SUBMITTAL CHECKLIST
1. This proposed zoning change meets the League City Comprehensive Plan. In the General Future Land Use Map 4.0-1 this land is shown as commercial.
2. The surrounding area is a mix of commercial, multifamily residential and single family residential. The lots are wooded and cleared of underbrush.
3. Across Dallas Street it is zoned General Commercial, there is an alley as a buffer behind the property, it is zoned SFR 2 across Coryell Street and SFR 7 across Park Road.
4. This zoning should be suitable for this property being that this business already exists on this lot and the Comprehensive plan for the city plans on this land being commercial in the future.
5. This application should not detriment nearby properties due to the business already exist at this location.
6. The traffic should stay about the same as it is right now and we will be adding a new parking lot to accommodate the new office we would like to build on the empty lots.
7. The same business exists on the property now so it should not harm the property value of nearby properties. The office we would like to build on the property is going to compliment the area (see attached photo for a general idea of the type of the style of building we would like to build.
8. There are no positive affects to deny this request, it is the same business in a nicer building and they will be paying commercial rather than residential taxes on the land.
9. The business is existing and would like to stay at their existing location with a nicer office.
10. Please see attached survey, photos of property, the general concept of the type of building we would like to build, and general drawings showing the phases of what we would like to do with the property. Phase 1- new office building, phase 2 – move existing house to residential lot

Ms Summers restated the staff report for this item with staff recommending denial.
Mr. Wycoff opened the public portion of this hearing.
Mr. Ray Williams, P.O. Box 882, League City: Owns the 20 unit duplex northeast of this property. Mr Garza bought that property in 1998 and zoning was place in 1999. He has been a good neighbor and tries

to park off the street and keep things clean. The recent zoning has put him out of compliance which is a financial burden on him. Some type of office zoning would more than likely serve his purpose. The buffer requirements for Limited Industrial would leave him only 40-foot on the interior of those lots for parking or a building of some kind. I recommend you table this to give Mr. Garza time to find something we neighbors can live with and he could live with that would not be such a financial burden on him.
Mr. Larry Garza, applicant: We try to be good neighbors, we have been very successful at this for the last 8 1/2 years. We would like the opportunity in the future to expand as our business grows. We have been limited in space by zoning. We have not been able to grow financially in terms of sales because of the limitations placed upon us. It was only in the last six months that we became aware that our property had been taken from what we thought it was 8 1/2 years ago to limited use and it is because of that I am here. I purposefully bought those two lots of trying to buffer our business from other homes. If I had it my way I would buy the rest of the block, from Houston Ave. to 4th Street to Dallas Street where I would have the entire block.
Mr. Zeller asked what type of business is Aztec Bolting.
Mr. Garza replied we are in the torc intention business. We provide tools for sale, rental, and field services for the purpose of tightening stud bolts for instance. We ship world wide. We are not in the commercial end of the business so we do not necessarily do business…
Mr. Zeller said so may I asked who your customers are? Is it a chemical company or is it a distributor that sells them.
Mr. Garza responded I could give 1500 different customers that range anywhere from the Exxons to the Bayers to the …
Mr. Wycoff said we are just trying to find out why this is industrial.
Mr. Garza responded in the beginning when we applied for variances for ordinances for construction it was zoned – classified as an office warehouse. It has remain to be but except we obviously utilize it to the best of our ability in being able to service our customers.
Mr. Wycoff asked why are we classifying this as industrial.
Ms Summers responded the classification its actually called warehousing and storage, which just happens to be in the industrial zoning only.
Mr. Wycoff said maybe we have a definition problem then.
Ms Holmes responded actually Dana did try to contact the applicant regarding… that is why we put CG on your because we thought that he could probably fit with office as long as his warehouse uses were more of an accessory to that office but at the time he felt it was more inline with the industrial line.
Mr. Wycoff and Mr. Zeller agreed his customers are industry but it is not an industrial use.
Mr. Wycoff said I think we are going for the wrong zoning here so I am for tabling this.

Ms Teresa Saunder-Smith: Has lived on Avondale for 44 years and it has always been homes except for Mr. Williams duplexes. Maybe this man tries to be a good neighbor but cars are parked on each side of the street, you have to watch for children and sometimes the UPS man is there. I am the only one here tonight because the neighbor on Houston Ave. and Avondale Street had chemo-therapy today and he could not be here but they complain about a noise. I do not know if it is a grinder or what the noise is but it is very disturbing to them. We would like to see that lot on Houston stay like it is now a beautiful lot with trees on it.
