complaints. All the complaints related to him will be kept for redressal whereas, related to LAC process will be forwarded to PIC Field Office for redressal through respective V-GRCs. Likewise, the PIC Field office will hand over complaints related to the Contractor for grievance redressal.

59. During the month of February 2020, a complaint was received from a DP belonged to Mouza Maryala. The complaint was related to change of alignment at RD 6+500 due to NTDC foundation installed in the ROW of main canal. The complaint was redressed with the assurance that NTDC pole will be removed and alignment will not be changed for the safeguard of his land. A copy of letter written to PD NTDC Project was also delivered to the DP on 19 February 2020 for his satisfaction. The complaint has also entered in the complaint register placed at GRC camp site of ICB-P1.

60. During the Month of March 2020, no complaint was received regarding project implementation.

5.2 Employment to DPs

61. Contract Clause 6.1 “Particular Condition of the Contract” binds the Contractor to provide jobs to skilled / unskilled persons, particularly Displaced Persons (DPs) to restore their problems of livelihoods. In this regard, during the socio-economic, gender and resettlement surveys of the Project area, DPs and other locals enquired about the job

opportunity for the affected people and others as well during the construction of channels. DPs were advised to apply, if they need jobs at project site.

62. When the construction activities will start, the Contractor/s will be briefed to provide the jobs to the DPs/locals on priority. Up to March 2020, 63 applicants were appointed as skilled and un skilled staff. Detailed regarding DPs and Non DPs of these employees are being collected, as the Contractor do not maintain such data. The distribution of these employees is provided in the following Table 5-1.

6 MEETINGS/VISITS HELD DURING REPORTING PERIOD

6.1 Meetings Held

63. During the reporting period, the key persons like Secretary Irrigation, Commissioner Rawalpindi, DC Jhelum, PD JIP and Team Leader Project Implementation Consultants (PIC) conducted meetings at different times in the project area. The objectives of these meetings was to develop clarity amongst the participants regarding prime minister visit, to expedite land acquisition process and, to vacate the ROW for the Construction of the Main Canal and its distribution system. The Meetings helped to exchange views and to discuss bottlenecks and constraints in land acquisition. The list of the meetings is provided in the following Table 6-1:

6.2 Visits of Key Persons to Project Area

64. From time to time, on the request of Project Director JIP, different key persons like Secretary Irrigation, Commissioner Rawalpindi and DC Jhelum conduct field visits to the

project area. The purpose and objectives of these visits are to see and discuss progress on various activities, issue, bottlenecks and other related problems at site. This helped to resolve the issues in a very short time. The list of visits is provided in the following Table 6-2:

7 ISSUES/BOTTLENECKS

7.1 Tower Foundations Installed in the ROW of Main Canal at RD 6+000 by NTDC (WAPDA)

65. NTDC has constructed foundations of a 500 kV Transmission line tower in the ROW of Main Canal at RD 6+000, after notification of Section IV (25-04-2017) of Land Acquisition. NTDC has been requested a no. of times to remove/relocate the tower foundations as these are coming right in the Main Canal prism of Contract Package P1 and would obstruct the proper operation of Canal. NTDC has not so far agreed to relocate the foundations of the tower and is demanding to either keep the tower foundation as constructed or pay relocation cost to NTDC by PMO.

66. The issue was raised in the 3rd meeting of PSC held on 17-12-2019. The Committee decided that a joint visit of the Consultants of PMO (Canals) and NTDC shall be made immediately and recommendations shall be submitted for resolution of the issue, at the earliest time.

67. In compliance to the 3rd PSC meeting decision, joint visit of consultants made and NTDC finally informed vide letter dated 17-02-2020 and 02-03-2020 that shifting of Tower is essential & there is no other option.

68. A letter from NTDC dated 26/02/2020 received in PMO Canals stating that a meeting with Top Management of NTDC shall be held in 1st week of March 2020 to take decision but the said meeting has not been conveyed so far by NTDC.

8 Way Forward

The remarkable percentage of unpaid DPs was caused due to many reasons which have

already been mentioned in the EMR. Although the efforts were made to contact them. The DPs

become scare in February 20 and started avoid to travel or come at gathering place due to virus. As the coronavirus situation is controlled and the LAC revenue staff resume their duty

(LAC persons of Tehsil Jhelum is not allowed to come on the duty due to above 50 years age), best try will be made with their association to cover unpaid DPs.
